Receipt issued by Kitty Sandow, the daughter of John and Ruby Sandow, who had from the late 1920s run a mixed business in Sussex Street, Linton. (Current address 88 Sussex Street.) Kitty worked in and later ran her parents' shop. After she married Reg Jennings in 1946, the shop became known as 'Jennings' Shop' or 'Jennings' Milk Bar'. 'Mrs W. Grace Elizabeth Jennings Carmichael (1867-1904), poet and nurse, was born on 24 February 1867 at Ballarat, Victoria, daughter of Archibald Carmichael, a miner from Perthshire, Scotland, and his wife Margaret Jennings, née Clark, from Cornwall, England. . She was educated at Melbourne and while still a child went to live on a station at Orbost, and grew up close to the bush she came to love so much. In 1888 she went to Melbourne to be trained as a nurse at the Royal Children's Hospital, Melbourne, and in 1891 published a small volume of prose sketches, Hospital Children. Having qualified she obtained a position on a station near Geelong, and subsequently married Francis Mullis. She contributed verse to the Australasian, and in 1895 Poems by Jennings Carmichael was published. She lived for a time in South Australia and then went to London, where she died in poor circumstances in 1904. Her husband, Henry Mullis, was last recorded in the workhouse in Woolrich, but then disappeared leaving the three children- Geoffrey 7 yrs, (Thomas) Clive 5 yrs & 4 year old (Archibald) Keith and one year old (Rupert) Wyatt, destitute & were sent to the Northampton workhouse, (Thomas ) Clive dying in 1906. In 1910, a group of Carmichael's admirers, discovered the whereabouts of her children, where a public fund was established to bring the children to Australia, the Victorian Government giving them free passage, arriving in Victoria in October of 1910. The children were placed in private homes and took on their mother's single name of Carmichael. In the late 1930s, plaques were unveiled in Orbost & Ballarat in honor of Grace Jennings Carmichael. The one in Orbost was part of the "Back To' celebrations. It hung in Mechanics' Institute in Orbost.This is significant to the Orbost region in that it is associated with a woman who is certainly our foremost female poet. A bronze cast memorial plaque set onto a wooden backing board. "The Gesture" was an independent organ of the Deaf and Dumb having no direct connection with any single organisation. Its aim was to help all agencies established to promote the advancement of the Deaf and Dumb. The aim was to be the "Voice" of the Deaf and Dumb of Australasia". To educate the public as to the real condition and needs of the afflicted brothers and sisters, to bring prominently before the hearing and speaking community the peculiar difficulties and obstacles that Deaf Mutes have to encounter in the battle of life. Beryl Knox speaking about early life in Melton. Page 1 1949 – 64 years ago. We began our married life at Melton Sth. The house on the corner of the Exford Rd and Staughton St-- dusty gravel roads, box thorns and noxious weeds everywhere and a sprinkling of houses and vacant land. It was a friendly community consisting of old family names. McDonalds, Blacks, Dodemaide, Cahill, Coopers, Minns, Tinklers, Nesbitts, Cochranes, Wickhams, Exells. Mavis Butler. The home owned by Mr. Robinson and Miss Robinson had been shifted in two parts transported from Diggers Rest and it is still standing 2013. Bruce’s father purchased the house and two adjoining blocks, the Conways built on one and the Rawlinson family on the other block. Eileen still resides there, she was only a baby in a pram and the family had not long arrived from England. The railway line was close to the house and the contents would rattle when heavy steams trains went through, and on a clear frosty night the 1am paper train would echo roar through very loudly when labouring towards the Exford Bridge. Then the two carriage motor train was introduced, this was great for the workers and schoolies who travelled to Melbourne. The train pulled up at the crossing or riding to pick up or drop off. Melva Gillespie (nee Hirt) Bill Cahill delivered the milk by the billy and then in bottles. Len Kennedy (Paul Kennedy’s father, Norma Murrays son) delivered Jongebloeds bread, he always had a sweep going for the Melbourne Cup and raffles for the footy club. Mr. Woodgate owned an old bus and pick up point was the Post Office when there was a Saturday film on a Melton. There were no doctors or dentists in the district. If we need a Doctor we had to travel to Bacchus Marsh or discuss problems over the phone. In later years a Bacchus Marsh Doctor rented the Bluestone building in McKenzie St a couple of days a week. If we needed the Dentist we had to travel to West Footscray or Footscray. We did our banking at “State Savings” then the Miss Minns had the agency and then Bardsleys Store. We travelled to Bacchus Marsh to the National and Commercial banks. Station Rd to Western Highway, now (High Street) was a narrow stretch of bitumen and gravel farmland either side and a couple of farm houses and large gum trees on the properties. Page 2 North of the Railway line Mrs Bessie Jones, mother of Chas and Betty Jones managed the Post Office, next door to her Chas and Betty had the Shell Centre, and later moved the business to Melton. Hughie Nesbitt and mother owned the grocery and hardware store, and I bought my first set of saucepans there. On the opposite side of Station road Mr Coombe owned the fruit shop, and also provided soft drinks and lollies for children. The Chaff Mill was on the corner of Station Rd and Brooklyn Rd. Mr Lumsden was manager and later years Bernie Trethowan and Jack Butler were partners. It finally burnt down and is a Service Station now. Along Brooklyn Rd there were a