The Eltham Court House is Eltham's oldest public building. It was classified by the National Trust in 1977. In 1857 five Eltham residents petitioned the licensing magistrates of the Heidelberg district asking for better police protection, including from itinerant gold prospectors who turned to crime when their quest was unsuccessful. In response the Eltham Courthouse was constructed in 1860. Over the years it has also been used for other activities, including for electoral polling purposes, inquests, early meetings of the Eltham Roads Board and even as an overflow classroom. This type of localised solution is characteristic of the self-reliance preserved in Eltham today. The court house is an important symbol of the spirit which makes Eltham distinctive as a community. The Eltham Courthouse is historically significant because its construction was intended to emphasise the centralised control over law and order in the Colony of Victoria in the wake of the 1852 Snodgrass committee report on the Victorian police force and the resulting Police Regulation Act (1853). The nature of the Court House planning and use of architectural devices make the building's function easily interpreted. The arrangement of rooms, with public entry and clerical rooms to the rear, and the use of raised floor levels throughout these spaces to signify relative rank is easily perceived. The distinction in entries, public, magistrate and person-in-custody, and the existing court furniture enhances appreciation of this building. The Eltham Court House is one of only two intact examples in the state of this simple design with projecting entry. The building is of architectural significance because it retains intact early features. These include use of handmade bricks, simple decoration, roof trusses, timber ceiling boards, original windows, doors and associated hardware and a collection of court furniture. Additions to the court house have been done in a manner which did not interfere with the fabric of the original building. Typical cases heard before the Court of Petty Sessions included financial debt, straying livestock, theft, assault, drunkenness, public disorder, truancy, motor vehicle offences, unregistered animals and failing to have children attend school, or be vaccinated. The courthouse operated for over 120 years before it closed in 1985. In April 2021, Nillumbik Shire Council authorised restoration of the building and furnishings. The extensive works required for the total restoration of this highly valued heritage building was undertaken by Ducon Building Solutions and other specialist contractors. Yet the nearest police were at Heidelberg eight miles (12.8km) away, or at the Caledonia Diggings 21 miles (33.7km) away.1 Subsequently the courthouse and then the police residence, near the corner of Main Road and Brougham Street, were built in 1859/60. The courthouse is Eltham’s oldest public building and the National Trust classified it in 1977. It ceased operation in 1984 and has since been used by local groups. There are only six other known examples of similar small brick country courthouses in Victoria . For £536, a Mr Duncan built the courthouse – a neat, narrow, oblong building with handmade orange bricks. Its gabled roof and porch are covered with brown slate tiles and it has 12-paned windows. Inside, the roof is peaked and the courthouse is still ventilated by oblong slits near the ceiling. Most of the fine carved timber and upholstered furniture is original. The original prisoners’ door, now permanently closed, led from the police station to the dock. Builders, Langridge Wright and Witney built a timber police station (since demolished) and a brick residence to its north,2 for £1150/7/-. Built around the same time were the lock-up behind the residence, also later demolished, and the two-storey orange brick stables. The former police residence also has a brown slate roof and handmade bricks. The front veranda roof is made of corrugated iron, as is the roof of the back weatherboard extension. The application for police protection was approved within a few months and police operated from a cottage rented at ten shillings a week and owned by William Jarrold. This was probably the one at the corner of Main Road and Dalton Street called Jarrold or White Cloud Cottage. In 1858 a second constable was appointed to Eltham following a fight at the hotel. The timber police office a replica of which was built in the early 1990s is at the building’s side. The lock-up was demolished following the relocation of the police to a new station in about 1952. The residence has been used as the Eltham District Historical Society centre since 1997. Records show court cases were held at Eltham before the courthouse was built, but the location is unknown. Some court cases were not very different from those today. In 1891 a man was charged with being drunk while in charge of a horse and was fined ten