More than 200 people attended the Council meeting in the public gallery and protested at the decision. 32 personal submissions were made to Council's Planning Special Committee meeting whose members vioted 3-2 against the development. The Committee consisted of the three Nillumbik Commissioners and three community members (Jim Connor, Bronwyn South and Janet Mattiske). Chief Commissioner Don Cordell, a former Shell employee excused himself from voting and the three communbity memebrs voted against the submission. The other two commissioners, Vin Heffernan and Kevin Abbott voted against it. They then immediately closed the meeting and opened a Council meeting lasting just seconds to use special reserve powers to overturn the decision. Subsequent to this the Commissioner run Council held a special meeting on Wednesday, October 23, 1996 where Commissioners Kevin Abbott and Vin Heffernan thanked all three community members of the Planning Special Committee and advised that their powers had been revoked. The article includes a joint statement from all three sacked members in which they state they have been able to bring a community perspective to the planning applications placed befopre the committee which has resulted in modifications to planning decisions. The members stated that "unfortunately, despite our best efforts to express considered apolitical opinions, it appears the Commissioners believe that any dissenting comment is politically motivated, and should therefore be disregarded." On 15 December 1994 the former Shire of Eltham ceased to exist following the Liberal Kennett Government local council amalgamations. A new Nillumbik Shire Council was established with unelected commissioners appointed. That Council sold the former Eltham Shire Council Offices and land at 89S Main Road Eltham to Dallas Price Homes Pty. Ltd. the sale being conditional upon the granting of a planning permit for a petrol station/convenience store, fast food and video outlet. The sale was conditional that if the permit was not granted by 30 August. 1997, the contract could be avoided by either the purchaser or the vendor. The proposed development consisted of a petrol station with undercover fuelling facilities, convenience shopping, a drive through service facility for fast food, an 80 seat cafe, automated banking, a children's play area and retail space. In addition, the proposal included a 200 square metre community facility for Council use, provision of on site carparking over 2 levels for 83 vehicles, and advertising signage. The Advisory Committee was appointed under Section 151 of the Planning and Environment Act 1987 to hear submissions on the proposal to develop the land at 895 Main Road Eltham, the site of the former Eltham Shire Offices. In September 1996, two applications were made by Contour Consultants Australia Pty Ltd on behalf of Dallas Price Homes Ply Ltd, to Nillumbik Shire Council. After extensive notification, the Council received 213 objections and a petition of over 1400 signatures. On October 9, 1996, Nillumbik Shire Council issued Notices of Decision to Grant Permit on Applications number 96/03376 and 96/0377 for the use and development of the land as a convenience Centre consisting of a petrol station, convenience store, cafe/takeaway food premises, a retail facility and a community facility, with associated advertising signs. Objectors to the proposals lodged Planning Appeals number 96/40724 and 96/40812 with the Administrative Appeals Tribunal on November 1, 1996. The grounds of appeal can be summarised as: inappropriate development, insufficient carparking, traffic and access issues, unsatisfactory design, inadequate permit conditions, the proposal being out of character with the area. and being contrary to the purpose and orderly development of the Eltham Town Centre, excessive noise, lack of consultation and unsuitable signage. On November 13, 1996, the Minister for Planning and Local Government directed the Registrar of the Administrative Appeals Tribunal. under Section 41 (1) (a) of the Planning Act 1980, to refer the Appeals to the Governor in Council for determination without a hearing or recommendation by the Tribunal. The Minister for Planning and Local Government called in the Appeals as he considered that they raised major issues of policy relating to the facilitation of development in accordance with the objectives set out in Section 4 of the Planning and Environment Act 1987, and that determination of the Appeals could have a substantial effect on the achievement of these planning objectives. The Minister required the Advisory Committee to consider the planning merits of the proposed use and development, and to address the issues raised in the objections. The Advisory Committee was required to produce a report providing: • The Committee's response to the matters detailed; • Relevant supporting information for the Advisory Committee's recommendation; and • A description of the proceedings conducted by the Advisory Committee and a list of those consulted or heard by the Committee. In March 1997, elections were held in the Shire of Nillumbik and the view of the new Council to this proposal differed from the view held by the earlier Council Hence the Submission made to the Committee by the Shire was against the decision by the Shire of Nillumbik to issue the Notices of Decision to Grant a Permit. The Recommendations of