On August 12, 1902, appearing before T. Smallman, Esq,. Police Magistrate, and Messrs. W. Duncan and W.J. Taylor, Justices of the Peace is Luther Haley, baker. Wilfred Henry Johnston, by his agent Stanley Ernest Elder had applied for a warrant of ejectment under the Landlord and Tenant Act 1890 against Luther Haley from the bakery premises at the corner of Main Road and York Street. From the evidence presented it is made known that Mrs Burgoyne of Eltham had purchased the property some months earlier from Mr Johnston, which consisted of a store and bakery establishment at Eltham occupied by Mr. Luther Haley, and whose lease expired some little time back, and up to the present time, Mr. Haley was not prepared to leave. He informed the court that he was unable to secure at Eltham a suitable house in which to carry on his business, but he was building a place near the railway station which he expected to be done in about three weeks time, at which time he would give up possession of the bakery. Mr Smallman informed the defendant, Luther Haley, that he would have to quit the premises in three weeks from the present date, and that a warrant of ejectment would be issued. However he also informed Mr Haley that he would order the warrant to lie in the office for three weeks from that date. The premises under construction refered to by Luther Haley in court were situated on the western side of Main Road, near the railway station slightly opposite present day Arthur Street. It was opened around September 1902 as a General Store, Bakery and Tea Rooms. In June 2024 Annie Hackrath shared a memory of living in the old bakery: "My husband and I lived in the old bakery for 18 months in 1978-9 , husband Geoff used the old bakery out the back as a wood workshop, making turnery and handcrafted furniture. The front shop was operated as a “sometimes” art gallery which we called “Gouge and Grain”. There were old sheds against the back fence which we thought were probably stables from the bakery days. Lovely memories of the old place which had so much character and seemed to attract a multitude of interesting creative people! Notes by Jock Read who donated painting to the Society: “Site of present-day Eltham Mall The property was owned by a Mr David Harbison who was connected to one of the Melbourne daily newspapers who donated the property to the City Newsboys Society to be used as they required. The property consisted of two building blocks with one four roomed house known as the Cottage. The Secretary of the City Newsboys Society decided to use the property as a Rest Home for mothers of newsboys who needed a rest and could not afford a holiday. Miss Onians added another four roomed dwelling to the home which was known as the Bungalow. Another three roomed residence was erected at the rear of the cottage for the use of the Caretaker. The rear of the property was used as a camp area for the use of Troop of Boy Scouts known as the 13th Melbourne Troop which met at the Newsboys Society Hall in Little Collins Street. Later the name of the troop was changed to City Newsboys Troop who held their Christmas camps at Eltham and Hurstbridge alternating years. In 1930 the caretaker (Mr. Francis) became ill and resigned that position. I had been a member of the scout troop and offered the position as Honorary Caretaker which I held for eight years. The Homes were used regularly as such until the death of Miss Onians. It was sold later and used as private homes until the Eltham Mall was built.” Further research has determined that apparently, Harbison left £1,000 in his will for the City Newsboys Society and the Secretary, Miss Edith Onians built the rest home from these funds. It was opened on November 12, 1919. The 1993 Eltham Heritage Tour was enjoyed by a busload of members of the Historical Society on a fine, calm day, Sunday May 23rd. Between 10.00 am and 4.30 pm, except for a brief lunch stop at the Eltham Living and Learning Centre, members passed about thirty places of local interest and others recommended for the Historic Buildings Register and the Register of the National Estate. The main entrance to Franco's was from Main Road. It was run by Sammy and another family member. Franco's was a 2 story restaurant. Pizza take away downstairs. Licensed, BYO upstairs. Downstairs originally had a female pianist/singer and the walls were a peachy pink colour with horse shoe shapes in the plaster, upstairs was a full function room with dance floor. It was renovated in the early 90s and a full bar added downstairs. They sold up and then opened a take away pizza shop on Bolton Street. The Penguin Drycleaners building was an extension built right over the entrance garden; the building to the left the former Volumes now Missing Gorilla. In April 1928 the MMBW had the land and the plans for what they were to construct but the timing of the actual building did not proceed as planned. Before the construction could commence the Great Depression of the 1930s intervened forcing the shelving of its plans. The new owners then offered the land for lease resulting in Frederick Werrett taking the opportunity to take up the land he formerly owned to continue his market gardening activities of growing potatoes, onions and other crops. The land and improvements made by Syme were leased in 1929 to Harry Telford a trainer from New South Wales. Phar Lap grazed there for a short time. [9] However the population of Melbourne continued to grow and the need for a sewerage treatment plant did not go away. In 1939 when the effects of the Depression had dissipated work on the Sewerage Effluent Treatment Plant commenced and the following year in October the Premier of the State, Albert Dunstan, officially commissioned it. The Sewerage Effluent Treatment Plant at Braeside served the communities of south-east Melbourne for thirty five years until 1975. In that year all the sewers that entered the Braeside plant were diverted to the South Eastern Trunk Sewer complex at Carrum.[10] In 1982 the chairman of the MMBW at that time, Alan Croxford, announced that a substantial part of the property at Braeside would be administered by the Parks and Gardens section of MMBW as a public park. Subsequently the responsibilities were transferred to Parks Victoria, the situation that exists today. It is known as “Braeside Park” now. From Eltham Montmorency Uniting Church, History http://www.elthammontmorencyuca.org/history/ In 1914 a small group of Presbyterians living on 'The Montmorency Estate', which had been established when the railway was extended to Eltham several years before, began meeting for worship in the Rattray Rd home of Robert Sharpe. Two years later a small weatherboard church, administered from Scots Church, Heidelberg, was built on land donated by Mr. Sharpe. In 1931 this building was moved to the corner of Rattray Road and Mountain View Roads. They were not extensively produced until 1880 and had ceased by 1905.
