Legal record - Transcript of High Court Appeal Philip Cooney v John Thomas Burns, 1921
The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. Craft - Ship Model, Portuguese Carvel, 1999
The Mahogany Ship is today regarded as a legend and refers to an ancient wreck that is purported to lie beneath the sand beside Armstrong Bay, several kilometres west of Warrnambool, Its location is currently unknown. For well over a century the mystery of this ship has fascinated Australians because the existence of such a vessel could throw a different light on the earliest phases of exploration of eastern Australia by Europeans. The story is that in January 1836 a party of whalers from Port Fairy travelled to the mouth of the Hopkins River in search of seals. Their boat overturned and one man was drowned. The three survivors were walking the 30 kilometres back to Port Fairy along the coast when, about halfway along, they discovered the wrecked ship in the dunes. It is said that Captain John Mills, who was in charge of the whaling station at Port Fairy promptly visited the wreck with several of his men, including Hugh Donnelly. Donnelly who was the originator of that version of events is now regarded as unreliable. Local history researcher Joan Fawcett believes Donnelly could not have visited the wreck in 1836 because he did not arrive in Victoria until 1841. The "mahogany" description can be traced to a letter from Port Fairy builder, architect and surveyor John Mason and published in the Melbourne Argus in 1876. He said he had seen the hull in 1846 and it "had the appearance of either cedar or mahogany." In 1884 Argus journalist `The Vagabond' wrote that the hull was built of "Spanish mahogany" and six years later Mason wrote another letter saying it might not have been mahogany but red gum or ironbark from New South Wales. He was too late with this new description as the wrecks mahogany tag was here to stay all through the hull was not visible as it had disappeared beneath the shifting sands by 1880. A more reliable account was later presented by the former editor of the Warrnambool Examiner, historian Richard Osburne, who wrote about the wreck in his book History of Warrnambool (published 1887). In it the author remembers to have noticed a wreck in the hummocks between Belfast and Warrnambool, in 1847 or 1848; he stated it was much nearer Warrnambool than Belfast, now known as Port Fairy, going on to state “in fact, it was only two or three miles from the former place, to the west of the big hummock which was supposed to fill Warrnambool Bay with drift sand washed by the Merri River before the cutting was made.” Osburne followed up with a letter to the Port Fairy Gazette on June 25, 1876, during a period of heightened interest in the wreck, although he was unsure of the provenance of the ship he went on to state in his letter. “The old wreck was, in fact, miles away from the Port Fairy beach, and only about four miles from Warrnambool. In the years 1847 and 1848. I have often seen the wreck and I regret to say I do not believe she was a foreign ship at all.”The ship model is significant for its association with the Warrnambool story of what is now referred to as the Mahogany Ship, an ancient shipwreck. The model is significant as it is an interpretation of a Portuguese caravel and possibly associated with the early history and exploration of Southern Australia. The model is a fine example of a hand crafted ship made from plans, not from a kit. Some of the materials used for the model are significant to the Gembrook community in that the timber used is a portion from a 30-meter pine tree that fell onto and destroyed the 120-year-old Gembrook church building. The model is also a dedication to Edward Kermond, who grew up in Warrnambool and claimed to have seen the shipwreck in the dunes when he was a lad in the late 19th century. (See note section of this document for further information on the creator and donation of the subject item).Ship model, an interpretation of a mahogany Portuguese carvel vessel in a glass display case with wood frame and a description plaque. Model is made from dark stained wood. The three masted vessel is fully rigged, with a Portuguese-like flag on mast. Plaque is rectangular, free standing on a pedestal. The model was handmade by Joe Hilder (Senior) in 1999 from flooring obtained from the Gembrook Uniting Church in Victoria. Inscriptions, hand written, under base of case and on plaque.Under base, black felt tip pen “Ship & Case made From / Flooring from Gembrook uniting Church, Flattened in 1999 / By Large Pine Tree.” On plaque, white paint "This interpretation of the Fabled Mahogany Ship was made by Joe Hilder, Gembrook Vic. is displayed in the memory of the late Edward Kermond (Ted) 1887-1973, a Warrnambool son who claimed to have seen the original ship as a child." flagstaff hill, warrnambool, flagstaff hill maritime museum, shipwreck coast, flagstaff hill maritime village, great ocean road, ship model, mahogany ship, mahogany ship story, portuguese caravel, joe hilder, edward kermond, ted kermond, gembrook uniting church, gembrook storm 1999, port fairy whalers, belfast whalers -

Equipment - Ship's Wheel, 1922
