These books contain reports of the Supreme Court of Victoria in 1960 and 1961. They came from the Ardlie family, members of which have been associated with Warrnambool and legal affairs since the early 1850s. John Ardlie came to Warrnambool in 1852 as the Clerk of Courts and his son William Ardlie was a prominent lawyer in Warrnambool for over 60 years. If it is this William Ardlie’s stamp in these volumes then it was used after his death. The signature is of John Ardlie, also a lawyer in Warrnambool and Port Fairy in the later decades of the 20th century.These volumes are of interest as they are connected to members of the Ardlie family, prominent lawyers and community members in Warrnambool in the 19th and 20th centuries.These are two volumes of law reports of the Supreme Court of Victoria– hard cover books with dark green covers and spines with red and gold bands and gold print. C. Glover and Sons Pty. Ltd. was founded on Brougham Street, Geelong c.1870. They operated as a wool and sheepskin storeroom situated on both sides of Brougham Street; where the current Elders building is located. The store was owned and operated by Joshua Glover with his brother Cyrus. A third brother Arthur also worked at the store. It was a very successful business and employed up to 40 men at its peak. Cyrus Glover died quite young, around 54, with his son Howard taking his place in the partnership at 23. During the Second World War the business was requisitioned by the Australian Government. Their wool was utilised to produce defence uniforms for Commonwealth personnel C. Glover and Sons was a very successful business which reluctantly closed its doors around 1975, as a result of the wool industry taking a downward turn Australia wide. It was decided by the family that this was the only option at the time. Howard Glover was Jan Glover’s (donor) father in law. Jan Glover donated these images to the National Wool Museum in 2021. On December 17,2007 the Carols by Candlelight launch was held in the City Square. With music by John Foreman, the McClymont sisters, Anthony Callea, Australia Girls Choir and others, Santa and live crosses from Channel 9 weatherman Steve Jacobs, there was much for attendees and passers by to be entertained by. Deakin University was established in 1974 as the fourth university in Victoria. It has a number of campuses around the state including Warrnambool where it merged with The Warrnambool Institute of Advanced Education in 1990. The university was named after Alfred Deakin, three times Prime Minister of Australia and leading figure in the process of Federation in Australia. Each year a number of students graduate from the Warrnambool Campus which is located on the Eastern edge of Warrnambool on the banks of the Hopkins River. In 2015, there were graduands from the faculties of Arts and Education, Business and Law, Science and health. Deakin University occupies an important educational position In Warrnambool and district. Joseph Anderson Panton lived through the entire reign of Queen Victoria and in over 60 years of being in Australia saw the country advance from the earliest gold-rush days through to the first decade of Federation. The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. Flavour of Eltham: recipes and other things was collected and published by the Friends of Shillinglaw Cottage in 1964. The original cottage once stood about 100 metres away from its current location in Panther Place, Eltham. Built in the 1870’s, it is one of Eltham’s earliest buildings. In 1963 it faced demolition to make room for the Eltham Shire offices. But local residents came together to save the cottage. It was the first time that an early settler’s brick building was removed and reconstructed. A fundraiser was the resident’s compilation of loved recipes into the cookery book Flavour of Eltham. It also includes illustrations and advertisements for local buisnesses. The foreword of the book states: “This book is about Eltham. But more than that it is about intention. It originated when the people of Eltham, the first in Australia to preserve the reconstruction an historical building, removed and rebuilt a cottage that reflected the spirit of a period. The shilling law cottage was first built in 1859 and was rebuilt in 1964. It has beauty and is rich with the past. The people of Eltham stand for something. There is, in this community, a firm resolve to preserve for their children the natural beauty of the district; to establish a centre whose allegiance is to aesthetic values rather than to commercial ones. Eltham already has this reputation, a reputation that is known beyond the borders of Australia. Its desire is to increase it. This book is a step forward in that direction.” October 1964. Charles Meynell Pitt Withers (aka Bill) was the youngest son of artist Walter Withers and Fanny (nee Flinn). He was born at Eltham 5 February 1902. Tyrrell George Granville Evans was born on 17th August 1892 Enlisted (No. 789) 7 July 1915 as a Private and was assigned to the 31st Battalion. Promoted to Sergeant 1 Nov 1915. Disembarked Suez 7 Feb 1916 Admitted to 32nd Stat. Hospital in France 21 July 1916 with a gunshot wound to the left arm. According to daughter-in-law, Janet Evans, on 19 July 1916, in the battle near Pozieres on the Somme, he was hit by a German high explosive shell and was unconscious and badly wounded. His left arm was shattered, and he had a bullet wound on his leg. Embarked at