Chisholm having paid to me the Sum of One Pound Ten Shillings, on account of the territorial revenue, I hereby License him to dig, search for, and remove Gold on and from any such Crown lands within the Dist of Ballarat as I shall assign to him for that purpose during the month of march 1853 not within half-a-mile of any Head Station, This License is not transferable, and to be produced whenever demanded by me or any other person acting under the authority of the Government, and to be returned when another License is issued. It was later given to the Ballarat School of Mines, then the City of Ballarat.A number of Miners' Rights made out to James Oddie of Ballarat, for a block of land in Magpie Street, Mount Pleasant, used as the Ballarat Observatory. The red 1995 Miners' Right includes land at Dana Street with red writing over it regarding its transferal. The Observatory Registration in No 19578 with the situation of residence area being 'Magpie Street Mount Pleasant 209 feet x 52 feet" The District and Division is Central D Ballarat. There was agitation surrounding the gold license which was thought to be an excessive fee and did not give the bearer right to representation. On 03 December 1854 the gold diggers on the Eureka Lead fought a short battle against the army and police troopers. A few months later a new system of taxing gold diggers was introduced - the Miner's Right.The Victorian Gold Licence was issued from 1851 until early 1855. Every man on a Victorian goldfield had to carry a valid gold license, so few survived the harsh treatment of being carried around a working goldfield. There was much dissatisfaction about what was thought to be an unfair mining tax (or gold license). On 29 November 1854 Ballarat miners burnt their licenses on Bakery Hill. On 3 December 1854 the Eureka Stockade Battle took place, resulting in the Goldfields Commission. The first Miner's Right was issued in late June 1855, and in July the first Local Courts were elected by miner's right holders. The two Fitnall Gold Licenses are important because they were issued on either side of the Eureka Stockade, and are in very good condition. The Gold Licenses were donated to the Ballarat School of Mines by John Wilson in 1921. Two gold licenses issued by the Colony of Victoria. Their children were Honor Mary Birch, known as Nora, born 1900, Margaret Martin, Bert Birch and Brigidene Brinkotter. In 1903 a Miner’s Right of one acre in area beside the Watsons Creek just outside the then Shire of Eltham was granted to Edwin Samuel Birch. In 1907 Birch applied to purchase this land but was unable to because it was part of the creek reserve. Documents show that the cottage existed at that time. Upon Birch’s death in 1932, his daughter, Honor Mary Birch was granted a permit to occupy the residence. Honor died in 1950 and was buried in Eltham Cemetery. In 1903 a Miners Right of one acre in area ...EDHS Newsletter No. 182, September 2008 In the late 1970s when our Society was the Shire of Eltham Historical Society, an offer was made to the Society regarding use of an old cottage at Christmas Hills. For various reasons the offer ultimately lapsed The cottage sat beside Watsons Creek just outside the then Shire of Eltham but following municipal restructuring it now lies within the Shire of Nillumbik. At that time some research on the cottage was carried out for the Society by Keith Chappel as part of a larger research project that he was doing. Keith's notes were taken from Lands Department records and showed that house is the subject of a permissive occupancy of Crown land comprising the creek reserve. In 1903 a Miners Right of one acre in area was granted to Edwin Samuel Birch. In 1907 Birch applied to purchase this land but was unable to because it was part of the creek reserve. The documents show that the house existed at that time. Birch died in 1932 and his daughter Honor Mary Birch was granted a permit to occupy the residence. The future of the cottage remains precarious because of its location on Crown land. In 2007 the Andrew Ross Museum began a campaign to ensure that it is preserved. It included a video presentation on the history of the cottage under the title of "This Old House- Birch Cottage".
