Warrnambool and District Historical Society Inc.Book, Ledger - Trust Account, Early 20th century
This Trust Accounts ledger belonged to the law firm of Mackay and Taylor of Kepler Street, Warrnambool. The law firms of George Mackay and James Fletcher merged in 1893 to form Fletcher and Mackay and in the early 1920s J. Taylor became the new partner with Mackay to form the legal practice of Mackay and Taylor. This firm continued in Kepler Street until the 1990s. George Mackay was a prominent resident of Warrnambool from 1891 to his death in 1926. The Trust Accounts ledger lists the accounts of several organizations such as the Ancient Order of Foresters, the accounts of deceased estates and accounts of individual residents of Warrnambool and district. The dates covered are from 1919 to 1923. The accounts appear to refer to an investment and banking society operated by Mackay and Taylor.The ledger has some significance as it contains information on the financial dealings of many well-known Warrnambool people and organizations. It has social significance as it shows the type of investment opportunities available to Warrnambool people in the first two decades of the 20th century. This is a foolscap-size bound book of 526 pages. The covers are of blue hard cardboard with buff-coloured spine and corners. The inside thick paper covers are of a blue and red mottled design. There are pages with alphabetical tabs at the start of the book. The pages are printed with red ruled lines for accounting purposes. The entries are in black ink. Tait collection: item 44 of 62 This document gives details of the Will and Probate of William McJannet, a Warrnambool carpenter who died in 1898 at the age of 80. He and his wife and two of his children came to Australia from Scotland in the 1850s and at the time of his death he was living in Raglan Parade. He left real estate to the value of £400 and the beneficiaries were his children. The lawyer concerned with this document, H. Parrington, had legal offices in Kepler Street with the firm known as Higgins and Parrington but Mr Parrington was in partnership with Mr J.Tait when this document was drawn up. The document has been passed down to successive lawyers occupying the Kepler Street premises and located in this building in 2014. This document is of some importance as William McJannet was a well-known resident of Warrnambool in the 19th century. The document will be useful to researchers. This is a piece of white paper folded in two with printed red lines on the edges of three of the pages. Three pages have typed material and one page has handwritten material in black ink. It gives details of the Will and Probate of William McJannet who died in 1898. A brochure explaining Legacy's work and the facilities they provide. It is aimed at the widows to inform them of what is available to them and it outlines the times for classes for the children. The earliest copy in 1944 included the charter of Legacy and headings in red printing. 'Melbourne Legacy offers friendship and help to the dependants of our departed comrades.' Headings included: Help and advice to mothers or guardians; Mothers' Club; Senior Widows' Club; Housing and repairs; Legal advice; Medical, dental and optical care; Education, Employment, Camps and holidays, Christmas party, Residences, Junior Legacy groups. The notation H26 in red pen shows that it was part of the archive project that was trying to capture the history of Legacy. Tait collection: item 57 of 62 This document gives details of the Will and Probate of Thomas Sleeman, a Nirranda farmer. He died in 1900 at the age of 85 and left real estate to the value of £600. The main beneficiaries were his sons and £30 was left to Mary Le Couteur, his daughter. He also bequeathed to the Wesleyan Church the half acre of land that the church was on at that time (presumably in the Nirranda district). The document has been drawn up by the law firm of O’Mahony and Murray which operated in Warrnambool early in the 20th century. The document has been passed down to successive lawyers occupying the legal premises in Kepler Street and located there in 2014 in the same building, the premises last occupied by the law firm of Mackay Taylor. This document is of some interest as it gives details of the Will and Probate of Thomas Sleeman, a farmer from Nirranda.This is a piece of white paper folded in two to make four pages. Three of the pages are ruled with blue lines and have margins ruled in blue. There is handwritten material on three pages. A seal of the Supreme Court of Victoria is attached with green ribbon and there are nine red stamps of the