Boulogne on H.S. Cambria for Middlesex War Hospital, England 24 July 1916. Evans returned to Australia and was discharged medically unfit, 7 April 1917. After months in the Caulfield Hospital his arm could not be saved, and it was amputated 18 July 1917. On July 6, 1918, Tyrrell George Granville Evans married Mary Pitt Withers at Eltham, daughter of artist Walter Herbert Withers (deceased) and wife Fanny (nee Flinn). They had three children, Mary Roberta Evans born February 8, 1921, at Balwyn and twins Shirley and Joyce born June 10, 1922. Mary died 17 days later, June 27, 1922, at Balwyn. Tyrrell had to cope with three children under three years old and a missing left arm. He had been lefthanded before his war injuries. He had help from the family, especially his sister. On August 1, 1924, Tyrrell George Granville Evans married Marian Frances Wilcox and they had two children: Barbara Marian, born 27 July 1925 and Tyrrell Granville, born 3 July 1928. The children were all brought up together in Glen Iris. Tyrrell became renowned as a one-armed golfer and tennis player. He was Senior Vice-President of the Lawn Tennis Association of Victoria and was on the committee of the Metropolitan Golf Club. At the time of his retirement, he was General Manager of the Colonial Meat Company. Tyrrell died September 3, 1962 and was succeeded by sixteen grandchildren. Alun LEACH-JONES (1937-24 December 2017) Born Maghull, Lancashire, United Kingdom Arrived Australia 1960 Alun Leach-Jones is recognised as one of Australia's leading abstract colour painters. He spent his childhood in the Welsh village of Glasfryn, Denbighshire. At the age of 14 he started a three year apprenticeship with the Solicitors Law Society, Liverpool illuminating manuscripts and hand copying legal documents. While working with the law society Leach-Jones studied painting and drawing in the evenings at the Liverpool College of Art between the years 1955-57. He immigrated to Australia in 1960, settling in Adelaide and attending the South Australian School of Art, after which he travelled and exhibited throughout Australia and abroad. In 1966 Leach-Jones celebrated Noumenon series was shown with Australian Galleries in Melbourne and he was immediately recognised as being part of what was then labelled as ‘the New Abstraction’ in Australian art. Later in 1968 his work was included in the influential exhibition "The Field" held at the National Gallery of Victoria. This item is part of the Federation University Art Collection. Sculture in bronze of Alan Marshall by Marcus Skipper, 1995 Alan Marshall, AM., O.B.E., Hon.LL,D. (1902-1984) was born at Noorat, Victoria and became one of Australia's most famous authors. His association with the Eltham area began in 1920 when he started his first job as a junior clerk at the Eltham Shire Offices, Kangaroo Ground. In the 1940's he spent some time living at Research. From 1955 he lived in Eltham for nearly 20 years. Disabilities resulting from polio as a young child did not prevent a wide range of experiences. Alan's occupations have been listed as clerk, night watchman, fortune teller, freelance journalist and author. He has been patron of many disadvantaged Children's Societies. Alan's books are numerous and include novels, short stories, children's books, history and travel. Among the best known are his autobiographies "I Can Jump Puddles" and "This is the Grass". Others include "These are My People", "Ourselves Writ Strange", "People of the Dreamtime"; "The Gay Provider" and "Wild Red Horses". In 1971 he wrote the Centenary History of the Shire of Eltham, "Pioneers and Painters". Covered under National Trust of Australia (Victoria), State significance. The bronze statue, by Marcus Skipper, is of author Alan Marshall, who is famed for his autobiography I Can Jump Puddles, about growing up and overcoming the effects of polio. That plucky little boy later lived in the Nillumbik district for more than 50 years, and on his death in 1984, was buried in the Nillumbik Cemetery at Diamond Creek. Although a hugely successful author, his grave is modest with only a tiny boulder and simple bronze plaque on a grassed plot. From 1955 to 1972 Marshall lived in a tiny fibro-cement bungalow at the rear of a house at Park West Road, Eltham, owned by his older sister, Elsie McConnell. It was there that he wrote most of his autobiographical trilogy and his history of the former Eltham Shire, Pioneers and Painters. His long association with Eltham Shire began in 1918 when his family moved to Diamond Creek. Then in 1920 he began work as a junior clerk at the Eltham Shire Offices on Main Road, Kangaroo Ground near the Yarra Glen Road, while boarding at the hotel next door. Marshall later bought a block of land in Research, which had three bark huts. In one of these he wrote his first book These Are My People. He later sold the land but lived in a caravan there and in 1955 wrote I Can Jump Puddles.1 Proud of its citizen, the Eltham Shire named a park after Marshall at the corner of Main Road and Leanne Drive, Eltham. In 1985 the Shire initiated the Alan Marshall Short Story Award. It was Marshall’s early life in the country that taught him to live courageously in spite of his crippling polio, and he inspired many. This informed his writing – full of courage, championing the battler and love of the bush. Alan Marshall was born in 1902 at Noorat in Western Victoria, as the only son of Billy a drover, horse