This ledger contains lists of sales of the Warrnambool business of Swintons Pty Ltd from 1907 to 1922. William and Ann Swinton migrated to Australia in 1854 and for a decade William Swinton worked as a builder and carpenter , erecting many buildings in the Warrnambool area, including the Wangoom Presbyterian Church. In 1865 he opened a shop in Timor Street, Warrnambool selling groceries, glassware, china and hardware. In 1888 the business became known as William Swinton and Sons. Branch stores were opened in Cudgee, Nullawarre, Wangoom, West Warrnambool and South Warrnambool. When William died his son Robert became the first managing director of Swintons Pty Ltd. In 1934 the business split in two with George Swinton and Sons selling furniture, clothing and glassware and Swintons Pty Ltd selling seeds, hardware and produce. Today the Swinton family still operates a furniture and bedding store in Timor Street. This ledger is of considerable significance as it is associated with the Swinton family Warrnambool businesses. It gives lists of sales for the years 1907 to 1922 and contains the names of the customers and their purchases over that time. It will be very useful to researchers. The current Swinton business in Timor Street is the oldest family business in Warrnambool and, with the Swinton name associated with businesses in Timor Street for 152 years, it is among the oldest family businesses in Australia. This ledger has a black cover with brown leather binding with a label on the spine with gold lettering on a red background. The insides of the cover have black and blue mottled patterning and the binding here has been reinforced with white tape. The pages are white with printed red lines. The entries are handwritten in black ink with some names underlined in red ink. The ledger cover is stained and one page is loose. It is elegant, sophisticated and durable. The label notes the design as “AUS MASSIV GEBOGENEM HOLZE vorm” which translates to “solid curved sandals shape”, a good description for the back of the chair. The chairs have marks, paper labels and symbols on them that show that the maker was Harnisch & Co., Neuschler (also called Banská Bystrica) Furniture Factory in Neuschol (Beszterczebanya), Hungary, privileged makers for the Imperial and Royal Austrian-Hungarian Empire 1867 – 1918. Bentwood chairs are made by a process of wetting wood in water, bending it into curved shapes, then allowing it to dry so that the shape becomes permanent. This process originated by Michael Thonet, who had been given the right to bend wood into desired curves by the Austrian Courts in 1842. In 1856 he was granted a 13 year patent to manufacture chairs and table legs of bent wood treated by steam or boiling water. In 1859 his company Gebruder Thonet produced his original design. Thonet’s early designs also featured hand carved or laminated wooden seats. His Model No. 14 produced in the 1850’s, was his most popular design. After Michael’s death in 1871 the family went on designing and producing chairs. The No. 18 chair was produced in 1876, one of a group of chars with back inserts consisting of curves and loops of bentwood. These bentwood chairs are believed to be associated with the either the original Warrnambool Town Hall or the Toc H Group in Warrnambool. The Warrnambool Town Hall played a significant role in the both the local government and the social events of local and district areas. This chest came from County Cavan, North Ireland, with Jane Fleming, when she migrated to Australia arriving at Port Fairy in approximately 1863. Jane Flemming was about 6 or 7 years old at the time and later was to become the mother of Mary Jane Giles (nee Flemming). This chest is one of many 19th century items of furniture, linen and crockery donated to Flagstaff Hill Maritime Village by, Vera and Aurelin Giles. The items are associated with Warrnambool and the Giles Family history. Items donated by the family have come to be known as the “Giles Collection”. Many items in the Lighthouse Keeper’s Cottage were donated by Vera and Aurelin Giles and mostly came from the home of Vera’s parents-in-law, Henry Giles and his wife Mary Jane (nee Freckleton) who married in 1880 and whose photos are on display in the parlour. Henry was born at Tower Hill in 1858, and was a labourer on the construction of the Warrnambool Breakwater before leaving in 1895 for around seven years to build bridges in NSW. Mary Jane was born in 1860 at Cooramook and she attended Mailor’s Flat State School and where she eventually was to become a student teacher. After which she became a governess at “Injemiara” where her grandfather, Francis Freckleton, had once owned