Master in Equity of the Supreme Court and one purple stamp of the Savings Bank (Head Office). The document is a little stained and the writing is fading but legible. The document gives details of the Will and Probate of the Nirranda farmer, Thomas Sleeman who died in September 1900. Tait collection: item 43 of 62 This is a document giving details of the Letters of Administration of John Moloney, a farmer from Bushfield, who died in July 1897. He died intestate but had real estate to the value of £510 and personal estate to the value of £142. The beneficiary was his wife, Mary Ann Moloney. The lawyer involved in drawing up this document was William Ardlie, one of the best-known lawyers in Warrnambool in the 19th and 20th centuries. He commenced his business in the 1860s and continued on until the 1930s when he was well in his eighties, making him at the time the oldest practising lawyer in Australasia. The document seemed to have been passed down by successive lawyers occupying the Kepler Street legal premises and located there in 2014.This document is of some interest as it gives details of the Letters of Administration of John Moloney, a 19th century farmer from Bushfield and it also concerns the lawyer, William Ardlie, a prominent Warrnambool lawyer at that time. It will be useful for researchers.This is a piece of cream-coloured thin parchment paper folded in two. It has handwritten material on two pages (black ink) containing details of the Letters of Administration following the death of John Moloney of Bushfield in 1897. This Directory of 1889 covers the location of Melbourne based trade and professional offices by street and in Alphabetical order. It covers all of Melbourne and its suburbs. It also covers government and official, ecclesiastic, legal, municipal and miscellaneous information. The directory details a cross section of a developing city with a splattering of advertisements opening up an in depth look of all aspects of living in the late 1800s. It is interesting to see that all the advertisements do not have any telecommunication numbers listed (personal shoppers or mail orders only). This was a period of high moral standing within the community and hotels advertised rooms " suites of rooms for families and single rooms for Ladies and Gentlemen" also "electric bells throughout the house. Telephone, night porter and hot and cold baths."This directory would be used by the majority of families and businesses working and living within the Kiewa Valley and the surrounding area. Melbourne was the only place where every aspect of living requirement was catered for. Although the delivery of services and goods were not at a high rate, certain items or transactions would require a visit to "the big smoke". Business information are listed both by suburb and alphabetically. There is also a section for British and Foreign Trade. This directory covered nearly everything to do with commerce, an example pay days for principle firms. Greater evolution of trade locations started to balloon out after the mid 1950's. Increased populations and greater levels of communication and safe fast transport facilities permitted greater devolution of commercial enterprises into rural communities, such as the Kiewa Valley.This directory has no front or back cover and is held together by its cloth spine. It contains over 1300 pages, however there may be some pages missing front and back of the directory which would have contained advertisements of some unknown shops. All the sides of this directory (except the spine) have advertisements and content information stamped on. The spine cover has been placed in the directory until further conservation work is carried out. It has gold coloured printing and in the central section, a gold coloured background with the words "Sands & McDougall's Melbourne Directory 1889." The spine has three adverts on the spine.On the spine in gold colour "South * British insurance Company Fire and Marine. Photograph: Julia Gillard and Betty Borchers A collection of busts of all past Australian Prime Ministers is displayed in the Ballarat Botanical Gardens. This photograph was taken when Julia Gillard unveiled her sculpture on 14 October 2014. Only two ex-Prime Ministers (including Gillard) have attended their own unveilings. Gillard was a lawyer before entering politics. She was the 27th Prime Minister of Australia from 2010 to 2013 and the first Australian female prime minister. Kevin Rudd successfully challenged Gillard's leadership in 2013 and he went on to lose the election. Julia Gillard resigned from parliament following the leadership challenge. Betty