Councillors Sylvia Phillips and Neil MacDonald have lobbied strongly against having the surplus from council's 1991/92 budget transferred into the trust. Tait collection: item 57 of 62 This document gives details of the Will and Probate of Thomas Sleeman, a Nirranda farmer. He died in 1900 at the age of 85 and left real estate to the value of £600. The main beneficiaries were his sons and £30 was left to Mary Le Couteur, his daughter. He also bequeathed to the Wesleyan Church the half acre of land that the church was on at that time (presumably in the Nirranda district). The document has been drawn up by the law firm of O’Mahony and Murray which operated in Warrnambool early in the 20th century. The document has been passed down to successive lawyers occupying the legal premises in Kepler Street and located there in 2014 in the same building, the premises last occupied by the law firm of Mackay Taylor. This document is of some interest as it gives details of the Will and Probate of Thomas Sleeman, a farmer from Nirranda.This is a piece of white paper folded in two to make four pages. Three of the pages are ruled with blue lines and have margins ruled in blue. There is handwritten material on three pages. A seal of the Supreme Court of Victoria is attached with green ribbon and there are nine red stamps of the Master in Equity of the Supreme Court and one purple stamp of the Savings Bank (Head Office). The document is a little stained and the writing is fading but legible. The document gives details of the Will and Probate of the Nirranda farmer, Thomas Sleeman who died in September 1900. Tait collection: item 43 of 62 This is a document giving details of the Letters of Administration of John Moloney, a farmer from Bushfield, who died in July 1897. He died intestate but had real estate to the value of £510 and personal estate to the value of £142. The beneficiary was his wife, Mary Ann Moloney. The lawyer involved in drawing up this document was William Ardlie, one of the best-known lawyers in Warrnambool in the 19th and 20th centuries. He commenced his business in the 1860s and continued on until the 1930s when he was well in his eighties, making him at the time the oldest practising lawyer in Australasia. The document seemed to have been passed down by successive lawyers occupying the Kepler Street legal premises and located there in 2014.This document is of some interest as it gives details of the Letters of Administration of John Moloney, a 19th century farmer from Bushfield and it also concerns the lawyer, William Ardlie, a prominent Warrnambool lawyer at that time. It will be useful for researchers.This is a piece of cream-coloured thin parchment paper folded in two. It has handwritten material on two pages (black ink) containing details of the Letters of Administration following the death of John Moloney of Bushfield in 1897. A seal of the Supreme Court of Victoria is attached with green ribbon and there is one red stamp of the Master in Equity of the Supreme Court. The document is somewhat dirty but quite legible. The numbers ‘255’ and ‘14’ are written in blue pencil on the back page. This Directory of 1889 covers the location of Melbourne based trade and professional offices by street and in Alphabetical order. It covers all of Melbourne and its suburbs. It also covers government and official, ecclesiastic, legal, municipal and miscellaneous information. The directory details a cross section of a developing city with a splattering of advertisements opening up an in depth look of all aspects of living in the late 1800s. It is interesting to see that all the advertisements do not have any telecommunication numbers listed (personal shoppers or mail orders only). This was a period of high moral standing within the community and hotels advertised rooms " suites of rooms for families and single rooms for Ladies and Gentlemen" also "electric bells throughout the house. Telephone, night porter and hot and cold baths."This directory would be used by the majority of families and businesses working and living within the Kiewa Valley and the surrounding area. Melbourne was the only place where every aspect of living requirement was catered for. Although the delivery of services and goods were not at a high rate, certain items or transactions would require a visit to "the big smoke". Business information are listed both by suburb and alphabetically. There is also a section for British and Foreign Trade. This directory covered nearly everything to do with commerce, an example pay days for principle firms. Greater evolution of trade locations started to balloon out after the mid 1950's. Increased populations and greater levels of communication and safe fast transport facilities permitted greater devolution of commercial enterprises into rural