... perspective to the planning applications placed befopre the committee... perspective to the planning applications placed befopre the committee ...Nillumbik Commissioners used 'reserve power's to permit a controversial Shell service station and Hungry Jack's restaurant development at the former Eltham Shire Office site at 895 Main Road. More than 200 people attended the Council meeting in the public gallery and protested at the decision. 32 personal submissions were made to Council's Planning Special Committee meeting whose members vioted 3-2 against the development. The Committee consisted of the three Nillumbik Commissioners and three community members (Jim Connor, Bronwyn South and Janet Mattiske). Chief Commissioner Don Cordell, a former Shell employee excused himself from voting and the three communbity memebrs voted against the submission. The other two commissioners, Vin Heffernan and Kevin Abbott voted against it. They then immediately closed the meeting and opened a Council meeting lasting just seconds to use special reserve powers to overturn the decision. Subsequent to this the Commissioner run Council held a special meeting on Wednesday, October 23, 1996 where Commissioners Kevin Abbott and Vin Heffernan thanked all three community members of the Planning Special Committee and advised that their powers had been revoked. The article includes a joint statement from all three sacked members in which they state they have been able to bring a community perspective to the planning applications placed befopre the committee which has resulted in modifications to planning decisions. The members stated that "unfortunately, despite our best efforts to express considered apolitical opinions, it appears the Commissioners believe that any dissenting comment is politically motivated, and should therefore be disregarded." "We feel sad that this situation exists even though we have done everything possible tio represent the views of our community, whilst maintaining the integrity of the planning process."The demolition of the former Shire of Eltham offices and proposed sale and development driven by the Commissioners for Nillumbik Shire Council brought the community together in substantial protest at the infrigement of ratepayers democratic say in local government and ciommunity assets combined with protests about inappropraite development of Eltham's Gateway. This issue led to the formation of the Eltham Community Action Group which still operates strongly today (2023) on behalf of the community to ensure appropriate development within the community.895 main road, commissioners, dallas price homes, development application, eltham hub, hungry jacks, nillumbik shire council, re-zoning, shell service station, town planning, eltham gateway, eltham gateway action group, eltham shire offices, shillinglaw farm, jim connor collection, dallas howgate, nillumbik planning special committee, jim connor, bronwyn south, janet mattiske, don cordell, vin heffernan, kevin abbott -

... to a planning application in December 1986 to redevelop the then Mobil... to a planning application in December 1986 to redevelop the then Mobil ...The Eltham Gateway Group (EGG) was established about 1987 by some Eltham residents concerned for the development of the Eltham Gateway, defined as that historically and environmentally sensitive region of land along Main Road, Eltham extending from the roundabout at Fitzsimons Lane to Dudley Street, Eltham. The gateway was a unique urban area with a strong sense of character that provided a distinctive entrance to the Eltham Town Centre. The intention of this group was to support development that preserved both the natural and historic features of the gateway region. It encouraged development sympathetic to Eltham’s traditional association with the arts and natural environment. The group was initiated in response to a planning application in December 1986 to redevelop the then Mobil service station site at 729 Main Road, Eltham on the corner of Brougham Street. This group worked with and encouraged the Eltham Shire Council to consider rezoning to protect the gateway area. A detailed Eltham Gateway Study undertaken by Tract Consultants assisted with the establishment of the Eltham Gateway Zone, the Eltham Gateway Policy and the Eltham Gateway Design and Siting Guidelines. The State Government subsequently agreed to a planning amendment to rezone the land from a Residential Zone C to an Eltham Gateway Zone under the Eltham Planning Scheme. While zoning changes over the years have altered the mix of permitted uses within this area the Eltham Gateway still looks and feels like a predominately residential style precinct, even where non-residential type uses operate. EGG was followed by the establishment of the Eltham Protection Society in about 1989 to respond to community planning issues beyond the area of the Eltham Gateway and in effect took over the role from the EGG. Jim Connor President Eltham District Historical Society 4 July 2022 During 1986/87 I was a community member on the Shire of Eltham’s Community Consultative Committee involved with the Eltham Gateway Study, which led to the establishment of the original Eltham Gateway Zone, under the then Eltham Planning Scheme The Eltham Gateway Group was the pioneer community action group dedicated to protecting the character of the Eltham Gateway. It was succeeded by the Eltham Protection Society. When the Shire of Eltham Offices were demolished by the unelected Commissioners of Nillumbik Shire Council in July/August 1996, significant community upset and protest led to the establishement of the Eltham Gateway Action Group (EGAG) which in present day form has evolved into the Eltham Community Action Group (ECAG) focussing on issues throughout Eltham and not just the Eltham Gatewayeltham community action group, eltham gateway, eltham gateway action group, eltham gateway design and siting guidelines, eltham gateway group (egg), eltham gateway policy, eltham gateway study, eltham gateway zone, eltham planning scheme, eltham protection society, jim connor, michael wilson, rodger dalling, tony mcmanus -