shillings. The courthouse was used for other purposes during its long history. It was probably used as a polling place as indicated by old photographs of election-day crowds outside. The Eltham Road Board met there from the early 1860s until 1868 when the Board transferred to Kangaroo Ground. During the same period the Road Board Secretary used the courthouse as an office until 1867 when it was transferred to his home at Wingrove Cottage. The courthouse was also used as an overflow classroom for the Dalton Street school in 1875. The two buildings can further link us with Eltham’s early days through Police Department correspondence. The first constable-in-charge was George Reid. In 1860 a letter to The Argus newspaper signed ‘A Sufferer’ declared the Eltham police were not active enough in their duties. The writer suggested that the ‘very snug’ police quarters were too comfortable, and he detailed various incidents including one of an alleged break-in to the Road Board Secretary’s home. But the Board Secretary, C S Wingrove, wrote to the Police Department refuting The Argus letter saying he had received full co-operation from Sen. Constable Peter Lawler.This collection of almost 130 photos about places and people within the Shire of Nillumbik, an urban and rural municipality in Melbourne's north, contributes to an understanding of the history of the Shire. Published in 2008 immediately prior to the Black Saturday bushfires of February 7, 2009, it documents sites that were impacted, and in some cases destroyed by the fires. It includes photographs taken especially for the publication, creating a unique time capsule representing the Shire in the early 21st century. The suggestion of an Avenue of Honour may have been originally put forward by Lady Irvine who was a member of the Welcome Home Committee. The Avenue of Honour was established to memorialise all those from Eltham who enlisted (some of whom were still fighting overseas at the time), similarly as the Shire of Eltham (Soldiers) Memorial Park was in tribute to all from the Shire who enlisted. The twenty-seven names of those killed from Eltham were engraved on the Eltham War Memorial Obelisk unveiled in 1919 at the corner of Main Road and Bridge Street. From an article in the Heidelberg News and Greensborough, Eltham and Diamond Creek Chronicle, September 22, 1917, p. 2, it was reported: Some few weeks ago a public meeting was held in the Eltham Rechabite Hall for the purpose of forming a committee to make necessary arrangements for the return of our brave lads from the front, with the result that the following officers were elected, viz., Sir William Irvine. president; Cr. R. D. Taylor, vice-president; Rev. T. W. Sapsford, secretary; Mr R. E. Gilsenan, treasurer; with a very strong committee of local residents. Lady Irvine then suggested that it would be nice to plant an Avenue of Honor, which was carried out in a very cheerful and spirited manner on Saturday afternoon. Cr Taylor and Mr R. E. Gilsenan occupied themselves during the fore-forenoon in getting the lining-out and other preliminaries ready, but shortly after one o'clock the willing workers could be seen wending their way towards the township, with picks, shovels. &c., on their shoulders, and in a very short time the gang at work was in appearance a very lively and pretty sight, the only thing that was missing was the camera, to have had a few snapshots taken. A little after 3 o'clock Sir William and Lady Irvine, and Mr W. Gray and family, arrived by motor. Cr Taylor then explained that their object in gathering together so hurriedly to plant the avenue was on account of the lateness of the season, and being offered 100 trees, free of charge, by Cr. Wm. G. Gray; of Allwood Nursery, Hurst's Bridge (for which the committee are deeply grateful to him and the public highly appreciate his generous offer). Sir Wm. Irvine then spoke at some length on the ravages of this cruel war, and the good that must result therefrom in bringing all closer together; he also referred to our brave lads who were fighting for us, and thought it was for those at home to show their appreciation by planting the Avenue of Honor. Lady Irvine thou proceeded to plant the first tree, which was an English oak: Sir William following by planting a Spanish chestnut; and Mrs W. G. Gray a sycamore. After that the gathering refired to the entrance of Mr R. E. Gilsenan's green paddock to partake of refreshments, which the ladies had kindly provided for the willing band of workers. Work was again taken to in earnest, and the planting finished, all being satisfied that they had done good work. At the Eltham Shire Council’s monthly meeting held May 6, 1918, Cr. Gray promised to give Council £20 to £25 worth of trees if the Council would plant and guard them. His desire was that a tree be planted in the name of every soldier lad who has gone to the front. Each tree was later adorned with a brass