Nellie Price entered Clarendon Presbyterian Ladies College in 1920. Daughter of Mr E H Price of 'Dumbarton' Sturt St W; sister of John L, Elvina Coltman & E Morris. Nell was President of the CPLC Old Collegians Association 1941-42 and Secretary 1955-57. She married Robert Smail, uncle of Andrew Smail (1954). Robert's father built the original Enderly house in Sturt St. This trophy provides a significant glimpse of both the nature and importance of sports amongst school students in the 1920s. In February 1965, Staffs Railway Store, the oldest business premises in the Eltham shopping district was demolished. Formerly a self-service grocery, restaurant and electrical repair shop, the building for many years housed Eltham’s only ‘family’ grocer and feed store. Earlier it had appeared to have been the town’s bakery. The building had been purchased in late March 1939 by Mr Eric N. Staff. At the time of E.N. Staff’s purchase there were huge bakers’ ovens located at the rear and the building also had a well and four toilets for employees. When the ‘pictures’ came to Eltham with the opening of the Eltham Public Hall across the road in 1941, Mr E.N. Staff extended the business and opened a milk bar and sweet shop. Further extensions re-established the tea rooms of days gone by. Mr E.N. Staff conducted business for about 15 years before handing over the reins to his son, Ray Staff. When his son Ray took over, the milk bar and tea rooms were closed for several years but the milk bar and was later re-opened and subsequently became a greengrocers and later again, a restaurant. The tea rooms section was converted to an electrical repair shop about 1955. Electoral Roll records for 1967 record Raymond Charles Staff at 929 Main Road, Eltham, grocer, and in 1968 at Lot 4, Hillcrest Avenue, Eltham, taxi truck operator. Wilfred Henry Johnston, by his agent Stanley Ernest Elder had applied for a warrant of ejectment under the Landlord and Tenant Act 1890 against Luther Haley from the bakery premises at the corner of Main Road and York Street. From the evidence presented we learn that Mrs Burgoyne of Eltham had purchased the property some months earlier from Mr Johnston, which consisted of a store and bakery establishment at Eltham occupied by Mr. Luther Haley, and whose lease expired some little time back, and up to the present time, Mr. Haley was not prepared to leave. He informed the court that he is unable to secure at Eltham a suitable house in which to carry on his business, but was building a place near the railway station which he expected to be done in about three weeks time, and he is then prepared to give up possession of the premises he now occupies. That Council sold the former Eltham Shire Council Offices and land at 89S Main Road Eltham to Dallas Price Homes Pty. Ltd. the sale being conditional upon the granting of a planning permit for a petrol station/convenience store, fast food and video outlet. The sale was conditional that if the permit was not granted by 30 August. 1997, the contract could be avoided by either the purchaser or the vendor. The proposed development consisted of a petrol station with undercover fuelling facilities, convenience shopping, a drive through service facility for fast food, an 80 seat cafe, automated banking, a children's play area and retail space. In addition, the proposal included a 200 square metre community facility for Council use, provision of on site carparking over 2 levels for 83 vehicles, and advertising signage. An Advisory Committee consisting of Dimitry Reed and Margaret Pitt was appointed under Section 151 of the Planning and Environment Act 1987 to hear submissions on the proposal to develop the land at 895 Main Road Eltham, the site of the former Eltham Shire Offices. In September 1996, two applications were made by Contour Consultants Australia Pty Ltd on behalf of Dallas Price Homes Ply Ltd, to Nillumbik Shire Council. After extensive notification, the Council received 213 objections and a petition of over 1400 signatures. On October 9, 1996, Nillumbik Shire Council issued Notices of Decision to Grant Permit on Applications number 96/03376 and 96/0377 for the use and development of the land as a convenience Centre consisting of a petrol station, convenience store, cafe/takeaway food premises, a retail facility and a community facility, with associated advertising signs. Objectors to the proposals lodged Planning Appeals number 96/40724 and 96/40812 with the Administrative Appeals Tribunal on November 1, 1996. The grounds of appeal can be summarised as: inappropriate development, insufficient carparking, traffic and access issues, unsatisfactory design, inadequate permit conditions, the proposal being out of character with the area. and being contrary to the purpose and orderly development of the Eltham Town Centre, excessive noise, lack of consultation and unsuitable signage. On November 13, 1996, the Minister for Planning and Local Government directed the Registrar of the Administrative Appeals