The Eltham Court House is Eltham's oldest public building. It was classified by the National Trust in 1977. In 1857 five Eltham residents petitioned the licensing magistrates of the Heidelberg district asking for better police protection, including from itinerant gold prospectors who turned to crime when their quest was unsuccessful. In response the Eltham Courthouse was constructed in 1860. Over the years it has also been used for other activities, including for electoral polling purposes, inquests, early meetings of the Eltham Roads Board and even as an overflow classroom. This type of localised solution is characteristic of the self-reliance preserved in Eltham today. The court house is an important symbol of the spirit which makes Eltham distinctive as a community. The Eltham Courthouse is historically significant because its construction was intended to emphasise the centralised control over law and order in the Colony of Victoria in the wake of the 1852 Snodgrass committee report on the Victorian police force and the resulting Police Regulation Act (1853). The nature of the Court House planning and use of architectural devices make the building's function easily interpreted. The arrangement of rooms, with public entry and clerical rooms to the rear, and the use of raised floor levels throughout these spaces to signify relative rank is easily perceived. The distinction in entries, public, magistrate and person-in-custody, and the existing court furniture enhances appreciation of this building. The Eltham Court House is one of only two intact examples in the state of this simple design with projecting entry. The building is of architectural significance because it retains intact early features. These include use of handmade bricks, simple decoration, roof trusses, timber ceiling boards, original windows, doors and associated hardware and a collection of court furniture. Additions to the court house have been done in a manner which did not interfere with the fabric of the original building. Typical cases heard before the Court of Petty Sessions included financial debt, straying livestock, theft, assault, drunkenness, public disorder, truancy, motor vehicle offences, unregistered animals and failing to have children attend school, or be vaccinated. The courthouse operated for over 120 years before it closed in 1985. In April 2021, Nillumbik Shire Council authorised restoration of the building and furnishings. The extensive works required for the total restoration of this highly valued heritage building was undertaken by Ducon Building Solutions and other specialist contractors. In 1857 five Eltham residents petitioned the Heidelberg district licensing magistrates. They pointed out that Eltham had two hotels, a population of about 1000, and many strangers employed on the public roads. Yet the nearest police were at Heidelberg eight miles (12.8km) away, or at the Caledonia Diggings 21 miles (33.7km) away.1 Subsequently the courthouse and then the police residence, near the corner of Main Road and Brougham Street, were built in 1859/60. The courthouse is Eltham’s oldest public building and the National Trust classified it in 1977. It ceased operation in 1984 and has since been used by local groups. There are only six other known examples of similar small brick country courthouses in Victoria . For £536, a Mr Duncan built the courthouse – a neat, narrow, oblong building with handmade orange bricks. Its gabled roof and porch are covered with brown slate tiles and it has 12-paned windows. Inside, the roof is peaked and the courthouse is still ventilated by oblong slits near the ceiling. Most of the fine carved timber and upholstered furniture is original. The original prisoners’ door, now permanently closed, led from the police station to the dock. Builders, Langridge Wright and Witney built a timber police station (since demolished) and a brick residence to its north,2 for £1150/7/-. Built around the same time were the lock-up behind the residence, also later demolished, and the two-storey orange brick stables. The former police residence also has a brown slate roof and handmade bricks. The front veranda roof is made of corrugated iron, as is the roof of the back weatherboard extension. The application for police protection was approved within a few months and police operated from a cottage rented at ten shillings a week and owned by William Jarrold. This was probably the one at the corner of Main Road and Dalton Street called Jarrold or White Cloud Cottage. In 1858 a second constable was appointed to Eltham following a fight at the hotel. The timber police office a replica of which