plaque with the name of a soldier and a wooden tree guard placed around them. Over the years many trees died, and following roadworks were replanted on a new alignment. Nillumbik Shire Council is continuing this process of replanting trees in a new alignment to move them away from overhead power lines and to clear the VicRoads reserve. Newspaper article: A sustainable award, Diamond Valley Leader, 1 November2006, Architect and building Llewellyn Pritchard won resource Efficiency Housing Award, finalist in HIA Greensmart Building of the Year Award. House – Environmental Leader (Published: Nillumbik Now and Then /​ Marguerite Marshall 2008; photographs Alan King with Marguerite Marshall.; p186) In 2006 environmental awareness was mushrooming in the community, which is reflected in the award-winning house at Main Road near Wattletree Road, Eltham. At first sight, the building appears a mix of a classic Eltham mud-brick house and an avant-garde building style. The crown of solar panels stretching along the width of the curved roof, indicates that this is no ordinary house. In fact it signals a new building trend of minimal impact on the environment. Yet it utilises the environment with high technical expertise to achieve comfort and cut running and maintenance costs. In recognition of this, its designer/builder, Conscious Homes, won the 2006 National HIA Greensmart Resource Efficiency Award. For Conscious Homes director, Llewellyn Pritchard, this house reflects a philosophy, strengthened by his connection with Aboriginal culture, through his foster siblings. Pritchard believes the sustainable way indigenous Australians lived and their spiritual connection with land, demonstrates how humanity is part of the ecology. His interest in environmental design stemmed from growing up in bushy Eltham Shire, with its mud-brick tradition. This was followed by studying Architecture at RMIT in the early 1980s, and learning about passive solar design. Pritchard says this house demonstrates that environmental sustainability is not about sacrifice, but about exceptional levels of occupant comfort, savings in running costs and modern fittings and appliances.1 The solar panels on the north roofs are intentionally obvious to make a statement about what the building is doing. But inside the systems are hidden and interactive with conventional services, such as the underground water tank. The house is water and energy self-sufficient and at 12 squares is much smaller than conventional houses, to minimise resources. Yet it accommodates his family of four with three bedrooms, a living/dining and kitchen area and a bathroom/laundry. Importantly the building is designed to last hundreds of years, by being able to be modified as the need arises, such as for commercial use. In this way the structure minimises its environmental impact. The solid double mud-brick walls (which are insulated) include steel beams and supporting frame, allowing the future removal or alteration of any section. The materials are local, recycled and of low toxicity where possible.2 Inside and out, the mud-brick is rendered and sealed with a combination of cement and sand and a mud-based coating in a soft golden hue increases its life. Inside, the golden-brown timber is plantation Mountain Ash and the concrete floors throughout – of local stone aggregate with a clear seal – have a natural looking random stone appearance. The house sustains a stable temperature of around 20 degrees, assisted by the concrete slab floor. The many large double-glazed windows and highlights (windows set high on walls) provide cross-flow ventilation. The north-facing living area maximises heating from the lower winter sun and is cooler in summer, because the sun is higher. Heating comes from a solar hydronic slab system. All appliances and fittings are high efficiency energy or water rated. Appliances in the timber kitchen include a gas stove and a dishwasher, using the building’s own power and water. French doors open from the living area to a deck, concealing the treatment system for all waste water. This is pumped through sub-soil drippers to the indigenous garden beds and no-dig vegetable patch. Below the carport is the 80,000-litre rainwater tank and at the back, the boiler room houses the solar boiler, water tank access, domestic water supply pump, filter gear and hydronic slab heating controls. The solar system is backed up with gas, which is needed to heat water only in winter. Gas used is less than one quarter of that for an average home with ducted heating. Excess power is fed back to the grid and the building uses about one quarter of the mains electricity of an average home. Anne Hamilton born 1814 Co Tyrone, Ireland married Michael Head Burgoyne (1820-1843) in 1839, Co. Tyrone, Ireland. They had two children, Charlotte Caroline (1840) and John James Thomas Neville (Londonderry, Ireland 1844) Whilst pregnant with John, husband Michael