Legal record (Item), Thomas Judd to James Bonwick: Agreement for Sale of Land at Parish of Boroondara, 1853, 28/02/1853
James Bonwick (1817-1906), the Victorian educator and historian, acquired land in Kew on which to establish a home and school in 1853, not 1854 as more commonly stated. Bonwick returned to England in 1859 for a period, later returning to Melbourne and settling in St Kilda. He was the author of a number of histories and an official transcriber of Government records.This newly acquired document, from a former owner of 'Parkhill' (20 Hillcrest Avenue, Kew), is of statewide importance as it is the original copy of the agreement made between Thomas Judd of Parkhill and James Bonwick in 1853 for the purchase of land in Kew. Both Thomas Judd and James Bonwick were significant pioneers of Victoria.TRANSCRIPT [TITLE] Thomas Judd to James Bonwick Agreement for Sale of Land at Parish of Boroondara [PAGE 1] Articles of agreement made and entered into this the Twentyth eighth day of February One thousand Eight Hundred and fifty three Between Thomas Judd of Melbourne in the Colony of Victoria Gentleman of the one part and James Bonwick of Melbourne in the Colony of Victoria Gentleman of the other part whereby the said Thomas Judd agrees to sell unto the said James Bonwick who hereby agrees to purchase a piece or parcel of land containing two and half acres be the land more or less part of Portion Number Eighty five of the Parish of Boroondara in the County of Bourke commencing at a point on the Northern boundary line of the said Portion Seventeen Chains fifty links East from the North West angle of the same and bounded on the East by other part of said Portion in a line bearing South Eight Hundred and sixty two feet on the South by other part of said Portion Eighty five in a line bearing West one Hundred twenty six and half feet on the West by other part of said Portion Eighty five in a line bearing North Eight Hundred and Sixty two feet on the North by the Northern boundary line of the said Portion Eighty five in a line bearing East one Hundred twenty six and half feet to the commencing point at or for the price or sum of one [PAGE 2] One Hundred Pounds to be paid and payable in the manner hereinafter mentioned that is to say the Sum of Thirty pounds to be paid on the day of the date hereof and the sum of forty pounds by the acceptance of the said James Bonwick for that sum at three months bearing interest thereon after the rate of Eight Pounds per centum per annum and the Sum of Thirty pounds by the acceptance of the said James Bonwick for that sum after Six months with interest thereon after the rate of Eight pounds per centum per annum It is furthermore agreed that the said James Bonwick shall have access by a right of way fifteen feet wide reserved by the said Thomas Judd to the Government Road being the Southern Boundary of Portion Eighty five. That in case default shall be made in the payment of any of any of the Acceptances above mentioned the amount paid shall be actually forfeited to the said Thomas Judd who shall be at liberty to resell the premises. The file contains a number of original files provenanced to the Judd family including a subdivision brochure of the Park Hill Estate (1916) that includes a map of the subdivision, an early photo of the ten-roomed house. Other primary sources include a seven page photocopy (& transcript) of notes on early Kew by Thomas Judd Jnr (1950). An undated letter accompanying the information refers to Miss Ina Balaam, the last descendant of the family to live in the house. The file also includes a photocopy of the obituary of Thomas Judd and a newspaper article/clipping from 1972, which includes a short history of the house and a photograph. Dr David Waldron has spent years trawling through government documents and speaking to old farmers and policemen trying to gather as much information as possible for a book on the subject of giant cats. In 2013 his book, co-authored with Simon Townsend, "Snarls from the tea-Tree: A History of Victorian Big cat Folkore" was published.Half a page from an undated Ballarat Courier with information relating to big cats in the Australian bush. It also includes an image of Dr David Waldron. The article is a response to the findings of Noel Judd of Smythesdale who reported the death of a Shetland pony , and found paw prints of a large cat nearby. 14th December 1927. The funeral of Cr. F.T. Le Page, leaving Cheltenham Church of Christ, Chesterville Road, for the old Cheltenham Cemetary. The undertakers were W.D. Rose & Son. Standing alongside the hearse is Mr Wally Rose. In front him is Mr Clarrie Judd, father of Mrs Clarice Whitehead. At the front of the procession are two Church of Christ Ministers. On the right is Mr Daniel Wakefield, who was minister at the time. On the left is Mr Mudge who was the previous minister. The man wearing collars are members of the Star of Moorabbin Order, of the Sons of Temperance Friendly Society. Others are elders from the church. Some of the names are: Mr George Brough, Mr Horace Brough, George Roberts, Tom Tilley, and Frank Martin. The house in the photograph was the home of Mr and Mrs Fred. Judd. The picket fence was at the front of the Church and the Cypress hedge on the right, was the home of Mr Chas. Fairbank, now the Church Manse grounds.Frank T Le Page arrived in Cheltenham, ( Two Acre Village) aged 3 with his father Nicholas Le Page , a tailor from Guernsey in the Channel Islands. Nicholas purchased one of Holloway's two-acre lots and established a market garden. Frank T Le Page worked on his father's market garden from age 14, then worked as a coachman and met Tommy Bent whilst employed at Brighton Grammar School. He bought land adjacent to his father's , built Daphne Cottage in 1876 and later established the Cheltenham Cream and Butter Factory. Frank T. Le Page was member of many community groups and was a Moorabbin Shire Councillor for 25 years serving a term as President. 'The Le Pages became one of the best known Moorabbin market gardening families, with a tradition of service to communal and civic affairs that is unmatched.' Alan Hutchins is the shop attendant, serving two patrons; Merle Judd (left) and Marion Elliott (right). Judd's Grocery Shop was opened by Clarence Judd in the 1920's and was a successor to the family's business formerly located on the corner of Centre and East Boundary Roads, East Bentleigh. Cheltenham had become an established village during the 1920's and Charman Road represented a second, more commercial development in the area. Refers to the service of: VX27958 "Edward JUDD" Enlisted 18.6.40 Aged 40. Discharged 8.11.1945 Rank Sapper 2/7 Field Regiment.This is basically a leather funnel tube. The large end has a curved circumference, with one side reinforced. It has a sewn leather hem. Half way down the "tube" is a leather band and strap assembly with two smaller straps riveted to the main tube. At the end of the strap assembly -is a rectangular hole and a small round hole. Established in 1921 by Reginald Langdon Buller, the ‘Calliope Vineyard’ was named after the only surviving ship from the Great Hurricane at Samoa - 1889. A.B. (Banjo) Patterson’s Ballad Of The Calliope tells the tale in stirring fashion. Reginald’s vision of his new enterprise successfully sailing through the tempests of business and agricultural life proved prophetic. Coincidently, Calliope is also the Greek Goddess of Poetry. Today Buller Wines remains a local family business.