... and the building was subsequently demolished. A planning application... demolished. A planning application for the site was then submitted ...Produced by Contour Consultants Australia Pty Ltd on behalf of Dallas Price Homes Pty Ltd as part of the planning process for redevelopment of the former Eltham Shire Office site at 895 Main Road. In 1963 the Shire of Eltham purchased the Shillinglaw property of approximately 2 acres in Main Road, Eltham for the widening of Main Road and as a site for new Council offices. This land, which contained the Shillinglaw Cottage (c1878-80), was the remaining section of the Shillinglaw family holding that originally comprised 30 acres, being Lot 90 of Holloway's 1851 subdivision. Eltham Council intended to demolish this cottage, but through extensive community action it was saved, funds were raised, and it was relocated to the current site adjacent to the Eltham Library. The new Eltham Shire Offices opened in 1965 were designed to ensure retention of the three Italian Cypress trees that were located outside the Shillinglaw Cottage. In 1971 the building was extended at the southern end to provide additional space, including for the Eltham Library and Council's Engineering Department. Renovations were undertaken to the offices during 1987. The Victorian State Government commenced to restructure local government in 1994, which resulted in the establishment of the Shire of Nillumbik and the cessation of the Shire of Eltham. This new Nillumbik Shire Council was headed by government appointed commissioners, who decided in 1995 to put the former Eltham Shire offices on the market. Eventually in June 1996 the property was sold for $1.1 million and the building was subsequently demolished. A planning application for the site was then submitted to Nillumbik Shire Council in September 1996 for construction of a 24-hour service station, convenience store, cafe/takeaway food premises, a retail facility and community facility. There were many objections to this proposed development and in controversial circumstances a planning permit was granted by the Nillumbik Shire Council commissioners. After protracted actions involving a planning panel and a planning advisory committee, established by the Minister for Local Government, the proposal was eventually rejected as not satisfying the requirements of the planning scheme. In December 1997 the purchaser withdrew from the contract of sale, just prior to Council announcing a withdrawal from the contract. While there have been a number of possible development proposals considered by subsequent Nillumbik Shire Councils, this site has remained vacant since July 1996. TIMELINE (Prepared by Jim Connor, Eltham District Historical Society- March 2018- Based on press, council and personal records) June 1996 - Eltham Shire offices sold to Dallas Price Homes for $1.1 million. July 1996 - Shire office building demolished against community's wishes. Council claimed building riddled with asbestos. September 1996 - Planning application submitted to Nillumbik Shire Council to construct on the site a 24 hours Shell service station, convenience store, Hungry Jacks café/takeaway food premises, a retail facility and community facility. 213 objections and petition of over 1400 signatures received. Minister for Planning and Local Government orders an independent investigation into valuation and sale. 9 October 1996 - Permit granted by Nillumbik Shire Council commissioners, in controversial circumstances. A Planning Special Committee consisting of 3 commissioners and 3 community representatives considered 32 community objections. One commissioner declared a potential conflict of interest so only 2 commissioners were able to vote. After hearing all objections, the community representatives moved a foreshadowed motion to refuse a permit. The commissioners then closed the meeting, formerly opened a council meeting (for about a minute) and approved the application. October 1996 - Community members appealed planning decision to Administrative Appeals Tribunal. November 1996 -Minister for Planning and Local Government Robert McClelland calls appeal in and directs MT to refer this 'major policy issue' to the Governor in Council. February 1997 - Planning panel (Dimity Reed and Margaret Pitt) established to consider submissions. March 1997 - New council elected with five councillors. April 1997 - Three of the five new councillors vote to fight Commissioner's decision to grant a permit. April 1997 - Planning panel (Dimity Reed and Margaret Pitt) conducts hearings at Nillumbik Shire offices. June 1997 -Planning panel rejected Dallas Price Homes proposal as being 'totally inappropriate' for the site and recommends the site be rezoned for 'public purposes'. July 1997 - Dallas Price Homes threatened to sue Council and individual councillors. October 1997 - Report released of an