This book is a legal reference book used by the Bank of Australasia after 1907. The Bank of Australasia was incorporated by the Royal Charter of England in March 1834. The bank began in Australia on 14th December 1835, opening in Sydney. The Acting Superintendent of the bank at that time was David Charters McArthur. He was Superintendent from 1867-to 1876. The Melbourne branch opened on 28th August 1838 in a two-roomed brick cottage on the north side of Little Collins Street, where two huge mastiff dogs were used at night to guard the bank. The government also provided an armed military sentinel. Due to the bank's rapid growth, a new building for the Melbourne branch was opened in 1840 at 75 Collins Street West. By 1879 the bank had been upgraded to a magnificent two-storey building on the corners of Collins and Queens Streets, with the entry on Collins Street. In 1951 the Bank of Australasia amalgamated with the Union Bank to form the Australia and New Zealand Bank, now known as the ANZ. Then in 1970, the ANZ merged with both the ES&A and the London Bank of Australia to form the ANZ Banking Group Limited. The ANZ Banking Group Ltd kindly donated a variety of historic items from the Bank of Australasia. BANK of AUSTRALASIA, WARRNAMBOOL – In 1854 Warrnambool had two banks, the Union Bank and the Bank of Australasia. Later, completely different bank businesses opened; in 1867 the National Bank of Australasia, then in 1875 the Colonial Bank of Australasia. The original Warrnambool branch of the Bank of Australasia was established in July 1854, and operated from a leased cottage on Merri Street, close to Liebig Street. The bank later bought a stone building previously erected by drapers Cramond & Dickson on the corner of Timor and Gibson Streets. Samuel Hannaford was a teller and then Manager at the Warrnambool branch from 1855 to 1856 and the Warrnambool Council chose that bank for its dealings during 1856-57. In 1859 Roberts & Co. was awarded the contract to build the new Bank of Australasia branch for the sum of £3,000. The land was on a sand hill on the northeast corner of Timor and Kepler Streets and had been bought in 1855 from investor James Cust. The new building opened on May 21, 1860. The bank continued to operate there until 1951 when it merged with the Union Bank to form the ANZ Bank, which continued operating from its Liebig Street building. Warrnambool City Council purchased the former Bank of Australasia building in 1971 and renovated it, then on 3rd December 1973 it was officially opened as the Art Gallery by Cr. Harold Stephenson and Gallery Director John Welsh. The Gallery transferred to the purpose-built building in Liebig Street in 1986 and the old bank building is now the Gallery club. Staff at the Bank of Australasia in Warrnambool included the following men but others were also involved: Samuel Hannaford, Teller then Manager from 1855-1856; W H Palmer, Manager from January 1857 until November 1869 when the Teller Basil Spence was promoted to Manager; H B Chomley, Manager from April 1873 and still there in 1886; A Butt, Manager in 1895-1904; J R McCleary Accountant and Acting Manager for 12 months, until 1900; A Kirk, Manager 1904; J Moore, staff until his transfer to Bendigo in December 1908; J S Bath was Manager until 1915; C C Cox, Manager until April 1923; Richard C Stanley, Manager 1923 to April 1928. The book has historical significance as it is connected to the Bank of Australasia which was established in Australia in 1835 by Royal Charter during the early Colonial period of Australia's history. The book was used as a reference to financial law by the Bank. The book is significant for its association with the Bank of Australasia in Warrnambool, the first bank in Warrnambool, established in 1854. The bank continued to operate until its merger in 1951 when it became the ANZ Bank, which is still in operation today. Richard Kennedy (1826-1903), a wholesale , retail and manufacturing chemist in Timor Street, came to Warrnambool in 1880 and had what was described in "Cyclopedia of Victoria' as the "largest and best appointed pharmacy in Victoria'. Kennedy was Vice President of the Pharmaceutical Society of Victoria, on the Pharmacy Board and was prominent in community affairs in Warrnambool. He was for some time President of the Mechanics Institute and the Warrnambool Hospital and a foundation member of the Warrnambool