This document shows that Mary Irwin of Peterborough, Victoria, died in April 1892 without making a will and the Letters of Administration were granted to her husband, William Irwin. However he died in 1901 without having fully administered Mary Irwin’s estate. In turn the estate administration was passed over to Charles McGillivray of Peterborough and one of Mary Irwin’s sons, William Irwin, residing in New Zealand. This document was drawn up in 1907, fifteen years after Mary Irwin’s death. She left property to the value of £100. No other details on Mary Irwin are available. He had a practice in Kepler Street, Warrnambool with the known dates, 1897 to 1910, with other offices in Koroit and Port Fairy during the same time. His manager in Warrnambool was Thomas Goodall who appears to have passed this document on to lawyers continuing on in the Kepler Street premises until it was found in the building once used by the legal business of Mackay Taylor.This is a piece of parchment paper folded in two and written on the back and front in brown-coloured ink (perhaps originally black). There is a seal of the Supreme Court of the Colony of Victoria attached with a green ribbon and three red stamps of the Master in Equity in the Supreme Court. The Circuit Court House buildings were located in Lydiard Street Ballarat. By 1862 the Ballarat Gaol was completed, including a tunnel connecting the Gaol to the Court House. The original initiative for the founding of the Ballarat School of Mines was taken at a meeting of the Ballarat Mining Board on 6 October 1869. The Provisional Ballarat School of Mines Council applied to the Government for the lease of the former Circuit Court House. It was approved for a 15 year period at one shilling per annum. The official opening of the Ballarat School of Mines by its first President, Sir Redmond Barry, was held 26 October 1870 in the former Circuit Court House, Lydiard Street Ballarat. Conversions were made to accommodate the new role it was to play. On 14 December 1912, demolition of the former Circuit Court House commenced. A civic campaign for new public offices developed in Kew in the 1880s. After much deliberation, the location chosen was the junction of Bulleen and Cotham Roads. The buildings were designed by George Watson and John Henry Harvey, architects within the Department of Public Works (Victoria). Building was commenced in 1887, and after one year, the buildings were opened. The Post Office was transferred to the new Commonwealth Government in 1901. The Police Station and Court House, sold by the Victorian Government to the City of Boroondara in 2007, are now a community cultural centre and performing arts venue.The buildings were listed on the Victorian Heritage Register Register (HO885) in 1991. These books contain reports of the Supreme Court of Victoria in 1960 and 1961. They came from the Ardlie family, members of which have been associated with Warrnambool and legal affairs since the early 1850s. John Ardlie came to Warrnambool in 1852 as the Clerk of Courts and his son William Ardlie was a prominent lawyer in Warrnambool for over 60 years. If it is this William Ardlie’s stamp in these volumes then it was used after his death. The signature is of John Ardlie, also a lawyer in Warrnambool and Port Fairy in the later decades of the 20th century.These volumes are of interest as they are connected to members of the Ardlie family, prominent lawyers and community members in Warrnambool in the 19th and 20th centuries.These are two volumes of law reports of the Supreme Court of Victoria– hard cover books with dark green covers and spines with red and gold bands and gold print. No information is available on George Murray except that he was a Melbourne accountant and died intestate in 1885. He left property to the value of £91 and the lawyer, Ernest Chambers, who was at that time at 12 Chancery Lane, Melbourne, was directed to list the creditors of George Murray and distribute the estate accordingly. Mr Chambers was one of George Murray’s creditors. Ernest Chambers later had a legal practice with offices at Warrnambool, Koroit and Port Fairy with the known dates 1897 to 1910. Thomas Goodall was the manager of the Warrnambool office and he was the one who had this document in his possession at that time and it was passed down to succeeding lawyers in the Kepler Street building. Tait collection: item 7 of 62This document is of interest in that it was originally issued by the lawyer Ernest Chambers who later had an office in Warrnambool. This is a piece of parchment containing the 1885 Letters of Administration in the estate of George Murray, a Melbourne accountant. The document is white with black ruled lines and has handwritten material in black ink. The document is folded at the lower edge with a seal of the Supreme Court of the Colony of Victoria. The seal is attached to the document by a green ribbon. There is also a blue stamp of the Master in Equity of the Supreme Court. The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. She died intestate in November 1881 and left property to the value of £363. This property reverted to her sister Agnes Thomson in 1889. No other details have been found on Helen Robertson. The lawyer in the case was George Skinner of Melbourne but the document was one of several stored in legal premises in Kepler Street, Warrnambool and passed on to successive lawyers occupying these premises. The Club was dismantled about 1958. From its beginnings in 1958, the Society has mounted exhibitions and/or displays, in early days in shop window and in community spaces located in the Kew City Hall (later Kew Library), and since 2010 at the Kew Court House. Exhibitions typically coincided with the annual Kew Community Festival in March, but after 2013 evolved into three new exhibitions yearly at the Kew Court House. Smaller displays continue to be mounted in the Kew Library. A series of photographs taken of current traders and members of the Society at the opening of the first exhibition for 2018 of the Kew Historical Society in its rooms at the Kew Court House. The exhibition was one of the Society's events at the annual Kew Festival.
