Legal Contract Bob ...Bob Hymans Collection Bob (Herman) Hymans (a former member of the Royal Netherlands Navy was born in Bloemendaal, Holland on 30th September 1922. During World War II he fought against the Japanese in the Dutch East Indies (now Indonesia) and was imprisoned in Changi and on the Burma Railway. After gaining qualifications as a Ski Instructor, Bob arrived in Falls Creek in May 1950. Working as an Instructor and Supervisor at Bogong Lodge, Bob decided his future was in accommodation. He was successful in negotiating an indenture for land from the State Electricity Commission (SEC). It took Bob two years to build his Grande Coeur Chalet but, tragically, it was burned down in August 1961. Bob also built the first Chairlift in Australia. This was a single chairlift and the structure was built from wooden electricity poles. He was constantly full of new ideas and proposals for the village. Bob Hymans died on 7th July 2007. This Collection of documents and letters tells the story of Bob’s endeavours to develop Falls Creek into the ski village it is today.This document is significant because it documents the story of an important pioneer of Falls Creek.A 5 page indenture or contract typed on paper. certificate, July 3, 1858
This is a certificate of indenture, a legal agreement, between George Beattie of Forest Creek, near Castlemaine in the colony of Victoria, and Peter Christian Smith of the same place. Both were miners. Beattie was the vendor and Smith paid twenty-five pounds for a land parcel. The contract was witnessed by John Hedderwick, a law clerk in Castlemaine. There is a record in the Mount Alexander Mail, dated Wed. 22 April 1857, of George Beattie purchasing land for three pounds, sixteen and sixpence in Castlemaine and that it was withdrawn. Records also show that a Peter and Thomas Smith farmed in Sandon near Castlemaine.This item is a useful research tool as it a hand-written record of part of the history of the gold fields region of Victoria.A white paper certificate of conveyance with black print and hand-written details from George Beattie to Peter Smith. Document - J E Brennan & Thomas Goodall Assignment of Interest 1912, 1912
Tait collection: item 62 of 62 This 1912 document is an agreement made between John Brennan, a farmer from Laang and Thomas Goodall, a law clerk from Warrnambool. The document shows that Thomas Goodall has given John Brennan £5 and Brennan has agreed to pass over to Goodall a 218 acre property in Laang. Brennan also agreed to pay a debt of £10-19-4 to Thomas Goodall by monthly instalments. Thomas Goodall was the law clerk for several lawyers in Warrnambool at the beginning of the 20th century and he was also the manager of the Warrnambool office of the lawyer, Ernest Chambers who had legal offices in Koroit and Port Fairy at the same time (end of 19th century and beginning of the 20th century). This document was in the possession of Ernest Chambers and it has been passed down to successive lawyers occupying the legal premises in Kepler Street where it was located in 2014 (former premises of the law firm of Mackay Taylor). This document is of some interest as it gives details of a business transaction between Thomas Goodall and John Brennan, both residing in the Warrnambool area early in the 20th century. This is a piece of buff-coloured paper folded in two to make four pages. There is typed and handwritten material on two sides of the paper. This is a 1912 document called an Assignment of Interest Under Contract with John Brennan agreeing to pay his financial debts to Thomas Goodall. The document contains the signatures of John Brennan and Thomas Goodall. Part of one page of the writing is in pencil. There is also a separate receipt sheet which is a receipt for £5 paid by Thomas Goodall to John Brennan. A yellow duty stamp is attached to this receipt. Document - Joseph J Kelson Probate 1906
Tait collection: item 25 of 62 This document contains details on the will and probate of Joseph Kelson, a farmer from Kirkstall who died in April 1906. He was a contractor who died at the age of 46 leaving a widow, Margaret (nee Flahavin) and eight children. The two oldest boys took over the contracting business and Joseph’s brother, David, supported the family during their time of need. Joseph Kelson left personal estate to the value of £460 with the chief beneficiary being his widow Margaret. Ernest Chambers, the lawyer who drew up this document had a legal practice in Warrnambool, Koroit and Port Fairy at the end of the 19th century and the beginning of the 20th century. He had possession of this document and it passed down to successive lawyers who occupied the Kepler Street legal premises and it was located in this building in 2014 and passed on to the Warrnambool and District Historical Society. This document is of interest as it gives details of the will and probate of Joseph Kelson who lived in the Warrnambool area during the late 19th and early 20th centuries. It will be useful to researchers. This is 1906 cream-coloured piece of parchment folded in two with handwritten material on three sides. It contains the will and probate details of Joseph Kelson, a farmer from Kirkstall, Victoria. Documents, Henry Parrington, 1896
