(Victorian Government, 07 December 1945). Tom Kennedy, Jnr, and his wife, Lucy, lived at 109 Pakington St Kew. Tom Kennedy Jnr. died 02 November 1963. Lucy Kennedy died 28 November 1987. "CONTEMPT OF COURT. MILK-CARTER GUILTY. Breach of an Injunction. A Supreme Court writ has been issued by Thomas Kennedy, sen., Thomas Kennedy, jun., Patrick John Kennedy, and Michael Kennedy, trading as Kennedy and Sons, Rose Lea Dairy, against Gordon Allberry Shepherdly, of Barnard street, North Kew, milk-carter, claiming an injunction and damages. Plaintiffs carry on business at Pakington street. Kew, and Melville street, Hawthorn, and they claim In their writ an injunction restraining the defendant from soliciting or endeavouring to obtain the custom of people who were customers of plaintiffs when Shepherdly was employed by them under an agreement dated March 13 1928. Plaintiffs also claim damages. Mr Read (instructed by Messrs. Moule, Hamilton, and Derham) appeared for plaintiffs before Mr. Justice Macfarlan in the Practice Court yesterday, to ask for an order for the committal of Shepherdly to prison, or alternatively, for an order that plaintiffs be at liberty to Issue a writ of attachment against him for contempt of court in soliciting or endeavouring to obtain the custom of plaintiffs' customers. The affidavits set out that Shepherdly was employed by plaintiffs from March I3, 1928. until June 6. 1930. An Interlocutory injunction had been granted pending trial of the action for a permanent injunction. Shepherdly, who appeared in person yesterday, said that he had a sick wife and two children. He had not served any of the customers referred to since the granting of the injunction. He had passed them over to another man for whom he was working. Mr Justice Macfarlan - In doing that you have committed a breach of the injunction, and I have no alternative but to order that you be sent to gaol. I will make an order that you be committed to prison until further order of the Court. I will direct, however, that the order be not executed until Tuesday next. Born in Bendigo and trained as a nurse in the 1950s, Sonia Jill O’Brien devoted a lifetime to social and environmental issues at both the state and local level. From her work in the 1960s with the Family Planning Association of Victoria, of which she was a founding member, through to the 1990s as a member of the Ethics Committee of the Department of Health, she supported efforts to improve women’s health and reproductive rights. At the local level she was most active on committees that worked to save the natural and built environment. The Power-line Action Group, the Studley Park Conservation Society, and the Yarra Bend Park Trust all benefitted from her indefatigable endeavours as well her vision. In 1980, Jill O’Brien successfully stood for the Kew City Council and served as Mayor in 1983 and 1984. With an eye to preserving the past as well as guarding the future, she had the Mayoral robes restored and in 1980 and 1981 was president of the Kew Historical Society. The preservation and restoration of Villa Alba in Walmer Street owes much to her determined efforts throughout the 1980s. On Council, she chaired a number of committees involved in the saving of the Kew River Parklands from the proposed transmission line of the SEC. For many years this painting hung in the offices of the Belfast & Koroit Steam Navigation Company in Port Fairy. It was painted by Arthur Victor Gregory (1867-1957), a water colourist and marine artist. It depicts the Fisheries Investigation Ship Endeavour, a trawler built to the specifications of the Commonwealth Government in 1909 to assist in identifying new fishing grounds in the seas around Australia. A brochure explaining 'A brief account of its history, membership, ideals and activities' The notation H2 in red pen shows that it was part of the archive project that was trying to capture the history of Legacy. The brochure lays out the history of the young organisation, it has 146 members in 1927, and clubs had started in Geelong, Ballarat, Bendigo and Sydney. Members were all men who had served in the forces of the British Empire during the war. 'The membership is selected and elected, only one representative being admitted from each occupation. An endeavour is always made to secure a prominent representative of each business, profession or trade, thus extending the influence of Legacy throughout the community.' Meetings were held in the Victoria Coffee Palace at 1pm on Tuesdays and included a half hour lecture. The policy and objectives were laid out including to preserve the memory of fallen comrades and to assist their dependents, particularly the children. Also to maintain a spirit of comradeship, and to safeguard the good standing and interests of ex-service men in the community and to assist the the to secure suitable employment. The brochure shows activities as: Employment Committee, Comradeship Committee, a pledge to assist the National War Memorial being established on the Domain site, and for the children the 'Deceased Soldiers' Children's Welfare Committee. A schedule of Boys' and Girls' Classes is included to show the options for the children. Also picnics, Christmas camp, cycle club, and rambles as arranged. Published: Nillumbik Now and Then / Marguerite Marshall 2008; photographs Alan King with Marguerite Marshall.; p95 Thanks to an Australia first effort by local residents, the historic Shillinglaw Cottage still survives. The cottage at Panther Place, Eltham, once stood about 100 metres away on Main Road. But in 1963 it faced demolition to make room for the Eltham Shire Offices (since demolished). However residents rallied to save Shillinglaw Cottage and became the first in Australia to remove and reconstruct an early settler’s brick building. A fundraiser was the residents’ compilation of loved recipes into the cookery book, Flavour of Eltham. The cottage, built in the late 1870s by noted pioneer builder George Stebbing, is one of Eltham’s earliest buildings and associated with significant early settlers. It is on the National Estate and National Trust Registers. The cottage was constructed with handmade bricks in the Flemish Bond style, typical of cottages and farmhouses in Flanders, Europe. It features burnt ‘header’ bricks over the façade, which