Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. Binnacle, Early to mid 20th Century
Mr John Wilson Gillie was born on the 31st of March 1864. On the 31st of July 1880 he was apprenticed for four years to J.J. Wilson and Sons, Nautical Instrument Makers of Sunderland. Following the apprenticeship he spent six months to a year as an ‘improver’ in Glasgow, and then started a new company ‘Wilson and Gillie’ in North Shields. At this time sail had just given way to steam and wooden ships to steel, and the railways were competing with colliers for the carrying of coal from the North East of England to London and the South. In 1858 only seven out of 44 shipyards on the Tyne were using iron, but by 1862 there were ten, employing around 4,000 men. These changes had a significant effect on nautical instrument manufacturers, as the magnetic compass for a wooden sailing vessel was very simple and required little in the way of compensation. For steel vessels much more was required and this was a period of great development, both in the compass bowl and the binnacle in which it was housed. In 1870 Sir William Thomson (later Lord Kelvin) designed his dry card standard compass, which completely replaced all previous designs. Wilson and Gillie started as agents for the Thomson compass, but later J.W. Gillie, using similar principles, redesigned the compass suspension and patented the ‘UNIT’ standard compass. It became popular with local shipowners and shipbuilders. In 1910 the firm of John Lilley and Son (which had been established in London in 1812), found themselves in financial difficulties and were saved with the help of John Wilson Gillie, who established, on the 8th of August 1911, a new firm of John Lilley and Son Limited. John Lilley and Son had been the sole London agents for Sir William Thomson, a very enviable position during this period, when the Thomson compass led the field. Unfortunately, Mr. Lilley had quarreled with the Glasgow company, who withdrew the agency and established their own branch in London (later to become Kelvin White and Hutton). On November 7th 1913, the firm of John Lilley and Son Limited of London amalgamated with Wilson and Gillie of North Shields, and after this date instruments manufactured by the two companies bore the name John Lilley and Son Limited of London and North Shields. During the 1930s many of the London nautical instrument makers were in difficulties, including John Lilley and Son Limited and Reynolds and Son, Dobbie and Clyde Limited, and Mr. J.W. Gillie arranged an amalgamation between these two companies. The new firm became Lilley and Reynolds Limited. In 1943, with estate duties in mind, the North Shields company was reconstituted and took the name of John Lilley and Gillie Limited, although the shareholders, directors and personnel remained unchanged In the early 1970s Lilley and Gillie developed close links with Observator in Rotterdam, who manufactured one of the first fully reliable transmitting magnetic compass systems. The Observator shareholders, Holland America Line, bought the share capital of John Lilley and Gillie Limited., but retained all the personnel and the directors. John Lilleys company began in 1812 growing at a time when the transition of compasses from timber ships, to steel vessels. Compasses at this time required a method of compensation to allow their inclusion in steel vessels without magnetic deviation. This therefore was a period of great development, both in the compass bowl and the binnacle in which it was housed and the Lilley company were leaders in the field. The tunes in the set of sheet music are mostly marches, jaunty and bright songs from the 1910s. The sheet music were published by W H P & Co., which was the company of William Henry Paling, Sydney. Paling was born in the Netherlands in 1825. He was a musician, composer, and violin teacher at the Academy of Rotterdam. In 1853 he arrived in Sydney where he became a piano and violin teacher and a professor of music at a ladies' college. He opened the W H Paling music warehouse around the same time, at 85 Wynyard Square in Sydney. He initiated clubs and groups, was involved in fundraising in the community, and conducted a Philharmonic Society concert. He seized the opportunity to supply the growing demand for pianos and local sheet music, becoming an agency for European manufacturers. He made several trips to Europe to supply his business. In 1875 the firm opened up premises in George Street Sydney. On his 1884-85 trip, he met Pietro Marich, an Austrian musician and businessman who then joined Piling's company and successfully expanded it into large premises with showrooms. In 1886 Piling's brother John joined the firm as partner. In 1883 it became a limited liability company, setting up in other major cities. He had many civic involvements and eventually presented his model farm at Campden for use as a hospital, along with finances to erect buildings on the land. He became ill after a trip to Europe, passing away in 1895, but the company continued in business.The collection of sheet music represents the musical and entertainment taste of the early 20th century. Sheet music was collected from Europe and locally and played in homes and public gatherings for listening to, for dancing and for background music. It was even recorded and played on portable gramophones with wax cylinders.Sheet Music wet; three sheets of printed music, comprising two large sheets with two pages of music printed on each side in black ink, and one small sheet with one page of music printed on one side in red ink.
