Produced by Contour Consultants Australia Pty Ltd on behalf of Dallas Price Homes Pty Ltd as part of the planning process for redevelopment of the former Eltham Shire Office site at 895 Main Road. In 1963 the Shire of Eltham purchased the Shillinglaw property of approximately 2 acres in Main Road, Eltham for the widening of Main Road and as a site for new Council offices. This land, which contained the Shillinglaw Cottage (c1878-80), was the remaining section of the Shillinglaw family holding that originally comprised 30 acres, being Lot 90 of Holloway's 1851 subdivision. Eltham Council intended to demolish this cottage, but through extensive community action it was saved, funds were raised, and it was relocated to the current site adjacent to the Eltham Library. The new Eltham Shire Offices opened in 1965 were designed to ensure retention of the three Italian Cypress trees that were located outside the Shillinglaw Cottage. In 1971 the building was extended at the southern end to provide additional space, including for the Eltham Library and Council's Engineering Department. Renovations were undertaken to the offices during 1987. The Victorian State Government commenced to restructure local government in 1994, which resulted in the establishment of the Shire of Nillumbik and the cessation of the Shire of Eltham. This new Nillumbik Shire Council was headed by government appointed commissioners, who decided in 1995 to put the former Eltham Shire offices on the market. Eventually in June 1996 the property was sold for $1.1 million and the building was subsequently demolished. A planning application for the site was then submitted to Nillumbik Shire Council in September 1996 for construction of a 24-hour service station, convenience store, cafe/takeaway food premises, a retail facility and community facility. There were many objections to this proposed development and in controversial circumstances a planning permit was granted by the Nillumbik Shire Council commissioners. After protracted actions involving a planning panel and a planning advisory committee, established by the Minister for Local Government, the proposal was eventually rejected as not satisfying the requirements of the planning scheme. In December 1997 the purchaser withdrew from the contract of sale, just prior to Council announcing a withdrawal from the contract. While there have been a number of possible development proposals considered by subsequent Nillumbik Shire Councils, this site has remained vacant since July 1996. Minister for Planning and Local Government orders an independent investigation into valuation and sale. 9 October 1996 - Permit granted by Nillumbik Shire Council commissioners, in controversial circumstances. A Planning Special Committee consisting of 3 commissioners and 3 community representatives considered 32 community objections. One commissioner declared a potential conflict of interest so only 2 commissioners were able to vote. After hearing all objections, the community representatives moved a foreshadowed motion to refuse a permit. The commissioners then closed the meeting, formerly opened a council meeting (for about a minute) and approved the application. October 1996 - Community members appealed planning decision to Administrative Appeals Tribunal. November 1996 -Minister for Planning and Local Government Robert McClelland calls appeal in and directs MT to refer this 'major policy issue' to the Governor in Council. February 1997 - Planning panel (Dimity Reed and Margaret Pitt) established to consider submissions. March 1997 - New council elected with five councillors. April 1997 - Three of the five new councillors vote to fight Commissioner's decision to grant a permit. April 1997 - Planning panel (Dimity Reed and Margaret Pitt) conducts hearings at Nillumbik Shire offices. June 1997 -Planning panel rejected Dallas Price Homes proposal as being 'totally inappropriate' for the site and recommends the site be rezoned for 'public purposes'. July 1997 - Dallas Price Homes threatened to sue Council and individual councillors. October 1997 - Report released of an Advisory Committee (Paul Jerome) established by the Minister for Planning and Local Government. Committee considered Dallas Price Homes proposal and an alternative concept plan proposal by Council for a gallery, workshop, offices and cinema community-based development. Advisory Committee recommended Dallas Price Homes proposal be rejected as not satisfying the requirements of the planning scheme and recommended further testing of the financial viability of Council's proposal. December 1997 - Dallas Price Homes withdrew from the contract of sale, just prior to Council announcing a withdrawal from the contract, which expired on 28th November and was not renewed by either side, after previously being extended twice pending a decision by the Minister. Council had to pay developer $58,000 for demolition costs. February 1998 - Dallas Price Homes application rejected by Planning and Local Government Minister. October 1998 - Nillumbik Councillors suspended and an Administrator appointed (until March 1999). The demolition of the former Shire of Eltham offices and proposed sale and development driven by the Commissioners for Nillumbik Shire Council brought the