Black and white photograph of bulldozer excavating the former Shillinglaw Cottage site for new Shire Offices. 'Shillinglaw Trees' in background. The cottage and land were purchased by the Shire of Eltham as the site for a new shire office building. The cottage was destined for demolition but members of the community concerned at losing one of the areas earliest buildings (built c.1859) initiated a fund-raising campaign to save the cottage. In 1964 the cottage was dis-assembled, all the bricks numbered and reassembled several hundred meters to the south on a site between the Gahan house and the Eltham Railway Trestle Bridge (present-day Panther Place), which became known as the Eltham Common. The new shire offices at 895 Main Road were opened in 1965. Following the Kennett Government amalgamation of local government areas in 1994, the Shire of Eltham ceased to exist, and a new Shire of Nillumbik was created 15 December 1994 from the former Eltham shire and parts of the Diamond Valley shire. The former West Riding which included parts of Montmorency, Lower Plenty and Briar Hill were ceded to the new City of Banyule. Commissioners were appointed for several years and the new Council occupied the former offices of the Shire of Diamond Valley in Greensborough. The former Eltham Shire offices remained vacant until August 1996 the Commissioners suddenly elected to have the former Shire offices demolished immediately and the site has remained vacant ever since. It was not until 1997 before the community was allowed to democratically elect new Councillors to represent them. This photo forms part of a collection of photographs gathered by the Shire of Eltham for their centenary project book,"Pioneers and Painters: 100 years of the Shire of Eltham" by Alan Marshall (1971). The collection of over 500 images is held in partnership between Eltham District Historical Society and Yarra Plenty Regional Library (Eltham Library) and is now formally known as the 'The Shire of Eltham Pioneers Photograph Collection.' The monument with time capsule was established by the Shire of Eltham Historical Society to commemorate Victoria’s 150th anniversary and mark the former location of the Eltham Town Centre, which existed along this section of Main Road, then known as Maria Street. The unveiling was conducted 10 November 1985 by Cr. Mary Grant (Shire President). The monument was constructed with a concrete base and the main feature is an old tyring plate or disc. The Time Capsule Ceremony involved lowering the sealed time capsule into place, bolting down its container lid and then concreting over the lid. The capsule contains items relating to present day (1985) Eltham and its people including a video film made by Joh Ebeli and also details of families and organizations who have contributed to construction of the monument. It is to be opened in the year 2035. The Society received an excellent response from local people, firms and organizations by way of assistance with this project. Graham Beyer, who originated the project, arranged many of the donations. He and his firm, Package Handling Equipment, donated the time capsule itself and carried out fabrication of sections of the monument. The design of the monument was adapted by Graham Beyer from drawings by Joh Ebeli. Charmac Industries donated the container for the time capsule and a cast gun metal name plate for the monument. BMG Concrete donated concrete for the base which was constructed by Caridi Construction Company. Northbourne Garden Supplies donated materials for the paving around the monument. Robert Becker from Eltham Apex directed construction of the paving by Society members. Terry Hutchinson donated the use of his crane to lift the tyring disc into place. Financial contributions were also made by the Eltham Chamber of Commerce and the Rotary Club of Eltham. In 1987 in commemoration of the Society’s 20th Anniversary, Joh Ebeli suggested the commissioning of a plaque to be added which explains the functions of the various items used in the Society’s Victorian 150th Anniversary Monument and this was unveiled by its designer, Joh Ebeli, on October 10, 1987. Circa 2010-2012 the monument was damaged through vandalism. The mounts for the ring had been broken. On 15 December 1994 the former Shire of Eltham ceased to exist following the Liberal Kennett Government local council amalgamations. A new Nillumbik Shire Council was established with unelected commissioners appointed. That Council sold the former Eltham Shire Council Offices and land at 89S Main Road Eltham to Dallas Price Homes Pty. Ltd. the sale being conditional upon the granting of a planning permit for a petrol station/convenience store, fast food and video outlet. The sale was conditional that if the permit was not granted by 30 August. 