Tribunal. under Section 41 (1) (a) of the Planning Act 1980, to refer the Appeals to the Governor in Council for determination without a hearing or recommendation by the Tribunal. The Minister for Planning and Local Government called in the Appeals as he considered that they raised major issues of policy relating to the facilitation of development in accordance with the objectives set out in Section 4 of the Planning and Environment Act 1987, and that determination of the Appeals could have a substantial effect on the achievement of these planning objectives. The Minister required the Advisory Committee to consider the planning merits of the proposed use and development, and to address the issues raised in the objections. The Advisory Committee was required to produce a report providing: • The Committee's response to the matters detailed; • Relevant supporting information for the Advisory Committee's recommendation; and • A description of the proceedings conducted by the Advisory Committee and a list of those consulted or heard by the Committee. In March 1997, elections were held in the Shire of Nillumbik and the view of the new Council to this proposal differed from the view held by the earlier Council Hence the Submission made to the Committee by the Shire was against the decision by the Shire of Nillumbik to issue the Notices of Decision to Grant a Permit. The Recommendations of the Advisory Committee were: i. The cafe and take away food premises are as of right uses and are therefore allowable, but that shop and petrol station are unacceptable uses. A community facility is a discretionary use and is acceptable. ii. A development of the type and scale proposed is totally inappropriate for this land and that the Applications number 96/03376 and 96/0377 for the use and development of the land as a convenience Centre consisting of a petrol station, convenience store, café/takeaway food premises, a retail facility and a community facility, with associated advertising signs, be refused. iii. The land should be rezoned for public purposes and should remain in the community's ownership for community use. Following this, the Minister for Planning and Local Government, the Hon. Robert Maclellan, appointed Mr. Paul Jerome as an Advisory Committee under section 151 of the Planning and Environment Act 1987 to consider a Convenience Centre and an alternative proposal by Iha Shire of Nillumbik being the Eltham Gateway Community Precinct Concept Plan for the site of the former Shire of Eltham municipal offices at 895 Main Road, Eltham. In summary, the terms of reference for the Advisory Committee required it to: • consider the merits of the Council proposal • examine the merits of both proposals in terms of net community benefit • address the report of the previous Advisory Committee on the Convenience Centre proposal The Advisory Committee inspected the site and considered all the material before It including submissions made by all parties to the previous Advisory Committee and correspondence received by the Department of Infrastructure both before and after that Committee submltted its report. The Advisory Committee also held discussions with the following people: • Cr. Robert Marshall • Cr. Margaret Jennings • Cr. Lex de Man • Mr. Dallas Howgate of Dallas Price Properties, also Dallas Price Homes • Mr. Barry Rochford, CEO, Shire of Nillumbik • Ms. Yvonne Rust, Planning Officer, Shire of Nillumbik • Mr. Gregory Burgess, Architect of the Eltham Library and of Council’s Community Precinct Concept Plan • Mr. Jim Connor representing Mrs Thelma Barkway of the Eltham Senior Citizens Club Having considered all the material before it, the Committee arrived at two basic conclusions. First, the DPP proposal should be rejected because, on its merits, It does not sufficiently satisfy the requirements of the planning scheme which is a statutory document. The planning scheme requires that, before making a decision on the permit applications for the DPP proposal, a range of matters must be considered. It follows that consideration of these matters should Influence the decision. These matters include local policies relating to character and amenity. In particular, these policies seek • to conserve and enhance the bushland/country atmosphere, artistic heritage and strong sense of community of the Eltham Town Centre by ensuring that the design and height of any new development is sympathetic to existing buildings • to achieve a pleasing physical environment within the Eltham Town Centre by encouraging a high standard of architecture and urban design • to encourage Improvement to pedestrian amenity through such facilities as open and shattered rest areas and meeting places, crossing facilities, pedestrian arcades, pedestrian links to car parks and pedestrian weather protection • to reduce conflict between vehicular traffic and pedestrian flows, and • to encourage pedestrian thoroughfares It is submitted, as set out In the main body of this report, that the DPP