The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. Set of three documents that were prepared to explore the concept of reusing the Royal Exhibition buildings and providing a Vintage tram route between them and the City. The first, an extensive report by The Met is an Addendum to the Fitzroy Feasibility Study of August 1986. The second is a document titled "1888 Street: A proposal for a Museum of Victorian Home and Street Life by Charles Sowerwine, University of Melbourne, and a handwritten note about the possible tram service and its operation written by Doug Prosser commenting on the proposal. The magazine was edited by Reverand R.C. Nugent Kelly as an Anglican Church publication. Reverend Kelly: Born in 1858 to Robert George and Mary Kelly (nee. Walker) of Birkenhead, England. Married Emma Louisa Edith Cremer in 1882 in England Died 11 Oct 1936 in Hornsby Shire, New South Wales, Australia Kelly joined All Saints Bendigo in 1896 where he edited the 'Our Own Magazine' and established a reputation for effective financial management. He left Bendigo in 1901. Much of his life was spent dedicated to church work which was documented as early as 1890. Now known as Old All Saints Cathedral, the church is located on the Northern corner of Mackenzie Street and Forest Street. The church was closed in 2015 and has remained abandoned. The church is located across the street from Bendigo Historical Society on Mackenzie Street. The Lambeth Conference: "The first Lambeth Conference took place in 1867 when the Archbishop of Canterbury, Charles Thomas Longley, invited the bishops of what would become the Anglican Communion to gather for a conference at Lambeth Palace.... There were two main issues that led to this invitation: First, a growing desire, expressed by many bishops around the world, to gather in order to pray, to study scripture and to confer together and, second, to address difficult pastoral and theological issues that were causing divisions between bishops around the world. These issues related to how the Christian gospel was and should be expressed in different cultures... Over successive Lambeth Conferences the mind of the bishops was expressed through published resolutions. These resolutions have touched on every area of the life and mission of the church... It has encouraged and enabled significant decisions to be made by the member churches" The 1897 conference resulted in 62 resolutions including the desire and establishment of regular conferences every ten years.1 October 1897 Edition of 'Our Own Magazine: A Church Monthly for the People'. The book was used by Charles Bacon who studied at the University of Nevada in the late 1930s/early 1940s. Bacon worked at Bunker Hill Mines and Kellogg Idaho, before arriving in Australian in 1951. He worked for CN Myers, a company involved with paper converting. CN Myers was a family business (on Charles Bacon's maternal line). Baron Sir Ferdinand Jacob Heinrich von Mueller was born in Germany on 30 June 1825. Ferdinand was a German-Australian physician, geographer, and a botanist. After passing the pharmaceutical examinations he studied botany at Kiel University. In 1847 he received the degree of Doctor of Philosophy from Kiel University.when he was 21 years old for a thesis on the flora of Schleswig-Holstein. In 1847, he moved to Adelaide, Australia and worked as a chemist. From 1848 to 1852 he travelled through the colony, discovering and describing a large number of unknown to Western science plants. He wrote a few papers to German periodicals on botanical subjects. In 1851, Mueller moved to Melbourne, capital of the new colony of Victoria. In 1853, He was appointed Government Botanist for Victoria by Governor Charles La Trobe. In 1873, Ferdinand received an honorary doctorate of the University of Rostock. In 1883, he was awarded the Clarke Medal by the Royal Society of New South Wales. He published many volumes on the Victorian plants. Many of Australian geographical features were named after him such as: the Mueller Ranges (WA), Muellers Range (Qld), Mount Mueller (in WA, NT, Tas and Vic) and many more. Mueller died in Melbourne on 10 October 1896 and is buried in the St. Kilda Cemetery A green cloth hard cover book. Title and author's name is engraved in gold on spine. This album was likely compiled by Freda Oxley, a friend of the Sellers who stayed with them at the Mission for a few years. The couple arrived in January 1925, replacing Mr and Mrs Gurney Goldsmith and stayed until January 1929. The photographs bear the stamp "Herschell's Prints - Pathe Agents". Charles Richard Herschell founded a film Production studio of the same name operating at 31 Agnes Street, Jolimont from 1925. A similar album by Freda Oxley with similar handwriting in white ink was donated to The National Library of Australia by her niece. Music in the Open Air was an initiative of Frank Wright, the Musical Director of the Greater London Council Parks Department. Frank Wright was a renown resident of Smeaton, where he was born in 1901. He lived at Laura Villa, and attended Smeaton State School. His father William was a gold miner and his mother's name was Sarah. He was the youngest of eleven children. Their family won many singing and instrumental awards. Frank was tutored by Percy Code and was awarded a gold medal for the highest marks in the ALCM examinations in the British Colonies at the