land. Henry and Mary’s family consisted of six, some of the children were born at Mailor’s Flat and later some children at Wangoom. They lived with their parents at Wangoom and Purnim west, and this is where Henry died in 1933 and Mary Jane in 1940.The chest is of historical significance as an example of an early piece of furniture brought to Australia by Jane Flemming when she migrated to Australia during the mid 19th century. The chest is associated with the Giles family as Jane later was to become the mother Of Mary Jane Giles (nee Flemming). The Giles family collection is of social and historical significance at a local level, because it not only illustrates the level of material support the Warrnambool community gave to Flagstaff Hill during it’s establishment. The furnishing requirements list what is needed for each room within the new school - Ballarat Junior Technical School - that was built near the Ballarat School of Mines. This mallet has a cylindrical head and would have been used to guide chisels for woodworking. The hammer end has a larger surface area than oblong mallets and gives greater control with less force. Wooden mallets don’t damage the metal head of the chisel as would an iron hammer. The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. This item was from the original Torquay primary School. It is believed to date back to the early 1900s or earlier. It was supplied to the school by the Public Works Department and still bears the PWB brands. The desk was purchased by the late George McCartney, at a public auction of the old school's furniture and effects and donated by the McCartney family to the Torquay and District Historical Society in 2017. Hand-made child's doll's house. Built by Mrs Yvonne Fitzmaurice and finished in 1979. This house was built as a 1:12 scale and is a model of a Californian house called Peppercorn farm. House was built by Yvonne and her family and took a period of three years. A lot of the furniture is handmade and the rest is collected from various shops. Catalogued books, manuals, repair kits etc used when building the house.The white painted verandah has a brass plate beside the door with the name Susan Fitzmaurice. This handmade basket is typical of baskets used for domestic purposes for many years in the early to mid 20th century. It was produced in Australia by Graf's. Wicker baskets were popular at this time as they were light but durable. They were made in a wide range of shapes and sizes, including laundry baskets, storage items in the home, in shops and by travelling hawkers. Wicker was also a common material used for furniture. Vintage baskets by Graf's are still in demand by collectors.This item is significant as it is representative of basketry items popular throughout Australia in the 1960s. The original owner of the beautiful wardrobe was William Swinton Jr. (1860-1929) and was later given to a friend of the Giles family. It is part of the Giles Collection. William Swinton Jnr. was a Warrnambool Councilor 1903-20 and Mayor 1917-19, during which time Warrnambool declared a City (1918). William's father, William Swinton Snr. (c.1831-1901) arrived in Warrnambool in 1854 from Edinburgh, Scotland. He established the Swinton store in Timor Street in 1865 where it is still located. William Snr's grand-daughter, Doris Swinton (1904-1986) was one of Australia's most highly decorated nurses of World War 2 and for 16 years matron of the Warrnambool and District Base Hospital. There is a street in Warrnambool named after the Swinton family. This Commode Chair has been skillfully adapted by a bush carpenter from a kitchen chair - possibly for an invalid at a time when toilets were usually outside and often difficult to reach. The hinged seat is held up by a wire hook (No.8 fencing wire), and the seat can be lifted to remove the commode pot. The cream paint is of the type universally used for kitchen furniture before a more diverse range of paint colours became available.A wooden commode chair converted from a kitchen chair with four round legs and a hinged seat. Underneath is a hole to hold chamber pot or covered commode. The backrest consists of three turned spindles between squared timber that supports a carved rail across top. This hand crafted doily, created during war time, features a side on image of a soldier handing a rifle with butt at his feet. In Victorian times, idle hands were frowned upon so women knitted and crocheted. In addition to their decorative function doilies have the practical role of protecting fine-wood furniture from the scratches caused by crockery or decorative objects, or from spilled tea when used on tea trays or with cups and saucers.
