It is for use only at sea and officially never on land, but can be used by private citizens. At sea, it is the only flag allowable for merchant ships registered in Australia under the Navigation and Shipping Act 1912 and The Shipping Registration Act 1981. Pleasure craft, however, may fly either the Red Ensign or the National Flag. The history of the Red Ensign is intertwined with the history of the Australian National flag. From 1901 to 1954 the Red Ensign was used as the National Flag by State and Local Governments, private organisations and individuals. The Blue Ensign was for Government use only, reflecting British practice with its ensigns. The design of the Australian Red Ensign was always kept in step with the Blue Ensign (i.e. with respect to the number of points on the stars, etc.) but there was often public confusion about which was the `correct′ flag to fly. Many thought the choice was merely one of fashion or preference. In 1941, Australia′s Prime Minister Robert Menzies stated that there should be no restrictions on private citizens using the Blue Ensign on land and, in 1947, Prime Minister Ben Chifley reaffirmed this position but it wasn’t until the passage of the Flags Act 1953 that the restriction on civilians flying the Blue Ensign was lifted after which, use of the Red Ensign on land became a rarity. Since 2008, 3 September has been officially commemorated as both Australian National Flag/Merchant Navy Day which allows the Australian Red Ensign to be flown on land for the occasion as a matter of protocol. The 20th Light Horse (Victorian Mounted Rifles) was raised in 1920 as part of the 3rd Cavalry Brigade, 2nd Cavalry Division, Citizen Military Forces, with Headquarters at Seymour and depots along the Goulburn Valley from Mansfield to Tocumwal in southern NSW. In December 1941, 20th Light Horse (Victorian Mounted Rifles) converted from horse to mechanised, initially as 20th Motor Regiment. In 1943 redesignated 20th Pioneer Battalion and deployed to Merauke, Dutch New Guinea. The regiment was disbanded at the end of the war, 1945. 20th Light horse was the only light horse unit to serve overseas in WWII. The two semaphore flags were used as a pair for visual signaling by hand. The semaphore system is an alphabet signaling system based on the waving of a pair of handheld flags in a particular pattern to compose words to be communicated to passing ships. The system was introduced by the Royal Navy in 1880 and was later adopted in Australia, with the first School of Signaling opening in Williamstown in 1890. The system was superseded in the 1970s by more sophisticated methods of communication. Information on the Cape Nelson flags indicates that they were made by Evan Evans P/L, Flag makers, 690 Elizabeth Street, Melbourne. Evan Evans (d.1927) started a tent‐making business in 1877 and by 1920 Evan Evans P/L maker of canvas goods, was located at 680 Elizabeth Street, Melbourne. In 1924 it acquired land at 632 Bourke Street and built a new factory. His son Ivor continued the business after 1927 and in 1938 opened a bulk store in Carlton.271 In 2016 the firm was located at 673 Spencer Street, Melbourne. Another pair of white semaphore flags made by Evan & Evans is held at Gabo Island, and Wilsons Promontory also has a pair. Cape Nelson’s white semaphore flags have second level contributory significance. This flag originally flew from the flagstaff on the Trades Hall Building in Camp Street Ballarat on December 3rd 1942. The flag prompted many enquiries to the Ballarat's Courier newspaper. The Courier in reporting that the flag was, in fact, a replica of the original Eureka Stockade flag went on to say that: "… it (seemed) very strange that the town in which Eureka made a name for Australia and its efforts to get freedom from control for the ordinary man, did not recognise the flag that flew while the first move for freedom was fought out against big odds." The Trades Hall Eureka flag, made of cotton material, was used in union marches during the 1940s. In later years it had been all but forgotten, until in 1981 it was brought to the office of the then MHR for Ballarat, John Mildren by members of the family that the flag maker had boarded with in Ballarat. David Miller, who had a keen interest in the Eureka story and was electorate officer for John Mildren, became custodian of the flag for many years and presented it to Ballarat Trades Hall for display. In 1994 The Ballarat Trades Hall Eureka flag travelled Australia as part of a touring Eureka collection. At that time, the Secretary of the Ballarat Regional Trades and Labour Council, Graeme Shearer said “…The Eureka flag then, as it does now, symbolises the struggle for basic rights and democracy”. On Wednesday 11th July 2001, following a ceremony to mark the refurbishment of the Galloway Monument, the Ballarat Trades Hall Eureka flag was unveiled at a function in the Ballarat Trades Hall by President of the Ballarat Trades & Labour Council, Rhonda Young, and Premier of Victoria, Steve Bracks. The Trades Hall gratefully acknowledges the assistance of Dean Mighell, then Victorian State Secretary of the CEPU/ETU - who was a passionate supporter of the diggers' stand at Eureka - and instrumental in making funds available to assist in Trades Hall's Eureka flag being mounted in the Main Hall of the Ballarat Trades Hall. These Union Jack flags are believed to have been used in the celebrations in Warrnambool on the occasion in 1953 of the Coronation of Queen Elizabeth 11 (oral tradition only). Warrnambool celebrated with street parades, shop decorations and displays, concerts, church services and dinners. It was customary at the time to use the British flag more than the Australian one. These flags are retained because of their possible connection to mid 20th century Warrnambool celebrations (1953 Coronation of Queen Elizabeth 11).These are seven Union Jack flags made of cloth with red, white and blue colouring.
