Edward (Edmund) de Lacy Evans was really Ellen Tremaye; and in 1856 she married her fellow passenger on her voyage to Australia, Mary Delahunty; under the assumed name of EDMUND De Lacy. In 1859 he/she married Sarah Moore. They were married for eight years when in 1867 she died in childbirth. In 1868 after Sarah had died; Ellen, now known as EDWARD de Lacy Evans married Julia Mary Marquand in Ballarat. From the Melbourne Argus Friday 5th Sept 1879, Page 7 THE EXTRAORDINARY PERSONATION CASE. [BY ELECTRIC TELEGRAPH. FROM OUR OWN CORRESPONDENT.) SANDHURST, THURSDAY. The De Lacy Evans case has created great excitement here. The man-woman having resided in the district for about 20 years, was well known amongst the miners, but no one appeared ever to have supposed that she was other than as she represented herself to be, and the discovery of her sex has caused the greatest astonishment. The police have not yet moved in the matter of the discovery of her antecedents, but from the result of inquiries I have made, there seems to be no room to doubt that the woman is identical with the girl Ellen Tremaye, referred to in yesterday's telegram as having arrived at Melbourne by the ship Ocean Monarch in June, 1857. The nurse at the hospital, Mrs. Holt, is positive she is the same, and says the opinion was held amongst those on board the vessel that Tremaye had been well connected, and that she had left home in consequence of some misconduct. The Ocean Monarch was an immigrant vessel, and on the voyage Tremaye and another young woman, named Rose Kelly, were very intimate, but the latter, being seized with a dangerous illness, was left at Rio Janiero. Mrs. Evans, the wife of the supposed man, states that she frequently heard Evans say that she came out by the Ocean Monarch. But the most satisfactory information of Evans' previous history yet received has been obtained from a Mrs. Thompson, a charwoman at Myers' Creek, who was also a shipmate of the girl Tremaye. At the time she made the voyage she was unmarried, and was accompanied by Miss Mary Ann Delahunty, a young lady who was very well connected, and who came from the same village as herself, named Monakine, on the north bank of the river Suir, in Kilkenny. Miss Delahunty was an orphan and brought with her about £900. After Rose Kelly was taken ill, Tremaye resorted to Miss Delahunty's berth, and the passengers appeared to think there was something strange about the manner in which Tremaye conducted herself, and she had been observed to wear a man's under-clothing. Upon the arrival of the ship in Hobson's Bay, Tremaye declared herself to be a man, and told Mrs. Thompson she intended to marry Miss Delahunty. The next Mrs. Thompson saw of Ellen Tremaye was at Peg-leg Gully, Eaglehawk. Tremaye had just established herself in a house there under the name of Edward de Lacy Evans, and Mrs. Thompson went to serve them with milk. When she went to the house, she saw Evans sitting inside dressed in male attire, and immediately recognised him as her fellow passenger, Ellen Tremaye. Evans had, at this time, married his second wife, Miss Moore, who was then present. Evans re-marked to her—"I think I know you." To which Mrs. Thompson replied—"I know you, too," and added something to the effect that Ellen (referring to Tremaye) was a queer girl." Oh, said Evans, evidently anxious that his then wife should not understand Mrs. Thompson's reference, "It's a good job she is gone back to the old country." Mrs. Thompson inquired as to what had become of Miss Delahunty, and Evans replied, "Oh, my poor wife and boy both died of consumption, and are buried in the North Melbourne cemetery. " In reply to an inquiry as to what had been done with her (Delahunty's) money, Evans said she had sent it home to a nunnery. Evans's then wife had been absent during a portion of this conversation, but at this point she returned, and Evans went outside to the milkwoman, and said, "For your life don't mention my dead wife's name ; call me Mr. Evans. This missus of mine is death on the Roman Catholics, and she can't bear to hear my dead wife's name mentioned." This conversation took place about 12 or 14 years ago, and Mrs. Thompson seems to have quite believed that Evans had personated a woman under the name of Ellen Tremaye on the voyage out and was really a man. Edison Records was one of the early record labels that pioneered sound recording and reproduction, and was an important player in the early recording industry. The first phonograph cylinders were manufactured in 1888, followed by Edison's foundation of the Edison Phonograph Company in the same year. The recorded wax cylinders, later replaced by Blue Amberol cylinders, and vertical-cut Diamond Discs, were manufactured by Edison's National Phonograph Company from 1896 on, reorganized as Thomas A. Edison, Inc. in 1911. Until 1910 the recordings did not carry the names of the artists. The company began to lag behind its rivals in the 1920s, both technically and in the popularity of its artists, and halted production of recordings in 1929. Thomas A. Edison invented the phonograph, the first device for recording and playing back sound, in 1877. After patenting the invention and benefiting from the publicity and acclaim it received, Edison and his laboratory turned their attention to the commercial development of electric lighting, playing no further role in the development of the phonograph for nearly a decade. Start of the Recording Industry: In 1887, Edison turned his attention back to improving the phonograph and the phonograph cylinder. The following year, the Edison company introduced the ”Perfected Phonograph”. Edison introduced wax cylinders approximately 4+1⁄4 inches (11 cm) long and 2+1⁄4 inches (5.7 cm) in external diameter, which became the industry standard. They had a maximum playing time of about 3 minutes at 120 RPM, but around the turn of the century the standard speed was increased to (first 144) and then 160 RPM to improve clarity and volume, reducing the maximum to about 2 minutes and 15 seconds. Several experimental wax cylinder recordings of music and speech made in 1888 still exist. The wax entertainment cylinder made its commercial debut in 1889 at first, the only customers were entrepreneurs who installed nickel-in-the-slot phonographs in amusement arcades, saloons and other public places. At that time, a phonograph cost the equivalent of several months' wages for the average worker and was driven by an electric motor powered by hazardous, high-maintenance wet cell batteries. After more affordable spring-motor-driven phonographs designed for home use were introduced in 1895, the industry of producing recorded entertainment cylinders for sale to the general public began in earnest. Blank records were an important part of the business early on. Most phonographs had or could be fitted with attachments for the users to make their own recordings. One important early use, in line with the original term for a phonograph as a "talking machine", was in business for recording dictation. Attachments were added to facilitate starting, stopping, and skipping back the recording for dictation and playback by stenographers. The business phonograph eventually evolved into a separate device from the home entertainment phonograph. Edison's brand of business phonograph was called the Ediphone. The collection of three phonograph cylinders are an example of early recorded music use for domestic entertainment. The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney.