1997, the contract could be avoided by either the purchaser or the vendor. The proposed development consisted of a petrol station with undercover fuelling facilities, convenience shopping, a drive through service facility for fast food, an 80 seat cafe, automated banking, a children's play area and retail space. In addition, the proposal included a 200 square metre community facility for Council use, provision of on site carparking over 2 levels for 83 vehicles, and advertising signage. An Advisory Committee consisting of Dimitry Reed and Margaret Pitt was appointed under Section 151 of the Planning and Environment Act 1987 to hear submissions on the proposal to develop the land at 895 Main Road Eltham, the site of the former Eltham Shire Offices. In September 1996, two applications were made by Contour Consultants Australia Pty Ltd on behalf of Dallas Price Homes Ply Ltd, to Nillumbik Shire Council. After extensive notification, the Council received 213 objections and a petition of over 1400 signatures. On October 9, 1996, Nillumbik Shire Council issued Notices of Decision to Grant Permit on Applications number 96/03376 and 96/0377 for the use and development of the land as a convenience Centre consisting of a petrol station, convenience store, cafe/takeaway food premises, a retail facility and a community facility, with associated advertising signs. Objectors to the proposals lodged Planning Appeals number 96/40724 and 96/40812 with the Administrative Appeals Tribunal on November 1, 1996. The grounds of appeal can be summarised as: inappropriate development, insufficient carparking, traffic and access issues, unsatisfactory design, inadequate permit conditions, the proposal being out of character with the area. and being contrary to the purpose and orderly development of the Eltham Town Centre, excessive noise, lack of consultation and unsuitable signage. On November 13, 1996, the Minister for Planning and Local Government directed the Registrar of the Administrative Appeals Tribunal. under Section 41 (1) (a) of the Planning Act 1980, to refer the Appeals to the Governor in Council for determination without a hearing or recommendation by the Tribunal. The Minister for Planning and Local Government called in the Appeals as he considered that they raised major issues of policy relating to the facilitation of development in accordance with the objectives set out in Section 4 of the Planning and Environment Act 1987, and that determination of the Appeals could have a substantial effect on the achievement of these planning objectives. The Minister required the Advisory Committee to consider the planning merits of the proposed use and development, and to address the issues raised in the objections. The Advisory Committee was required to produce a report providing: • The Committee's response to the matters detailed; • Relevant supporting information for the Advisory Committee's recommendation; and • A description of the proceedings conducted by the Advisory Committee and a list of those consulted or heard by the Committee. In March 1997, elections were held in the Shire of Nillumbik and the view of the new Council to this proposal differed from the view held by the earlier Council Hence the Submission made to the Committee by the Shire was against the decision by the Shire of Nillumbik to issue the Notices of Decision to Grant a Permit. The Recommendations of the Advisory Committee were: i. The cafe and take away food premises are as of right uses and are therefore allowable, but that shop and petrol station are unacceptable uses. A community facility is a discretionary use and is acceptable. ii. A development of the type and scale proposed is totally inappropriate for this land and that the Applications number 96/03376 and 96/0377 for the use and development of the land as a convenience Centre consisting of a petrol station, convenience store, café/takeaway food premises, a retail facility and a community facility, with associated advertising signs, be refused. iii. The land should be rezoned for public purposes and should remain in the community's ownership for community use. Following this, the Minister for Planning and Local Government, the Hon. Robert Maclellan, appointed Mr. Paul Jerome as an Advisory Committee under section 151 of the Planning and Environment Act 1987 to consider a Convenience Centre and an alternative proposal by Iha Shire of Nillumbik being the Eltham Gateway Community Precinct Concept Plan for the site of the former Shire of Eltham municipal offices at 895 Main Road, Eltham. In summary, the terms of reference for the Advisory Committee required it to: • consider the merits of the Council proposal • examine the merits of both proposals in terms of net community benefit • address the report of the previous Advisory Committee on the Convenience Centre proposal The Advisory Committee inspected the site and considered all the material before It including submissions made by all parties to the previous Advisory Committee and correspondence received by the Department of Infrastructure both before and after that Committee submltted its report. The Advisory Committee also held discussions with the following people: • Cr. Robert Marshall • Cr. Margaret Jennings • Cr. Lex de Man • Mr. Dallas Howgate of Dallas Price Properties, also Dallas Price Homes • Mr. Barry Rochford, CEO, Shire of Nillumbik • Ms. Yvonne Rust, Planning Officer, Shire of Nillumbik • Mr. Gregory Burgess, Architect of the Eltham Library and of Council’s Community Precinct Concept Plan • Mr. Jim Connor representing Mrs Thelma Barkway of the Eltham Senior Citizens Club Having considered all the material before it, the Committee arrived at two basic conclusions. First, the DPP proposal should be rejected because, on its merits, It does not sufficiently satisfy the requirements of the planning scheme which is a statutory document. The planning scheme requires that, before making a decision on the permit applications for the DPP proposal, a range of matters must be considered. It follows that consideration of these matters should Influence the decision. These matters include local policies relating to character and amenity. In particular, these policies seek • to conserve and enhance the bushland/country atmosphere, artistic heritage and strong sense of community of