Advisory Committee (Paul Jerome) established by the Minister for Planning and Local Government. Committee considered Dallas Price Homes proposal and an alternative concept plan proposal by Council for a gallery, workshop, offices and cinema community-based development. Advisory Committee recommended Dallas Price Homes proposal be rejected as not satisfying the requirements of the planning scheme and recommended further testing of the financial viability of Council's proposal. December 1997 - Dallas Price Homes withdrew from the contract of sale, just prior to Council announcing a withdrawal from the contract, which expired on 28th November and was not renewed by either side, after previously being extended twice pending a decision by the Minister. Council had to pay developer $58,000 for demolition costs. February 1998 - Dallas Price Homes application rejected by Planning and Local Government Minister. October 1998 - Nillumbik Councillors suspended and an Administrator appointed (until March 1999). The demolition of the former Shire of Eltham offices and proposed sale and development driven by the Commissioners for Nillumbik Shire Council brought the community together in substantial protest at the infrigement of ratepayers democratic say in local government and ciommunity assets combined with protests about inappropraite development of Eltham's Gateway. Textile - Yomut Turkmen Islamic Rug, c 1880
... for a planning application from the Bendigo Islamic Association to build... Bendigo' dinner. In 2014 approval for a planning application from ...This rug was a gift and gesture of friendship from the local Muslim community to the City of Greater Bendigo. It was presented to Mayor, Cr Rod Fyffe on behalf of the people of Bendigo at a 2016 'Thank You Bendigo' dinner. In 2014 approval for a planning application from the Bendigo Islamic Association to build a community centre and mosque in East Bendigo prompted a series of public protests that captured widespread media attention. During this tumultuous period the Council identified the need for a community-wide plan to promote diversity and help address potentially divisive cultural issues. These events led to the COGB becoming the first local government area (LGA) formally accredited under Australia’s Welcoming Cities Standard. Community leaders emerged who wanted to show that the anti-mosque protesters did not reflect the views of the majority of Bendigo residents. The community lead ‘Believe in Bendigo’ movement gained momentum, and the Council and other local organisations joined forces to present a unified message that Bendigo residents do not tolerate racism. Muslims have made Central Victoria their home since the Goldrush, contributing to the community and the economy for the past 120 years. Traditional Islamic rugs, especially their patterns and motifs are intrinsically linked with the design of the Bendigo Mosque and Bendigo Islamic Community Centre providing important points of reference for the architects of the project. Typically, mosques are linked with specific cultural groups but not in the case of Bendigo where the Muslim community is made up of multi-ethnic groups. This meant the building's design was not fixed to a specific style or cultural iconography but instead needed to encompass many. The small local Muslim community selected a specific Australian architect because of their interest and knowledge of Islamic design and iconography gained through family collection of Islamic textiles. In thinking about the design of the mosque and community centre the architects wanted to acknowledge the role of Afghans in Australian history, especially tribal Afghans who helped build connections across the interior of Australia between First Nations communities, European settlers and Central Asian migrants. The gift of this Turkmen rugto the Bendigo community thus symbolises collaborative partnerships across faith and cultural groups based on friendship and mutual benefit. A Turkman rug was specifically chosen as it is the pinnacle of nomadic arts of the Islamic world. It was also important to the architects and the local Muslim community that the gift was a female artistic product as it was mainly a female Muslim architecture team that designed the mosque in Bendigo and there was a desire to select something that celebrated female artistry. This hand-woven rug is an engsi, made for a woman in preparation for marriage. Design work and weaving is a shared experience, between many generations of women and each rug hold the personal story of the woman it is made for and her family and thus holds deep symbolic meaning. There are often songs and poetry that are recited as the rug is made – helping the makers to memorisze the mathematical structure of the design. An engsi is put on the doorway to a yurt as part of a wedding ceremony. During the ceremony the groom turns the engsii upside down to check the quality of the rug makers weaving skills. The nomadic lifestyle of Yomut Turkman tribes determines the size of the rug as the loom can’t be carried. Its size is also restricted by the dimensions of the doorway of the yurt. This rug is dated as c 1880 because of the types of patterns used, the use of natural dyes (synthetic dyes were introduced to the area in 1890s) and with the smoother weaving on the back indicating the quality of craftsmanship dating to this time period. The Yomut engsi rug was made in Turkmenistan c1880 by Yomut Turkmen Tribes people and is designed to fit over the doorway of a yurt during a wedding ceremony. The main field motif is related to Turkoman jewelery design. The women and girls of the tribe spin the wool and design and weave the rugs. The men shear the sheep, dye the wool and clip the rug after it has been woven. The word “Turkoman” is thought to have been derived from Turk-iman, meaning the first nomadic Turkic tribes that began to follow Islam. Dyes used are natural including orange from madder root. bendigo mosque, bendigo islamic association, city of greater bendigo community partnerships, city of greater bendigo community groups -