communities, such as the Kiewa Valley.This directory has no front or back cover and is held together by its cloth spine. It contains over 1300 pages, however there may be some pages missing front and back of the directory which would have contained advertisements of some unknown shops. All the sides of this directory (except the spine) have advertisements and content information stamped on. The spine cover has been placed in the directory until further conservation work is carried out. It has gold coloured printing and in the central section, a gold coloured background with the words "Sands & McDougall's Melbourne Directory 1889." The spine has three adverts on the spine.On the spine in gold colour "South * British insurance Company Fire and Marine. Photograph: Julia Gillard and Betty Borchers A collection of busts of all past Australian Prime Ministers is displayed in the Ballarat Botanical Gardens. This photograph was taken when Julia Gillard unveiled her sculpture on 14 October 2014. Only two ex-Prime Ministers (including Gillard) have attended their own unveilings. Gillard was a lawyer before entering politics. She was the 27th Prime Minister of Australia from 2010 to 2013 and the first Australian female prime minister. Kevin Rudd successfully challenged Gillard's leadership in 2013 and he went on to lose the election. Julia Gillard resigned from parliament following the leadership challenge. Betty Borchers worked as a legal secretary. This document has been published with the Certificate of Incorporation under the Companies Act 1938 limiting the Company by Guarantee. The Special Licence grants dispensation for the use of the word "Limited". The Special Licence was granted by the Victorian State Attorney General T.W. Mitchell whose father-in-law was Harry Chauvel (led the calvary charge at Beersheba during World war 1). This document records the legal status of 'Junior Legacy, Melbourne' in 1952. Melbourne Legacy has had name changes over the years. In September 1952 Junior Legacy Melbourne was incorporated. Under the provisions of the Companies Act 1938, it was registered as a company with limited liability without the need for 'limited' in its' name (see page 1). Two other copies are at 00317 and 01490.Signifies that Junior Legacy Melbourne was incorporated under the Companies Act 1938 and the special licence granted to Junior Legacy, Melbourne meant that Junior Legacy Melbourne did not have to use the word "Limited" upon condition that the terms of the Memorandum and Articles of Association submitted to and cerified by the Attorney General are strictly followed. A record of a former entity of Melbourne Legacy. Wodonga & District Historical Society IncCertificate - Recognition of Service World War II - James S. N. Harris
James Stewart Noel Harris was born in Rutherglen on 21 March 1905 to John Richards Harris and Jessie Lily nee Prentice. His father was a doctor in Rutherglen. John later entered politics and was knighted for his services in May 1937. After finishing his secondary schooling James (Stewart) Harris moved to Melbourne to study law, becoming a resident of Trinity College in 1925 and rising to become Senior Student in his final year, 1928-29. He enlisted in the Air Force Cadets at Point Cook in 1925 and transferred to the Air Force Reserve in 1930. On 7th October 1940 James transferred to active service as a Flight Officer. He worked his way up the ranks, being appointed Wing Commander in 1944. He also served as Chief Instructor of the RAAF School of Administration, receiving the RAAF Long Service Commendation. The RAAF School of Administration and Special Duties had moved from Ascot Vale to Trinity College in 1942 meaning that James Harris' service career had returned to the place it began in 1925. In 1945 he requested to be transferred back to the Reserve so that he could resume his civilian life. On discharge, James returned to Wodonga and resumed his legal career. In the early 1930s he had joined the legal practice of Mr. Edmondstone which had opened for business in High Street, Wodonga in 1886. The practice continued to develop and in 1966 was joined by Lou Lieberman, becoming known as “Harris Lieberman & Co”. Harris Lieberman still operates in Wodonga and Albury. James Stewart Noel Harris died in Wodonga on 30th November 1978.This item is significant because it recognises the War Service of a prominent citizen of Wodonga.A colour printed certificate presented to James S. N, Harris in appreciation for his service for "King and Empire" during World War II. The text is surrounded by columns and an arch. The Australian and British flags are at the top as well as representations of the Navy, Army and Air Force. It also features the logo of the Shire of Wodonga above the text. The badge of the Commonwealth Armed Forces is at the