Library Committee minutes from 1920 discuss the placing of an Honour Board in the Library, there was obviously some discussion from the Ballarat and Bendigo Law Associations about whom should be placed on the board and whether it was appropriate that it be located in the library. The board was donated by the Committee of Counsel, from the Bar and so only commemorates barristers. It is curious that this was not placed in Selborne Chambers where many barristers had rooms including one of the men on the Board (Higgins). This board joined the much bigger LIV memorial board that celebrates all Victorian lawyers who served during WWI.While memorial boards are a common addition to many public and civic building after World War One. This memorial board is the only one that commemorates members of the Bar, in that sense it is of great significance to the legal community. Two of the men commemorated on the board were sons of judges (Higgins, son of the Justice Henry Bourne Higgins of the High Court and Hodges, son of Justice Henry Hodges of the Supreme Court). Franc Carse was related by marriage to the a’Beckett family (also judges of the Court) and his father in law was on the Supreme Court Library committee in 1914. Eric Connelly and Murdoch Mackay shared rooms in Selborne Chambers. Connelly died in late 1918 in France, a member of General Pompey Elliott’s staff. Connelly had previously taken part in the Gallipoli landings in April 1915. There are many Court books in existence, they record the details in Criminal Cases, of the date of a hearing, before which judge, the nature of th crime, the plea, verdict and sentence. This one is of particular interest as it is the book that records the particulars of the case of Ned Kelly, before Justice Sir Redmond Barry in October 1880.A very significant item giving the ongoing importance of the Kelly legend. This scar or 'toe hold' tree fell over 50 yrs ago. It had died 50yrs before it fell and is estimated to be around 400 years old. It has a diameter of 1.3 m and is the only 'toe hold' tree in Nillumbik. Heritage Excursion - Killeavey Walk and Talk - Saturday 5th November Jane Woollard’s book Laughing Waters Road Art Landscape and Memory in Eltham devotes several chapters to the property Killeavey situated on the Yarra River at the end of Reynolds Road, Eltham. Jane has written about the natural history and indigenous history of the area and stories of the family who lived at Killeavey for many years. Killeavey was the home of Sir William Irvine, Victorian and Federal Parliamentarian and Supreme Court Judge. Later it was the home of his daughter Beatrice Morrison, a significant figure in the Eltham community. The original house was destroyed by fire and its replacement was demolished by Parks Victoria. Its sits high above the Yarra River and contains significant garden remnants. The surrounding bushland is valued for its significant plant communities. In September 2011 we visited Killeavey but without the benefit of the information more recently available from Jane’s research. We are fortunate that Jane will be joining us on this walk. There will be an extended stop at the house site for a discussion on the environment and history of the area. Prize awarded to James Cleeland Shaw (BD 15/10/1862) for excellence in conduct and general proficiency. James entered Ballarat College 1870. Son of Mr. W.H.Shaw the Managing Director of the celebrated Phoenix Foundry which played such an important part in the early industrial history of Ballarat and who lived all his Ballarat life in a house in Armstrong Street South not far from Dana Street. Born in Ballarat on 15th October 1862 and attended Ballarat College 1870-1877. Was articled to Hardy and Madden of Ballarat Solicitors. Practised as a Solicitor in Ballarat for some years. Went to Western Australia in 1897 and acted for a time as Deputy Master of Western Australia Supreme Court. Was for some time partner with Drake Brockman now a judge but latterly practised as Shaw and Shaw in partnership with his brother Frank as Solicitors at 81 St. Georges Terrace, Perth, Western Australia. Example of prize ordered from London where they were specially bound and embossed with the College crest. District Police Office Sandhurst Court records. October 1857 - October 1858. Brown ledger containing the records of the District Police Office Sandhurst. Cover has linen like covering with suede leather corners and spine. All have decorative scroll and pattern work. Dates written in ink on the spine. Remnants of an adhesive label on the spine. Inside covers lined with red, green and gold patterned paper. Entries include names of judges, solicitors, witnesses, accused and plaintiffs, Each record include descriptions of charges and the rulings. Most of the sittings were conducted by police magistrate Lachlan McLachlan. Notes Philip Barton inherited the book from his father Russell Barton who died in 