The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. It was still in use up till approx 2012 when the office was renovated. This work forms part of the collection assembled by the historian Dorothy Rogers, that was donated to the Kew Historical Society by her son John Rogers in 2015. The manuscripts, photographs, maps, and documents were sourced by her from both family and local collections or produced as references for her print publications. Many were directly used by Rogers in writing ‘Lovely Old Homes of Kew’ (1961) and 'A History of Kew' (1973), or the numerous articles on local history that she produced for suburban newspapers. From 1851 the Victorian government required all men on Victorian Goldfields to carry a Gold License. The fee was one pound per month, and was payable in advance. There was agitation surrounding the gold license which was thought to be an excessive fee and did not give the bearer right to representation. On 03 December 1854 the gold diggers on the Eureka Lead fought a short battle against the army and police troopers. A few months later a new system of taxing gold diggers was introduced - the Miner's Right.The Victorian Gold Licence was issued from 1851 until early 1855. Every man on a Victorian goldfield had to carry a valid gold license, so few survived the harsh treatment of being carried around a working goldfield. There was much dissatisfaction about what was thought to be an unfair mining tax (or gold license). On 29 November 1854 Ballarat miners burnt their licenses on Bakery Hill. On 3 December 1854 the Eureka Stockade Battle took place, resulting in the Goldfields Commission. The first Miner's Right was issued in late June 1855, and in July the first Local Courts were elected by miner's right holders. The two Fitnall Gold Licenses are important because they were issued on either side of the Eureka Stockade, and are in very good condition. The Gold Licenses were donated to the Ballarat School of Mines by John Wilson in 1921. Two gold licenses issued by the Colony of Victoria. When Ballarat Junior Technical School building was opened in 1921, there was little cleared space for the students to use for sporting activities. The area known as Battery Paddock was used for dodge-ball and football. Gradually the slope area was cleared and planted. In November 1922 a tennis court was opened in the Battery Paddock. It was designed and built by two former students of the Ballarat School of Mines. The old Mount Doran school house was moved to the area as a students' common room. A new tennis court was built in the same vicinity in 1934. This area was on the corner of Grant and Albert Streets. Area is where the Corbould Building and the Automotive Skills Centre of School of Mines Ballarat Grant Street Campus now stand. The Sidcup Collection came to RACS from the University of Melbourne, Pathology Department and is regarded as one of the most valuable held by the College. It includes the patient records created by the Australian Surgical Unit at the hospital and covers the period 1916 - 1919. There are 50 watercolour illustrations of patients sketched by Sgt. Daryl Lindsay, X-ray prints, photographs, diagrams and some case histories. Private Pritchard was treated by the Australian Surgical Unit during WW1.These casts are unique in Victoria An original plaster cast taken of a patient Private Pritchard, who required reconstructive surgery c1917-1921. Worn by Elizabeth Goodwin of Liverpool, England, who married Horace Book at St Andrew's Church, Brighton in 1921. The fabric was purchased by her father, a ship's captain, when he was in China. The bride had her dress made in Liverpool and made to a Butterick's pattern. Elizabeth was very active in public life and a well-known member of the Book family. Woodbury College is an indirect predecessor of Preshil School in Kew. Woodbury College was founded in Glenferrie Road by a Miss Harcourt, former principal of Sydenham College, Moonee Ponds. Miss Harcourt maintained the school until the goodwill was purchased in 1908 by Miss LJ Macey, who had previously operated Lillsden Ladies' College in Edgevale Road, between c.1891 and c.1903. The first school was in a rented building on the south side of Cotham Road between Atkins and Davis Streets. In 1910, a new school building was built on the corner of Uvadale Grove and Cotham Road [the building is still extant as of 2020]. Woodbury College was operated by Miss LJ and Miss HJ Macey until 1920. In 1921, the school amalgamated with the newly formed St Andrew's College, Mont Victor Road, Kew (Vic) under the leadership of Rev JT Lawton [who had previously been principal of St Andrew's School of the 'Pathfinder' in South Yarra]. Miss Macey was for a period the Headmistress of the amalgamated school. Opened on Tuesday, November 15th, 1921 the Hall was erected by the Citizens of Bendigo to commemorate the deeds of the men and women of the district who served in the Great War. Now one of the largest Memorial Museums in the country the Bendigo Soldiers Memorial is now home to a broad range of military memorabilia. Situated on the highly visible Pall Mall, the hall was redeveloped and officially reopened as a museum in 2018.
