Date of issue has been damaged by silverfish - Mr H A Wilcox was appointed Secretary in 1909, becoming General Manager in the Tramway Board which succeeded the private company in 1916. Rule 76, page 21 allows for the wearing of the Australian Tramway Employees Association union badge. The Union was recognised by the Company in August 1912 and the wearing of Union badges on watch chains was permitted. A possible date for the document is 1912. The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. This postcard folder contains lithographs of photographs taken locally by Georg Rose between 1880 and 1942. He reproduced them at his company's premises, the Rose Stereographic Company at Armadale, Victoria. The postcard folder was purchased as a Warrnambool souvenir by the donor's parents around 1945 to 1950. Interestingly, the city on the cover is printed as "Warrambool", which is a location in New South Wales, but the postcards within all have the locations and text of Warrnambool. The photographs include the 'new' concrete bridge, built in 1922 to replace the original bridge, built in 1872. The boathouses belonging to Proudfoots and to Flett/Fanny Nelson are also pictured on the Hopkins River mouth. The twelve photographs included locations connected to other items in our Collection. [Kepler Street towards Presbyterian Church on Spence St] George Rose, 1861-1942: - famous for his Late 19th and early 20th century photography. He was born in Clunes, Victoria, and was in his 20th year when he founded Rose Stereograph Company in 1880. He took the opportunity of a popular trend of the times to produce stereographs, pairs of almost duplicate photographs which appeared to be in 3D when viewed in a handheld stereo viewer. By the 1920s these lost their popularity, so he used his photographic skills to produce cards and postcards of scenes and people. The photographs in this postcard folder were taken between 1880 and 1942 by the renowned Victorian photographer George Rose. The locations match photographs and postcards in our collection that were taken at different times. A comparison between them shows the changes over time in the land and bay, the buildings and other structures, transportation and even the fashions of the times, building the story of our local history.This copy of a postcard folder has a blue-grey textured rectangular card cover with a sketch of a rose on the front along with the name of the postcard series. the location of the series' focus, the producer's details and lines for adding an address. The folded cover contains a long, concertinaed page with six titled photographs on each side, totalling twelve in all. Interestingly, the cover has the location name of "Warrambool", a place in NSW, instead of Warrnambool, the location of all of the photographs inside. He performed on the University's historic Erard Grand Concert piano on stage in Founders Hall, describing it as "absolutely amazing.' The instrument was 93 years old and hadn't been played for more than eighty years. An audience of 500 were entertained with pieces by Schubert and Bach for the first half of the program and Waltzes, Mazurkas, and Polonaises by Chopin after the interval. A feature of the show is Lola's celebrated Spider Dance which was acknowledged many years ago by the crowd throwing gold nuggets onto the stage.