2002. Russell Barton was a barrister who practised on the Supreme Court Circuit in Bendigo from 1960 - 1975. He was interested in history and it is assumed that he was given the book by the Bendigo Court officials. This badge was given to William Clarence Busse when he became a lifetime member of the Chiltern Football Club. Football became popualr in Chiltern during the 1860s, with the local team becoming a key part of the creation of a formal competition for the Ovens and Murray region, which came about in 1893. The Chiltern team also participated in the founding of the Chiltern and District Football Association in 1912, where they won their first premiership in 1914. In 1954, the team played in a Grand Final against Greta that had a 43 minute long final quarter. Chiltern was ahead when the fourth quarter should have ended, but the timer did not go off and the game went into overtime, allowing Greta to snatch the win and set in place a decades-long rivalry. Today, the team continues to compete under the nickname the 'Swans' in the Tallangatta and District Football League. Wilfred Clarence Busse was born in Chiltern in 1898. He completed his education at Wesley College in Melbourne then studied law at the University of Melbourne, before becoming a barrister. During his career, he often worked in the chambers of Judge Bernard Cussen (1859-1933) of the Supreme Court. Cussen was popular as a judge and lawyer, known for being just and precise and for completing through statutory consolidation in his spare time. Beyond his career as a lawyer, Busse wrote historical fiction inspired by his life in Chiltern, these included "The Blue Beyond; A Romance of the Early Days in South Eastern Australia" and "The Golden Plague: A Romance of the Early Fifties," which won the T.E.Role gold medal for the best historical novel in 1930 and went on to become a best seller. He was a member of the Chiltern Athenaeum until his death in 1960. This object is significant for its link to W.C. Wearing a loved one’s hair or giving a lock of your hair to someone for wearing, could be a gesture of love and friendship, or of mourning. The tangibility and personal nature of hair made it a common keepsake, especially in cases of high mortality or where family members were separated by oceans without the possibility of air travel. The intention and origin of this locket is currently unknown, but it is likely it was a keepsake of love or mourning, either way, a emotional object. This object artistically significant as an example of late 19th/early 20th century jewellery, and social and spiritual sigifiicance as locket containing a piece of hair, which, regardless of exact intention, imbues it with a strong emotional aura. Boroondara Cemetery, established in 1858, is within an unusual triangular reserve bounded by High Street, Park Hill Road and Victoria Park, Kew. The caretaker's lodge and administrative office (1860 designed by Charles Vickers, additions, 1866-1899 by Albert Purchas) form a picturesque two-storey brick structure with a slate roof and clock tower. A rotunda or shelter (1890, Albert Purchas) is located in the centre of the cemetery: this has an octagonal hipped roof with fish scale slates and a decorative brick base with a tessellated floor and timber seating. The cemetery is surrounded by a 2.7 metre high ornamental red brick wall (1895-96, Albert Purchas) with some sections of vertical iron palisades between brick pillars. Albert Purchas was a prominent Melbourne architect who was the Secretary of the Melbourne General Cemetery from 1852 to 1907 and Chairman of the Boroondara Cemetery Board of Trustees from 1867 to 1909. He made a significant contribution to the design of the Boroondara Cemetery Boroondara Cemetery is an outstanding example of the Victorian Garden Cemetery movement in Victoria, retaining key elements of the style, despite overdevelopment which has obscured some of the paths and driveways. Elements of the style represented at Boroondara include an ornamental boundary fence, a system of curving paths which are kerbed and follow the site's natural contours, defined views, recreational facilities such as the rotunda, a landscaped park like setting, sectarian divisions for burials, impressive monuments, wrought and cast iron grave surrounds and exotic symbolic plantings. In the 1850s cemeteries were located on the periphery of populated areas because of concerns about diseases like cholera. They were designed to be attractive places for mourners and visitors to walk and contemplate. Typically cemeteries were arranged to keep religions separated and this tended to maintain links to places of origin, reflecting a migrant society. Other developments included cast iron entrance gates, built in 1889 to a design by Albert Purchas; a cemetery shelter or rotunda, built in 1890, which is a replica of one constructed in the Melbourne General Cemetery in the same year; an ornamental