No information has been found on the Commission Agent John Fitts except that he died at the Yarra Bend Asylum at the age of 51 and was formerly a resident of Ascot Vale, a suburb of Melbourne. Tait collection: item 19 of 62 This is an 1899 document giving Will and Probate details of William Cox who died in Warrnambool in March 1899. He was a farmer residing in Moore Street Warrnambool at the time of his death at the age of 83. He left real estate to the value of £425 and personal estate to the value of £412 to Gwenllian Williams who may have been his sister or niece. A Mr and Mrs Williams were also living in the Moore Street house at the time of Cox’s death. His executors were Thomas Goodall, a law clerk who managed the office of the lawyer Ernest Chambers in Warrnambool and John Ward, a pioneer settler in Warrnambool and a shopkeeper in Jamieson Street in 1899. No other details are available on William Cox. This is an interesting document as it gives details of the Will and Probate belonging to a local Warrnambool person, William Cox. The lawyer dealing with the document was Ernest Chambers who had legal offices in Warrnambool, Port Fairy and Koroit at the end of the 19th century and the beginning of the 20th century. This document has been passed on to successive lawyers occupying legal chambers in the Kepler Street building and that is where the document was held until passed on to the Warrnambool and District Historical Society in 2014.This is an 1899 piece of parchment paper folded in two with handwritten material on three sides of the paper. The seal of the Supreme Court of the Colony of Victoria is attached with blue ribbon and there are two stamps, one blue one of the Colonial Bank in Warrnambool and the other a red one of the Master in Equity of the Supreme Court in Melbourne. This document shows that Mary Irwin of Peterborough, Victoria, died in April 1892 without making a will and the Letters of Administration were granted to her husband, William Irwin. However he died in 1901 without having fully administered Mary Irwin’s estate. In turn the estate administration was passed over to Charles McGillivray of Peterborough and one of Mary Irwin’s sons, William Irwin, residing in New Zealand. This document was drawn up in 1907, fifteen years after Mary Irwin’s death. She left property to the value of £100. No other details on Mary Irwin are available. The Circuit Court House buildings were located in Lydiard Street Ballarat. By 1862 the Ballarat Gaol was completed, including a tunnel connecting the Gaol to the Court House. The original initiative for the founding of the Ballarat School of Mines was taken at a meeting of the Ballarat Mining Board on 6 October 1869. The Provisional Ballarat School of Mines Council applied to the Government for the lease of the former Circuit Court House. It was approved for a 15 year period at one shilling per annum. The official opening of the Ballarat School of Mines by its first President, Sir Redmond Barry, was held 26 October 1870 in the former Circuit Court House, Lydiard Street Ballarat. Conversions were made to accommodate the new role it was to play. On 14 December 1912, demolition of the former Circuit Court House commenced. A civic campaign for new public offices developed in Kew in the 1880s. After much deliberation, the location chosen was the junction of Bulleen and Cotham Roads. The buildings were designed by George Watson and John Henry Harvey, architects within the Department of Public Works (Victoria). Building was commenced in 1887, and after one year, the buildings were opened. The Post Office was transferred to the new Commonwealth Government in 1901. The Police Station and Court House, sold by the Victorian Government to the City of Boroondara in 2007, are now a community cultural centre and performing arts venue.The buildings were listed on the Victorian Heritage Register Register (HO885) in 1991. These books contain reports of the Supreme Court of Victoria in 1960 and 1961. They came from the Ardlie family, members of which have been associated with Warrnambool and legal affairs since the early 1850s. John Ardlie came to Warrnambool in 1852 as the Clerk of Courts and his son William Ardlie was a prominent lawyer in Warrnambool for over 60 years. If it is this William Ardlie’s stamp in these volumes then it was used after his death. The signature is of John Ardlie, also a lawyer in Warrnambool and Port Fairy in the later decades of the 20th century.These volumes are of interest as they are connected to members of the Ardlie family, prominent lawyers and community members in Warrnambool in the 19th and 20th centuries.These are two volumes of law reports of the Supreme Court of Victoria– hard cover books with dark green covers and spines with red and gold bands and gold print. No information is available on George Murray except that he was a Melbourne accountant and died intestate in 1885. He left property to the value of £91 and the lawyer, Ernest Chambers, who was at that time at 12 Chancery Lane, Melbourne, was directed to list the creditors of George Murray and distribute the estate accordingly. Mr Chambers was one of George Murray’s creditors. Ernest Chambers later had a legal practice with offices at Warrnambool, Koroit and Port Fairy with the known dates 1897 to 1910. Thomas Goodall was the manager of the Warrnambool office and he was the one who had this document in his possession at that time and it was passed down to succeeding lawyers in the Kepler Street building. This is a piece of parchment containing the 1885 Letters of Administration in the estate of George Murray, a Melbourne accountant. The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney.