Borchers worked as a legal secretary. This document has been published with the Certificate of Incorporation under the Companies Act 1938 limiting the Company by Guarantee. The Special Licence grants dispensation for the use of the word "Limited". The Special Licence was granted by the Victorian State Attorney General T.W. Mitchell whose father-in-law was Harry Chauvel (led the calvary charge at Beersheba during World war 1). This document records the legal status of 'Junior Legacy, Melbourne' in 1952. Melbourne Legacy has had name changes over the years. In September 1952 Junior Legacy Melbourne was incorporated. Under the provisions of the Companies Act 1938, it was registered as a company with limited liability without the need for 'limited' in its' name (see page 1). James Stewart Noel Harris was born in Rutherglen on 21 March 1905 to John Richards Harris and Jessie Lily nee Prentice. His father was a doctor in Rutherglen. John later entered politics and was knighted for his services in May 1937. After finishing his secondary schooling James (Stewart) Harris moved to Melbourne to study law, becoming a resident of Trinity College in 1925 and rising to become Senior Student in his final year, 1928-29. He enlisted in the Air Force Cadets at Point Cook in 1925 and transferred to the Air Force Reserve in 1930. On 7th October 1940 James transferred to active service as a Flight Officer. He worked his way up the ranks, being appointed Wing Commander in 1944. He also served as Chief Instructor of the RAAF School of Administration, receiving the RAAF Long Service Commendation. The RAAF School of Administration and Special Duties had moved from Ascot Vale to Trinity College in 1942 meaning that James Harris' service career had returned to the place it began in 1925. In 1945 he requested to be transferred back to the Reserve so that he could resume his civilian life. On discharge, James returned to Wodonga and resumed his legal career. In the early 1930s he had joined the legal practice of Mr. Edmondstone which had opened for business in High Street, Wodonga in 1886. The practice continued to develop and in 1966 was joined by Lou Lieberman, becoming known as “Harris Lieberman & Co”. Harris Lieberman still operates in Wodonga and Albury. James Stewart Noel Harris died in Wodonga on 30th November 1978.This item is significant because it recognises the War Service of a prominent citizen of Wodonga.A colour printed certificate presented to James S. N, Harris in appreciation for his service for "King and Empire" during World War II. The text is surrounded by columns and an arch. The Australian and British flags are at the top as well as representations of the Navy, Army and Air Force. It also features the logo of the Shire of Wodonga above the text. The badge of the Commonwealth Armed Forces is at the centre bottom of the certificate. This small collection also includes black and white photographs of James Samuel Noel Harris in uniform and also saluting on presentation of an award recognising his service in 1942.On Certificate: PRESENTED TO James S. Photocopied file of corresponence and documentation relating to a claim by L.J. Mills, Nurseryman, that adjoining property owner, J. Collins, Farmer, assists with replacement of a vermin proof wire netting dividing fence destroyed by 1939 bushfire. File includes 1939 and 1940 detailed property inspection reports by Vermin and Noxious Weeds Branch, Lands Department, Lilydale, describing land use in the area and signs of vermin activity. Application approved 18th April, 1940. Appeal lodged by Mr Collins disallowed in May, 1940. File closed June, 1940 with Departmental suggesion that Mr Mills consider further legal action through a Solicitor as fence had still not been wire-netted. TRANSCRIPTS: Vermin & Noxious Weeds Inspection Reports "19/9/1939 (To) Superintendent (Department of Lands and Survey, Melbourne) Re L.J. Mills application for Vermin Proof Fence. I called on Mr Mills yesterday 18th instant in connection with this matter. Mr Mills has a flower farm and claims that rabbits and hares are damaging his flowers. He showed me a bed of carnations which he stated were being damaged by rabbits. There was evidence of some leaves being nipped off, but I am unable to say whether this is due to rabbits or grubs. Very little if any real damage is being done. The property is netted on the east and south boundary and on half the north and west boundary. The surrounding country is undlating and fairly steep in places. The land to the east across Grandview Avenue (sic) is all planted out in old established orchards and well cultivated. Cleared grass