This book is a legal reference book used by the Bank of Australasia after 1900. The Bank of Australasia was incorporated by the Royal Charter of England in March 1834. The bank began in Australia on 14th December 1835, opening in Sydney. The Acting Superintendent of the bank at that time was David Charters McArthur. He was Superintendent from 1867-to 1876. The Melbourne branch opened on 28th August 1838 in a two-roomed brick cottage on the north side of Little Collins Street, where two huge mastiff dogs were used at night to guard the bank. The government also provided an armed military sentinel. Due to the bank's rapid growth, a new building for the Melbourne branch was opened in 1840 at 75 Collins Street West. By 1879 the bank had been upgraded to a magnificent two-storey building on the corners of Collins and Queens Streets, with the entry on Collins Street. In 1951 the Bank of Australasia amalgamated with the Union Bank to form the Australia and New Zealand Bank, now known as the ANZ. Then in 1970, the ANZ merged with both the ES&A and the London Bank of Australia to form the ANZ Banking Group Limited. The ANZ Banking Group Ltd kindly donated a variety of historic items from the Bank of Australasia. BANK of AUSTRALASIA, WARRNAMBOOL – In 1854 Warrnambool had two banks, the Union Bank and the Bank of Australasia. Later, completely different bank businesses opened; in 1867 the National Bank of Australasia, then in 1875 the Colonial Bank of Australasia. The original Warrnambool branch of the Bank of Australasia was established in July 1854, and operated from a leased cottage on Merri Street, close to Liebig Street. The bank later bought a stone building previously erected by drapers Cramond & Dickson on the corner of Timor and Gibson Streets. Samuel Hannaford was a teller and then Manager at the Warrnambool branch from 1855 to 1856 and the Warrnambool Council chose that bank for its dealings during 1856-57. In 1859 Roberts & Co. was awarded the contract to build the new Bank of Australasia branch for the sum of £3,000. The land was on a sand hill on the northeast corner of Timor and Kepler Streets and had been bought in 1855 from investor James Cust. The new building opened on May 21, 1860. The bank continued to operate there until 1951 when it merged with the Union Bank to form the ANZ Bank, which continued operating from its Liebig Street building. Warrnambool City Council purchased the former Bank of Australasia building in 1971 and renovated it, then on 3rd December 1973 it was officially opened as the Art Gallery by Cr. Harold Stephenson and Gallery Director John Welsh. The Gallery transferred to the purpose-built building in Liebig Street in 1986 and the old bank building is now the Gallery club. Staff at the Bank of Australasia in Warrnambool included the following men but others were also involved: Samuel Hannaford, Teller then Manager from 1855-1856; W H Palmer, Manager from January 1857 until November 1869 when the Teller Basil Spence was promoted to Manager; H B Chomley, Manager from April 1873 and still there in 1886; A Butt, Manager in 1895-1904; J R McCleary Accountant and Acting Manager for 12 months, until 1900; A Kirk, Manager 1904; J Moore, staff until his transfer to Bendigo in December 1908; J S Bath was Manager until 1915; C C Cox, Manager until April 1923; Richard C Stanley, Manager 1923 to April 1928. The book has historical significance as it is connected to the Bank of Australasia which was established in Australia in 1835 by Royal Charter during the early Colonial period of Australia's history. The book was used as a reference to financial law by the Bank. The book is significant for its association with the Bank of Australasia in Warrnambool, the first bank in Warrnambool, established in 1854. The bank continued to operate until its merger in 1951 when it became the ANZ Bank, which is still in operation today. No information is available on George Murray except that he was a Melbourne accountant and died intestate in 1885. He left property to the value of £91 and the lawyer, Ernest Chambers, who was at that time at 12 Chancery Lane, Melbourne, was directed to list the creditors of George Murray and distribute the estate accordingly. Mr Chambers was one of George Murray’s creditors. Ernest Chambers later had a legal practice with offices at Warrnambool, Koroit and Port Fairy with the known dates 1897 to 1910. Thomas Goodall was the manager of the Warrnambool office and he was the one who had this document in his possession at that time and it was passed down to succeeding lawyers in the Kepler Street building. Tait collection: item 7 of 62This document is of interest in that it was originally issued by the lawyer Ernest Chambers who later had an office in Warrnambool. This is a piece of parchment containing the 1885 Letters of Administration in the estate of George Murray, a Melbourne accountant. The document is white with black ruled lines and has handwritten material in black ink. The document is folded at the lower edge with a seal of the Supreme Court of the Colony of Victoria. The seal is attached to the document by a green ribbon. There is also a blue stamp of the Master in Equity of the Supreme Court. Tait collection: item 47 of 62 This is a document giving details of the Will and Letters of Administration following the death in 1895 of Charles Spencer of Brooklands, Birchanger, Essex, England. It is not known why the document has been drawn up in Melbourne and also makes reference to Warrnambool lawyers but it is presumed that some or all of the beneficiaries of the will lived in the Warrnambool district at the time. Charles Spencer left personal estate to the value of £689 to his wife, Emily, and children. Mentioned in the document are the lawyers J.S.Tait and Henry Parrington who were partners in a law firm in Warrnambool at the end of the 19th century (going under the name of Higgins and Parrington). The document has been passed down to successive lawyers occupying legal