few houses and Victoria Hall, not a very big hall, but catered for lots of functions, Balls, Fancy Dress, Bazaars, Square Dancing and meetings. The Bacchus Marsh Baptists held Sunday School in the hall. A group of shops were built south of the railway line Molly and Len Skinner managed the Post Office and handled a few essential groceries. Tom McDonald and Ron Lunsberg were the butchers. Mary and Syd Cooper lived next door to us and often in turn would run out of something when we had a baking spree we would borrow or exchange, sugar flour etc over the fence. Mavis and Jack Butler lived there before the Coopers. Bernie and Iris Trethowan lived two doors up. Neighbours were invited into their home to view the first black and white television in Melton Sth. Bill Exell was one of the first Melton Sth farmers to sell his land to developers, the land was idle for years before housing developed. I joined the Melton Valley Golf Club in 1960. The Gun Club as our Club House, an old tin shed consisting a water tank, trestle table and forms and dirt floor. It was a 9 hole course with sand scraps and landscape putting before greens. The Common or parkland was part of the Golf Course. It was open for every ones recreation. Roy Norton an old identity trained his trotters on the Common and wouldn’t clear the track for the golfers. The golfers had to avoid him to continue to play. We had to keep clear when the young youths came in their paddock cars and motorbikes. Over the years the Toolern Creek flooded its banks, water and debri covered the course on one year our first Club house was flooded out. It took several working bees to clean it up. We lived at Melton Sth for 15 years and moved to Melton on the farm “Croxton Park.” The Nixon family farm “Mowbray” adjoined the farm. Bruce worked the land cropping the farm when Mrs Nixon died. Page 3 (page 4 on the handwritten script) Bruce had the first offer to buy, in those days it wasn’t easy to get good bank loans. Part of the land is the Golf Course now and Mr O’Shea purchased the bulk. Moving to Melton was totally different – I became involved with Committees, Scouts, Guides, Mothers Clubs, CWA, Church Op shop (8 years). Melton Amateurs players produced and tutored by Mabel Rogers exerts from Pyjama Game, South Pacific, Carousel - later years a group of ladies did gentle water exercise at Essendon and Station Road swimming pool. I was 20 or so years in Probus. The local followed the football, there was always a Gymkhana on the long weekend in June. The tennis always created a lot of interest during the finals. It didn’t matter which team played the supporters were treated to a cup of tea and leftovers from their afternoon tea. In 1978 were the first residents to move into the Jennings Estate Kurunjang and lived there 31 years and retired 4 years ago into Unit. The amazing changes I have experienced. Merrimu supplied our water, after depending on tanks. On 15 December 1994 the former Shire of Eltham ceased to exist following the Liberal Kennett Government local council amalgamations. A new Nillumbik Shire Council was established with unelected commissioners appointed. That Council sold the former Eltham Shire Council Offices and land at 89S Main Road Eltham to Dallas Price Homes Pty. Ltd. the sale being conditional upon the granting of a planning permit for a petrol station/convenience store, fast food and video outlet. The sale was conditional that if the permit was not granted by 30 August. 1997, the contract could be avoided by either the purchaser or the vendor. The proposed development consisted of a petrol station with undercover fuelling facilities, convenience shopping, a drive through service facility for fast food, an 80 seat cafe, automated banking, a children's play area and retail space. In addition, the proposal included a 200 square metre community facility for Council use, provision of on site carparking over 2 levels for 83 vehicles, and advertising signage. An Advisory Committee consisting of Dimitry Reed and Margaret Pitt was appointed under Section 151 of the Planning and Environment Act 1987 to hear submissions on the proposal to develop the land at 895 Main Road Eltham, the site of the former Eltham Shire Offices. In September 1996, two applications were made by Contour Consultants Australia Pty Ltd on behalf of Dallas Price Homes Ply Ltd, to Nillumbik Shire Council. After extensive notification, the Council received 213 objections and a petition of over 1400 signatures. On October 9, 1996, Nillumbik Shire Council issued Notices of Decision to Grant Permit on Applications number 96/03376 and 96/0377 for the use and development of the land as a convenience Centre consisting of a petrol station, convenience store, cafe/takeaway food premises, a retail facility and a community facility, with associated advertising signs. Objectors to the proposals lodged Planning Appeals number 96/40724 and 96/40812 with the Administrative Appeals Tribunal on November 1, 1996. The grounds of appeal can be summarised as: inappropriate development, insufficient carparking, traffic and access issues, unsatisfactory design, inadequate permit conditions, the proposal being out of character with the area. and being contrary to the purpose and orderly development of the Eltham Town Centre, excessive noise, lack of consultation and unsuitable signage. On November 13, 1996, the Minister for Planning and Local Government directed the Registrar of the Administrative Appeals Tribunal. under Section 41 (1) (a) of the Planning Act 1980, to refer the Appeals to the Governor in Council for determination without a hearing or recommendation by the Tribunal. The Minister for Planning and Local Government called in the Appeals as he considered that they raised major