Tait collection: item 39 of 62 This document gives the details of the Will and Probate of Thomas Oakley who died in Warrnambool at the age of 75 in 1893. He had come with his first wife to Australia in 1852 and was a Customs Officer in Warrnambool, in charge of the signals and premises, living in Merri Street. Later after the death of his wife (they had ten children) he married Eliza McKeeman in 1870 and they lived at ‘Oakbank’ near the Warrnambool Cemetery where Oakley pursued farming interests. They had a further eight children, many of them making their mark in the business and community life of Warrnambool and further afield. Thomas Oakley left real estate to the value of £900 and personal estate to the value of £1251, with the beneficiaries being his wife, his daughters, Elizabeth and Mary Anne from his first marriage and the eight children of his second marriage. The lawyers concerned with this document, O’Mahony and Murray, had offices in Warrnambool in Kepler Street at the end of the 19th century and the beginning of the 20th century. This document was in the possession of Ernest Chambers, a Warrnambool lawyer during the same period. It was then passed down to successive lawyers occupying the Kepler Street premises and located there in 2014.This document is of considerable importance as it gives details of the Will and Probate of Thomas Oakley, a prominent and successful landowner in Warrnambool in the 19th century. It will be of great use to researchers. This is a white piece of thick paper folded in two with handwritten material on four sides of the paper. The pages have printed red lines at the edges of three pages. The document contains details of the Will and Probate of Thomas Oakley who died in 1893 in Warrnambool. James Jones was the son of Philip Jones, a Chairmaker, and Ann Jones who settled in East Brighton after the sale of land c1852 in the area of the Henry Dendy Special Survey of 1841. Mary Ann Moore was the daughter of Thomas Moore, a Gardener, and Sarah Harris who also settled in Brighton c1852. James and Mary Ann Jones settled and raised their family in East Brighton now Bentleigh. Mr John Herron resided at 4 Vickery St Bentleigh until 1989. Sadly Martha Jones born 1888 died in 1890 and James Jones had to purchase a plot at Brighton General Cemetery for her burial. Baby Ethel May was interred in 1893 and another baby in 1900 then Mary Ann in 1903 and James in 1940James Jones and Mary Ann Moore were born in Brighton c1857 and c 1859 into pioneer market gardener families in the area of the Dendy Special Survey of 1841. They married in 1883 and raised their family in East Brighton, now Bentleigh. Sadly infectious diseases took the lives of many infants throughout the Colony of Victoria due to the poor state of water supply and sewerage disposal and locally the swamps of the Elster Creek were a constant breeding ground. Martha Jones born 1888 died 1890 and was interred in Brighton General Cemetery in a family plot purchased by her father James Jones. In 1893 another daughter Ethel May died and was buried in the family plot. An original paper receipt No. 3454 for payment on 23 March 1893 by James Jones to Brighton General Cemetery of £1 . 1s For the burial of baby Ethel May Jones in a plot 4 feet x 8 feet, in the Wesleyan section portion 199 compartment G. Fee was for reopening the grave he had purchased in 1890 for the burial of his daughter Martha, aged 2 years . This navigation cart of Lady Bay and Warrnambool Harbour was originally surveyed in 1870 but this version includes the update for magnetic variation in 1893. Since the printing of the chart several annotations have been added. These include an additional stamp dated 15-8-1910, a handwritten comment across the top of the page dated August 1910, and another handwritten comment regarding the ‘Proposed Extension of Dock’ dated 19-2-1925, plus connected drawings, notes and figures. The 1925 proposal on this chart may have been a reaction to the Royal Commission of 1923, when the damaged stonework on the seaward side of the Warrnambool Breakwater, caused by the action of the sea, was the subject of enquiry. A conference between the Public Works, Water Commission and the Harbour Trust concluded that it would less costly to make repairs to prevent further damage rather than replaced the damage portion of the wall. A contract was raised in late 1924 to deposit rubble on the damaged side of the breakwater to minimise the Southern Ocean’s destructive action and work had started by August 1925. The Breakwater construction had begun in 1874 and was completed in 1890. The Victorian Government had commissioned Sir John Coode, a British harbour engineer, to present a plan to complete the Warrnambool Breakwater but his original plan was too expensive. He prepared a revised plan for a shorter structure. The construction proved to be too short to protect adequately from the weather and didn't allow enough depth for larger vessels to come into port. The decreasing trade was further affected by siltation in the bay due to the breakwater, and the completion of the railway line. The situation of the harbour became a real problem by 1910 and required continuous dredging. In 1914 the Breakwater was extended but proved to be a failure because the work began to subside and by 1920 about two thirds of the harbour was silted up. Alterations made in the 1920's increased the silting problem and by the 1940's the harbour was no longer used. More alterations were made in the 1950's and 1960's. This chart is significant for its strong connection to the maritime history of Warrnambool Harbour and Lady Bay and the Warrnambool Breakwater. The Warrnambool Breakwater is registered as a place of significance on the Victorian Heritage Database (VHR H2024). The Warrnambool Breakwater is one of the most important late 19th century maritime engineering projects in Victoria and significant in the development of Victorian coastal shipping. It is also significant for its connection with British harbour engineer, Sir John Coode. The chart is a historical record of structures existing in 1893; the Warrnambool Jetties, Warrnambool Breakwater in Lady Bay, the leading lights (lighthouses), streets, roads, bridges and many buildings.
