On 15 December 1994 the former Shire of Eltham ceased to exist following the Liberal Kennett Government local council amalgamations. A new Nillumbik Shire Council was established with unelected commissioners appointed. That Council sold the former Eltham Shire Council Offices and land at 89S Main Road Eltham to Dallas Price Homes Pty. Ltd. the sale being conditional upon the granting of a planning permit for a petrol station/convenience store, fast food and video outlet. The sale was conditional that if the permit was not granted by 30 August. 1997, the contract could be avoided by either the purchaser or the vendor. The proposed development consisted of a petrol station with undercover fuelling facilities, convenience shopping, a drive through service facility for fast food, an 80 seat cafe, automated banking, a children's play area and retail space. In addition, the proposal included a 200 square metre community facility for Council use, provision of on site carparking over 2 levels for 83 vehicles, and advertising signage. The Advisory Committee was appointed under Section 151 of the Planning and Environment Act 1987 to hear submissions on the proposal to develop the land at 895 Main Road Eltham, the site of the former Eltham Shire Offices. In September 1996, two applications were made by Contour Consultants Australia Pty Ltd on behalf of Dallas Price Homes Ply Ltd, to Nillumbik Shire Council. After extensive notification, the Council received 213 objections and a petition of over 1400 signatures. On October 9, 1996, Nillumbik Shire Council issued Notices of Decision to Grant Permit on Applications number 96/03376 and 96/0377 for the use and development of the land as a convenience Centre consisting of a petrol station, convenience store, cafe/takeaway food premises, a retail facility and a community facility, with associated advertising signs. Objectors to the proposals lodged Planning Appeals number 96/40724 and 96/40812 with the Administrative Appeals Tribunal on November 1, 1996. The grounds of appeal can be summarised as: inappropriate development, insufficient carparking, traffic and access issues, unsatisfactory design, inadequate permit conditions, the proposal being out of character with the area. and being contrary to the purpose and orderly development of the Eltham Town Centre, excessive noise, lack of consultation and unsuitable signage. On November 13, 1996, the Minister for Planning and Local Government directed the Registrar of the Administrative Appeals Tribunal. under Section 41 (1) (a) of the Planning Act 1980, to refer the Appeals to the Governor in Council for determination without a hearing or recommendation by the Tribunal. The Minister for Planning and Local Government called in the Appeals as he considered that they raised major issues of policy relating to the facilitation of development in accordance with the objectives set out in Section 4 of the Planning and Environment Act 1987, and that determination of the Appeals could have a substantial effect on the achievement of these planning objectives. The Minister required the Advisory Committee to consider the planning merits of the proposed use and development, and to address the issues raised in the objections. The Advisory Committee was required to produce a report providing: • The Committee's response to the matters detailed; • Relevant supporting information for the Advisory Committee's recommendation; and • A description of the proceedings conducted by the Advisory Committee and a list of those consulted or heard by the Committee. In March 1997, elections were held in the Shire of Nillumbik and the view of the new Council to this proposal differed from the view held by the earlier Council Hence the Submission made to the Committee by the Shire was against the decision by the Shire of Nillumbik to issue the Notices of Decision to Grant a Permit. The Recommendations of the Advisory Committee were: i. The cafe and take away food premises are as of right uses and are therefore allowable, but that shop and petrol station are unacceptable uses. A community facility is a discretionary use and is acceptable. ii. A development of the type and scale proposed is totally inappropriate for this land and that the Applications number 96/03376 and 96/0377 for the use and development of the land as a convenience Centre consisting of a petrol station, convenience store, café/takeaway food premises, a retail facility and a community facility, with associated advertising signs, be refused. iii. Eltham Courthouse Officially Reopened (Jim Connor, EDHS Newsletter No. 263 April 2022) In the Conservation Management Plan prepared in 2006 for the Eltham Justice Precinct there is mention that more than 350 court houses have been built by the Public Works Department since 1856, when the Department was established. It also states Eltham was in an early group of 'Victorian Free Classical' structures, featuring a projecting entry porch and gabled roof. Characteristically, this group shares a simple, rectangular shape, central placement of the court room with smaller-scale offices set back at the sides or rear of the court room, arched openings, and decorative string courses. The Statement of Significance listed in the Victorian Heritage Register states: ‘The Eltham Court House dates from the time when the town was largely self-contained. It was initiated in response to itinerant gold prospectors who turned to crime when their quest was unsuccessful. This type of localised solution is characteristic of the self reliance preserved in Eltham today. The court house is an important symbol of the spirit which makes Eltham distinctive as a community.’ It also states: ‘The Eltham Court House, built in 1860, is one of only two intact examples in the state of this simple design with projecting entry.’ So with this background it is most appropriate this valued historic building has recently been the subject of a total restoration, as detailed in previous newsletters. This was a major project undertaken by Nillumbik Shire Council. At a small function in the Eltham Courthouse, on 23rd March 2022, Nillumbik Shire Council Mayor Fran Eyre declared the fully restored building officially reopened. In doing so the Mayor spoke about the earlier law and order function of the court and the importance of this building to the Eltham community. Wingrove Ward Councillor Geoff Paine then highlighted the importance of historical societies and groups within the shire and their valued activities in recording and preserving their local history. EDHS president Jim Connor thanked everyone involved with the project and provided an overview of the history of the courthouse. Michael Ioannides, Council’s project manager, spoke about how the restoration process proceeded and those involved in undertaking the works required. Cr. Natalie Duffy, various council officers, EDHS executive committee members, as well as representatives of the head contractor Ducon Building Services and the heritage advisors, RBA architects and Conservation Consultants, were also in attendance, as was a representative of Nillumbik U3A. After the formal part there was some light hearted interpretation of how past legal proceedings may, or may not have, occurred within this courthouse, before some refreshments were shared in the former second courthouse at the rear, which is now utilised by Nillumbik U3A. Nillumbik Now and Then takes the reader on a journey from when the Aboriginal people were this area's sole inhabitnats, to the present day. Nillumbik's history - told in this collection of 96 stories, which are nearly all based on sites - mirrors those of the wider Australian community. It includes tales of the Wurundjeri people, a former convict, farmers, a bushranger, gold-mining, soldiers, artists, intellectuals, environmentalists and sportspeople. Each story is illustrated with a photograph. As a journalist with the former Diamond Valley News, Marguerite Marshall wrote a series of articles on local places of historic interest, later published as the small book "Eltham Shire - Historic Buildings and Places". Many years later an expanded version was published under the title "Nillumbik Now and Then". This is a much larger version of "Nillumbik Now and Then", including significant rewriting and many additional articles. The new publication was made possible by financial support from the Victorian Public Records Office, Bendigo Bank and Nillumbik Shire Council. EDHS and other historical societies in Nillumbik assisted with content for many of the stories. The book was launched at the Eltham Library on Wednesday 19th November 2008. Published in 2008 immediately prior to the Black Saturday bushfires of February 7 2009, it documents sites that were impacted, and in some cases destroyed by the fires. It includes photographs taken especially for the publication, creating a unique time capsule representing the Shire in the early 21st century. It remains the most recent comprehenesive publication devoted to the Shire's history connecting local residents to the past.