This ship's wheel was hand made from wood and metal using a recycled cart wheel. It originally belonged to the "Reginald M", a 2 masted, flat bottomed, coastal trading ketch with single chine. The REGINALD M The vessel “Reginald M” was a two-masted coastal ketch, owned and built by Mr. Jack (John) Murch of Birkenhead, Port of Adelaide, South Australia. Its construction took approximately 6 months and it was launched at Largs Bay in 1922. The Reginald M’s purpose was to serve the coastal trade of South Australia, to carry cargo cheaply and efficiently. It is believed that the keel was in fact hewn from two telegraph poles! Its builder frequented all the salvage yards for materials and fittings. Reginald M had a very shallow draft and a flat bottom that enabled it to come close to shore and to sit high and dry at low tide or to be beached on sand. The flat bottom was also to make the ship able to skim over reefs. Wagons could load and unload direct from her side. Her cargo included Guano, Barley, Wool, Horses, Cattle, Timber, Explosives, Potatoes, Shell Grit and Gypsum. On April 9th 1931Reginald M weathered a large storm in St Vincent Gulf, SA. The vessel suffered much damage; mast snapped and the crew laboured for four hours to free her by chopping off the past and rigging. The crew patched her up and slowly returned to Port Adelaide with only a portion of the insured cargo being damaged. Her crew members at the time were owner Mr John H Murch of Wells Street Largs Bay, Skipper Mr R Murch – John’s brother, Murray – son of Captain Murch and Seaman John Smith. Reg Webb purchased Carribie Station, at Marion in the Warooka District, south of Adelaide, in 1921. He cleared the land and farmed sheep and grain. In 1923 he shipped his own wool and grain from Marion Bay, having first carted 300 bags of the barley grain, 12 bags at a time, along the unmade track to the jetty. A photograph donated to Flagstaff Hill, dating about 1929 - 1942, shows two men on the Reginald M, holding between them their fishing catch of a large hammer shark. The photograph is stamped “GRENFELL STUDIO PORT LINCOLN PRINT” and titled “hammer shark caught on Reginald Emm”. The donor’s family lived on the Your Peninsular and despatched their grain from a chute at Gleeson’s Landing to the awaiting transport vessel. Reg knew the Murch Brothers from Port Adelaide. The brothers had been using their ketch REGINALD M to ship Guano from the Islands, led by Captain Richard Murch. Reg approached them in 1934 about shipping grain from Marion Bay. The brothers visited the bay and thought it was an ideal place. They showed Reg where to stack his grain and they measured up the cliffs. When Reg was ready, they brought down and installed a ninety foot wooden chute. The bags of grain were then individually sent down the chute, landing in a waiting small boat then rowed to REGINALD M, 14 bags at a time. After 10 hours REGINALD M would be fully loaded with 1300 bags of grain and shipped to waiting ports. At one time a wild storm destroyed the chute but it was rebuilt and strengthened. REGINALD M was involved in shipping the grain from there until 1938. In 1940 Able Seaman Allan H Lucas served on Reginald M between September and December, being engaged and discharged from Port of Adelaide. His Certificate of Discharge was signed by ship’s Master W S Murch. It seems that at some stage Reginald M was used as a Customs vessel, as one photograph in Flagstaff Hill’s collection shows “H.M.C. No. 3, Pt Adelaide” on the bow. In 1969 the last freight left Marion Bay on the ketch REGINALD M carrying grain, wool and explosives. In late 1970 she was sold to the Mt. Lyell Mining and Railway Company and was used by them as a barge to carry explosives. In 1972 the Navy League of Strahan, Tasmania, purchased her for use by the Strahan Sea Cadet Unit to use at Macquarie Harbour and renamed her T.S. Macquarie. However this plan for use of Reginald M did not come to pass. In 1974 Mr. Andrew Rennie, of East Brighton, Melbourne, bought her for a similar purpose. , paying $5,000 and donating a ‘Cadet of the Year” trophy to the Sea Cadets. He sailed her from Strahan to Melbourne, planning to use her for pleasure sailing. Also in 1975 Reginald M was sold to Melbourne Ferry Company at auction. Later in 1975 the Reginald M was bought by Flagstaff Maritime Museum for $20,000 . She has been restored and is now one of the exhibits in the Village lagoon or lake. It was restored in 2006 using funds from a $4,000 government grant. This ship's wheel is significant because of its association with the REGINALD M. REGNIALD M was a coastal trading ketch from South Australia built in 1922. It is one of very few sailing coastal trading vessels still extant, and its flat bottom, single chine shape illustrates a very simple but robust method of construction, compared to other round bilged examples of trading vessels. She is now listed on the Australian Register of Historic Vessels (ARHV Number: HV000562.)Ship’s wheel, also called a Helm, eight spoke design. Centre of wheel is handmade of wood and has iron rings around each side. The spokes are fitted into this wooden hub. The outer wheel has an iron ring on one side and sections of a wooden ring on the other. There are both original and modern bolt and screw fastenings. The wheel has remnants of black paint. This ship’s wheel was originally fitted to the ketch REGINALD M and removed during its restoration. flagstaff hill, warrnambool, shipwrecked-coast, flagstaff-hill, flagstaff-hill-maritime-museum, maritime-museum, shipwreck-coast, flagstaff-hill-maritime-village, ship's wheel, hand made ship's wheel, coastal trader, reginald m, ketch, john murch, ch murch, reg webb, carribie station, mt lyell copper company, queenstown navy league, andrew rennie, melbourne ferry company, r.f. dale -