... . In 2007 a planning application to build two offices and seven.... In 2007 a planning application to build two offices and seven ...Wingrove Cottage built 1858-1859 of hand made bricks is historically significant for its long association with Charles Wingrove, a prominent figure in Victorian local government, as secretary to the Eltham District Road Board and Shire Council from 1858 to 1904, and Shire Engineer and Secretary to the Heidelberg Road Board. The cottage was used as the office of the Eltham District Road Board and Council for many years It is one of the Shire's oldest dwellings, and one of the few surviving 19th century buildings associated with early Eltham and located in the original Eltham Village Reserve. The symmetrical planting of a pair of Pencil Pines (not visible in photo) is also historically and aesthetically significant as characteristic of the early period of planting in the district and because they are a distinctive landscape feature. In October 2002 new owners demolished the outbuildings attached to the rear of the cottage. Community protest at the demolition resulted in Council issuing a Stop Work order. The owner was issued with a court order in September 2003 to develop a conservation management plan and restore the heritage listed property. The owner sold the property in 2005 to Cameron Construction in 2005 who undertook the restoration work. In 2007 a planning application to build two offices and seven dwellings at the rear of the property was ultimately rejected. The cottage is now the main office for Cameron Construction. Covered under Heritage Overlay, Nillumbik Planning Scheme. Published: Nillumbik Now and Then / Marguerite Marshall 2008; photographs Alan King with Marguerite Marshall.; p57 Wingrove Cottage on Main Road beside Eltham Primary School, is one of the Shire’s most important historical buildings and was central to local government for almost 50 years. The cottage was built in stages from 1858 to 1888 for Charles Symons Wingrove JP. He was the Eltham District Road Board’s first paid secretary and later the Shire Secretary when the board became the Eltham Shire Council. Wingrove held those positions, and that of engineer for a time, for 46 years. He was also one of the main figures in the Municipal Association of Victoria. As Eltham’s first paid municipal officer, Wingrove used one room in his 11 – (originally two) roomed home, as the office for the board then the council. Meetings were held there from the late 1850s (as well as at more central locations) until Wingrove’s retirement in 1904. The cottage is a rare example of a local government office occupying a Road Board /Shire Secretary’s purpose-designed house. The cottage is also significant because it is the oldest largely intact building from the original Eltham township reserve (south of Dalton Street).1 The township had its origins in the 1848 Nillumbik Parish Plan and was one of the state’s earliest township reserves. The rectangular house of handmade bricks, roofed with grey slate tiles and with a veranda encompassing three sides, is reminiscent of those in the central goldfields including Castlemaine. Its overhanging eaves and gables were unlike houses in Melbourne at the time. Wingrove, who was born in 1827, had been a gold digger and a road surveyor. Impossible to imagine in today’s world, Wingrove was also the Shire of Heidelberg’s secretary and engineer for part of the time that he was secretary in Eltham. Living next door to the primary school was a mixed blessing. Wingrove and his wife Katherine, who had ten children, sent their eight surviving children to the school. But they had occasional disputes with the school authorities when their cattle wandered into the schoolyard. Eltham showed Charles Wingrove its appreciation of his services by giving him two illuminated addresses, one after ten years and the other at retirement. Wingrove died in 1905 aged 76 and was buried in the St Katherine’s Church of England cemetery in St Helena. His grave is surrounded by those of family members including his wife, Katherine and two babies, Henry, 12 months and Isobella, 15 months, who died in the mid-1860s. Cottage ownership passed to his wife, then to daughter Caroline and then to daughter Bessie, a Melbourne University graduate and artist. During the Great Depression their brother Walter was the ratepayer. At one stage the Wingrove property extended to Metery Road and included a small creek. The family ran a small dairy and orchard, with associated farm buildings, which were later removed. In 1949 part of the property was compulsorily acquired by the Eltham Primary School, which infuriated owner Bessie Wingrove. She protested in a letter about this ‘monstrous act of unmitigated tyranny’.2 She was the last Wingrove to occupy the cottage and died in 1955. Wingrove descendants sold the house in 1974 and the property was subdivided. In the 1960s the Eltham