centre bottom of the certificate. This small collection also includes black and white photographs of James Samuel Noel Harris in uniform and also saluting on presentation of an award recognising his service in 1942.On Certificate: PRESENTED TO James S. Photocopied file of corresponence and documentation relating to a claim by L.J. Mills, Nurseryman, that adjoining property owner, J. Collins, Farmer, assists with replacement of a vermin proof wire netting dividing fence destroyed by 1939 bushfire. File includes 1939 and 1940 detailed property inspection reports by Vermin and Noxious Weeds Branch, Lands Department, Lilydale, describing land use in the area and signs of vermin activity. Application approved 18th April, 1940. Appeal lodged by Mr Collins disallowed in May, 1940. File closed June, 1940 with Departmental suggesion that Mr Mills consider further legal action through a Solicitor as fence had still not been wire-netted. TRANSCRIPTS: Vermin & Noxious Weeds Inspection Reports "19/9/1939 (To) Superintendent (Department of Lands and Survey, Melbourne) Re L.J. Mills application for Vermin Proof Fence. I called on Mr Mills yesterday 18th instant in connection with this matter. Mr Mills has a flower farm and claims that rabbits and hares are damaging his flowers. He showed me a bed of carnations which he stated were being damaged by rabbits. There was evidence of some leaves being nipped off, but I am unable to say whether this is due to rabbits or grubs. Very little if any real damage is being done. The property is netted on the east and south boundary and on half the north and west boundary. The surrounding country is undlating and fairly steep in places. The land to the east across Grandview Avenue (sic) is all planted out in old established orchards and well cultivated. Cleared grass land adjoins the south boundary and bush land adjoins the north and west boundaries. I walked over a large area surrounding Mr Mills land and never saw any rabbits or hares or any indications of rabbits. This locality is not rabbit infested and very little wire netting is being used. I do not consider that a vermin proof fence is necessary between these allotments. - Jas H Allison (Inspector, Vermin and Noxious Weeds Branch, Lands Department, Lilydale)." Follow up report following renewal of application for Certificate by Mr Mills, citing rabbits causing considerable damage to his flowers. He laid poison and obtained 9 carcases and stated that there is evidence of rabbit infestation from the adjoing land. "19/3/1940 (To) Mr Hannah (Superintendant, Department of Lands and Survey, Melbourne) Re L.J. Mills, Grandview Grove Ringwood, Lot 4 Grandview Estate Pt CG20 Ph of Warrandyte. I interviewed Mr Mills at his home on 15th inst. He showed me carcases of rabbits which he stated had been poisoned on his land. In places young plants had been nipped off apparently by rabbits. I made an inspection of adjoining properties and found one live burrow close to Mr Mills northern boundary. There were scratches and other evidence of rabbits on land north and west of Mr Mills property. In view of the present evidence of rabbits I consider that a vermin proof fence is now necessary to protect the flowers grown by Mr Mills. His land is netted on whole of east and south boundary and half way on west and north boundary. The two letters give the nitty gritty of the going-on's at the time in the MMTB. .1 - three quarto sheets, stapled in the top left hand corner, dated Monday 2 May, outlining activities at home. The main point is a O'Meara - Eakins appeal which involved extensive legal advice about titles, positions etc. Mr O'Meara title noted as chief draftsman. Notes names of various legal figures such as Mr. Herring KC. Also notes Cr. Gray, Cr. Gorman, Mr. Bell (Jnr?), Mr Cass. Appears that Mr. McGlashan "has been dipping his beak into the flowing bowl" and had been dismissed. Appears he was collecting the fees from the Wattle Park Golf course. The Powder Magazine was built in 1859 by T Dawson and Company for fifteen hundred pounds and was restored in 1966 by the National Trust. The building was constructed to store black-powder used by miners on the goldfields for blasting for mining and quarrying as legally, miners had to leave bulk gunpowder the Powder Magazine overnight. Due to the passing of an 1857 act regulating the importation, transportation and importation of black powder, several Powder Magazines like the Beechworth Powder Magazine were constructed. The Magazine Powder is uniquely designed to ensure that in the chance of an explosion, the explosion is minimalized by travelling vertically rather than horizontally. The Powder Magazine was constructed using granite, slate roofing and a high stone wall and includes several safety features including wooden nails, lightning