died. Following John’s birth, she emigrated to Victoria, Australia where she married Thomas Hunniford in 1854. Daughter Anne Jane Hunniford was born in Eltham in 1855. Anne (Annie) Jane Hunniford and John James Thomas Neville Burgoyne were half siblings. In the mid 1860s Annie Hunniford succeeded her father, Thomas Hunniford as Post Mistress for Eltham. This was the time period that he placed advertising for same in the local paper. Australia Post: Gold brought life to the township - Diamond Valley News, Tuesday July 2, 1985, p17 On February 1, 1854, the first Eltham Post Office was established, commencing an association between the township and the Postmaster-General's Department that has continued for 131 years. At that time, the number of permanent residents would have been fairly small, probably less than 200. The discovery of gold in June 1851, at Anderson’s Creek, some five miles away, and later at Caledonia Diggings, Queenstown (now known as St Andrews), about 14 miles to the north-east, brought large numbers of prospectors passing through the township, hopefully culling the creeks and gullies for the precious metal. This additional "floating population" brought a greater demand for supplies and for communication with the outside world, and so it helped in the development of Eltham. Today, Eltham is a thriving township. It boasts an excellent shopping centre, municipal offices, court house. post office and many other amenities. Eltham continued to develop at a leisurely pace. During 1860, a total of just over 8000 postal articles were handled at the Eltham Post Office. By 1862, the mail route was "to and from Melbourne by way of Eltham and Kangaroo Ground, three times a week, by coach". There was also a branch mail that operated between Eltham and Greensborough, three times weekly. This was also conveyed by coach. Some time between 1864 and 1868 the management of the post office passed from Thomas Hunniford to his daughter, Miss Anne Hunniford, who managed the Eltham Post Office until her death in 1928. A big improvement in communication was provided for Eltham residents when a telegraph office was established at the post office in 1877. During 1923 a manual telephone exchange was provided at Eltham, the first two subscribers being J.J. O’Connor and Eltham Police Station. In 1949 the manual exchange was replaced by an automatic exchange and there were some 150 subscribers. Following the death of postmistress Miss Anne Hunniford in 1928, B.M. Burgoyne was placed temporarily in charge of the office. In 1929, J. N. Burgoyne was appointed postmaster, and he in turn was succeeded by H. C. Burgoyne in 1951. The post office was moved to a new site in 1954, but continued under the charge of Mr Burgoyne. In January 1958 there was a further change of site when the post office was raised to official status and transferred to new premises in Main Rd. William Donoghue was acting postmaster when the new office was opened. In March 1958 Mr W.E. Tovey was appointed postmaster, followed by Douglas McG. Gilmour in 1959. William Donoghue was fully appointed in 1966 and Barry Reichelt followed in 1973, prior to the present postmaster, Peter Jolly in November 1982. Peter is a young man with 18 years' experience. He commenced his training as a postal clerk at the training school in Melbourne in 1968 and was promoted to postal clerk at the Brunswick Post Office in 1969. He was finally transferred as postmaster to Fawkner Post Office in 1980. He has been at Eltham Post Office for the past 2½ years. He is married with one child and lives in Montmorency. The Eltham Post Office employs a staff of 21, of whom seven are indoor staff, 12 are postmen and two are drivers. The postmen in Eltham have an uphill battle delivering mail because of the hilly terrain. Nine of the postmen deliver mail on motorbikes, and the two delivery vans are both four wheel drives. Eltham Post Office services basically a residential area, with deliveries to 5600 homes. This is growing at the rate of 600 homes every 18 months, i.e. about 32 homes per month. Wingrove Cottage built 1858-1859 of hand made bricks is historically significant for its long association with Charles Wingrove, a prominent figure in Victorian local government, as secretary to the Eltham District Road Board and Shire Council from 1858 to 1904, and Shire Engineer and Secretary to the Heidelberg Road Board. The cottage was used as the office of the Eltham District Road Board and Council for many years It is one of the Shire's oldest dwellings, and one of the few surviving 19th century buildings associated with early Eltham and located in the original Eltham Village Reserve. The symmetrical planting of a pair of Pencil Pines (not visible in photo) is also historically and aesthetically significant as characteristic of the early period of planting in the district and because they are a distinctive landscape feature. In October 2002 new owners