the Advisory Committee were: i. The cafe and take away food premises are as of right uses and are therefore allowable, but that shop and petrol station are unacceptable uses. A community facility is a discretionary use and is acceptable. ii. A development of the type and scale proposed is totally inappropriate for this land and that the Applications number 96/03376 and 96/0377 for the use and development of the land as a convenience Centre consisting of a petrol station, convenience store, café/takeaway food premises, a retail facility and a community facility, with associated advertising signs, be refused. iii. This booklet was issued to householders in Australia giving information on meat rationing during World War Two. Meat was rationed because much of the meat processed in Australia was sent overseas to Britain and to soldiers in war areas. The booklet includes hints on how to make the most of the meat ration. Meat and other key foods such as tea, sugar and butter were rationed during World War Two. Each person in Australia was allowed two meat coupons a week and, depending on the type of meat, this equated to one pound to two pounds of meat per coupon. Products such as sausages, brains, tripe, poultry, rabbits, bacon and ham were not rationed (but few people could afford poultry). This booklet is of interest because it is a memento of the times in World War Two when several food items were rationedThis is a small booklet of 10 pages. These two framed model ship plans are from more than 650 produced for the LOCH ARD Centenary (1878-1978) Commemoration Committee. These plans were originally researched, designed and distributed in 1977 to assist entrants in the Committee’s Ship Model Competition. The competition was arranged as a means of creating public interest and awareness for the 100th anniversary of the tragic LOCH ARD shipwreck on Victoria’s south west coast in 1878. The main subject specified for modelling was “The Loch Ard ― Iron Wool Clipper 1873”. “The plans were drawn by Mr P Webb to the order of the Committee through Mr P Williams, organizer of the competition. The details were based on all available information which resulted in considerable historical research…and received favourable comment from model makers because of their attention to detail…In excess of 650 sets of plans were sold before entries closed…Many plans were probably purchased by collectors and interested persons for historical reference. An illustrated historical story sheet…was prepared and enclosed with the plans…” (‘Loch Ard Shipwreck Centenary 1878-1978 Report’, November 1978). An example of the attention to historical detail delivered on the plans is the inclusion of the following useful information about the original vessel: “Tonnage….1,693 G.R.T., 1,624 N.R.T. Builders….Charles Connell & Co., Ltd., Scotstoun, 1873. Owners….General Shipping Co., Glasgow, (Aitken Lilburn & Co., Ltd.)”. The quality of research and drafting makes these framed copies of considerable interpretive value to related items from the LOCH ARD shipwreck on display at Flagstaff Hill. They were originally mass produced but are now out of print. Flagstaff Hill retains other (unframed) copies in storage. The plans, in conjunction with the scale Ship Model of the LOCH ARD also on display, are of interpretive significance to Flagstaff Hill Maritime Village. The plans provide historical and technological context to artefacts from the shipwreck, increasing understanding and appreciation of those objects. Flagstaff Hill’s collection of artefacts from LOCH ARD is significant for being one of the largest collections of artefacts from this shipwreck in Victoria. It is significant for its association with the shipwreck, which is on the Victorian Heritage Register (VHR S417). The collection is significant because of the relationship between the objects, as together they have a high potential to interpret the story of the LOCH ARD. The LOCH ARD collection is archaeologically significant as the remains of a large international passenger and cargo ship. The LOCH ARD collection is historically significant for representing aspects of Victoria’s shipping history and its potential to interpret sub-theme 1.5 of Victoria’s Framework of Historical Themes (living with natural processes). The collection is also historically significant for its association with the LOCH ARD, which was one of the worst and best known shipwrecks in Victoria’s history. These are detailed and researched plans from the original vessel, drawn to scale and printed on good quality paper, and framed behind glass to be hung on display. One slightly smaller plan “Lines, Decks and Details” portrays the hull lines as a body plan (straight on at the bow), a sheer plan (full side view), and a half breadth plan (a top-down view of deck to keel), as well as two top-down views of the upper decks and main deck with fittings and details of specific fixtures. One slightly larger “Sail and Rigging Plan” presents a side on, above deck view of masts and shrouds and a front on, above deck view showing “Elevation of Mainmast Looking Aft”. Each plan bears the draftsman’s initials and date of completion (“P.A.W. 10/77”). The larger plan also includes a boxed label attributing the project to the “LOCH ARD CENTENARY Commemoration Committee Ship Model Competition.”Smaller plan: heading “LOCH ARD: LINES, DECKS and DETAILS”; initials “P.A.W. 10/77”.