was built in the early 1990s is at the building’s side. The lock-up was demolished following the relocation of the police to a new station in about 1952. The residence has been used as the Eltham District Historical Society centre since 1997. Records show court cases were held at Eltham before the courthouse was built, but the location is unknown. Some court cases were not very different from those today. In 1891 a man was charged with being drunk while in charge of a horse and was fined ten shillings. The courthouse was used for other purposes during its long history. It was probably used as a polling place as indicated by old photographs of election-day crowds outside. The Eltham Road Board met there from the early 1860s until 1868 when the Board transferred to Kangaroo Ground. During the same period the Road Board Secretary used the courthouse as an office until 1867 when it was transferred to his home at Wingrove Cottage. The courthouse was also used as an overflow classroom for the Dalton Street school in 1875. The two buildings can further link us with Eltham’s early days through Police Department correspondence. The first constable-in-charge was George Reid. In 1860 a letter to The Argus newspaper signed ‘A Sufferer’ declared the Eltham police were not active enough in their duties. The writer suggested that the ‘very snug’ police quarters were too comfortable, and he detailed various incidents including one of an alleged break-in to the Road Board Secretary’s home. But the Board Secretary, C S Wingrove, wrote to the Police Department refuting The Argus letter saying he had received full co-operation from Sen. Constable Peter Lawler.This collection of almost 130 photos about places and people within the Shire of Nillumbik, an urban and rural municipality in Melbourne's north, contributes to an understanding of the history of the Shire. Published in 2008 immediately prior to the Black Saturday bushfires of February 7, 2009, it documents sites that were impacted, and in some cases destroyed by the fires. It includes photographs taken especially for the publication, creating a unique time capsule representing the Shire in the early 21st century. The Melbourne and Metropolitan Board of Works (MMBW) plans were produced from the 1890s to the 1950s. They were crucial to the design and development of Melbourne's sewerage and drainage system. The plans, at a scale of 40 feet to 1 inch (1:480), provide a detailed historical record of Melbourne streetscapes and environmental features. Each plan covers one or two street blocks (roughly six streets), showing details of buildings, including garden layouts and ownership boundaries, and features such as laneways, drains, bridges, parks, municipal boundaries and other prominent landmarks as they existed at the time each plan was produced. (Source: State Library of Victoria)This plan forms part of a large group of MMBW plans and maps that was donated to the Society by the Mr Poulter, City Engineer of the City of Kew in 1989. Within this collection, thirty-five hand-coloured plans, backed with linen, are of statewide significance as they include annotations that provide details of construction materials used in buildings in the first decade of the 20th century as well as additional information about land ownership and usage. The copies in the Public Record Office Victoria and the State Library of Victoria are monochrome versions which do not denote building materials so that the maps in this collection are invaluable and unique tools for researchers and heritage consultants. A number of the plans are not held in the collection of the State Library of Victoria so they have the additional attribute of rarity.Original survey plan, issued by the MMBW to a contractor with responsibility for constructing sewers in the area identified on the plan within the Borough of Kew. The plan was at some stage hand-coloured, possibly by the contractor, but more likely by officers working in the Engineering Department of the Borough and later Town, then City of Kew. The hand-coloured sections of buildings on the plan were used to denote masonry or brick constructions (pink), weatherboard constructions (yellow), and public buildings (grey). That area of Kew bordered by Cotham Road, Park Hill Road, Ermington Lane (now Ermington Place), and Belmont Avenue contained some of the significant homes owned by Kew pioneers. Chief among these was ‘Park Hill’ on an enormous lot facing Park Hill Road. The Jubilee History of 1910 noted, six years after this plan was drawn, that: ‘Park Hill Road, forming the southern boundary of the cemetery, takes its name from Park Hill, the residence of Mr. Thomas Judd, who has resided there since December, 1852.’ Other named houses on the plan include ‘Ferndale’ facing Cotham Road; ‘Ermington’ adjacent to Judd’s Park Hill, facing Park Hill Road; and ‘Gilden’ and ‘Mont Belmont’ facing Belmont Avenue. Mont Belmont was designed by the architectural firm of Reed, Henderson and Smart for William George Lilley in 1887 and was completed in 1888. During the latter part of 2003 all of the historical societies and similar organisations in the Shire of Nillumbik attended a series of combined meetings arranged by Nillumbik Shire Council. The meetings were arranged by the Council's Arts and Cultural Services Co-ordinator and the Community Events Officer. ..The principal outcome of meetings ..to organise a Nillumbik Heritage Week to run from Friday 26th March to Sunday 4th April. The main event will be a combined heritage "expo" from 26th to 28th March, to be held in the Panton Hill Hall. The theme will be "Dirt Farming" which derives from the subsistence farming activities of the early settlers but could be widened to include gold mining, earth building and even modem day bushland regeneration. It fits well with the name "Nillumbik" which in the language of the Wurundjeri meant the not so good country covering most of our area and contrasted with the rich soil of the Kangaroo Grounds which they called Moor-rul. The following weekend each society will arrange their own separate activities. We intend to have open days at our Local History Centre on both days and this will include a display in the adjoining former Eltham Court House. Various family scenes taken from outside the family home on the southeast corner of the intersection of Nyora Road and Pitt Street with Eucalyptus Road. Also, scenes of the Stokes Orchard and equipment used, construction of water reservoir at the end of Nyora Road near Reynolds Road and Diosma Road as well as early stages of the Stokes Orchard housing development. Frank Stokes worked as a qualified accountant at Kennons leather factory in Burnley, while living at 1 Thomas Street, Mitcham. He suffered from migraines and wanted to go back to the land (he had previously worked on farms and orchards since coming to Australia in 1926 both in WA and Vic.). He first travelled to the district by train in July 1942 to find land with the intention to establish an orchard. By chance he met Arthur Bird of Bird Orchard (bounded by Pitt Street, Eucalyptus Road and Wattle Grove) and they got talking over their common interest. Arthur put Frank up for the night and pointed out the land, 158 acres- Taylor Estate- £900, part of Crown Allotment 15, Section 5, Parish of Nillumbik (CA15) somewhat diagonally opposite Bird Orchard. He applied through the Riverina Agency to purchase the land who in turn had to get permission from Canberra to sell as there was a new government regulation banning land sales except for immediate production. He obtained a loan on his Mitcham house of £600 @ 5% and paid £450 deposit with quarterly payments of £15 over 5 years. The title to the property was issued May 15, 1946. He was helped and advised by Arthur Bird who farmed the neighbouring orchard. Early 1943 he took possession and would catch the train out to Eltham on Fridays after work and began building a hut for shelter and to lock up tools. He was able to pay a neighbour (Hawkins) to help with clearing and fencing 25 acres and with a horse and single furrowed plow, planted approximately 2,500 fruit trees - cherries, peaches, plums, almonds, pears, apricots and lemons as well as a few apples and oranges; a massive job. A huge problem was hares and rabbits eating all the new buds off the tiny trees. As well as laying poison he painted the trees with a mixture of cow manure and lime. Often working by moonlight. It was extremely difficult to get wire and wire netting because of the war but after much effort he obtained a permit from the Agricultural Department for supplies in March 1944. In February 1945 he applied for a permit to build a “packing shed” as no house building allowed. It was to be 33 feet x 21 feet and cost £312. Constructed mostly from second-hand materials, which was hard to obtain, especially iron for roofing. Frank finished work at Kennons October 31, 1945, and in March 1946 he sold the Mitcham house for £1230 plus £170 for furniture. The family of five then moved into a very unfinished at Eltham, which was a struggle to weatherproof. Eventually rooms were divided off and lined with hessian bags and whitewashed. Their income was firewood (cut and sold), selling rockery stones and cut sweet bursaria. (It was discovered during