age of seventeen years. He became the Australian Open Cornet Champion by the age of eighteen. A year later, Frank conducted the City of Ballarat Band, and later the Ballarat Soldiers’ Memorial Band. He formed the Frank Wright Frisco Band and Frank Wright and his Coliseum Orchestra. These bands won many South Street awards, and Frank as conductor won many awards in the Australian Band Championship contest. In 1933 Frank Wright sailed to England to conduct the famous St Hilda’s Band and was appointed in 1934 as the Musical Director of the London County Council (the GLC or Greater London Council), where he organized many amazing concerts in most of the 150 parks, in and around the London district. He was also responsible for some of London’s major concerts at Kenwood, the Crystal Palace and Holland Park. He was made Professor of Brass and Military Band Scoring and Conducting and was a Fellow of the Guildhall School of Music and Drama. Frank was often invited to adjudicate Brass Band Championships around Europe, in Australia, including South Street and in New Zealand. Frank was awarded an M.B.E. in 1967 and he died in November 1970. The Gregory Hall was built on the grounds of All Saints Uniting Church, Chapel Street, East St Kilda in 1910-11. It was used for assemblies and classes at the All Saints' Grammar School which, after faltering fortunes, closed in1937. It was then leased to Zercho's Business College, founded in 1911 by Frederick William Zercho (the brother of Charles Henry Zercho, who was headmaster of the All Saints Grammar School in 1913-1919). The certificate, dated 16 August 1938, is a birthday greeting addressed to F. W. Zercho that also acknowledges one year since the establishment of the Gregory Hall branch of the college. It is signed by the headmistress, staff and students. Zercho's Business College became the largest business college in Australia. In 1968 it was sold to Stott's Business College.Two page certificate in leather bound folder: two sheets of white paper, handwritten and decorated with ink of multiple colours and each affixed to a board. The boards are covered with blue-dyed leather, decorated with gold ink, and were once joined together to form an outer cover for the pages. One sheet carries on one side a message to FW Zercho Esq that has been written in decorative calligraphy, and signatures. Charles Symons Wingrove, J.P. (1829-1905) arrived in Victorian in 1851. He had trained as an engineer, but tried his luck on the goldfields. In 1857 he was appointed as Secretary to the Eltham District Roads Board only one year after its foundation. He was to hold the position with the Board and later the Eltham Shire Council for total of 47 years. He also held the position of engineer for a large part of this period. During part of this time he was also secretary to the Heidelberg Shire Council. Over this period he was responsibly for an area stretching from Clifton Hill to Healesville, along the northern bank of the Yarra River. Other positions included Secretary to the Victorian Agricultural Society over along period.Wingrove was a main figure in the Municipal Association of Victoria. By the time he retired he was recognized as the “Grand Old Man” of Victorian local government. In 1858 Wingrove had a brick cottage built in Main Road near the State School and he lived here until his death. One room was uded as the Board and Council office. His descendants owned the house until 1974. It was later used as a psychiatric clinic. The park opposite the cottage has been named Wingrove Park in his honour. He is buried at St Helena with other members of his family. Age (Melbourne, Vic. : 1854 - 1954), Tuesday 18 July 1905, page 5 ABOUT PEOPLE. A conspicuous figure in northern municpal history, Mr. Charles Symons Wingrove, has passed away. He was for many years secretary and engineer for the shire of Eltham, and prior to the formation of the shire held the position under the old road board, his official connection with the district dating from beyond 1857. For about twelve years he also filled the position of shire engineer for Heidelberg council while retaining his other post, and the immense territory under his professional control, reaching from the boundary of Collingwood up to Healesville, was a matter of fatherly pride and interest to him. He arrived in Victoria in 1851, and was 76 years of age at his death. Mr. Wingrove retired from the position in the Eltham council only about a year ago. William James Capewell, Ernest James Andrew and George Harrison all of Eltham collected the sum of £150 towards the purchase of Lot 20 Henry Street and whereby a Contract of Sale dated 30 December 1921 agreed to purchase (as Trustees of The Eltham Hall to be used in perpetuity for the benefit of the inhabitants of the Eltham District) the land, furniture, fittings and chattels from Jack Alfred Harrison, George Hugh Bird and Edward Samuel McColl for £750. The first President was declared to be Ernest James Andrew, Honorary Secretary, A.J. Morse, Honorary Treasurer, Charles Robert Nicholls and the first elective committee to be Thomas Nunn Jewell, William John Pasco, George Burchall, William James Burgess, John William Cox, Ernest James Andrew, John Michael Ryan, Frederick William Gillespie Didfield, Charles Harold Williams, Joseph Banks, Laurence Bourke, Charles Robert Nicholls, William James Capewell and James Pascal.