rod and a solid outer wall. This photograph is historically significant as it documents the development of laws related to mining, the actions taken to ensure the safety of those nearby potentially dangerous equipment and the architectural skills to design a storage facility to minimize damage caused by a potential explosion. This ledger appears to have been a mortgage document held by the law firm of Mackay Taylor and Co. with the evidence for this the presence of two loose sheets of paper in the ledger with that firm’s letterhead. Mackay Taylor was established in 1893 with the merger of the firms of George Sutherland Mackay and James Fletcher, independent practising lawyers at the time. The new firm became Fletcher and Mackay and later changed to Mackay and Taylor when J. McD. Taylor became a partner in the 1920s and the business was at 131 Kepler Street, with a new building erected in the late 1920s. The legal business closed in the 1990s with the mortgage section of the firm becoming Mackay Taylor Securities in 1990 (later Southern Securities). The ledger was recovered when the building was being cleared out and Percy Eccles, a real estate agent, handed it to the Warrnambool and District Historical SocietyThis ledger has considerable significance as an example of a law firm’s business activities in the mid 20th century. Tait collection: item 29 of 62 This document contains information on the Will and Letters of Administration of James Jones, a gardener from Warrnambool. The document indicates that he died intestate in August 1896 at the age of 57 but details of a will are included in the document. The fact that this document was drawn up 14 years after his death indicates that there was a problem with the will. James Jones left real estate to the value of £80 and personal estate to the value of £10. The sole beneficiary was his widow, Mary Ann Jones. No other information has been found on James Jones. No Warrnambool lawyer is mentioned in this document but it was located at the former legal premises in Kepler Street of Mackay Taylor and passed on to the Warrnambool and District Historical Society in 2014. It is presumed that it had been passed down to successive lawyers occupying the same building since 1910. This document is of interest because it contains information on the Will and Letters of Administration of a Warrnambool resident, James Jones. Tait collection: item 41 of 62 This document gives the details of the Will and Probate of Henry Phillips who died in Warrnambool in 1895 at the age of 55. He came to Australia from England in 1861 and established a hay and corn store in Liebig Street, Warrnambool. He was a prominent member of the Congregational Church and lived at ‘Ilfracombe’ in Lava Street. He and his wife Emma had eight children, two of whom had businesses in Warrnambool. Henry Phillips left personal estate to the value of £521 and the beneficiaries were his wife, Emma and their children. This document came into the possession of a Warrnambool lawyer, Ernest Chambers and passed down to successive lawyers occupying legal premises in Kepler Street. The document was located in this building in 2014 in the former premises of the law firm of Mackay Taylor. This document is of considerable importance as it contains details of the Will and Probate of Henry Phillips. He was a prominent businessman in Warrnambool in the 19th century. The document will be useful to researchers. This is a cream-coloured piece of parchment paper folded in two and containing the Will and Probate details of Henry Phillips, a Warrnambool hay and corn merchant who died in 1895. These are personal documents that belonged to Henry Roberts Parrington. They include statements regarding his preliminary and final examinations that qualified him as a lawyer in England (1867, 1873), annual certificates of registration as a lawyer in New Zealand (1876-1886), personal affidavits presented to the Supreme Court of Victoria and permission to practise as a lawyer in Victoria (1886). Henry Roberts Parrington qualified as a lawyer in England in 1873 and worked as a barrister and solicitor in New Zealand from 1876 to 1886. He then came to Australia and worked for the legal firm of Messrs Higgins in Geelong and Bayly and Higgins in Warrnambool. The business in Kepler Street, Warrnambool later became known as Higgins and Parrington and, in 1900, as Parrington and Tait (partner John Sym Tait). When John Tait retired in 1901 Henry Parrington was the sole proprietor of the practice. He died in Melbourne in 1926. These documents have some significance as they are original papers documenting Henry Parrington’s early years as a lawyer. He was a prominent lawyer in Warrnambool in the late 19th and early 20th centuries. These sixteen paper documents relate to the lawyer, Henry Roberts