the 1940s that Bursaria contained the sunscreen compound Aesculin. The RAAF utilised this compound from Bursaria during WW2 for pilots and gunners.) The orchard’s first fruit sale was a 1/2 case of Le Vanq peaches in December 1947 - 8 shillings. In 1956 plans for house were drawn and Glen Iris bricks purchased (1956 Olympic Rings variant). The building of the house commenced in 1957 - 12 feet of original packing shed removed – and was completed in 1959. Water was connected from newly built pressure storage on the property at the end of 1959 and the electricity connection for the first time at 3pm on April 29, 1960. In the mid-1970s the Shire of Eltham divided the orchard up into numerous rate-able parcel lots, which became unaffordable for Frank. Consequently, Stokes Orchard was turned into a housing development by Macquarie Builders and marketed as the Stokes Orchard Estate in two stages; Stage 1 encompassing Scarlet Ash Court, Ironbark Close and Peppermint Grove bounded by Nyora and Eucalyptus roads c.1976 and Stage 2 encompassing Stokes Place, Orchard Way, The Crest and The Lookout bound by Nyora and Diosma roads c.1979. The development of Orchard Way, The Crest and The Lookout did not proceed as planned due to the lack of the sewer along Diosma Road and so many of the proposed lots were incorporated into five-acre parcels instead. Plum Cottage is covered by Heritage Overelay HO256 in the Nillumbuk Planning Scheme This two-lot land holding was created as a subdivision and sold to Charles Stuart McNeil by May 1955. Sometime in the period 1955-1960, the builder-designer, John Harcourt had created a pise house on the site, straddling the two subdivision lots. The designer, John M. Harcourt was a pioneer builder in pise-de-terre and mudbrick in the Eltham Shire, Eltham being synonymous with alternative lifestyles and building practises until the onset of suburbia in the late 20th and early 21st centuries. This hipped-roof house is set high above Main Road on a V-shape plan characteristic of the Arts & Crafts style, with rammed earth or pise walls, timber joinery and a cement tiled roof. The V shape plan was used by important English and Eltham Arts & Crafts designers. The use of natural materials such as stone and timber construction is an essential part of the Arts & Crafts style and Harcourt’s work. So too is the application of the style on both the exterior and interior of the house as a holistic concept. The house adjoins the Lim Joon adobe house built and designed by Alistair Knox in the same era (HO119), thus forming a distinctive pair, both using an uncommon plan form. This house was identified in the Shire of Shire of Eltham Heritage 1992 as contributory to the Eltham Gateway Conservation Area, then proposed as an urban conservation area (now Heritage Overlay Area). Land Ownership Emily Jane Smith of 12 Woodside Street Fitzroy owned Crown Allotments 1 & 2 Sections 14, 27 by August 1918, selling to William Henry Smith of 12 Woodside Street, Nth Fitzroy May 1921. (John) James Isherwood of Main Road, Eltham owned the property by 1928 (the year of his death) with the beneficiary of his estate and next owner of this site being his widow, Minnie Maria Isherwood of Cemetery Road, Eltham. His holding in Main Road included parts of what was described in rate records as allotments1 & 2 Section E6. In the late 1930s, early 1940s her son Alfred John Isherwood was also rated for the land around this site, with the rated nett annual value varying between £2 and £5. Alfred Isherwood also lived at Main Road, Eltham with his wife Ellen: her early death at the age of 24 was reported in the Argus of 1923. Part of the Isherwood land was divided off and sold to Charles Stuart McNeil by May1955. Sometime in the period 1955-1960, the builder-designer, John Harcourt had created a pise house on the site, straddling the two subdivision lots. The house is visible on an aerial photograph from 1960s. Reputedly the house was called Plum Cottage and erected for Harcourt’s mother-in-law. A garage was added in 1959. Charles McNeil died in1971 aged 87: he was the son of Don McNeil and Margaret Arkell. Available rate records from the construction era start in the of the 1970s (1972-3) and list Mr H.C. & M/S A.V. Charity at 616 Main Road Eltham of this property with a nett annual value of $740. More recent valuer's data describes the property as lots 1 & 2 LP25668, located in the Central Riding of Eltham Shire, owned by Ann Valerie Charity and later, in 1990, by the Chincarini family. Building Description This hipped roof 11 .5 square house is set high above Main Road on a characteristic-shape plan and has