Property - 88 acres & 14 perches in Wandin Road Coldstream, Part of Crown Allotment 42B, Parish of Gruyere, County of Evelyn, Certificate of Title Volume 4021, Folio 804186.Executors of E HARDY AI Summary (24/9/2026) This 1931 auction contract records the sale of 88 acres and 14 perches at Coldstream, known as “Red Court,” Wandin Road, being Crown Allotment 42B, Parish of Gruyere, as described in Certificate of Title Volume 4021 Folio 804186. The vendors were Equity Trustees Executors & Agency Co. Ltd. and Edgar Henry Trebilco, acting as executors of the estate of Edward Allott Hardy. The sale was conducted jointly by C. E. Carter of Ringwood and Phillips & Nicholson of Swanston Street, Melbourne. The purchaser’s name and the price were left blank in this copy, which is marked as a typewritten auction contract. The conditions required the purchaser to sign immediately after the auction, pay a deposit of one quarter of the purchase price, and pay the balance in five equal annual instalments, with 6% interest, unless the purchaser elected to pay the full balance within one month interest free. The vendors sold as mortgagees under Mortgage No. 575114, and the purchaser was required to accept the identity and description of the land without requisition or claim for boundary discrepancies. The contract excluded all moratorium legislation and required that possession be available within one month of the sale.