brick fence erected in 1896-99(?); the construction and operation of a terminus for a horse tram at the cemetery gates during 1887-1915; and the Springthorpe Memorial built between 1897 and 1907. A brick cremation wall and a memorial rose garden were constructed near the entrance in the mid- twentieth century(c.1955-57) and a mausoleum completed in 2001.The maintenance shed/depot close to High Street was constructed in 1987. The original entrance was altered in 2000 and the original cast iron gates moved to the eastern entrance of the Mausoleum. The Springthorpe Memorial (VHR 522) set at the entrance to the burial ground commemorates Annie Springthorpe, and was erected between 1897 and 1907 by her husband Dr John Springthorpe. It was the work of the sculptor Bertram Mackennal, architect Harold Desbrowe Annear, landscape designer and Director of the Melbourne Bortanic Gardens, W.R. Guilfoyle, with considerable input from Dr Springthorpe The memorial is in the form of a small temple in a primitive Doric style. It was designed by Harold Desbrowe Annear and includes Bertram Mackennal sculptures in Carrara marble. Twelve columns of deep green granite from Scotland support a Harcourt granite superstructure. The roof by Brooks Robinson is a coloured glass dome, which sits within the rectangular form and behind the pediments. The sculptural group raised on a dais, consists of the deceased woman lying on a sarcophagus with an attending angel and mourner. The figure of Grief crouches at the foot of the bier and an angel places a wreath over Annie's head, symbolising the triumph of immortal life over death. The body of the deceased was placed in a vault below. The bronze work is by Marriots of Melbourne. Professor Tucker of the University of Melbourne composed appropriate inscriptions in English and archaic Greek lettering.. The floor is a geometric mosaic and the glass dome roof is of Tiffany style lead lighting in hues of reds and pinks in a radiating pattern. The memorial originally stood in a landscape triangular garden of about one acre near the entrance to the cemetery. However, after Dr Springthorpe's death in 1933 it was found that transactions for the land had not been fully completed so most of it was regained by the cemetery. A sundial and seat remain. The building is almost completely intact. The only alteration has been the removal of a glass canopy over the statuary and missing chains between posts. The Argus (26 March 1933) considered the memorial to be the most beautiful work of its kind in Australia. No comparable buildings are known. The Syme Memorial (1908) is a memorial to David Syme, political economist and publisher of the Melbourne Age newspaper. The Egyptian memorial designed by architect Arthur Peck is one of the most finely designed and executed pieces of monumental design in Melbourne. It has a temple like form with each column having a different capital detail. These support a cornice that curves both inwards and outwards. The tomb also has balustradings set between granite piers which create porch spaces leading to the entrance ways. Two variegated Port Jackson Figs are planted at either end. The Cussen Memorial (VHR 2036) was constructed in 1912-13 by Sir Leo Cussen in memory of his young son Hubert. Sir Leo Finn Bernard Cussen (1859-1933), judge and member of the Victorian Supreme Court in 1906. was buried here. The family memorial is one of the larger and more impressive memorials in the cemetery and is an interesting example of the 1930s Gothic Revival style architecture. It takes the form of a small chapel with carvings, diamond shaped roof tiles and decorated ridge embellishing the exterior. By the 1890s, the Boroondara Cemetery was a popular destination for visitors and locals admiring the beauty of the grounds and the splendid monuments. The edge of suburban settlement had reached the cemetery in the previous decade. Its Victorian garden design with sweeping curved drives, hill top views and high maintenance made it attractive. In its Victorian Garden Cemetery design, Boroondara was following an international trend. The picturesque Romanticism of the Pere la Chaise garden cemetery established in Paris in 1804 provided a prototype for great metropolitan cemeteries such as Kensal Green (1883) and Highgate (1839) in London and the Glasgow Necropolis (1831). Boroondara Cemetery was important in establishing this trend in Australia. The cemetery's beauty peaked with the progressive completion of the spectacular Springthorpe Memorial between 1899 and 1907. From about the turn of the century, the trustees encroached on the original design, having repeatedly failed in attempts to gain more land. The wide plantations around road boundaries, grassy verges around clusters of graves in each denomination, and most of the landscaped surround to the Springthorpe memorial are now gone. Some of the original road and path space were resumed for