issues of policy relating to the facilitation of development in accordance with the objectives set out in Section 4 of the Planning and Environment Act 1987, and that determination of the Appeals could have a substantial effect on the achievement of these planning objectives. The Minister required the Advisory Committee to consider the planning merits of the proposed use and development, and to address the issues raised in the objections. The Advisory Committee was required to produce a report providing: • The Committee's response to the matters detailed; • Relevant supporting information for the Advisory Committee's recommendation; and • A description of the proceedings conducted by the Advisory Committee and a list of those consulted or heard by the Committee. In March 1997, elections were held in the Shire of Nillumbik and the view of the new Council to this proposal differed from the view held by the earlier Council Hence the Submission made to the Committee by the Shire was against the decision by the Shire of Nillumbik to issue the Notices of Decision to Grant a Permit. The Recommendations of the Advisory Committee were: i. The cafe and take away food premises are as of right uses and are therefore allowable, but that shop and petrol station are unacceptable uses. A community facility is a discretionary use and is acceptable. ii. A development of the type and scale proposed is totally inappropriate for this land and that the Applications number 96/03376 and 96/0377 for the use and development of the land as a convenience Centre consisting of a petrol station, convenience store, café/takeaway food premises, a retail facility and a community facility, with associated advertising signs, be refused. iii. The land should be rezoned for public purposes and should remain in the community's ownership for community use. Following this, the Minister for Planning and Local Government, the Hon. Robert Maclellan, appointed Mr. Paul Jerome as an Advisory Committee under section 151 of the Planning and Environment Act 1987 to consider a Convenience Centre and an alternative proposal by Iha Shire of Nillumbik being the Eltham Gateway Community Precinct Concept Plan for the site of the former Shire of Eltham municipal offices at 895 Main Road, Eltham. In summary, the terms of reference for the Advisory Committee required it to: • consider the merits of the Council proposal • examine the merits of both proposals in terms of net community benefit • address the report of the previous Advisory Committee on the Convenience Centre proposal The Advisory Committee inspected the site and considered all the material before It including submissions made by all parties to the previous Advisory Committee and correspondence received by the Department of Infrastructure both before and after that Committee submltted its report. The Advisory Committee also held discussions with the following people: • Cr. Robert Marshall • Cr. Margaret Jennings • Cr. Lex de Man • Mr. Dallas Howgate of Dallas Price Properties, also Dallas Price Homes • Mr. Barry Rochford, CEO, Shire of Nillumbik • Ms. Yvonne Rust, Planning Officer, Shire of Nillumbik • Mr. Gregory Burgess, Architect of the Eltham Library and of Council’s Community Precinct Concept Plan • Mr. Jim Connor representing Mrs Thelma Barkway of the Eltham Senior Citizens Club Having considered all the material before it, the Committee arrived at two basic conclusions. First, the DPP proposal should be rejected because, on its merits, It does not sufficiently satisfy the requirements of the planning scheme which is a statutory document. The planning scheme requires that, before making a decision on the permit applications for the DPP proposal, a range of matters must be considered. It follows that consideration of these matters should Influence the decision. These matters include local policies relating to character and amenity. In particular, these policies seek • to conserve and enhance the bushland/country atmosphere, artistic heritage and strong sense of community of the Eltham Town Centre by ensuring that the design and height of any new development is sympathetic to existing buildings • to achieve a pleasing physical environment within the Eltham Town Centre by encouraging a high standard of architecture and urban design • to encourage Improvement to pedestrian amenity through such facilities as open and shattered rest areas and meeting places, crossing facilities, pedestrian arcades, pedestrian links to car parks and pedestrian weather protection • to reduce conflict between vehicular traffic and pedestrian flows, and • to encourage pedestrian thoroughfares It is submitted, as set out In the main body of this report, that the DPP proposal fails substantially to meet these policies and In so doing does not merit the exercise of discretion In Its favour with the Issuing of a permit. This finding is not offset by the investment and employment attributes of the proposal. They do not override the need to comply with the planning scheme. Second, the Council proposal, on Its own merits, substantially meets all statutory requirements applicable to this site with a possible reservation about car parking and traffic management which need further definition and assessment as the concept is refined. The Council proposal, however, has a serious weakness in that Its financial viability has not been adequately tested. The Committee refers to 'financial' rather than 'commercial' viability in recognition that Council owns the land and may enter into a range of agreements and partnerships to realise its concept some of which may be truly commercial and some of which may involve an element of subsidy arising from Council's involvement as a public body acting on behalf of its community.