Royal District Nursing Service (now known as Bolton Clarke)
Photograph - Photograph, black and white, Barry Sutton, circa 1965
Sister Short is writing down information being given by patient Sue Rowley who will be discharged from the Hospital. It will be phoned through to the appropriate RDNS Centre where it is recorded by the Clerical staff and passed to the RDNS Sister who will visit Sue on her discharge. Liaison had occurred between Doctors and the Trained nurses of the Melbourne District Nursing Society (MDNS), from its inception in 1885. This increased when Midwifery was introduced in 1893 with close liaising with the Women’s Hospital. As District nursing grew it was recognized that closer liaising between many Public Hospitals would be beneficial, for not only the MDNS, later called Royal District Nursing Service (RDNS), nursing staff, but also for the patients and the hospitals. In August 1964 a Liaison Officer commenced at the Alfred Hospital. This soon increased to Liaison Officers working full time at several Public Hospitals. They facilitated the smooth transition from hospital to home for many patients who required ongoing nursing care. Liaison Sisters regularly attended discharge planning meetings, interviewed prospective clients, co-ordinated discharge and booked the first visit by the visiting RDNS staff. At the time of a patient’s discharge, the Liaison Sister forwarded information on their diagnosis and instructions regarding the care required at home to the appropriate RDNS Centre, and in turn the attending District Sister wrote a report of progress and any queries to the hospital doctor, via the Liaison Sister, at the time the patient was attending outpatients. Any new instructions were then sent back to the District Sister. Liaising also occurred between District Sisters in the field and Doctors when patients were referred by General Practitioners and did not attend a hospital. A Physiotherapist worked under contract to teach transfer techniques to RDNS Sisters before RDNS employed there own Physiotherapist who taught staff the correct techniques, not only for safety of the patient, but to reduce physical strain on RDNS nursing staff and patient’s family members. The Physiotherapist made home visits with the attending RDNS Sister when required.Standing to the left of the black and white photograph is hospital Physiotherapist, Anne Radford, who has short dark hair and is wearing a white coat. She is side on and has her hands placed on the upper and lower right arm of Sue Rowley, who is sitting in a wheelchair. Sue has short dark hair and is wearing a neck brace and her left hand is holding a pulley rope. She is wearing a white top under a dark jacket and light coloured slacks. To her right is Royal District Nursing Service (RDNS), Liaison Sister, Margaret Short who is facing Sue. She has her left hand extended supporting an open book and has a pen in her right hand which is poised on a page in the book. Sister Short is wearing her RDNS grey short sleeve uniform dress and grey peaked hat over her short dark hair. The RDNS insignia is seen on the top of her left sleeve. Behind the wheelchair are some wooden bars, two upright and two vertical, which are attached to a brick wall, the pulley rope is through a wheel attached to the right hand upright. The brick wall joins another which has part of a window visible. Behind the Sister and wheelchair are four shelves attached to this brick wall. Several round weights are on the shelves.Photographer stamp. Nightdress, Early 20th century
This handmade woman’s nightdress comes from the Kinnear family of Allandale, Allansford. In the early 1840s William and John Allan took up a large tract of land to the east of the Hopkins River and in the late 1840s William Allan took over the Allandale section of the run and John Allan took the Tooram section. In 1906 the Kinnear family acquired a portion of Allandale which included the homestead. The nightdress came from the estates of the donor’s great aunts. This item is retained as an example of an early 20th century woman’s nightdress and it has the provenance of coming from the Kinnear family of Allandale Allansford. This is a white cotton nightdress with an opening to the waist which is enclosed with two white buttons. There is a frill of lace on one side of the opening. The white collar also has a large white frill of lace. The long sleeves are inset and have a band of lace at the wrists. Tool - Hammer, 1930-1955's
