The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. Set of three documents that were prepared to explore the concept of reusing the Royal Exhibition buildings and providing a Vintage tram route between them and the City. The first, an extensive report by The Met is an Addendum to the Fitzroy Feasibility Study of August 1986. The second is a document titled "1888 Street: A proposal for a Museum of Victorian Home and Street Life by Charles Sowerwine, University of Melbourne, and a handwritten note about the possible tram service and its operation written by Doug Prosser commenting on the proposal. The date of this map or plan is uncertain but it appears to be from the early to mid 1870s. One of the landholders identified on the plan, James Allan of Coimadai died suddenly on the 9th July, 1874 (see Bacchus Marsh Express, 11 July, 1874, page. 3). Schuss was advertised as Victoria’s Official Ski Journal It was issued monthly from 1935 to 1961 except during the war when summer issues covered two months. This continued after the war, but it averaged 10 issues annually over its 25 year life. Schuss was published by the Ski Club of Victoria which had a membership of 38 Ski Clubs and demanded to be recognised as the prime authority on skiing in the state. The other 30 ski clubs with 85% of the members disagreed and the politics of skiing became heated. These clubs formed the Federation of Victorian Ski Clubs with their own journal, Ski Horizon. With the establishment of the Victorian Ski Association, Ski-Horizon published its last issue in Nov - Dec. 1955 and the role of the official journal was fully taken over by “Schuss”. This item is significant because it contains stories, images and information documenting the development of the ski industry in Victoria.The journal features stories and events chronicling developments in Victoria and internationally. The cover features a photo of Charles Bozon in a happy mood at Mt Buller as he balances on the toe of one ski supported by ski poles. The photo was courtesy of Eric Burt. Charles Bozon Jr. (15 December 1932 – 7 July 1964) was an alpine ski racer and world champion from France. The Mayor's room was traditionally a private space in which the Mayor met with visitors and official guests. The signatures in this Visitor's Book reflect the breadth of community members who were received by Mayor's throughout the 20th century. From local people to overseas dignitaries their signatures are recorded for prosperity as evidence of their visit to Bendigo. Signatures include the Duchess and Duke of York (Later the King and Queen of England) who visited on the 28th April 1927 as part of their national visit which coincided with the opening of Parliament House in Canberra. Royals Prince Charles and Lady Diana signed the book on the April 15th, 1983 and Prime Minister John Howard and Members of Cabinet in 1998. Large tan leather and green cloth bound book. 390 lined pages each with three ruled vertical columns titled; Name, Address, Remarks. Marbled front and back end papers. Handwritten copy of a newspaper report on an explosion at the New Chum Consolidated Mine. The explosion occurred about 7.30 am on Friday 21/1/1881 when a fire broke out in the engine house. Some dynamite and caps had been placed in the engine house for convenience sake. Seven men were injured. They were T. The two land auction plans shown in this record relate to the sale of land from the Glenmore Estate property. The Glenmore property was established by C.J. (Charles James) Griffith and James Moore around 1840. Moore sold his interest to Moelesworth Greene in 1848. Greene was the nephew of the other owner Charles Griffith who died in 1863. From around the 1870s onwards parts of the Estate were subdivided and put up for sale or lease. In subsequent decades more changes in ownership occurred. These two plans document another major sale of the land from the original Glenmore Estate including part of the estate which had become used for dairy farming and was at that time known as the Glenvale Estate. Two single page maps pasted together on a single page of a bound volume of maps. One map shows 15 separate lots of land for sale. The other map which has the words 'Glenvale Estate' at the top of the map shows 4 lots of land for sale. Both parcels of land were originally part of the Glenmore Estate a pastoral holding belonging to C.J. Griffith and James Moore which the began in the Rowsley area south west of Bacchus Marsh in the 1840s. The maps are pasted into a bound volume containing 76 maps or plans in total. This album was likely compiled by Freda Oxley, a friend of the Wellers who stayed with them at the Mission for a few years. The couple arrived in January 1925, replacing Mr and Mrs Gurney Goldsmith and stayed until January 1929. The photographs bear the stamp "Herschell's Prints - Pathe Agents". Charles Griffith was born in Kildare, Ireland in 1808. He studied at Trinity College, Dublin acquiring a B.A. in 1829 and an M.A. in 1832 before being admitted to practice as barister. In 1840 he emigrated to Australia arriving in the Port Phillip District in November 1840. Soon after arriving he and his friend James Moore formed a business partnership and acquired land in the Parwan Valley near Bacchus Marsh. This land had been in the possession of a Mr. McKenzie who agreed to sell his land and sheep to Griffith and Moore. The property they acquired came to be known as Glenmore. The partnership with James Moore lasted until 1848. In 1846, whilst in Ireland, Griffith married Miss Jane Catherine Magee, then returned to Glenmore and later took his nephew, Molesworth Richard Greene, into partnership, which arrangement proved to be long and prosperous. In 1857, they bought runs at Mount Hope and Mount Pyramid, which they kept until the days of free selection. Griffith led an active and successful public life. He was a member of the new Victorian Legislative Council in 1851, and was later an elected representative of the Legislative Assembly 1853-1859. He occupied many important public positions, including that of magistrate for Bacchus Marsh. Griffith was a devout Anglican and hosted Bishop Charles Perry at his station near Bacchus Marsh in 1849. He died in 1863 at his home in South Yarra. The diary is a detailed account of Griffith's voyage from Ireland to Australia and of his early months in Melbourne. After this it covers his early months establishing himself on his property, Glenmore, near Bacchus Marsh. The timeline of the diary stretches across 1840 and 1841. Griffith was an educated gentleman who made detailed observations about the environment he found himself in. The diary is particularly notable for Griffith's commentary about his interactions with people from first nations, and reveals some of his thinking about Colonial policies directed at first nations people. The diary also includes some sketches of individual first nations people along with some sketches of flora and fauna. The final part of the diary includes a glossary of Aboriginal words Griffith was familiar with. Digital file. PDF format.
