The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. 1892-1953 The Methodist Children's Home in Cheltenham was founded c1880 to provide housing for neglected children from the inner city. The Founders aimed to provide regular nourishment, a stable environment and integrate the children into the local community thereby improving their education and lives. However new settlers to Cheltenham area who were seeking a healthier and more respectable lifestyle for their families were not happy to share Church and School with the Home's Children. 1911 school parents committee moved to exclude the Home's Children but this was countered by the Home's Committee who defeated the motion 60 to 8. 1915 Dr Scantlebury was pressured by school parents into ordering the confinement/ isolation of all Homes Children if an infectious disease was contracted by a child. This resulted in the Homes Children missing school for months so an application was made to the Victorian Education Dept. for e School to be set up at the Home. However funds were short due to WW1. In 1917 John Livingston, former Homes child who had become successful, bequeathed his estate to the Home and the Vic.Education Dept agreed to a school at the Home. The Influenza epidemic 1919 saw the children quarantined for 4 months as a precaution at the Home. When Flu actually struck, a further 5 months isolation was ordered. July 1920 their own school was on site and continuity of education could proceed , however it reinforced the isolation of the institution contrary to the Founders vision of integration.. 1925 the Danks family funded a Domestic Economy Class for girls, but not until 1936 could the children attend the local High School so that they could pursue office work, apprenticeships, commercial college courses. 1947 a benefactor donated £5,000 to pay fees for school, university or apprenticeship in Arts & Cultural subjects. Some of the children were able to join the local society as Methodist minister, accountant, nurses, farmers, secretaries, trademen whilst others were unable to adjust as crime and misfortune ensued. 1939 some past residents began a group called Living Stones Union that they circulated to the others giving news and a sense of family connectedness among themselves. ( Rev. N. Marshall, KCC Local History , H. Stanley 2005) 1950's saw a new direction for the support of children and families in poor and difficult situations . The new Burwood Homes Facility opened in 1951 and children were transferred from Cheltenham in 1952. Tin Hat Day was established in 1922 after the end of WWI. It raised funds to benefit returned soldiers who had fallen on hard times after the war and during the Great Depression. It continued on during WW2 and into the 1950s. This badge is c1940. The tin hat badge was modelled on the British steel combat helmet known as the Brodie helmet, designed and patented in London in 1915 by John Leopold Brodie. Colloquially, it had many names including the shrapnel helmet, battle bowler, Tommy helmet, tin hat, dishpan hat, tin pan hat, washbasin, and in the United States the doughboy helmet. The German Army called it the Salatschüssel (salad bowl).Tin Hat Day was a significant annual event over several decades. Badges such as are not rare; they were sold in large numbers but as ephemeral items relatively few of those sold were retained.A round metal badge with a domed centre, mimicking a stylised tin hat. Frances Rigg was a local business identity in Kew, at one stage managing the local branch of the English, Scottish and Australian (ES&A) Bank at 175 High Street from c. 1920 until the 1940s. After Francis Rigg’s death, the collection of buttons and medallions was inherited by his son, Ken Rigg (1922-2014). The collection was subsequently donated to the Kew Historical Society in 2015 by Francis' grandson, Adrian Rigg, at the time of the Gallipoli & Beyond Commemoration in 2015. The collection covers a period of almost 40 years. The majority of the buttons are patriotic buttons, issued and sold during and immediately after the First World World War (1914-1918) to raise funds for national and overseas causes. The collection also includes a number of locally significant sporting event buttons and sporting club medallions, issued in the 1920s and 1930s.Patriotic and other pressed tin buttons and badges were produced in large numbers in the first decades of the twentieth century. By nature, insubstantial and ephemeral, they have not always survived. The collections of badges, buttons and medallions in the Kew Historical Society collection is homogenous and yet diverse, ranging from buttons sold to raise funds for the war efforts in 1914-18 and 1939-45, to those used at festivals and sporting events. Because of the manufacturing process, many surviving buttons and badges have been affected by inadequate storage, suffering from oxidisation and physical damage. These survivors are now historically and socially significant artefacts, revealing much about the attitudes and values of the period in which they were produced. This document was sent from Sydney Legacy to assist Melbourne Legacy with fund raising. In 1974 Sydney Legacy raised $4,070 using this technique, and $163,883 in 1984 . The Citizens Committee was made up of non Legatees who were prominent within the business community. A prominent leader of industry was selected to chair the committee. The committee only met three times a year.