This double headed hammer seems to be modified for a particular use, with the addition of a one-pronged claw on one end. It was used in the making of ship model Sovereign of the Seas. It is part of a collection of objects used by Jim Williams, maker of fine ship models from about 1930-1955. Most of the components for the models, as well as many of the tools, were handmade by Jim Williams. Jim’s family has donated the ship model “Sovereign of the Seas” and many tools, accessories and documents used in the making of this and other ship models have been donated to Flagstaff Hill Maritime Village. Ship model of HMS Sovereign of the Seas, scale model of 17th Century English war ship, was handmade and carved from plans, enclosed in airtight glass case. All components of that model, including even the smallest pulleys, were hand crafted using tools designed and made by Jim. Outstanding details include functional rigging and moving cannons. Please see our record 3732 of the mode Sovereign of the Seas for further details of the ship and the maker. This hammer is connected with the hobby and skill of ship model making that has been crafted as a leisure activity for many generations. The hobby is often chosen by serving and retired mariners who appreciate the connection with maritime history. This hammer was modified and was used by local Warrnambool man, Jim Williams, who was employed at Cramond and Dickson clothing store, and then at Fletcher Jones menswear for 27 years. It was used in making components for the model of the historic ship, the Sovereign of the Seas. The Sovereign of the Seas was a historic 17th century English war ship with important maritime heritage. Hammer, small, double ended; metal hammer one end, wooden bulbous handle, metal claw hook at the end. This hook is part of a claw hammer with one prong broken off, perhaps to serve a particular purpose. The claw end has remnants of red paint. This hammer is part of a collection of tools and accessories once used by Jim Williams, maker of a series of ship models 1930-1955 including “HMS Sovereign of the Seas”. flagstaff hill, warrnambool, flagstaff hill maritime museum, shipwreck coast, flagstaff hill maritime village, great ocean road, ship model sovereign of the seas, jim williams, james bernard williams, ship model hobby, ship model tools, ship model making equipment, ship model making accessories, double ended hammer, modified hammer, sovereign of the sea, ship model, hobby, ship model tool, english war ship -

Vehicle - Vessel - Couta boat, Viator, 1890-1920
The historic Victorian ‘couta boat “Viator” was built by renowned boat builder J.R. Jones of Williamstown in Melbourne, between 1890 and 1920. He was one of the early builders of this design. The features of Viator - carvel planked, open cockpit, vertical stem and straight keel, single mast and a pivoting centreboard - are all characteristics of an early Bass Strait ‘couta boat. This has been confirmed by experienced Victorian ‘couta boat restorer Tim Phillips. Viator served as a ‘couta fishing boat in the Warrnambool area until the mid-1930s, then some say she served as a mail ferry across to Portland. Later it was used as a fishing and recreation boat for local families. For years Viator sat in a paddock in East Warrnambool until purchased in 1975 and donated to Flagstaff Hill. ‘COUTA BOATS - The ‘couta design for vessels is believed to have originated at Port Phillip, Victoria, for the purpose of the Barracouta (‘couta) fishing industry, being both fast and seaworthy. , The 'couta fish was an important food fish in Australian waters, supplying Melbourne with plenty of inexpensive fish. VIATORY’S OWNERS - Some of Viator’s history is known: - 1940, registered Port Fairy and owned by G.J. Richards. - 1941-1945, registered in Port Fairy and owned by Jens “Peter” Petersen. - 1950’s “Brusher” Richards of Warrnambool and Port Fairy used it for fishing. - Peter Watson and his son also went fishing in Viator. - Frank Ferrier, boat builder, was an owner (son of ‘La Bella’ hero, William Ferrier) - Arthur Rogers owned Viator too, then sold it to Terry Pridmore and Wayne Moorefield - The Viator was stored in a paddock, unused for years, in Fairmont Avenue, Warrnambool, where it was gradually deteriorating. - 1975 Viator was purchase at a very reasonable price from Pridmore, then donated to Flagstaff Hill Maritime Village. RESTORATION - Shipwright Erik Mikkelsen soon started restoration on the Viator after it arrived at Flagstaff Hill in 1975. In 2006 the Maritime Museums of Australia awarded a grant to Flagstaff Hill Maritime Village to assist with the restoration and renovation of the Viator. Its restoration continues today in the care of Flagstaff Hill’s boat builder. J R. JONES - boat builder The photograph of the EVA MYRL shows the builder J R Jones with his team of workers. The other photograph shows a vessel built by J R Jones' son, J B Jones of Footscray, and his team of boat boulders. The photograph of the EVA MYRL was taken by E. A. Dond---. The other photograph is of the Sturrock Coot, taken a Albert Park Lake in St Kilda. The Viator is the most significant boat in the Flagstaff Hill's fleet, being the last remaining local 'couta boat and one of few existing examples of this craft. Viator received Heritage status with the Australian Maritime Museums Council and is listed on the Australian Register of Historical Vessels in 2006 (ARHV Number: HV000561). Viator was built in Victoria in the early days by renowned boat builder J.R. Jones, and sailed by fishermen for many years, both local and on the coastal waters of Victoria, and was possibly used for the mail service. It is significant for being used for the fishing trade, for government service, perhaps as a mail boat, and for recreation by local families.Vessel, the ‘Viator’, an historic Victorian ‘couta boat, handmade by renowned boat builder This J.R. Jones 'couta boat, the Viator, was built in Williamstown, c.1890-1920.