land adjoins the south boundary and bush land adjoins the north and west boundaries. I walked over a large area surrounding Mr Mills land and never saw any rabbits or hares or any indications of rabbits. This locality is not rabbit infested and very little wire netting is being used. I do not consider that a vermin proof fence is necessary between these allotments. - Jas H Allison (Inspector, Vermin and Noxious Weeds Branch, Lands Department, Lilydale)." Follow up report following renewal of application for Certificate by Mr Mills, citing rabbits causing considerable damage to his flowers. He laid poison and obtained 9 carcases and stated that there is evidence of rabbit infestation from the adjoing land. "19/3/1940 (To) Mr Hannah (Superintendant, Department of Lands and Survey, Melbourne) Re L.J. Mills, Grandview Grove Ringwood, Lot 4 Grandview Estate Pt CG20 Ph of Warrandyte. I interviewed Mr Mills at his home on 15th inst. He showed me carcases of rabbits which he stated had been poisoned on his land. In places young plants had been nipped off apparently by rabbits. I made an inspection of adjoining properties and found one live burrow close to Mr Mills northern boundary. There were scratches and other evidence of rabbits on land north and west of Mr Mills property. In view of the present evidence of rabbits I consider that a vermin proof fence is now necessary to protect the flowers grown by Mr Mills. His land is netted on whole of east and south boundary and half way on west and north boundary. Letter, Set of two letters, carbon copy, typed by Mr Lewis Russell to Mr. R. A. Spencer while on tour with Mr Bell in 1938. See Reg Item 934 for the report. The two letters give the nitty gritty of the going-on's at the time in the MMTB. .1 - three quarto sheets, stapled in the top left hand corner, dated Monday 2 May, outlining activities at home. The main point is a O'Meara - Eakins appeal which involved extensive legal advice about titles, positions etc. Mr O'Meara title noted as chief draftsman. Notes names of various legal figures such as Mr. Herring KC. Also notes Cr. Gray, Cr. Gorman, Mr. Bell (Jnr?), Mr Cass. Appears that Mr. McGlashan "has been dipping his beak into the flowing bowl" and had been dismissed. Appears he was collecting the fees from the Wattle Park Golf course. Letter continuation of 4 May - appeals still going on, the death of Mr Monsbourgh and dismissal of Mr. Ellis and a 3rd sheet dated 9th May. Reports on drawing up a lease for a Mr. Better, snow and some personal family matters? .2 - letter dated 3/8/1938 Has notes re Mr O'Connor and the benefit society, retiring gratuity, costs, Mr Guice, Mr Richardson. The Powder Magazine was built in 1859 by T Dawson and Company for fifteen hundred pounds and was restored in 1966 by the National Trust. The building was constructed to store black-powder used by miners on the goldfields for blasting for mining and quarrying as legally, miners had to leave bulk gunpowder the Powder Magazine overnight. Due to the passing of an 1857 act regulating the importation, transportation and importation of black powder, several Powder Magazines like the Beechworth Powder Magazine were constructed. The Magazine Powder is uniquely designed to ensure that in the chance of an explosion, the explosion is minimalized by travelling vertically rather than horizontally. The Powder Magazine was constructed using granite, slate roofing and a high stone wall and includes several safety features including wooden nails, lightning rod and a solid outer wall. This photograph is historically significant as it documents the development of laws related to mining, the actions taken to ensure the safety of those nearby potentially dangerous equipment and the architectural skills to design a storage facility to minimize damage caused by a potential explosion. This ledger appears to have been a mortgage document held by the law firm of Mackay Taylor and Co. with the evidence for this the presence of two loose sheets of paper in the ledger with that firm’s letterhead. Mackay Taylor was established in 1893 with the merger of the firms of George Sutherland Mackay and James Fletcher, independent practising lawyers at the time. The new firm became Fletcher and Mackay and later changed to Mackay and Taylor when J. McD. Taylor became a partner in the 1920s and the business was at 131 Kepler Street, with a new building erected in the late 1920s. The legal business closed in the 1990s with the mortgage section of the firm becoming Mackay Taylor Securities in 1990 (later Southern Securities). The ledger was recovered when the building was being cleared out