Copy of "Plaint Summons No. 39" lodged at the County Court, Ballarat May 1901, titled "Nankervis vs The Ballaarat Tramway Company Limited." Cost claimed was L100 (100 Pounds). Comprises: 1. Cover sheet, on pre printed form, filled out in light black ink and with pencil notations giving a sum of L28/9/6 and L30/0/0 (settlement figure?). Pinned with a brass clip to the cover sheet, which is in poor condition at edges is a handwritten sheet giving particulars of the demand and other details. 2. Copy of Interrogatories for the demands - three sheets of typed paper, pinned together to a typed cover sheet with a brass clip. Dated 15/4/1901 and signed by the W.E. Johnston, Deputy Judge. 3. Copy of handwritten statement by a person (a doctor?) who called on Mrs. Nankervis to assess her condition and circumstances - dated 28/3/1901. 4. Copy of handwritten letter from T. Anderson Robertson (Barrister and Solicitor) of Lydiard St. Ballarat, dated 27/2/1901 to the Chairman and Directors of the Ballarat Tramway Co. Ltd. advising them of the accident and seeking compensation. 5. Letter as for item 4, but dated 18/3/1901 detailing the accident and seeking L50. (50 pounds) settlement. - three separate sheets - handwritten letter. In the cataloguing sheet is an e-mail from Alan Bradley outlining how the documents were obtained. Newspaper clipping contained within Reg. Item 2526, page 10, titled "From Horse Tram to Trolly Bus" (mis-spelt word) recording the history of the cable trams in Melbourne, the formation of the company, prohibition of steam locomotives, costs, mechanical problems, Council objections, rails, visit of Mr. Hallide, court actions, King St. track, take over by the MMTB and that "conversion war still rages" - and perhaps trolley buses. Thirteen typed, foolscap size, page (carbon copy) of the Commonwealth Court of Arbitration decision and basis for this decision made 14/6/1955 by Conciliation Commissioner E.W. Tokin. Notes history of dispute, MMTB, SEC, Adelaide, Hobart, Launceston, Ballarat, Bendigo and Geelong. Details basis for decisions of Contract of Employment, additional rates for trackman, time allowance at commencement and finish of duty, meals, training of traffic employees, special night allowances, margins. On bottom of page 5, the formal award commences: gives details of award duration, rates of pay, contract of employment, margins compared to the basic award, additional rates, hours of labour, shift work, overtime. holiday work, call forward and call back to duty, spread of hours, Saturday and Sunday work, special night allowances, time allowance at commencement and finish of duty, attending for duty, reporting for duty, meals, acting out of grade, surpluses and shortages, annual leave, sick leave, free travel uniforms, training of traffic employees, reports, union notices and punishments. Was stapled for all 13 pages with three staples on left hand side. Pages 10 to 13 have become unstapled. Contained within a heavy grey cardboard folder with "A.T.M.O.E.A Award as from 14.6.55" written on outside cover in black ink.