breaker, hawker and then general store owner. At the age of six, Marshall contracted infantile paralysis and was later hospitalised in Colac for 18 months. With his father’s encouragement, Marshall learnt to swim, wrestle and box, ride a bicycle (downhill), ride a horse and drive a car. Marshall won a scholarship to Stott’s Correspondence College to study accountancy. To help him continue his studies and find employment, his family bought 12 acres (4.8ha), in Ryans Road, Diamond Creek, opposite Windmill Court. There they ran cows, some poultry and an orchard. But life with a disability and during the Depression was hard for Marshall, who for 20 years, endured long periods of unemployment and loneliness and was often exploited at work.2 However, life improved in the 1930s, when he published short stories and articles in newspapers and magazines, including a column of advice to the lovelorn, which he wrote for nearly 20 years. At age 42 Marshall published his first book and in the next 30 years he published more than 20. His most successful book was I Can Jump Puddles, which sold more than three million copies internationally. It was made into a film, released in 1971, by Czechoslovakian director Karel Kachyna. Marshall was one of the first Australians to write about Aborigines who called him Gurrawilla - teller of tales - when he lived with them in Arnhem Land for eight months.3 In 1941 Marshall married Olive Dixon, with whom he had two daughters, Catherine and Jennifer. Marshall and Olive divorced in 1957. In 1972 Marshall was awarded an OBE for his work with the handicapped. He was also awarded an Honorary Doctor of Laws by Melbourne University, an Order of Australia for services to literature and the Soviet Order of Friendship of Peoples.This collection of almost 130 photos about places and people within the Shire of Nillumbik, an urban and rural municipality in Melbourne's north, contributes to an understanding of the history of the Shire. Published in 2008 immediately prior to the Black Saturday bushfires of February 7, 2009, it documents sites that were impacted, and in some cases destroyed by the fires. It includes photographs taken especially for the publication, creating a unique time capsule representing the Shire in the early 21st century. The building was designed by Charles Maplestone of Heidelberg, son-in-law to Anthony Beale of St Helena. Maplestone was a prominent architect who came out to Australia with his family in 1852. The foundation stone was laid by Mrs Isabella Maplestone on 11th November 1867. The bricklayers for the church were George Stebbing, H Limmer, H Spicer and a Mr Timm while Thomas Day was the stonemason. Another three years were to pass before sufficient money could be raised for its completion. It was opened by Bishop Perry on 1st November, 1870. The church bell which hung under a tree for 50 years until it was incorporated in the parish hall was brought out from England and presented by Charles Orme. In 1916, the estate of George Martin Pizzey left sufficient money to build the red brick hall, which still stands today (2023) though in January 1969 the hall and bell tower were badly damaged by bushfire. Coincidentally the former home of benefactor, George Pizzey was destroyed in the same fire. Of particular significance are the interior and exterior of the church, the Sunday school and hall with emphasis on pre-World War I fabric (excluding the 1990s additions) and the three coloured glass windows currently suspended in the 1990s entry foyer. In 2011 further alterations were made to the front of the Church. The church is historically significant because it was the oldest public building in the former Diamond Valley Shire, is amongst the oldest buildings in the Shire of Nillumbik and is associated with the early settlement of the Diamond Creek district. The church is historically, socially and spiritually significant because it has been a place of worship for over 150 years and continues to be, an important meeting place in the Shire. The church is aesthetically significant for the three stained glass windows executed by the noted stained glass manufacturers, Ferguson & Urie, as well as the supporting coloured glass windows in the church. The Sunday school & parish hall is architecturally significant because the hall is a well executed and preserved example of the work of noted church architects, North & Williams. It is historically significant because it is connected with local parishioner and Melbourne industrialist, George Pizzey, who bequeathed funds for its construction. Today the church has a large congregation, but its early years were marked by a small congregation struggling to find enough money to survive. It was gold in Diamond Creek that resulted in the building of this National Trust registered property.1 This church is far removed from William Wilson’s humble barn (later the Bowling Green) where the first Anglican church services were conducted – probably the first in the district.2 In the mid 19th century services were infrequent as the Rev Francis Hales, travelling on horseback, also conducted services elsewhere, including at Heidelberg, Coburg, Kinglake, Arthurs Creek, St Andrews and Kangaroo Ground. In 1860 Diamond Creek came under the jurisdiction of the Eltham Parish. Until the mid 1860s the Diamond Creek settlement included only about 20 families who were struggling farmers. But this changed when gold was found in 1862. Then the township