rammed earth or pise walls, timber joinery and a cement tiled roof. The V-shape plan was used by Important designers such as C.F.A. Voysey (UK) who interpreted medieval domestic architecture as part of the Arts & Crafts style of the late 19th and early 20th centuries. The pise walls are covered with a textured render while the cement roofing tiles are also seen in the Harcourt Hill examples. Reputedly the ceiling joists are of a deep section and span long lengths with no need for hanging beams in the roof space. The ceilings are low and panelled in main rooms with apparently Caneite soft board infill panels between the exposed ceiling beams. These are painted white but may have been stained at one time. The focus of the house is the large living area with its vast random stone fireplace. Significance Plum Cottage is significant to the locality of Eltham because: Historically: • Plum Cottage is closely associated with the important historical theme of earth construction evident in Eltham and elsewhere in the Shire since theear1y Arts & Crafts inspired creations at Penleigh Boyd's The Robins (1912, HO101) and those at Montsalvat (1934-, HO82) but more prominent from the Second War period when earth building in Eltham was promoted in national periodicals as an alternative building method that avoided the building materials shortages of that era; • The choice of the earth building technique also expresses the theme of refuge or alternative living, synonymous with Eltham in the early to mid 20th century; • as a good example of domestic architecture from John Harcourt who was the first major post Second War figure in an important phase of Eltham’s earth building development, using his characteristic Old English or Arts& Crafts style that relies in this case on the pise wall construction, pitched roof forms, exposed ceiling joists, half timbering, random stonework, and panelled internal wall finishes. Architecturally: • Plum Cottage's pise wall construction is uncommon among the early earth-walled structures in the Shire, that are mainly of adobe or mud brick, and as a building material is uncommon among the Shire’s suburban dwellings generally which are clad typically with either fired clay bricks or timber boarding. Aesthetically: • Plum Cottage is a good and well preserved example of a modern Old English or Arts & Crafts style earth-walled building in the Shire • For the proximity of the significant Lim Joon adobe house designed by Alistair Knox adjoining to the north, providing a distinctive earth wall house pair, with uncommon plan forms. It lies just beyond the eastern end of Pitt Street, south of Nyora Road to the northern end of Eucalyptus Road and extends east from Eucalyptus Road to Reynolds Road. The topography of CA15 is generally steep, sloping up to a hill near the centre of the land, the ridgeline passing through the properties along the southern side of Diosma Road. Eucalyptus Road is a straight north-south road with its northern end at the north west corner of CA15. Until the end of the 1970s this road was an un-named Government Road and was largely not open to traffic. With residential development in the 1970s the road was constructed, and the council allocated the name obviously in recognition of the predominant species of the local bushland. CA15 was purchased from the Crown by George D’Arley Boursiquot, a prominent Melbourne printer, on 28th October 1852. On November 23, 1922, former Member for Gippsland and Melbourne Real Estate Agent, Hubert Patrick Keogh purchased the allotment then sold it March 13, 1925, to local farmer, Robert David Taylor, a former Shire of Eltham Councillor (1911-1920) and Shire President (1919). Taylor had extensive land holdings stretching west towards Bible Street and Main Road. The Taylor home was situated at the top of the hill in Bible Street at present day 82 Bible Street. At the time of Taylor’s purchase in 1925, CA15 was subdivided into 48 lots that could be described as small rural properties or large residential lots. A typical lot size was one hectare or 2.5 acres. The subdivision created two roads, Nyora Road, and Diosma Road, each following an irregular alignment between Eucalyptus and Reynolds Roads. However, the lots were not sold off separately nor were the roads constructed. The land effectively remained as one parcel for many further years. Robert David Taylor died November 30, 1934, and probate was granted to his son of the same name, Robert David Taylor of Bible Street, Salesman and William McLelland Vance Taylor of 73 Emmeline Street, Northcote, Clerk, with the transfer of the land into their names on July 8, 1935. On