These documents relate to the proposed 1896 sale of a legal practice by Henry Parrington, a solicitor from Warrnambool, to Samuel Backhouse, a lawyer from Melbourne and his brother, a Terang lawyer. The draft indenture papers were drawn up but, after some weeks of negotiations, Henry Parrington withdrew from the sale. He was then sued by Samuel Backhouse for breach of contract. The outcome of this case is not known but Parrington continued his practice in Warrnambool. Henry Roberts Parrington qualified as a lawyer in England in 1873 and worked as a barrister and solicitor in New Zealand from 1876 to 1886. He then came to Australia and worked for the legal firm of Messrs Higgins in Geelong and for Bayly and Higgins in Warrnambool. The business in Kepler Street, Warrnambool later became known as Higgins and Parrington and, in 1900, as Parrington and Tait (partner John Sym Tait). When John Tait retired in 1901 Henry Parrington was the sole proprietor of the practice. He died in 1926 in Melbourne. These documents have some significance as they relate to Henry Parrington’s legal career. He was a prominent lawyer in Warrnambool in the late 19th and early 20th centuries.This material is in three sections:- .1 Eleven pages of handwritten material on blue paper (draft indenture document). The last page is blank and the front section has the red stamp of the Melbourne firm of Backhouse and Mellor. The front page is stained and there is a hole punched through the document at the top left hand corner. .2 Twelve handwritten letters – correspondence between Henry Parrington and Samuel Backhouse. These are on white paper and are a little crumpled and stained. .3 Twelve typed letters (typed from the handwritten letters noted above). These documents concern the 19th century proposed sale of the legal practice of Henry Parrington of Warrnambool to Samuel Backhouse of Collins Street, Melbourne. Samuel Backhouse came to Warrnambool to inspect the Parrington practice and offered £750 for the practice. The offer was accepted and the contract for the sale was drawn up. Henry Parrington then withdrew from the sale and was sued by Backhouse for breach of contract. Backhouse was wanting £150 compensation. The outcome of this case is not known. ... , Contractor Warrnambool Town Hall Legal record Plans and Contract ...This is a set of documents including three sheets of blueprint plans for the New Town Hall and Offices for Warrnambool, created in 1890 by the Architect Mr Arthur H. Cutler of Melbourne. The Contract was signed by the Town Mayor for Warrnambool, Mr William Simpson on May 7th 1890. Also, a Council copy of the Contract dated 26 June 1890, with the signatures and diagram where the two official stamps would be placed. The Foundation Stone was laid the following year by the next Mayor, John Hyland on February 24th 1891. The contractor for the building was granted to W. Kellas (William) of Warrnambool. The Town Hall and Offices were built on the corner of Liebig and Timor Streets in Warrnambool. On March 20th 1983 the new Performing Arts Centre was opened y the Mayor, Councillor R w Andreson, on the same site. The new building incorporates the 1890 Town Hall building. The plans, contracts, documents and various references to people on the documents are significant to the history of the City of Warrnambool and its community. The Warrnambool Town Hall building is also significant for the many community events held there over the decades after it was built. Appreciation for the significance of the almost century-old Town Hall building is demonstrated by its inclusion in the new Performing Arts Centre.Set of five documents that includes Plans for the Warrnambool Town Hall, the Contract cover page and a letter from the Architect to the Council. 'Applications and allotment of 12,000 new shares, containing lists of shareholders for The Central Deborah Gold Mine as at 15th January 1948, contains information regarding applications for shares, transaction details of what was sold, cost and allocated to list of people who they were sold to'. A3 lined paper, hand written with names of each purchaser and balances of each transactions. Blue & white forms printed as contracts of applications to the directors of the company to state who the owners of the shares were and receipt of payments. Forms state the issue of release of 12,000 contributing shares of 1 pound each per share which were submitted by shareholders desiring to exercise their quota rights. Also contains hand written receipts from the Bank of New South Wales Chambers regarding applications to purchase shares from W.J Donovan who was a member of the Melbourne stock exchange which was part of Union Bank of Australia in 1948.
