These books contain reports of the Supreme Court of Victoria in 1960 and 1961. They came from the Ardlie family, members of which have been associated with Warrnambool and legal affairs since the early 1850s. John Ardlie came to Warrnambool in 1852 as the Clerk of Courts and his son William Ardlie was a prominent lawyer in Warrnambool for over 60 years. If it is this William Ardlie’s stamp in these volumes then it was used after his death. The signature is of John Ardlie, also a lawyer in Warrnambool and Port Fairy in the later decades of the 20th century.These volumes are of interest as they are connected to members of the Ardlie family, prominent lawyers and community members in Warrnambool in the 19th and 20th centuries.These are two volumes of law reports of the Supreme Court of Victoria– hard cover books with dark green covers and spines with red and gold bands and gold print. No information is available on George Murray except that he was a Melbourne accountant and died intestate in 1885. He left property to the value of £91 and the lawyer, Ernest Chambers, who was at that time at 12 Chancery Lane, Melbourne, was directed to list the creditors of George Murray and distribute the estate accordingly. Mr Chambers was one of George Murray’s creditors. Ernest Chambers later had a legal practice with offices at Warrnambool, Koroit and Port Fairy with the known dates 1897 to 1910. Thomas Goodall was the manager of the Warrnambool office and he was the one who had this document in his possession at that time and it was passed down to succeeding lawyers in the Kepler Street building. Tait collection: item 7 of 62This document is of interest in that it was originally issued by the lawyer Ernest Chambers who later had an office in Warrnambool. This is a piece of parchment containing the 1885 Letters of Administration in the estate of George Murray, a Melbourne accountant. The document is white with black ruled lines and has handwritten material in black ink. The document is folded at the lower edge with a seal of the Supreme Court of the Colony of Victoria. The seal is attached to the document by a green ribbon. There is also a blue stamp of the Master in Equity of the Supreme Court. The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. A civic campaign for new public offices developed in Kew in the 1880s. After much deliberation, the location chosen was the junction of Bulleen and Cotham Roads. The buildings were designed by George Watson and John Henry Harvey, architects within the Department of Public Works (Victoria). Building was commenced in 1887, and after one year, the buildings were opened. The Post Office was transferred to the new Commonwealth Government in 1901. The Police Station and Court House, sold by the Victorian Government to the City of Boroondara in 2007, are now a community cultural centre and performing arts venue.The buildings were listed on the Victorian Heritage Register Register (HO885) in 1991. They are historically and architecturally significant to the State of Victoria because Watson and Harvey's designs exhibit diversity in integrating civil offices, they accommodate the apex of road junctions, and they demonstrate a departure from the contemporaneously favoured High Victorian Classical to the Queen Anne style in the design of civic buildings.Photograph of tall leadlight windows in the former Court Room (now the Just Theatre) of the Kew Court House. Tait collection: item 34 of 62 This is a document giving the details of the Letters of Administration following the death of Helen Robertson, a spinster from St. Kilda, Melbourne. She died intestate in November 1881 and left property to the value of £363. This property reverted to her sister Agnes Thomson in 1889. No other details have been found on Helen Robertson. The lawyer in the case was George Skinner of Melbourne but the document was one of several stored in legal premises in Kepler Street, Warrnambool and passed on to successive lawyers occupying these premises. The actual date of the photographs is unknown. The photos depict members of the Cheltenham Tennis Club. The courts were located in the Cheltenham Park, where the Memorial now stands. The Club was dismantled about 1958. This 1891 document contains the information on the Will and Probate of John Gould, an engineer from Russells Creek. No information has been found on John Gould except that he died in October 1890 at the age of 67. The solicitor, William Ardlie was a well-known Warrnambool lawyer, commencing a practice in 1865 and continuing well into the 20th century making him at the time one of the longest-serving lawyers in the British Empire.