proposal fails substantially to meet these policies and In so doing does not merit the exercise of discretion In Its favour with the Issuing of a permit. This finding is not offset by the investment and employment attributes of the proposal. They do not override the need to comply with the planning scheme. Second, the Council proposal, on Its own merits, substantially meets all statutory requirements applicable to this site with a possible reservation about car parking and traffic management which need further definition and assessment as the concept is refined. The Council proposal, however, has a serious weakness in that Its financial viability has not been adequately tested. The Committee refers to 'financial' rather than 'commercial' viability in recognition that Council owns the land and may enter into a range of agreements and partnerships to realise its concept some of which may be truly commercial and some of which may involve an element of subsidy arising from Council's involvement as a public body acting on behalf of its community. Taken some time after 1864, these photographs depict the Star Hotel both directly (8674.1) and from the Hotel north west down Ford Street (8674.2). The images depict the building with its modern exterior, having settled for this brick form after several other building designs. The Star Hotel was the first hotel opened in Beechworth, and would go through a series of dramatic changes under its first three owners. The original timber structure was built by W.H. Neuber, though at the time it was only known as ‘The Beechworth Hotel’. The site was later purchased in 1855 by mining entrepreneur, and prolific business owner, John Alston “Six Stars” Wallace. He would go on to extend the established hotel, rebuilding much of it with weatherboard and a shingled roof, adding a two storey structure with a verandah and a theatre capable of supporting 400-500 people, which was often used for international performances. Renamed as the Star Hotel, it was the second in a chain franchise, eventually leading to the “Six Stars” moniker Wallace went by, with hotels at Rutherglen, Chiltern, Yackandandah, Bright, Snake Valley, and of course, Beechworth. Under his ownership, it developed into a popular location for merchants, wayfarers, and locals alike, with the help of his brother Peter as manager. Situated on a road once synonymous with Melbourne to Sydney roadtrips, and the allure of the gold mines, the popularity of the Star drew all manner of clientele from across the country. As such a central hub, the ‘Star Assembly Rooms’ were used as a meeting place for debates, discussions, festivities, and problem solving among the various working sects of the area. These meetings included shareholder discussions for prospecting companies, railway planning, council meetings, and discussions surrounding the interactions between European and Chinese miners, both good and bad. By late 1856, John had the Beechworth at auction through J.H. Grey & Co. It was most likely due to the high profile murder of the manager, Robert Murdoch, during an altercation in relation to a dine and dash event by a Swedish miner, Charles Jansen, who had been ‘excited by drink’ on November 17th. He had refused to pay for his meal and waiter James Mitchell failed to persuade him otherwise. Mitchell, or possibly Murdoch himself, forced him out as tempers and threats escalated. As the photos tell, there are a number of doors which may be entered through, and Jansen used an alternate entrance to access the building. Murdoch was investigating the noise when he encountered the furious man. He was subsequently stabbed with no warning by a small clasp knife, as he tried to stop the intrusion. His exclamations, "I’m stabbed, I’m stabbed!” alerting other occupants, and Jansen was restrained and arrested. Murdoch died the next day from his injuries, with the inquest carried out on the theatre stage. Some 3000 members of the town attended the funeral, and the Star hung black cloth in memory of Robert and his death. Afterwards, an auction caw the property pass to Messrs Robertson and Quirk, though would return shortly thereafter to Six Stars’ portfolio. Six Stars would later sell off his properties from 1862, with the Beechworth Star purchased by 1864 by John Sitch Clark. This allowed Clark to redevelop a significant portion of the Hotel, stripping a central section and constructing the brick structure that survives today, reopening the Star in July that year. It was after this time that our photographs were taken. Clark would later sell the property to Frank Mitchell, shortly before his own death. The next owner, Frederick Allen, lived on the property before the deed was sold to him in the 1880s. He would later sell the property to William Carroll in 1890, with proprietorship eventually moving to Mr. W.H. Porter, and transferring to a Mr. Marendaz by 1913 and Mr. Holly in 1915. Licensing disputes would arise 1917 between Margaret Carroll and a Mrs. McDonald, before