demolished the outbuildings attached to the rear of the cottage. Community protest at the demolition resulted in Council issuing a Stop Work order. The owner was issued with a court order in September 2003 to develop a conservation management plan and restore the heritage listed property. The owner sold the property in 2005 to Cameron Construction in 2005 who undertook the restoration work. In 2007 a planning application to build two offices and seven dwellings at the rear of the property was ultimately rejected. The cottage is now the main office for Cameron Construction. Published: Nillumbik Now and Then /​ Marguerite Marshall 2008; photographs Alan King with Marguerite Marshall.; p57 Wingrove Cottage on Main Road beside Eltham Primary School, is one of the Shire’s most important historical buildings and was central to local government for almost 50 years. The cottage was built in stages from 1858 to 1888 for Charles Symons Wingrove JP. He was the Eltham District Road Board’s first paid secretary and later the Shire Secretary when the board became the Eltham Shire Council. Wingrove held those positions, and that of engineer for a time, for 46 years. He was also one of the main figures in the Municipal Association of Victoria. As Eltham’s first paid municipal officer, Wingrove used one room in his 11 – (originally two) roomed home, as the office for the board then the council. Meetings were held there from the late 1850s (as well as at more central locations) until Wingrove’s retirement in 1904. The cottage is a rare example of a local government office occupying a Road Board /Shire Secretary’s purpose-designed house. The cottage is also significant because it is the oldest largely intact building from the original Eltham township reserve (south of Dalton Street).1 The township had its origins in the 1848 Nillumbik Parish Plan and was one of the state’s earliest township reserves. The rectangular house of handmade bricks, roofed with grey slate tiles and with a veranda encompassing three sides, is reminiscent of those in the central goldfields including Castlemaine. Its overhanging eaves and gables were unlike houses in Melbourne at the time. Wingrove, who was born in 1827, had been a gold digger and a road surveyor. Impossible to imagine in today’s world, Wingrove was also the Shire of Heidelberg’s secretary and engineer for part of the time that he was secretary in Eltham. Living next door to the primary school was a mixed blessing. Wingrove and his wife Katherine, who had ten children, sent their eight surviving children to the school. But they had occasional disputes with the school authorities when their cattle wandered into the schoolyard. Eltham showed Charles Wingrove its appreciation of his services by giving him two illuminated addresses, one after ten years and the other at retirement. Wingrove died in 1905 aged 76 and was buried in the St Katherine’s Church of England cemetery in St Helena. His grave is surrounded by those of family members including his wife, Katherine and two babies, Henry, 12 months and Isobella, 15 months, who died in the mid-1860s. Cottage ownership passed to his wife, then to daughter Caroline and then to daughter Bessie, a Melbourne University graduate and artist. During the Great Depression their brother Walter was the ratepayer. At one stage the Wingrove property extended to Metery Road and included a small creek. The family ran a small dairy and orchard, with associated farm buildings, which were later removed. In 1949 part of the property was compulsorily acquired by the Eltham Primary School, which infuriated owner Bessie Wingrove. She protested in a letter about this ‘monstrous act of unmitigated tyranny’.2 She was the last Wingrove to occupy the cottage and died in 1955. Wingrove descendants sold the house in 1974 and the property was subdivided. In the 1960s the Eltham Shire named the park opposite the cottage in Wingrove’s honour. The cottage has since had several owners including psychiatrist Dr Daniel Kahans, who practised there. In October 2002 late rear additions which had been substantially altered were demolished contrary to council planning controls. This caused a community outcry and resulted in legal proceedings against the owner. Fortunately the historical significance of the demolished section was not as great as the older front part of the building, which has been retained and was later restored.This collection of almost 130 photos about places and people within the Shire of Nillumbik, an urban and rural municipality in Melbourne's north, contributes to an understanding of the history of the Shire. Published in 2008 immediately prior to the Black Saturday bushfires of February 7, 2009, it documents sites that were impacted, and in some cases destroyed by the fires. It includes photographs taken especially for the publication, creating a unique time capsule representing the Shire in the early 21st century.