occasions, spare remnants of the 1956 bricks have been known to be unearthed in gardens on the estate as they were utilised by Frank Stokes to fill in rabbit holes. On May 26, 1950, a parcel of land was compulsorily acquired by the Melbourne and Metropolitan Board of Works on the hilltop to establish an easement for a high-level service reservoir to augment Eltham’s water supply. The project also included pipe tracks for the necessary water mains. The reservoir has now been superseded by higher level water tanks east of Reynolds Road and its former site is now a public reserve. On November 27, 1964, the State Electricity Commission served notice to compulsorily acquire a further parcel through the eastern part of the land for a major electricity transmission line that augmented supply from the La Trobe Valley to Melbourne. The easement was registered February 11, 1966. The easement was widened July 18, 1969 for a second transmission line to be constructed. In 1971 Melbourne Metropolitan Planning Scheme amendments adopted Nyora Road as the boundary between a residential zone to the north and a rural zone to the south. This determined the future development of the land. In the mid-1970s the Shire of Eltham divided the orchard into numerous rate-able parcel lots, the 48 lots having been established in 1925 and the subsequent rates assessment proved unsustainable for Stokes. He commenced selling lots outside the boundary of the orchard, north of Diosma and South of Nyora. However shortly later the land between Nyora and Diosma Roads and west of the electricity easement was sold and subdivided into residential lots, a housing development by Macquarie Builders and marketed as the Stokes Orchard Estate. New streets were created, and most were named after trees, although one, Stokes Place, commemorates the former owners. The development was undertaken in two stages; Stage 1 (1975) encompassing Scarlet Ash Court, Ironbark Close and Peppermint Grove bounded by Nyora and Eucalyptus roads and Stage 2 (1978) encompassing Stokes Place, Orchard Way, The Crest and The Lookout bound by Nyora and Diosma roads. The developer, Macquarie Builders went bankrupt shortly after the release of Stage 2 leaving many purchasers to fend for themselves and arrange for their own independent builders. There were also difficulties with sewerage for the land immediately south of Diosma Road and so the conventional residential lots were abandoned in favour of larger lots. It lies just beyond the eastern end of Pitt Street, south of Nyora Road to the northern end of Eucalyptus Road and extends east from Eucalyptus Road to Reynolds Road. The topography of CA15 is generally steep, sloping up to a hill near the centre of the land, the ridgeline passing through the properties along the southern side of Diosma Road. Eucalyptus Road is a straight north-south road with its northern end at the north west corner of CA15. Until the end of the 1970s this road was an un-named Government Road and was largely not open to traffic. With residential development in the 1970s the road was constructed, and the council allocated the name obviously in recognition of the predominant species of the local bushland. CA15 was purchased from the Crown by George D’Arley Boursiquot, a prominent Melbourne printer, on 28th October 1852. On November 23, 1922, former Member for Gippsland and Melbourne Real Estate Agent, Hubert Patrick Keogh purchased the allotment then sold it March 13, 1925, to local farmer, Robert David Taylor, a former Shire of Eltham Councillor (1911-1920) and Shire President (1919). Taylor had extensive land holdings stretching west towards Bible Street and Main Road. The Taylor home was situated at the top of the hill in Bible Street at present day 82 Bible Street. At the time of Taylor’s purchase in 1925, CA15 was subdivided into 48 lots that could be described as small rural properties or large residential lots. A typical lot size was one hectare or 2.5 acres. The subdivision created two roads, Nyora Road, and Diosma Road, each following an irregular alignment between Eucalyptus and Reynolds Roads. However, the lots were not sold off separately nor were the roads constructed. The land effectively remained as one parcel for many further years. Robert David Taylor died November 30, 1934, and probate was granted to his son of the same name, Robert David Taylor of Bible Street, Salesman and William McLelland Vance Taylor of 73 Emmeline Street, Northcote, Clerk, with the transfer of the land into their names on July 8, 1935. Frank Stokes worked as a qualified accountant at Kennons leather factory in Burnley, while living at 1 Thomas