Parrington. They are all original documents from England, New Zealand and Australia (Victoria). Most have printed material on them. All have statements and information handwritten in black ink and many have stamps relating to the country concerned. Some are foolscap size and are printed on blue paper. This book belonged to the Warrnambool solicitor, Con O’Mahony (1863-1920). In 1883, he won the University of Melbourne Bowen Prize for his essay on the Federation of the Australian colonies. His prize, ten volumes of the ‘Lives of the Chancellors’, is today in the possession of the Warrnambool and District Historical Society. O’Mahony had a legal practice in Warrnambool in the Royal Chambers in Kepler Street at the end of the 19th century and the beginning of the 20th century. He was initially in a partnership with Messrs E.W. Klingender and Murray, then ,when this partnership was dissolved, he continued the business under the name of O’Mahony and later O’Mahony and Murray. He was actively involved in the management of the Warrnambool Mechanics’ Institute and was a member of the Warrnambool Hospital committee. The item here described shows O’Mahony’s interest in bridge-playing, a popular pastime at that time. This book is of some significance as it belonged to Con O’Mahony, a well-known lawyer in Warrnambool in the early 1900s. It also shows the interest in bridge-playing as a pastime during that period. This is a small hard cover book of 112 pages. It was published in 1901(eighth edition) and contains seven chapters on how to play bridge, a scoring table and an index. The last three pages are advertisements for other books on bridge. The cover is yellow with the title of the book, the author’s name and the publisher on the front cover contained within a scroll pattern with four coloured images of the four kings from a pack of cards. The back cover has a list of the British Chess Handbooks published by George Routledge & Sons Ltd. This book, a de-luxe copy, was given to John Dwyer as the Chief President of the Australian Natives Association from 1938 to 1940. The Australian Natives Association (A.N.A.) was established in Melbourne in 1871 as a benefit society. Originally membership was restricted to white men born in Australia. The A.N.A. was influential in Australian politics, especially in the 1890s when it campaigned vigorously for Federation. In 1993 it merged with Manchester Unity I.O.O.F. to form Australia Unity, for many years the largest benefit society in Australia. The annual Victorian Conference of A.N.A was held in Warrnambool in 1931. John Beynon Dwyer (1904-1999) came to Warrnambool in 1937 and assumed control of the legal practice in Kepler Street of Desmond Dunne, retiring in 1984. J. B. Dwyer was a long-serving City Councillor (1937-1975) and was awarded an O.B.E. for municipal service in 1966. This book is of considerable importance as it was a presentation copy given to John B. Dwyer, a prominent Warrnambool lawyer, when he retired as Chief President of the Australian Natives Association in 1940. This is a soft-cover book of 92 pages. It is a de-luxe edition with a green leather cover with gold printing on the front. The inside of the covers has a green and yellow mottled pattern The leather on the spine is very worn and the book’s cover is scuffed. There are some insert title pages in yellow and blue thick card. He worked for the railways as an engineering employee and was long-term trade unionist (Amalgamated Engineering Union and the Australian Railways Union) and ALP member; he lived and worked in the Ballarat area. Norm was active in workplace disputes during the ALP split in 1955. He was a long time supporter of Ballarat Trades Hall. Simon Crean served as President of the ACTU - 1985-1990. He served as a member of federal parliament - 1990-2013 - holding various cabinet posts. He retired at the 2013 election. Betty Borchers worked as a legal secretary. These items come from the estates of Dorothy and Agnes Ardlie of Warrnambool They are documents connected to the deaths of their parents, Ethel and Arthur Ardlie. They include notes re the cost of legal fees in connection with the death of the mother, Ethel Ardlie (1968), an inventory of household items auctioned, will and probate documents and a probate assessment in connection with the death of the father, Arthur Ardlie (1946) and information from the monumental mason regarding the cost of burial and headstone details of the latter. Arthur Ardlie (1872-1946), a law clerk, was the son of the prominent Warrnambool lawyer William Ardlie and his wife, Mary and the grandson of John and Mary Ardlie, early settlers in Warrnambool. Arthur Ardlie married Ethel Ryan (1880-1967) in 1903 and they had three daughters, Olive (1905-1912), Dorothy (1910-1993) and Agnes (1915-1993).