the Eltham Town Centre by ensuring that the design and height of any new development is sympathetic to existing buildings • to achieve a pleasing physical environment within the Eltham Town Centre by encouraging a high standard of architecture and urban design • to encourage Improvement to pedestrian amenity through such facilities as open and shattered rest areas and meeting places, crossing facilities, pedestrian arcades, pedestrian links to car parks and pedestrian weather protection • to reduce conflict between vehicular traffic and pedestrian flows, and • to encourage pedestrian thoroughfares It is submitted, as set out In the main body of this report, that the DPP proposal fails substantially to meet these policies and In so doing does not merit the exercise of discretion In Its favour with the Issuing of a permit. This finding is not offset by the investment and employment attributes of the proposal. They do not override the need to comply with the planning scheme. Second, the Council proposal, on Its own merits, substantially meets all statutory requirements applicable to this site with a possible reservation about car parking and traffic management which need further definition and assessment as the concept is refined. The Council proposal, however, has a serious weakness in that Its financial viability has not been adequately tested. The Committee refers to 'financial' rather than 'commercial' viability in recognition that Council owns the land and may enter into a range of agreements and partnerships to realise its concept some of which may be truly commercial and some of which may involve an element of subsidy arising from Council's involvement as a public body acting on behalf of its community. SHIRE OF ELTHAM COMMUNITY PHOTOGRAPHIC SURVEY Photography is an artform which many of us practice, sometimes purely for artistic pursuit, sometimes to record the people and events in our lives. In 1988, as part of a local Bicentennial project, the Shire of Eltham conducted the Eltham Community Photographic Survey. Up to 100 entries were to be selected by a panel of photographers for entry into the Eltham Photographic Survey Exhibition. Entries had to be submitted by May 13, 1988. Entrants whose images were selected for the exhibition were contacted and requested to further submit an entry form providing entrant’s name, area of residence, age, and proposed captions. These details were then used to produce labels for the exhibition mounts. Where negatives had not been supplied, these were requested to support the display of printed enlargements mounted on 10” x 8” cardboard. The mounted prints were made available post exhibition for sale at $8.50 each for colour prints and $7.00 for B&W prints. Residents in the Shire were invited to collect a free roll of film and take a photograph of what they either liked or did not like about the area. A total of 160 entrants submitted multiple entries for the exhibition. Of those selected for exhibition, entrants ranged in age from 9 to 70 years. All custom colour and black and white printing for the exhibition was completed by Wattle Studios of Eltham. The Eltham Photographic Survey was jointly auspiced by the Shire of Eltham and Wattle Studios, of 953 Main Road, Eltham. It was also intended to hold the exhibition at a venue in the Shire’s North Riding from Monday, June 20 to Friday June 24. It was then displayed at the Were Street Theatre, Montmorency from Friday, June 24 to Thursday, July 7. Series 34: Eltham Community Photographic Survey 1988 - Prints & Documentation Series consists of 117 photographs of Shire scenes taken by members of the community. Items I - 41 are larger photographs mounted on card, which were exhibited. Items 42 - 117 are unmounted copies, alternative takes and other entries. Corresponding negatives contained in Series 35: Eltham Community Photographic Survey 1988 – Negatives which consists of 267 colour and B&W negatives and one colour slide of Shire scenes taken by members of the community. The negatives are arranged by the entrant number of the photographer. The Eltham Community Photographic Survey collection is significant to the local community as it was curated by the local community - ordinary people of all ages - representing what they liked and did not like in the area where they lived. It represents an unfiltered representation of the Shire of Eltham as it was in 1988. It also represents one of many projects as part of the national programme of events and celebrations to commemorate the bicentenary. This section of Main Road was duplicated in 1968, from Pitt Street to Elsa Court. Generally speaking, the duplication was constructed on the western side. John Henry Clark was the youngest of three boys born to William Henry Clark (1823-1877) and Maria White (1843-1914). He and his brothers, William Charles Clark (1872-1945), Clement Kent Clark (1874-1912) operated a photography business (Clark Bros.) from 25 Thomas Street, Windsor near Prahran during the period c.1894 to 1914. Following death of Clement in September 1912 and their mother in 1914, the Clark Bros business appears to have dissolved, the premises demolished, and a new house was under construction in 1915. John set up business independently in 1914 operating out of 29 Moor Street, Fitzroy where he is registered in the 1914 and 1915 Electoral Rolls. By 1916 John had relocated to Eltham where he continued his practice as a photographer and took many of the early images around the district of Little Eltham. Around 1930 John changed professions and opened a