Street, Mitcham. He suffered from migraines and wanted to return to working the land (he had previously worked on farms and orchards since coming to Australia from England in 1926, both in WA and Vic.). He first travelled to the district by train in July 1942 to find land with the intention to establish an orchard. By chance he met Arthur Bird of Bird Orchard (bounded by Pitt Street, Eucalyptus Road, and Wattle Grove) and they got talking over their common interest. Arthur put Frank up for the night and pointed out the land, 158 acres- part of the Taylor Estate- £900, Crown Allotment 15, Section 5, Parish of Nillumbik (CA15) somewhat diagonally opposite Bird Orchard. Stokes applied through the Riverina Agency to purchase the land who in turn applied for permission from Canberra to sell as there was a new government regulation introduced during the Second World War banning land sales except for immediate production. Stokes obtained a loan on his Mitcham house of £600 @ 5% and paid £450 deposit with quarterly payments of £15 spread over 5 years. Stokes was assisted and advised by Arthur Bird who farmed the neighbouring orchard. In early 1943 Stokes took possession and would catch the train out to Eltham on Fridays after work and began building a hut on the corner of Nyora Road and the Government Road (Eucalyptus Road) for shelter and to lock up tools. He established an orchard on the central western part of the land through the centre of which ran a natural waterway (part of the present-day linear park) and was able to pay a neighbour (Hawkins) to help with clearing and fencing 25 acres, and with a horse and single furrowed plough, planted approximately 2,500 fruit trees - cherries, peaches, plums, almonds, pears, apricots and lemons as well as a few apples and oranges; a massive task. Aerial photographs from the 1940s through to the 1990s clearly show the orchard with most of the larger CA15 site remaining as natural bushland. A huge problem was hares and rabbits eating all the new buds off the tiny trees. As well as laying poison he painted the trees with a mixture of cow manure and lime, often working by moonlight. Procurement of wire and wire netting was difficult because of the war but after much effort he obtained a permit from the Agricultural Department for supplies in March 1944. In February 1945 Stokes applied for a permit to build a “packing shed” as no house building was allowed. It was to be 33 feet x 21 feet and cost £312. It was constructed mostly from second-hand materials, which were hard to obtain, especially iron for roofing. Stokes finished work at Kennons on October 31, 1945, and in March 1946 he sold the family home at Mitcham for £1,230 plus £170 for furniture. On May 15, 1946, title to the CA15 property was issued to Frank Howard Alfred Stokes, Orchardist and Gladys Ethel Stokes, Married Woman, both of Pitt Street, Eltham. The family of five then moved into the very unfinished “packing shed” at Eltham, which was a struggle to weatherproof. Eventually rooms were divided off and lined with hessian bags and whitewashed. Their income was firewood (cut and sold), selling rockery stones and cut Sweet Bursaria. (It was discovered during the 1940s that Sweet Bursaria contained the sunscreen compound Aesculin. The RAAF utilised this compound from Sweet Bursaria during WW2 for pilots and gunners.) The orchard’s first fruit sale was a half-case of Le Vanq peaches in December 1947 for the price of 8 shillings. In 1956 plans for house were drawn and Glen Iris bricks purchased (1956 Olympic Rings variant). The building of the house commenced in 1957 - 12 feet of original packing shed was removed – and was completed in 1959. Water was connected from newly built pressure storage on the property at the end of 1959 and the electricity connection for the first time at 3pm on April 29, 1960. The house remains to present day (somewhat modified) at 1 Nyora Road, home to Nyora Studio Gallery. On occasions, spare remnants of the 1956 bricks have been known to be unearthed in gardens on the estate as they were utilised by Frank Stokes to fill in rabbit holes. On May 26, 1950, a parcel of land was compulsorily acquired by the Melbourne and Metropolitan Board of Works on the hilltop to establish an easement for a high-level service reservoir to augment Eltham’s water supply. The project also included pipe tracks for the necessary water mains. The reservoir has now been superseded by higher level water tanks east of Reynolds Road and its former site is now a public reserve. On November 27, 1964, the State Electricity Commission served notice to compulsorily acquire a further parcel through