community together in substantial protest at the infrigement of ratepayers democratic say in local government and ciommunity assets combined with protests about inappropraite development of Eltham's Gateway. Resources were scarce so there was a transition away from the traditional style memorials that sprang up post 1918 to one of building facilities that would provide ongoing benefit to the community. Even before the end of the Second World War, the citizens of Eltham began to consider an appropriate form of memorial for those from the area who fought and died in the First and Second World Wars. In 1943 the Eltham Women’s Auxiliary raised funds for the construction of buildings to be established on land to be purchased for the proposed War Memorial. On March 27th, 1945, the Eltham District Progress Association called a meeting of local people who in turn set up and registered the Eltham War Memorial Trust Inc. As a focus for the purpose of the memorial, the newspaper notice read:- ‘Those who have had a member of their family in the fighting services will want to see that the form of a memorial we are concerned with is the one which will be a constant reminder to us of those who fought for us and the little ones for whom they fought and died.’ At that meeting it was decided the Memorial should take the form of a baby health centre along with a creche and children’s library. In late 1945, the newly formed Eltham War Memorial Trust purchased the land at 903-907 Main Road Eltham from Miss Shillinglaw, which once formed part of the Shillinglaw farm on Lot 90 of Holloway’s 1851 “Little Eltham” subdivision. Eltham Courthouse Officially Reopened (Jim Connor, EDHS Newsletter No. 263 April 2022) In the Conservation Management Plan prepared in 2006 for the Eltham Justice Precinct there is mention that more than 350 court houses have been built by the Public Works Department since 1856, when the Department was established. It also states Eltham was in an early group of 'Victorian Free Classical' structures, featuring a projecting entry porch and gabled roof. Characteristically, this group shares a simple, rectangular shape, central placement of the court room with smaller-scale offices set back at the sides or rear of the court room, arched openings, and decorative string courses. The Statement of Significance listed in the Victorian Heritage Register states: ‘The Eltham Court House dates from the time when the town was largely self-contained. It was initiated in response to itinerant gold prospectors who turned to crime when their quest was unsuccessful. This type of localised solution is characteristic of the self reliance preserved in Eltham today. The court house is an important symbol of the spirit which makes Eltham distinctive as a community.’ It also states: ‘The Eltham Court House, built in 1860, is one of only two intact examples in the state of this simple design with projecting entry.’ So with this background it is most appropriate this valued historic building has recently been the subject of a total restoration, as detailed in previous newsletters. This was a major project undertaken by Nillumbik Shire Council. At a small function in the Eltham Courthouse, on 23rd March 2022, Nillumbik Shire Council Mayor Fran Eyre declared the fully restored building officially reopened. In doing so the Mayor spoke about the earlier law and order function of the court and the importance of this building to the Eltham community. Wingrove Ward Councillor Geoff Paine then highlighted the importance of historical societies and groups within the shire and their valued activities in recording and preserving their local history. EDHS president Jim Connor thanked everyone involved with the project and provided an overview of the history of the courthouse. Michael Ioannides, Council’s project manager, spoke about how the restoration process proceeded and those involved in undertaking the works required. Cr. Natalie Duffy, various council officers, EDHS executive committee members, as well as representatives of the head contractor Ducon Building Services and the heritage advisors, RBA architects and Conservation Consultants, were also in attendance, as was a representative of Nillumbik U3A. After the formal part there was some light hearted interpretation of how past legal proceedings may, or may not have, occurred within this courthouse, before some refreshments were shared in the former second courthouse at the rear, which is now utilised by Nillumbik U3A. Eltham Plans £2.5m Community Centre Over Next 15 Years THE people of Eltham have drawn up a plan to make their township a model community centre in the next 15 years. And yesterday the Chief Secretary (Mr Rylah) inspected the plan at the Eltham shire offices before declaring it open for public inspection In the picture (right) Mr. Rylah (centre) is shown inspecting the new plan with town planner and former councillor, Mr. Howard Bartlett, and the shire president, Cr. C. Pelling. The result of six years' work by shire officers, the plan provides for a business centre, public buildings and recreational reserves. The shire council expects that £2,500,000 will be invested by Government departments, banks, private firms and sporting bodies to implement the plan. 500 Car Park A