burial purposes. The post war period saw an increased use of the Cemetery by newer migrant groups. The mid- to late- twentieth century monuments were often placed on the grassed edges of the various sections and encroached on the roadways as the cemetery had reached the potential foreseen by its design. These were well tended in comparison with Victorian monuments which have generally been left to fall into a state of neglect. The Boroondara Cemetery features many plants, mostly conifers and shrubs of funerary symbolism, which line the boundaries, road and pathways, and frame the cemetery monuments or are planted on graves. The major plantings include an impressive row of Bhutan Cypress (Cupressus torulosa), interplanted with Sweet Pittosporum (Pittosporum undulatum), and a few Pittosporum crassifolium, along the High Street and Parkhill Street, where the planting is dominated by Sweet Pittosporum. Planting within the cemetery includes rows and specimen trees of Bhutan Cypress and Italian Cypress (Cupressus sempervirens), including a row with alternate plantings of both species. The planting includes an unusual "squat" form of an Italian Cypress. More of these trees probably lined the cemetery roads and paths. Also dominating the cemetery landscape near the Rotunda is a stand of 3 Canary Island Pines (Pinus canariensis), a Bunya Bunya Pine (Araucaria bidwillii) and a Weeping Elm (Ulmus glabra 'Camperdownii') Amongst the planting are the following notable conifers: a towering Bunya Bunya Pine (Araucaria bidwillii), a Coast Redwood (Sequoia sempervirens), a rare Golden Funeral Cypress (Chamaecyparis funebris 'Aurea'), two large Funeral Cypress (Chamaecyparis funebris), and the only known Queensland Kauri (Agathis robusta) in a cemetery in Victoria. The Cemetery records, including historical plans of the cemetery from 1859, are held by the administration and their retention enhances the historical significance of the Cemetery. How is it significant? Boroondara Cemetery is of aesthetic, architectural, scientific (botanical) and historical significance to the State of Victoria. Why is it significant? The Boroondara Cemetery is of historical and aesthetic significance as an outstanding example of a Victorian garden cemetery. The Boroondara Cemetery is of historical significance as a record of Victorian life from the 1850s, and the early settlement of Kew. It is also significant for its ability to demonstrate, through the design and location of the cemetery, attitudes towards burial, health concerns and the importance placed on religion, at the time of its establishment. The Boroondara Cemetery is of architectural significance for the design of the gatehouse or sexton's lodge and cemetery office (built in stages from 1860 to 1899), the ornamental brick perimeter fence and elegant cemetery shelter to the design of prominent Melbourne architects, Charles Vickers (for the original 1860 cottage) and Albert Purchas, cemetery architect and secretary from 1864 to his death in 1907. The Boroondara Cemetery has considerable aesthetic significance which is principally derived from its tranquil, picturesque setting; its impressive memorials and monuments; its landmark features such as the prominent clocktower of the sexton's lodge and office, the mature exotic plantings, the decorative brick fence and the entrance gates; its defined views; and its curving paths. The Melbourne and Metropolitan Board of Works (MMBW) plans were produced from the 1890s to the 1950s. They were crucial to the design and development of Melbourne's sewerage and drainage system. The plans, at a scale of 40 feet to 1 inch (1:480), provide a detailed historical record of Melbourne streetscapes and environmental features. Each plan covers one or two street blocks (roughly six streets), showing details of buildings, including garden layouts and ownership boundaries, and features such as laneways, drains, bridges, parks, municipal boundaries and other prominent landmarks as they existed at the time each plan was produced. The hand-coloured sections of buildings on the plan were used to denote masonry or brick constructions (pink), weatherboard constructions (yellow), and public buildings (grey). Plan No.1570 shows the layout of gardens and houses in Sackville Street, Davis Street, Wrixon Street, and Fitzwilliam Street in 1904. While Thomas Street is included on the map, at this stage no houses had been built. The plan identifies two named houses: ‘Fairview’ and ‘Kylemore’. Fairview is more fully delineated in Plan No.1563. Kylemore is one of the few houses in Kew designed by John Beswicke. The most notable owner of Kylemore was William Whitehead, who owned the house between 1895 and 1900. In 1894, Australian newspapers reported the marriage of Whitehead’s daughter to Dr. Gerald Eugene Cussen, the brother of Sir Leo Cussen, the Supreme Court Judge. The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent.