and Percy Eccles, a real estate agent, handed it to the Warrnambool and District Historical SocietyThis ledger has considerable significance as an example of a law firm’s business activities in the mid 20th century. Tait collection: item 29 of 62 This document contains information on the Will and Letters of Administration of James Jones, a gardener from Warrnambool. The document indicates that he died intestate in August 1896 at the age of 57 but details of a will are included in the document. The fact that this document was drawn up 14 years after his death indicates that there was a problem with the will. James Jones left real estate to the value of £80 and personal estate to the value of £10. The sole beneficiary was his widow, Mary Ann Jones. No other information has been found on James Jones. No Warrnambool lawyer is mentioned in this document but it was located at the former legal premises in Kepler Street of Mackay Taylor and passed on to the Warrnambool and District Historical Society in 2014. It is presumed that it had been passed down to successive lawyers occupying the same building since 1910. This document is of interest because it contains information on the Will and Letters of Administration of a Warrnambool resident, James Jones. It will be useful for research.This is a cream-coloured piece of parchment paper (1910) folded in two with handwritten material on three sides. The first page has black printed material in script with the information filled in in black ink. It contains the information on the Will and Letters of Administration of James Jones, a gardener from Warrnambool. The paper is ruled on one side with black lines. Tait collection: item 41 of 62 This document gives the details of the Will and Probate of Henry Phillips who died in Warrnambool in 1895 at the age of 55. He came to Australia from England in 1861 and established a hay and corn store in Liebig Street, Warrnambool. He was a prominent member of the Congregational Church and lived at ‘Ilfracombe’ in Lava Street. He and his wife Emma had eight children, two of whom had businesses in Warrnambool. Henry Phillips left personal estate to the value of £521 and the beneficiaries were his wife, Emma and their children. This document came into the possession of a Warrnambool lawyer, Ernest Chambers and passed down to successive lawyers occupying legal premises in Kepler Street. The document was located in this building in 2014 in the former premises of the law firm of Mackay Taylor. This document is of considerable importance as it contains details of the Will and Probate of Henry Phillips. He was a prominent businessman in Warrnambool in the 19th century. The document will be useful to researchers. This is a cream-coloured piece of parchment paper folded in two and containing the Will and Probate details of Henry Phillips, a Warrnambool hay and corn merchant who died in 1895. The document has handwritten material (black ink) on three sides of the paper. A seal of the Supreme Court of Victoria is attached with a green ribbon and there is one red stamp of the Master in Equity of the Supreme Court on the second page. These are personal documents that belonged to Henry Roberts Parrington. They include statements regarding his preliminary and final examinations that qualified him as a lawyer in England (1867, 1873), annual certificates of registration as a lawyer in New Zealand (1876-1886), personal affidavits presented to the Supreme Court of Victoria and permission to practise as a lawyer in Victoria (1886). Henry Roberts Parrington qualified as a lawyer in England in 1873 and worked as a barrister and solicitor in New Zealand from 1876 to 1886. He then came to Australia and worked for the legal firm of Messrs Higgins in Geelong and Bayly and Higgins in Warrnambool. The business in Kepler Street, Warrnambool later became known as Higgins and Parrington and, in 1900, as Parrington and Tait (partner John Sym Tait). When John Tait retired in 1901 Henry Parrington was the sole proprietor of the practice. He died in Melbourne in 1926. These documents have some significance as they are original papers documenting Henry Parrington’s early years as a lawyer. He was a prominent lawyer in Warrnambool in the late 19th and early 20th centuries. These sixteen paper documents relate to the lawyer, Henry Roberts Parrington. They are all original documents from England, New Zealand and Australia (Victoria). Most have printed material on them. All have statements and information handwritten in black ink and many have stamps relating to the country concerned. Some are foolscap size and are printed on blue paper.