the eastern part of the land for a major electricity transmission line that augmented supply from the La Trobe Valley to Melbourne. The easement was registered February 11, 1966. The easement was widened July 18, 1969 for a second transmission line to be constructed. In 1971 Melbourne Metropolitan Planning Scheme amendments adopted Nyora Road as the boundary between a residential zone to the north and a rural zone to the south. This determined the future development of the land. In the mid-1970s the Shire of Eltham divided the orchard into numerous rate-able parcel lots, the 48 lots having been established in 1925 and the subsequent rates assessment proved unsustainable for Stokes. He commenced selling lots outside the boundary of the orchard, north of Diosma and South of Nyora. However shortly later the land between Nyora and Diosma Roads and west of the electricity easement was sold and subdivided into residential lots, a housing development by Macquarie Builders and marketed as the Stokes Orchard Estate. New streets were created, and most were named after trees, although one, Stokes Place, commemorates the former owners. The development was undertaken in two stages; Stage 1 (1975) encompassing Scarlet Ash Court, Ironbark Close and Peppermint Grove bounded by Nyora and Eucalyptus roads and Stage 2 (1978) encompassing Stokes Place, Orchard Way, The Crest and The Lookout bound by Nyora and Diosma roads. The developer, Macquarie Builders went bankrupt shortly after the release of Stage 2 leaving many purchasers to fend for themselves and arrange for their own independent builders. There were also difficulties with sewerage for the land immediately south of Diosma Road and so the conventional residential lots were abandoned in favour of larger lots. The development of Orchard Way, The Crest and The Lookout did not proceed as planned and the proposed lots were incorporated into five-acre parcels instead. These included a low-density group housing development by the Graves family and the award winning Choong House (1983) with Gordon Ford developed garden immediately next door situated on the ridge of the hill nestled amongst the original bush, Eucalypt trees and Sweet Bursaria. In 1994, Nillumbik Shire Council applied Significant Environment and Significant Landscape overlays upon the properties on the south side of Diosma Road to ensure protection of this natural bush garden environment. With the arrival of the sewer along Diosma Road in the 1990s, most of these five-acre parcels have since been subdivided multiple times. The Choong house presently sits on a 2.7-acre property, which in 2022 Nillumbik Council nominated for Cultural Significance Heritage protection and is considered potentially significant at State level. The Stokes family were also associated with the Eltham Christian Church. In the 1970s this church had met in temporary premises in Eltham. Lots of the original 1925 subdivision remained south of Nyora Road and a number of these lots were utilized for the Eltham Christian School, which was established by the Eltham Christian Church in 1981. The school operated on this site until 2000. The premises are now used by The Vine Baptist Church. By the mid-1980s the whole of CA15 had been developed for residential and school purposes, except for the sections north of Diosma Road and between the transmission lines and Reynolds Road. The development coincided with the discovery of colonies of the rare and endangered Eltham Copper Butterfly on the site. This resulted in a community and political campaign to save the butterfly habitat. With the co-operation of the land developer the subdivision was altered to create two bushland reserves in the critical butterfly habitat areas. In the late 1980s the State Government was investigating options for establishing a metropolitan ring road link between Diamond Creek and Ringwood. The chosen route was adjacent to Reynolds Road and so this created a freeze on development of CA15 between Reynolds Road and the electricity easement. The ring road proposal was eventually abandoned, and this part of the land was subdivided into low density residential lots. Diosma Road has been discontinued at the electricity easement and the eastern part incorporated into View Mount Court with access from Reynolds Road. The whole of CA15 has now been developed for residential or associated purposes, ranging from conventional density to quite low density south of Nyora Road. Some remnants of the orchard remain, a few cherry trees on the Graves property and a lone apple tree in Stokes Place. The butterfly reserves comprise significant areas of remnant bushland.
