The Memorial Park and Shire of Eltham War Memorial tower are sited at was once known as Garden Hill and was reknowned for its panoramic views it offered tourists from the 1880s on. In 1907 Birch applied to purchase this land but was unable to because it was part of the creek reserve. The house existed at that time. Birch died in 1932 and his daughter Honor Mary Birch was granted a permit to occupy the residence. The future of the cottage remains precarious because of its location on Crown land.