it became delicenced some years prior to 1935. It was around this year that the property was bought by Mr. W.J. Pemberton at the meagre price of £500, down from the £13,000 Six Stars originally auctioned it for. It served as a Youth Hostel for a period of time around 1972, and currently the building serves as a private accommodation on the second floor, with shops taking up the ground floor level.These photographs of the Beechworth Star Hotel as they depict a form of Beechworth's first hotel, and also the site of a high profile murder. He owned it from 1901 until 1919. Thomas Marshall was the owner from 1919 - 1972. After 1972 it became Marshall's Hotel Pty Ltd . From 1981 there have been various owners. Sol Green came to Australia as a penniless migrant who made his fortune as a bookmaker. He was inducted into the Australian Racing Museum Hall of fame in 2002. He purchased the Shipley stud from George Rolfe about 1905 and set about turning the Ayrford cattle property into a successful horse stud. His horse Comedy King won the Melbourne Cup in 1910 and was retired to stud in 1912. He became one of the top 10 Australian Stallions in the ensuing years. He dispersed his stud at Shipley in 1918 and this catalogue lists the stock sold that day. The property remained in the Green family and continued as a dairy farm with cheese factory and piggery by his son Bob Green. Sol Green was known for his philanthropic gestures extending help where needed on various fronts. Shortly before his death in 1948 he donated 47000 pounds to five Melbourne hospitals.This catalogue has significance firstly on a local level in that Shipley was an important farm in the district and secondly that it was owned by Mr Sol Green who was a person of standing within the racing industry as a bookmaker but also as a stud owner and owner of a Melbourne cup winner in 1910. The Hallford truck was made by J & E Hall, of Dartford, England, whose business commenced in 1785. In 1926 the Fisher family of Mongan's Bridge took delivery of the 1923 Hallford truck which was used on the farm to transport cream to the Kiewa Butter Factory in Tangambalanga. In 1967, the truck was sold to Mr Greg Bedstead and other members of the Kiewa Valley Historical Society for the KVHS who reimbursed them at a later date. The truck was housed at the Butter Factory for many years and was paraded on special occasions. The truck was purchased for $380. It's chassis no. 2439 and the price included a spare chain. (Ref. E. The minutes book of the Warrnambool Woollen Mill are an important record of the beginnings of one of Warrnambool's major industries for close to one hundred years. They record the struggle in the early days of 1909 and 1910 to raise the capital. Also mentioned is the support which had been given by local people of small means who were prepared to back the enterprise while those with financial means had been rather more reserved. Apart from a Mr Vidler all the initial directors were initially working in an honorary capacity. They lamented the fact that local banks held half a million pounds on fixed interest so there was no shortage of money. The first directors were appointed in March 1909 : Jas. Worland, W H Philpott, G S Mackay, E H Price, S McDonald, J C Beeching, W Rogers ,J Marfell, J Deany, Jas Duirs, Jas. Ponting, H Jessen, S Nettleton, J Blain, J Gooden, Drs. Holmes, Henderson and Powell. Mr J E Bennett was secured as first manager of the mill in 1910 Over the ten year period of this book there is much discussion on possible returns and share prices as well as decisions relating to the operation of and production from the mill. Within four years they were using more yarn than they were producing. Electricity was connected around 1914 and by 1915 shareholders were receiving eight percent return on their investment and were also contributing to the first world War effort by supplying blankets. Assets continued to accumulate and building was also continued with sandstone being quarried from the site and rain water tanks and asphalt floors installed, all contributing to savings. By 1917 The Warrnambool Woollen Mill was considered to be one of the states best investments and it continued to prosper through the years. The second minutes book likewise records similar events and circumstances for the period 1933-1945. This like wise is an interesting period, covering the period of the second World War. In 1955 the Warrnambool Woollen Mill formed a partnership with the Wangaratta Woollen Mills. Dunlop bought the mill in 1968. From that time until its closure in 2000 it had a number of different owners, the last being the Smith Family Industries. These minutes books hold an important information regarding the establishment and early operation of one of Warrnambool's major industries. The mill itself has strong connection to the Warrnambool community and many of the names mentioned as directors and shareholders have held positions within the community as businessmen and city officials.
