Eltham Courthouse Officially Reopened (Jim Connor, EDHS Newsletter No. 263 April 2022) In the Conservation Management Plan prepared in 2006 for the Eltham Justice Precinct there is mention that more than 350 court houses have been built by the Public Works Department since 1856, when the Department was established. It also states Eltham was in an early group of 'Victorian Free Classical' structures, featuring a projecting entry porch and gabled roof. Characteristically, this group shares a simple, rectangular shape, central placement of the court room with smaller-scale offices set back at the sides or rear of the court room, arched openings, and decorative string courses. The Statement of Significance listed in the Victorian Heritage Register states: ‘The Eltham Court House dates from the time when the town was largely self-contained. It was initiated in response to itinerant gold prospectors who turned to crime when their quest was unsuccessful. This type of localised solution is characteristic of the self reliance preserved in Eltham today. The court house is an important symbol of the spirit which makes Eltham distinctive as a community.’ It also states: ‘The Eltham Court House, built in 1860, is one of only two intact examples in the state of this simple design with projecting entry.’ So with this background it is most appropriate this valued historic building has recently been the subject of a total restoration, as detailed in previous newsletters. This was a major project undertaken by Nillumbik Shire Council. At a small function in the Eltham Courthouse, on 23rd March 2022, Nillumbik Shire Council Mayor Fran Eyre declared the fully restored building officially reopened. In doing so the Mayor spoke about the earlier law and order function of the court and the importance of this building to the Eltham community. Wingrove Ward Councillor Geoff Paine then highlighted the importance of historical societies and groups within the shire and their valued activities in recording and preserving their local history. EDHS president Jim Connor thanked everyone involved with the project and provided an overview of the history of the courthouse. Michael Ioannides, Council’s project manager, spoke about how the restoration process proceeded and those involved in undertaking the works required. Cr. Natalie Duffy, various council officers, EDHS executive committee members, as well as representatives of the head contractor Ducon Building Services and the heritage advisors, RBA architects and Conservation Consultants, were also in attendance, as was a representative of Nillumbik U3A. After the formal part there was some light hearted interpretation of how past legal proceedings may, or may not have, occurred within this courthouse, before some refreshments were shared in the former second courthouse at the rear, which is now utilised by Nillumbik U3A. Originally built by John Hill, a shoemaker at Kangaroo Ground around 1878. In the late 1970s when our Society was the Shire of Eltham Historical Society, an offer was made to the Society regarding use of an old cottage at Christmas Hills. The cottage sat beside Watsons Creek just outside the then Shire of Eltham but following municipal restructuring it now lies within the Shire of Nillumbik. For various reasons the offer ultimately lapsed. At that time some research on the cottage was carried out for the Society by Keith Chappel as part of a larger research project that he was doing. Keith’s notes were taken from Lands Department records and showed that the property was the subject of a permissive occupancy of Crown land comprising the creek reserve. In 1903 a Miner’s Right of one acre in area was granted to Edwin Samuel Birch. In 1907 Birch applied to purchase this land but was unable to because it was part of the creek reserve. The documents show that the cottage existed at that time. Upon Birch’s death in 1932, his daughter, Honor Mary Birch was granted a permit to occupy the residence. Honor Mary Birch, known as Nora, was born 1900, the daughter of Edwin Samuel Birch and Honor (nee Young). In 1939 she married George Henry Williams (aka Henry). Honor died 8 July 1976. Her siblings were Margaret Martin (dec), Bert Birch and Brigidene Brinkkotter. In her will she gave and bequeathed “all the improvements on the land held by me at Christmas Hills under Permissive Occupancy from the Department of Land and Survey consisting of the house property thereon and all the contents of the said house to my nephew Brian Joseph Martin of Christmas Hills aforesaid farmer”. The will described the property as a four room, five square house, about 100 years old with enclosed verandah, including kitchen, combined lounge dining room, bedroom and store room; built of ‘bush slabs’ with a corrugated iron roof. A dairy had been erected in 1935. After her death, the property was acquired by the Melbourne Metropolitan Board of Works in 1978. The property is listed on the Victorian Heritage Database HO200-Hill, later Birch farm complex, 945 Eltham-Yarra Glen Road, Watsons Creek and described as: The house has a steep but simply gabled roof form clad with corrugated iron, vertical adzed hardwood slab front wall construction, split palings to the gable ends; rubble freestone chimney at one end (with added gsi flue), pole-framed Graeme Butler & Associates, 2006: 101 Shire of Nillurnbik Planning Scheme Amendment C13 Heritage Assessments verandah (rebuilt?); six-pane double-hung sash windows; T&G bead-edge boarded ledged & braced door; and paling clad rooms added at verandah ends. A slab-clad large fireplace is at the north corner of the house, with a gsi upper cladding added and an internal lining of rubble stone. The rear facade is different construction, being drop-slab, and sits beneath a rear skillion addition to the main gabled form: this may be more recent construction. The house appears to have been once set up for public display and may have been recreated in part for that purpose. Outbuildings are reached by a track along the east side of the house, including what may have been a creamery (typical standard inter-war design clad with corrugated iron and lined with 1938 Lysaght Queens Head Australia galvanised sheet iron) and a paling clad gabled out-house. Timber outbuildings of differing eras are to the north-west of the house, with pole framing and paling infill construction and Redcliffe brand corrugated iron. Post and rail (front) and split paling (rear) fence remnants line the front boundary. The Andrews Labor Government said it would deliver locals in Melbourne’s north-east more peak hour train services and less time stuck at boom gates, and we have. The first stage of the Hurstbridge Line Upgrade has been delivered – six months early and on budget. This includes the new Rosanna Station, duplicated track between Heidelberg and Rosanna and the removal of the dangerous level crossings at Alphington and Rosanna. There’s more to do and only Labor will deliver the next stage of the Hurstbridge Line Upgrade to give local commuters more train services and a more comfortable commute. The $530 million project will include a brand new train station at Greensborough and the duplication of three kilometres of track between Greensborough and Montmorency, and 1.5 kilometres of track between Diamond Creek and Wattle Glen to allow more train services during the morning peak. This will allow trains to run every six and a half minutes at Greensborough, every 10 minutes at Eltham and Montmorency, and every 20 minutes at Hurstbridge, Diamond Creek and Wattle Glen – as well as two extra Hurstbridge express services. Locals on the Labor Government’s new Mernda line will also get five extra train services during the morning peak, with a major upgrade of the Clifton Hill junction where the Mernda and Hurstbridge lines connect. Labor will also protect the Eltham Trestle Bridge – the last remaining timber bridge on Melbourne’s electric train network – which has local heritage protection and is an important part of the area’s character. The Liberals will leave this bridge to rot and demolish the nearby childcare centre and football club with their under-cooked and under-costed promise to upgrade the Hurstbridge line. Only Labor will protect this important piece of Melbourne’s history with planning work to be carried out for a long-term solution as part of the project. Stage two of the Hurstbridge Line Upgrade will create more than 950 jobs, with construction to start in 2020 and finish by 2022.