premises in Kepler Street and it was located in this building in 2014. The Letters of Administration for this estate was granted to Henry Parrington. The personal estate comprised £689 which had been lent to Spencer Smith on the security of land in the Parish of Wangoom, County of Villiers the repayment of which is secured by an indenture of mortgage dated 1st June 1892. [Ref: PROV. VPRS28/P0002, 73/750 Charles Spencer Grant of Administration] This document has no known local relevance except for the involvement of two Warrnambool 19th century lawyers. Further investigation has shown the personal estate mentioned in this will comprised £689 as a mortgage secured loan to a local resident, Spencer Smith.This is a cream-coloured piece of parchment paper folded in two and containing handwritten material on four pages which have black ruled lines on the edges. The 1899 document gives details of the Will and Letters of Administration of Charles Spencer, of Brooklands, Birchanger, in the County of Essex in England. The Bostock, Manifold and Aitkin families were all pioneering families in the Western District of Victoria almost from the time of settlement. They leased and owned vast tracts of land and operated businesses around the district, often associated with the farming industry. This document is dated 5th July 1865 and is an assignment of stock by way of mortgage. Augustus Bostock is the mortgagor with James William Manifold Aitkin and Ernest Bostock as mortgagees. At various times they were involved in running businesses together, in particular the Aitkin and Bostock store and flour mill. Three of the Bostock men were married to three of the Aitkin sisters. The amount in question is £2157/3/2 and surety is 8000 sheep and their increase, presently running at Coomete. The penciled in details on the document refer to Robert Brand Paterson who was later in business with Aitkin This is one of a number of documents which relate to the Bostock family who were one of the most important pioneering families of the Western District. They owned and leased various properties around Warrnambool and were involved in many aspects of social and business life. The document itself is indicative of its time and provides an insight into the details and terms of such documents at the time.Large grey coloured, lined hand written document over four pages. Oliver Lewis Randell (1836-1/7/1899) was a Welshman who began in Ballarat in the 1860's before moving to the Bendigo goldfields in 1871. He was a speculator and one of the first members of the Bendigo Stock Exchange. He had large stock holdings throughout the state, including at the time of his death, 2000 shares in the New Chum Mining Co., and 1000 shares in the North Duke Mining Co., both of BendigoThree metal stencils. The Senior Technical Schools Athletics Association ‘Herald Shield’ is one of many timber and metal repoussé commissions undertaken by students and staff at the Ballarat Technical Art School. The School was known for the quality of its art metal work which was applied to product, interior and commemorative designs. Between 1915 and 1936 Wilfred Kenneth (c1883-1957) taught boys and girls at preparatory and senior levels, including the ‘Art Metal Work and Repoussé’ industrial design specialisation. During World War I, Kenneth oversaw the training of repatriated soldiers which catalysed into a new, a successful art metal business, the Decorative Metal Craft Company in Chancery Lane, Ballarat. The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. Bendigo Weekly from Friday, June 28, 2002 - Snippets of Bendigo history, the Pall Mall story, part two - by Edith Lunn. Close to the jeweller's shop, we came to Chancery Lane. Many early legal firms had their offices there. Among them were: Quick&Rymer, Luke Murphy&Don and Macoboy&Taylor. A branch of the Bendigo united Friendly Society's Dispensary opened on the corner. Other small business in the walk included a florist, men's hairdresser and a boot and shoes repairer. Moving on there was Betteridge's Agency for the Singer sewing machine company, Wilkinson's photographic studio, Sutton's music shop and Favaloro's cake shop and café the ''Savoy'' was opened in the 1920's. Whitelock and Carter had their men outfitters business in the building, Cocking's was a very popular drapery store. After Cocking's closed down, Stoneman's supermarket opened in the premises. Alongside there was a passageway that led upstairs to the office of Phillip Secher and Son, Accountants and the Bendigo jockey club. This is a set of documents including three sheets of blueprint plans for the New Town Hall and Offices for Warrnambool, created in 1890 by the Architect Mr Arthur H. Cutler of Melbourne. The Contract was signed by the Town Mayor for Warrnambool, Mr William Simpson on May 7th 1890. Also, a Council copy of the Contract dated 26 June 1890, with the signatures and diagram where the two official stamps would be placed. The Foundation Stone was laid the following year by the next Mayor, John Hyland on February 24th 1891. The contractor for the building was granted to W. Kellas (William) of Warrnambool. The Town Hall and Offices were built on the corner of Liebig and Timor Streets in Warrnambool. On March 20th 1983 the new Performing Arts Centre was opened y the Mayor, Councillor R w Andreson, on the same site. The new building incorporates the 1890 Town Hall building. The plans, contracts, documents and various references to people on the documents are significant to the history of the City of Warrnambool and its community. The Warrnambool Town Hall building is also significant for the many community events held there over the decades after it was built. Appreciation for the significance of the almost century-old Town Hall building is demonstrated by its inclusion in the new Performing Arts Centre.Set of five documents that includes Plans for the Warrnambool Town Hall, the Contract cover page and a letter from the Architect to the Council.