small cobbler's shop in 1931 near the pond opposite Dalton Street adjacent to the Jarrold family cottage. He never married and continued his profession as a bootmaker from this little shop, maintaining a close relationship with Mrs Jarrold for the rest of their lives. ELTHAM HERITAGE TOUR The Society excursion on 24th May 1992 was arranged by David Bick, leader of the team carrying out the Shire's heritage study. David selected a number of sites or buildings identified in the study, some of them lesser known components of the Shire's heritage. The tour commenced at the Eltham Shire Office at 10.00 am. Travel was by private car and mini-bus with stops at about twelve locations for commentary by David.It included a short walk in Hurstbridge and lunch at Kinglake. Eltham's original Wesleyan Methodist Church Covered under Heritage Overlay, Nillumbik Planning Scheme. Published: Nillumbik Now and Then /​ Marguerite Marshall 2008; photographs Alan King with Marguerite Marshall.; p97 The pretty Uniting Church building at the corner of John and Main Roads Eltham has served the community since 1881.1 Originally called the Eltham Wesleyan Church, the church became the Eltham Methodist Church in 1902, the year it united with the Primitive Methodists.2 As the church community developed, influencing and being influenced by the wider community, its buildings changed accordingly. Eltham Wesleyans first worshiped together in 1850 at the home of William and Mary Crozier on 24 acres (9.7ha) bounded by Mount Pleasant Road and Pitt Street. From 1855 the Wesleyans worshipped in a slab-and-bark hut; then in 1858 in a chapel on Henry Street close to Maria Street (now Main Road). Meanwhile, in 1860, the Primitive Methodists opened a brick chapel at the corner of Susan and Bridge Streets. The John Street building – in the Early English Gothic style with biochrome brick window frames, buttress heads and pinnacle – was designed by architects Crouch and Wilson. Church member George Stebbing built the church as he did Eltham’s St Margaret’s Anglican Church and Shillinglaw Cottage. The Church Honour Roll is a poignant reminder of how church members have served the wider community: 27 members enlisted and 11 died in World War One. Despite the Great Depression, 1931 was a time of expansion for the church. Its red-brick hall was opened by prominent Methodist and philanthropist F J Cato of the Moran and Cato Grocery chain. The hall enabled the church to attract people from outside through activities like its gymnasium – with 40 boys and youth participating – and the girls’ callisthenics club, which competed at the Ballarat South Street Competitions. The church also held concerts, bazaars, picnics and sports, with badminton and tennis played on the church court at 23 John Street. Two stained-glass windows commemorate tragic events. A dove representing the Holy Spirit and Comforter marked the death in 1936 of member Effie Lowerson from scarlet fever at 14 years. The other depicting the Biblical story A sower went forth to sow, commemorates Ross Gangell, who died in 1961 at 23 years of a rare blood condition. Eltham’s population expanson resulted in the growth of the church and an extension in 1971, designed by member and architect Colin Jones. The church was linked to the hall and additions included a foyer, vestry, meeting room and toilets. The design reflected the Eltham style of the time, with its simplicity, extensive clear glass, reused baked clay-bricks from the 1881 church, heavy ceiling beams and solomite (compressed straw) ceiling. On June 26, 1977 the church became part of the new Uniting Church in Australia consisting of the former Methodist and Congregational and most of the Presbyterian Churches. In 1981 membership peaked at 159 – about 20 years after most Protestant churches – and continued to reach out to the wider community.3 In 1987, 147 children attended Selihoo, the weekly after-school program organised with St Margaret’s Anglican Church. From 1993, the church with other local churches, participated in LINC (Love in the Name of Christ), helping the wider community in various ways including babysitting, transport, gardening and visiting. Despite such initiatives, church numbers declined, and on June 23, 1996, the church merged with the Montmorency Uniting Church.4 However, the church continued to proclaim its message of love in community service and strong social justice action, such as in Jubilee 2000, supporting debt relief to the world’s 45 poorest countries. Some of the many church members who have had an outstanding impact on the wider community include Philip Shillinglaw, farmer and poet, and Arthur Bird (after whom the Arthur Bird Reserve is named), a pioneer orchardist and the Sunday School Superintendent for 33 years. Others were: the Rev Dr Cliff Wright, who established the Methodist Youth Fellowship and was prominent in the World Council of Churches, the Rev Brian Howe, who became Deputy Prime Minister and Tim Marshall, awarded the Order of Australia in 2000 for his work on salinity.This collection of almost 130 photos about places and people within the Shire of Nillumbik, an urban and rural municipality in Melbourne's north, contributes to an understanding of the history of the Shire. Published in 2008 immediately prior to the Black Saturday bushfires of February 7, 2009, it documents sites that were impacted, and in some cases destroyed by the fires. It includes photographs taken especially for the publication, creating a unique time capsule representing the Shire in the early 21st century.