grew to 200 families, including miners, civil administration workers and shopkeepers. The resulting growth of Church of England adherents prompted them to petition the Government in 1866 for land to build a church. The area chosen, on which the original building still stands, was at the centre of the proposed township. Today church leaders believe that this conspicuous location is one of the reasons for its exceptional growth. Prominent architect Charles Maplestone designed the building as he did the Presbyterian Church at Kangaroo Ground. St John’s, which is still intact, was built in the Gothic Revival style with the traditional rectangular plan of a central nave and sanctuary at the end. It is typical of small churches built in Victoria at that time, with polychromatic hand-made bricks, a porch, diagonal buttresses and a slate roof.3 The church was officially opened by Lord Bishop Perry on November 1, 1870. But during the next 40 years, due to the varying fortunes of gold mining, the church struggled to remain viable. In 1909 it separated from the Eltham Parish to form a parish with Greensborough. Life became more difficult with the privations of World War One. Then disaster struck in 1915 when fire destroyed the Diamond Creek Gold Mine, wiping out the major livelihood of most parishioners. However the church’s morale was lifted in 1916, when it received a bequest to build the red brick hall, from late parishioner and prominent leather manufacturer, George Pizzey. As prosperity grew, in 1924 the congregation separated from Greensborough, but they rejoined in the 1930s Depression. In the 1950s the wider population soared, impacting on St John’s, and it became a separate parish, becoming responsible for six churches at St Andrews, Hazel Glen, Hurstbridge, St Helena and Yarrambat. As parishioner numbers outgrew the building, extensions were added in 1989 and then in 1993, blending in well with the original building. Church members have made a huge contribution to the local community. John Ryan was a Heidelberg Shire Councillor for 25 years from 1931, Mayor in 1939 and headed several local sporting and other organisations. His son Jock became a clergyman and a local historian heading the Nillumbik Historical Society. Another parishioner, Dr Ted Cordner, came to Diamond Creek in 1920. One of his sons Donald, who was a local doctor, won the Brownlow Medal, was President of the Melbourne Cricket Club and President of the Melbourne Grammar School Council. Roy ‘Monty’ Vale was a state Liberal MP and was related to May Vale, a member of the Heidelberg School of Artists.4 In the early 21st century St John’s Anglican Church is one of the fastest growing congregations in Melbourne. This instrument was used by Dr Fritz Duras (1896-1965), who moved to Australia from Germany in 1937. As his father was Jewish, Duras was forced to leave Germany, and came to Australia to take up a post as director of physical education at Melbourne University. This instrument was part of a collection of instruments given to his son-in-law, Dr Michael Kloss, who was an obstetrician. Dr Kloss subsequently had it engraved and used it in his own practice, before donating the item to the College. Steel packing forceps. The forceps resemble a pair of scissors in style, with a curved end section. The prongs at each end of the forceps have been flatted and are ridged for grip. The number '314' is engraved on both sides of the inner aspect of the forceps. The initial 'E' is engraved on one side of the inner aspect of the forceps. Caroline Lewers, née Murrell, b. 1867 at Happy Valley, was a daughter of Ambrose and Mary Murrell. Prior to her marriage, Caroline Murrell assisted her mother to manage the Victoria Hotel in Linton. In 1910 she married William Ochiltree Lewers (son of Annie Lewers and Samuel Lewers). Caroline's sister-in-law Lily (Mary Lillian) Murrell, née Young, was born in Birmingham, England, and migrated to Australia with her father James Young when she was seven. In Australia James Young changed his name to Clarke and was known as James Young Clarke (Lily also used this surname). James Young Clarke moved with Lily to Linton, where he ran J Y Clarke's tobacconist and barber shop in Sussex Street. Lily Clarke married William Murrell, son of Ambrose and Mary Murrell, in 1901. They lived at Daylesford and other localities before returning to Linton in about 1912, when William Murrell took over management of the newsagency. Isobel Antoinette McDonagh (her first name also spelled Isabel, Isabell, Isabella) was born in Jamaica in 1847, a daughter of Robert & Antoinette McDonagh. In 1851, in Ireland, Isobel and her sister Jane were orphaned after both their parents died within a few months of each other. In 1855 Isobel and her sister came to Australia with their uncle John McDonagh and his wife Martha (née Mathews). Following the death in childbirth of her sister Jane in 1878, Isobel married her brother-in-law Frederick William Mitchell in 1881. She was the mother of Frederick William Mitchell, Robert Harold Mitchell, Albert Earnest Mitchell, Ida Olive Mitchell and Lillian (or Lily) Isabell Mitchell.Painted/modified black and white photograph which has been printed on glass, depicts a young lady with hair drawn back from face and worn in a bun or chignon at the back, wearing a dark coloured dress with a high neck and some trimming on bodice and sleeves. A narrow frill of white lace(?) is visible above the collar.
