Tait collection: item 49 of 62 This document gives details of the Will and Probate of Charles Wines of Warrnambool. Charles Wines was born in Somerset, England in 1832 and died in July 1900, residing in Lava Street East, Warrnambool, at the time. He and his wife came to Australia in 1852 and settled in the Woodford area, remaining there until about 1880 when they shifted to Mailors Flat. He was married to Hannah and they had a large family, with eleven surviving at the time of his death. He left real estate to the value of £1618 and personal estate to the value of £14 with the chief beneficiaries being his sons, Thomas and George and his wife, Hannah. After his wife’s death the estate was to be divided equally amongst the surviving children. The lawyer involved in drawing up this document was Ernest Chambers. He had legal offices in Warrnambool, Koroit and Port Fairy at the end of the 19th century and the beginning of the 20th century. The document was in his possession and was then passed down to successive lawyers occupying the legal premises in Kepler Street. It was located in this building in 2014 (last occupied by the legal firm of Mackay Taylor). This document is of considerable interest as it gives details of the Will and Probate of Charles Wines. Charles and other members of the Wines family were prominent settlers in the Woodford/Mailors Flat/Warrnambool area in the 19th and 20th centuries. This is a cream-coloured piece of parchment paper folded in two to make four pages. The pages are unruled and there is handwritten material on the four pages in black ink. A seal of the Supreme Court of Victoria is attached with a green ribbon and there is one red stamp of the Master in Equity of the Supreme Court. The document is stained but legible. The Warrnambool Examiner was founded by John Wilkinson and Richard Osburne in 1851. After a gap of a couple of years Richard Osburne resumed publication in October 1853 and continued until 1867. William Fairfax and Henry Laurie then leased the paper (1867 to 1872) before Richard Osburne again became the proprietor from October 1872 to April 1878 and from December 1879 to December 1880 when publication ceased. Richard Osburne was a pioneer settler in Warrnambool, arriving in 1847. He was prominent in community activities in the town and was a most important early historian, publishing his seminal work, ‘The History of Warrnambool’ in 1887, using the Warrnambool Examiner newspapers to assist with the history. Fairfax and Laurie were the proprietors when the papers describe herein were printed. William Fairfax was a member of the Fairfax family which were, and still are, associated with the publication of many Australian newspapers. Henry Laurie later became well-known as a Melbourne University Philosophy Professor.These original newspapers are most important because they contain much information on Warrnambool’s early history and are a primary source for historians. These papers are also of importance because some parts of these papers were not filmed and are not currently available on microfilm. These papers were in a Warrnambool City Council storage area and it is surmised that they have come from the old Warrnambool Museum which no longer exists. These are original copies of the Warrnambool Examiner newspapers from 3rd April 1868 to 29th September 1868 inclusive (two copies of each). They are broadsheets of two pages per newspaper printed on the four sides. Both sets are bound with plain cardboard folders, green binding and string. One set cover is broken and this set is unmarked and a bit crumpled. Sir Henry de Castres Kellett (1851-1924) the son of a hereditary baronet, was born at Mt Gambier, South Australia in 1851. His English title had been created in Ireland in 1801, but the family was originally Norman with the later branches living in England and Ireland. Sir Henry Kellett assumed the title in 1906. Henry Kellett was a prominent Kew retailer, continuing his father’s newspaper and stationery business in Bulleen Road (now High Street). At various stages, he also acted as an insurance, postal and real estate agent. He lived in Walpole Street and later at Lota Begg (now demolished) in Westbrook Street, East Kew. In 1884, Henry Kellett was elected to the Kew Borough Council and served for 40 years; a remarkable example of public service. He was elected Mayor for a single term in 1888-9. Sir Henry de Castres Kellett died in St George’s Hospital in 1924 following a tragic car accident in Cotham Road, Kew while on Council business. The vehicle, in which he was travelling with fellow councillors and the Town Clerk, collided with a tram.
