This is an 1877 document, the Letters of Administration in connection with the will and probate of William Ellis, a veterinary surgeon from Wimmera Street, Stawell. He died after an altercation with W. Richards, the landlord of the Post Office Hotel, where he was knocked against the wall of the verandah of the hotel. He left a small estate, with his property valued at under £107. This document is only of interest in that it came from the former legal offices of Mackay Taylor in Kepler Street, Warrnambool. It originally came from Thomas Goodall, a legal clerk in the office of lawyer Ernest Chambers who passed it on to George Mackay, the lawyer in the forerunner firm of Mackay Taylor where it remained until the firm of Mackay Taylor ceased to exist and the buildings were cleaned out. This is a piece of parchment folded and sealed at the bottom edge with a seal of the Supreme Court of the Colony of Victoria. The material in the document is handwritten in black ink. Thomas John Barton was born in 1836 in Gloucestershire and after his father died in 1850 arrived in Melbourne in 1852 along with his mother, adult sisters, younger brothers, his uncle, his uncle's wife Suzanna and their family. Thomas tried gold mining at Woods Point but found it too difficult. He then partnered with Ewen Hugh Cameron to provide the miners with meat. In 1864 they purchased a plot of land in Marysville and set up a butchers/abattoirs and from there began their business of taking supplies to the miners at the nearby Woods Point and Jamieson goldfields. In 1865 the business was firmly established and Thomas married Selina Croker at Heidelberg and brought her back to Marysville. Their first home was 'The Chestnuts', which included the store, and was situated on the town side next to the Steavenson River. Sadly, in 1876 Selina died of complications after giving birth to their sixth child. Thomas was in need of a nanny to care for his six children, including the newborn baby, and so he employed Emily Ada Sparke, who is the eldest daughter of the local school teacher. Thomas and Emily subsequently marry in 1878 and they go on to have a further 10 children over the next several years. Thomas assisted in the establishment of the first school in Marysville in 1870 and remained a very active member of the community including as a Councillor for the Shire of Healesville, Shire President and he was also appointed as a Justice of the Peace. Thomas died in Carlton in 1911. Both the garden and gallery were destroyed during the 2009 Black Saturday bushfires. Some of the sculptures were totally destroyed though a few did survive the fires. John Lindt had previously photographed the mountain scenery of the Black Spur and purchased 71 acres and subseqently built his home and guesthouse from where he continued his career. "The Hermitage had a garden designed by John Lindt's friend, Ferdinand von Mueller, who was at one stage the Director of the Melbourne Botanic Gardens. The garden featured New Guinea tree houses from which John Lindt made frequent panoramas of his property and the surrounding forest of towering mountain ash. Aged 81 Lindt died of heart failure during disastrous bushfires on 19 February 1926 at the Hermitage. In 2003, a proposal for a 5 storey building on the corner of Lambourn and Devonshire Roads Watsonia for an apartment complex, medical centre, shops and cafe was approved by VCAT, despite strong opposition by local residents. The proposal did not proceed. In 2019 a proposal for a 2 storey medical centre, cafe and residence was approved for the site and construction commenced.