gives a chequered effect. The roof is made of slate, while the windows are 12-paned sash with relieving arches. It is not clear who were the first owners of the cottage. The National Trust claims that Stebbing built it for farmer Thomas Cochrane.1 Others say Cochrane first owned the land but Stebbing was Shillinglaw’s first owner and remained so until 1887. The Shillinglaw family then bought it and lived there for around 80 years until 1963 when they sold it to the Eltham Council.2 Farmer Thomas Cochrane bought the Shillinglaw Cottage site from land developer Josiah Holloway. The site was the largest in what Holloway called Little Eltham, of some 30 acres (12 ha), extending along the creek from Henry Street to Luck Street. In 1874 Cochrane sold the land to George Stebbing. Meanwhile in 1861, Stebbing was the owner and occupier of a house at Pitt Street, Eltham, which he had built. Evelyn Observer journalist James Rossiter rented the Pitt Street house, then in 1881 Phillip Shillinglaw occupied it. Stebbing constructed several buildings of note in the area, including the Uniting Church at John Street, the building beside it – a former bank – and St Margaret’s Church of England in Pitt Street. Stebbing was also an Eltham Shire Councillor from 1871 to 1873 and a trustee and treasurer of the Eltham Wesleyan Church.3 In the 1870s he is recorded as the owner of up to five houses. Earlier he had been described as a bricklayer and later became a farmer. In 1882 Stebbing returned to the Pitt Street house and Shillinglaw occupied the new house in Main Road, which he owned from 1887. Shillinglaw was a prolific poet and preached at the Eltham Primitive Methodist Church, where he also served as Sunday School superintendent and led the Young People’s Society Christian Endeavour. The Shillinglaws saw many changes in their property’s boundaries – the major one occurring at the turn of the century when land for the railway and Eltham station was acquired from their holding. The northern part of the remaining land was then used for some of the first commercial developments in what was to become the Eltham Shopping Centre. Later still, the land immediately north of the cottage was bought by the Eltham War Memorial Trust for the War Memorial Buildings and the fire station. The Trust’s land eventually passed to the council. The council bought the remaining two acres (0.8 ha) with the house, and with the exception of the commercial development between the fire station and the post office, all of the former Shillinglaw land is owned by the council or government instrumentalities.4 Since the late 20th century, the cottage has had varied uses, such as a handcrafts store and as a restaurant.This collection of almost 130 photos about places and people within the Shire of Nillumbik, an urban and rural municipality in Melbourne's north, contributes to an understanding of the history of the Shire. Published in 2008 immediately prior to the Black Saturday bushfires of February 7, 2009, it documents sites that were impacted, and in some cases destroyed by the fires. It includes photographs taken especially for the publication, creating a unique time capsule representing the Shire in the early 21st century. Bob (Herman) Hymans (a former member of the Royal Netherlands Navy) was born in Bloemendaal, Holland on 30th September 1922. During World War II he fought against the Japanese in the Dutch East Indies (now Indonesia) and was imprisoned in Changi and on the Burma Railway. After gaining qualifications as a Ski Instructor, Bob arrived in Falls Creek in July 1950. Working as an Instructor and Supervisor at Bogong Lodge, Bob decided his future was in accommodation. He was successful in negotiating an indenture for land from the State Electricity Commission (SEC). It took Bob two years to build his Grand Coeur Chalet but, tragically, it was burned down in August 1961. Bob also built the first Chairlift in Australia. This was a single chairlift and the structure was built from wooden electricity poles. He was constantly full of new ideas and proposals for the village. Bob Hymans died on 7th July 2007. This Collection of documents and letters tells the story of Bob's endeavours to develop Falls Creek into the ski village it is today.This letter is significant because it reflects the relationship between Bob Hymans, the State Electricity Commission and the Management Committee.A letter to Mr. Hymans' from the SEC outlining changes to be made to the land divisions in Christie Street. The intention was to create two separate sites - Site 4 and Site 4A. SIte 4 was the location of Mr Hymans' existing accommodation. He had submitted a proposal for development of Site 4A. The dimensions of each site and the proposed rentals is included in this letter. Bob (Herman) Hymans (a former member of the Royal Netherlands Navy) was born in Bloemendaal, Holland on 30th September 1922. During World War II he fought against the Japanese in the Dutch East Indies (now Indonesia) and was imprisoned in Changi and on the Burma Railway. After gaining qualifications as a Ski Instructor, Bob arrived in Falls Creek in July 1950. Working as an Instructor and Supervisor at Bogong Lodge, Bob decided his future was in accommodation. He was successful in negotiating an indenture for land from the State Electricity Commission (SEC). It took Bob two years to build his Grand Coeur Chalet but, tragically, it was burned down in August 1961. Bob also built the first Chairlift in Australia. This was a single chairlift and the structure was built from wooden electricity poles. He was constantly full of new ideas and proposals for the village. Bob Hymans died on 7th July 2007. This Collection of documents and letters tells the story of Bob's endeavours to develop Falls Creek into the ski village it is today.This item is significant because it documents proposals put forward by Bob Hymans to develop facilities in the Falls Creek Tourist Area.A letter from J. Dale Fisher, an architect acting on behalf of Mr Hymans. The letter accompanied plans submitted to the SEC and the Management Committee for approval of the development of SIte 4, Christie Street, Falls Creek. The plans had been modified in response to earlier concerns related to cost. The new chalet would provide accommodation and a swimming pool and stables.