Shire named the park opposite the cottage in Wingrove’s honour. The cottage has since had several owners including psychiatrist Dr Daniel Kahans, who practised there. In October 2002 late rear additions which had been substantially altered were demolished contrary to council planning controls. This caused a community outcry and resulted in legal proceedings against the owner. Fortunately the historical significance of the demolished section was not as great as the older front part of the building, which has been retained and was later restored. This collection of almost 130 photos about places and people within the Shire of Nillumbik, an urban and rural municipality in Melbourne's north, contributes to an understanding of the history of the Shire. Published in 2008 immediately prior to the Black Saturday bushfires of February 7, 2009, it documents sites that were impacted, and in some cases destroyed by the fires. It includes photographs taken especially for the publication, creating a unique time capsule representing the Shire in the early 21st century. It remains the most recent comprehenesive publication devoted to the Shire's history connecting local residents to the past. nillumbik now and then (marshall-king) collection, cameron construction, charles symons wingrove, eltham, eltham road district board, eltham shire council, main road, wingrove cottage -

Photographs- Kiewa Valley House (before and after extensions) & Tawonga District General Hospital- Set of 6 colour photographs
The establishment of Kiewa Valley House, was a significant victory for residents and senior citizens in the Kiewa Valley district. Plans were laid in the mid 1970’s and a proposal was formulated for a 12 bed unit nursing home to be attached to the Tawonga District General Hospital. The need for an aged care facility in Mount Beauty was prompted by recognition of the high ratio of senior citizens residing in the area. At the time residents had to travel to Beechworth, Wangaratta or Wodonga for care. On June 6th, 1980, an appeal to finance a 12 bed nursing wing was launched at a public meeting in Mount Beauty The Hospital and Charities Commission’s development board finally approved the application for government funds to build the 12 bed nursing home in early 1981. The official opening of the nursing home was on March 6th, 1985. Opening of the lounge extensions occurred in May, 1993 Many local residents have taken advantage of facilities at Kiewa Valley House when they became unable to manage independently in their own homes. This has meant they did not have to face the stress of leaving the area and being separated from their local family and friends. Many SEC workers and their families have been residents of Kiewa Valley House over the years.Set of 6 colour photographs of Kiewa Valley House and original Tawonga District General Hospital in Mt Beauty 1 Kiewa Valley House, before extensions, with old weatherboard hospital in background 2 & 3 Official opening of Kiewa Valley House. 4 & 5 Gardens between Kiewa Valley House and Hospital 5. Document - News Clipping, Advertiser, Public Outcry at Abbott Veto with 'Reserve Power; 200 residents yell abuse as commissioners give ok to Eltham service station; Advertiser, Tuesday, October 15, p1, 1996
Nillumbik Commissioners used 'reserve power's to permit a controversial Shell service station and Hungry Jackls restaurant development at the former Eltham Shire Office site at 895 Main Road. This issue led to the formation of the Eltham Community Action Group which still operates strongly today (2023) on behalf of the community to ensure appropriate development within the community.895 main road, commissioners, dallas price homes, development application, eltham hub, hungry jacks, nillumbik shire council, re-zoning, shell service station, town planning, eltham gateway, eltham gateway action group, eltham shire offices, shillinglaw farm, shillinglaw trees, jim connor collection, dallas howgate, frank burgoyne, robert marshall, nillumbik planning special committee, jim connor, bronwyn south, janet mattiske, don cordell, vin heffernan, kevin abbott -

Nillumbik Commissioners used 'reserve power's to permit a controversial Shell service station and Hungry Jackls restaurant development at the former Eltham Shire Office site at 895 Main Road. Community residents who made submissions included Russell Yeomans speaking on behalf of the Eltham Gateway Action Group and Eltham District Historical Society, Des Ryan on belaf of Eltham Senior Citizens, Angela Newhouse, others on behalf of Our Lady Help of Christians Primary School and Judge Book Village, Tom Munro, Ian Jennings, Margartet Ball a fifth generation descendant of the Shillinglaw family, one of the early settlers of the area and owner of the land that was sold to Council, Frank Burgoyne who said "there will be a lot of creaking and rumbling in the cemetery if this goes through. So many old people who have done so much for Eltham are buried up there and it is up to us to pass on what they left to the younger generation. Eltham is a beautiful spot; why louse it up?" A second article "Anger over reserve power" by Laeta Antonysen provides commentary from the three Planning Special Committee community members, former Eltham Shire Councillor Jim Connor, Bronwyn South and Janet Mattiske about the process that took place and the first time use of the spoecial reserve power to overturn the decision of the committee. Barry Rochford, Nillumbiuk CEO defends the use of the power.
