Protection of Person and Property Act 1881 The ''Protection of Person and Property Act 1881'' was one of more than 100 Coercion Acts passed by the Parliament of United Kingdom of Great Britain and Ireland between 1801 and 1922, in an attempt to establish law and order in Ireland. The 1881 Act was passed by parliament and introduced by Gladstone. It allowed for persons to be imprisoned without trial. On 13 October 1881, the Act was used to arrest Charles Parnell after his newspaper, the ''United Ireland'', had attacked the Land Act. On Gladstone's return to office in 1880, William Edward Forster was made Chief Secretary for Ireland. He carried the Compensation for Disturbance Bill through the Commons, only to see it thrown out in the Lords. On 24 January 1881, he introduced a new Coercion Bill in the House of Commons, to deal with the growth of the Irish National Land League. Despite a 41-hour long fillibuster in the House by the Irish Parliamentary Party, the bill passed, among its provisions being one enabling the British government in Ireland to arrest without trial persons "reasonably suspected" of crime and conspiracy. However those arrested were often not always suspect, only supportive of the Irish National Land League's movements. Over 100 such acts were passed, some of the more notable of which were "An Act for the more effectual Suppression of Local Disturbances and Dangerous Associations in Ireland", "The Protection of Life and Property in Certain Parts of Ireland Act", and the "Protection of Person and Property Act 1881". An Irish Coercion Bill was proposed by Sir Robert Peel to calm the increasing difficult situation in Ireland as a result of the Great Famine 1844–47. The Bill was blocked and this led, in part, to Peel's retirement as Prime Minister. Later attempts to introduce Irish coercion acts were blocked by the filibustering of Joseph Biggar. As a response to the Plan of Campaign of the mid-1880s the new Chief Secretary for Ireland Arthur Balfour secured a tough Perpetual Crimes Act (1887) (or Coercion Act) aimed at the prevention of boycotting, intimidation, unlawful assembly and the organisation of conspiracies against the payment of agreed rents. The Act resulted in the imprisonment of hundreds of people including over twenty MPs. The so-called ''Crimes Act'' (or "Coercion" Act) was condemned by the Catholic hierarchy since it was to become a permanent part of the law and did not have to be renewed annually by parliament, but the Papacy issued the bull Link: "Saepe Nos" in 1888 which was uncritical of the Acts. Trial by jury was abolished. An influential analysis of the pros and cons of the Act was published in 1888 by W. H. Hurlbert, a Catholic Irish-American author. The Old Identities' Association was a forerunner of the Old Colonists' Association Ballarat. John Brooksbank was a very early arrival to Ballarat in September 1851, which was not long after the discovery of gold at Ballarat. J. Brooksbank lost a dog in 1857 "LOST from the Half Way House, Smythe's Creek Road, a black bloodhound and kangaroo dog. Anyone detaining him after this date will be prosecuted. J. BROOKSBANK" (Ballarat Star, 30 December 1857) Another very early identity in Ballarat, James Oddie, advertised the sale of J. Brooksbank's hotel in 1860: "JAMES ODDIE & CO. have received instructions from the Mortgagees, to sell I by auction at their rooms, Dana street, on Thursday, 20th September, at twelve o'clock, All that desirable properly known as the , Halfway House Hotel, Together with all that piece or parcel of ' land situate in the parish of Cardigan and county of Grenville, containing 34 acres 1 rood 26 ½ perches, part of allotment 1, section 6, of said parish, situated on the Ballarat and Smythesdale road, and recently occupied by Mr J. Brooksbank. The property consists of a spacious stone building one story high, strong and substantially built, the internal fittings and arrangements are neat and complete. The house possesses all requisite accommodation for a respectable country hotel. In addition are stockyards, stables &c, all well and securely fenced. Terms at Sale. The next page has three newspaper cuttings. The first is 'The Victorian Waterworks'. It has costings for contracts for water supply, amounts which will supply water from the Coliban to the Castlemaine and Sandhurst districts, and if the Government should purchase the Bendigo Waterworks, and to construct the Upper Coliban reservoir, additional expenditure may be required. (from Daily Telegraph - 1868). The second is some information on The Yan Yean Aqueduct. The third is a letter to the Editor of the Argus from Joseph Brady, dated August 2, 1870, in reference to repairing the leak in the outlet tunnel of the Malmsbury Reservoir. He says the repair of the tunnel was not essential and is unnecessary and 2nd. If the bank was cut through and restored, for years the bank would not be safe, as the earth used in the restoration would require time to subside and unite with the old work. In 1977, artist Annette Meikle undertook a commission to illustrate a book recording stories of places and people in the Bayside area. It was published in 1978 as Sandringham Sketchbook, with text by Elizabeth Waters. The sketches were intended to record remaining examples of Bayside’s early architecture and environment, as well as reflect newer architectural changes. Meikle went on to donate 22 of these sketches to Bayside City Council in 2003. Erected in 1964, this stone cairn on Beach Road in Beaumaris marks the site of the wattle and daub cottage of James and Susannah Moysey. James, Susannah and their cousin Nicholas arrived in Victoria in 1844 and leased land on the cliff-top. They built a cottage, cleared the land for sheep and cattle and established vegetable gardens.