feature of the business centre will be a quadrangle car park surrounded by shops, and with parking space for 500 cars. The public buildings will include new municipal offices, a public auditorium, a library and meeting rooms. The council plans to realign the course of Diamond Creek near the town to provide extra land for playing fields. Three Ovals The plan proposes three ovals, including improvements to an existing one, as well as a 50-metre Olympic swimming pool, tennis courts and bowling greens. In the 15 years which the shire council hopes to carry out the plan, the shire population of 18,000 is expected to increase two and a half times. Opening the display of maps and a model, Mr. Rylah said he commended the shire council's invitation to the citizens to suggest improvements to the plan. Eltham shire had grown tremendously in the past 20 years, from a sleepy country town to an important shopping centre. In late 1966 the children’s library service was integrated into the Heideberg Regional Library Service and the building was officially renamed the Eltham War Memorial Hall. Following the opening of the Eltham Infant Welfare Centre, work began in 1953 planning for the entrance to the grounds, which is signaled by a wrought iron arch entitled “Eltham War Memorial” . In 1954 the Eltham War Memorial Trust decided that a legacy provided by the late Councillor Ernest James Andrew (d. 29 March 1950) in memory of his wife, Mrs. Ellen Andrew (d. 13 July 1946) and who are both buried at Eltham Cemetery, should be used to fund the construction of the entrance. A metal plate inscribed to this effect was attached to the gates. Work on the Memorial Gardens was undertaken throughout the following decade, with a Memorial Forecourt included in the final 1956 plans for the Pre-School Centre. A quote was accepted by the Trust in 1963 for the implementation of a memorial garden, which included grading of a sixty-five foot strip at the rear of the Trust buildings and construction of concrete paths. The stone retaining walls at the front of the site were installed in 1968 when Main Road was widened and it is believed that the Memorial Gates were relocated at that time also. Eltham Senior Citizens Centre In 1964, Eltham Shire Council purchased a section of land from the Trust at the northern end of the site, as a provision for Country Fire Authority buildings. At the same time the Elderly Citizens Club proposed a Senior Citizens Centre on the south western section of the Trust’s property. This was approved by the Trust with the provision that the building was constructed in ‘accord’ with those already existing. In 1965 Council took on board the plans for the Senior Citizens Centre and applied for a government grant. These could only be awarded if Council owned the site. In 1962 the Trust had resolved to hand over the assets to Council once the Memorial Gardens were completed. This was in line with Health Department requirements that grants for the ongoing operation and maintenance of the three facilities would only be made once the the facilities were completed and handed over to Council. In 1965 the Department of Health further demanded substantial alterations to the Pre-School playground as a result of the pending impact of the planned Senior Citizens Centre and Main Road duplication. As a consequence, handover of the Trust’s assets to Council was initiated with a formal ceremony held in the Children’s Library on August 28th, 1965. The Trust continued on as a committee of management for another twelve months. Plans and specifications for the Senior Citizens Centre were prepared by March 1966. Council obtained a grant from the Government which covered one third of the cost and the building was completed by April 1967. The Shire of Eltham established the Avenue of Honour at the gateway to the shire as well as an obelisk at the corner of Main Road and Bridge street and the Shire of Eltham War Memorial Tower at Kangaroo Ground. After the Second World War communities once again desired to preserve the memories of those who served and paid the ultimate sacrifice. Resources were scarce so there was a transition away from the traditional style memorials that sprang up post 1918 to one of building facilities that would provide ongoing benefit to the community. Even before the end of the Second World War, the citizens of Eltham began to consider an appropriate form of memorial for those from the area who fought and died in the First and Second World Wars. In 1943 the Eltham Women’s Auxiliary raised funds for the construction of buildings to be established on land to be purchased for the proposed War Memorial. On March 27th, 1945, the Eltham District Progress Association called a meeting of local people who in turn set up and registered the Eltham War Memorial Trust Inc. As a focus for the purpose of the memorial, the newspaper notice read:- ‘Those who have had a member of their family in the fighting services will want to see that the form of a memorial we are concerned with is the one which will be a constant reminder to us of those who fought for us and the little ones for whom they fought and died.’ At that meeting it was decided the Memorial should take the form of a baby health centre along with a creche and children’s library.