Bowls Club. He also made locally perfumes with many varieties named after people or events of the time-Federation, Nellie Melba etc.. His pharmacy building in Timor Street and his house 55 Canterbury Road "Ivanhoe" still stands (2019) The use of a lighthouse in his advertising and on his bottles is of particular interest. Organisation-Club/society-sport3767.4a: A receipt of purchase from Henry Jackson, General ironmonger and Iron merchant, by Mr F.D. Jones (labelled as secretary on the receipt/treasure in other documents) on behalf of the Devils Own Cricket club. The receipt is a professionally made, printed template printed on blue/purple coloured limed paper with red margins. The transactions made by Mr Jones are handwritten in cursive font with black ink. The receipt indicates that payment was made to Mr Jackson on the 10th and 25th of March 1875. the pound was used as currency. 3767.4b: This receipt is dated March 25th 1875. Detailing the repair of a cricket ball. W.B. Fox, a saddler and harness marker, executed the repairs. The receipt is a professionally made, printed template in black ink on a light blue sheet of lined paper with red margins. The purchase order and payment remarks are handwritten in cursive with black ink. Pounds were used a currency. 3767.4c: This receipt is entirely handwritten in cursive with black ink on a torn rectangular piece of blue coloured paper. There is no official printing or branding on the receipt. The receipt details the purchase of a cricket ball by the Treasurer of the DOCC in March 1875 from F. Macoboy. The page has a large red stain/smudge in the top right-hand corner. 3767.4d: This professionally printed receipt is printed in black ink on a rectangular piece of white/cream coloured paper. The official branding is that of W. Welch, a general printer, binder etc. from Sandhurst. The record of the purchase of a 150-page record book for the DOCC by Mr. Jones is handwritten in cursive with black ink. The receipt is dated 8th March 1875 and payment was made on 9th March 1875. 3767.4e: This reciept is a handwritten note in black ink on a blue piece of lined paper no larger than a business card. The note, dated 1st March 1875, is addressed to Mr. F Jones, Hon Treasurer Devils Own C.C. The note is written by R.W. Franklyn in reference to 3767.4c and reads as follows: "Please pay M'acoboy 5/- price of ball" 3767.4f: This receipt in professionally printed in black ink on a blue coloured, lined paper. The branding refers to Henry Jackson, as per 3767.4a, and details the purchase of cricket equipment by the Law C.C. The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. 1. PAstor Friedrich Leypoldt was born in Stuttgart, Germany in 1844 and came to Australia in 1869 and became pastor of the Bendigo Lutheran church. He married Elise Julia Buddee in 1870. He served as pastor for 60 years. On the occasion of his 25th anniversary he was presented with 80 sovereigns raised by donations from the German community and other Bendigo citizens. He died 1/1/1932 and is buried in the Lutheran section of the White Hills Cemetery. 2. Mr Henry Iser was born in Hamburg, Germany in 1854 and emigrated to Australia in the late 1880's. He had various positions before travelling to Sydney to take up a position on the island of Yap in the Carolina group, Micronesia. Ill health caused his return to Bendigo where he was an accountant, firstly for Lyceum Grocery Store and then Cohn Brothers Brewery. He brought his fiancée, Caroline Collen from Germany and they married in 1888.When his brother-in-law Willem Humme became ill, Henry joined him at his timber yard and ironmongery, eventually being made a partner. Thus, today's Hume and Iser was born. Henry Iser died in 1932.Black and white postcard of the German Lutheran Church in Bendigo with a photo of pastor Rev. F. Leypoldt. Gunpowder is very volatile and can be ignited by the smallest spark. Several horrific accidents resulted in NSW passing legislation to cover the safe storage of gunpowder but initially these laws did not apply to Victoria. this was rectified and the first Melbourne magazine was erected on Batman's Hill in 1845. The Victorian Gunpowder Act (1857) made local councils responsible for the safe storage of gunpowder. The Victorian government made L.909 available for a suitable building in Sandhurst. Built on Camp Hill it was finished in April 1857 and the first keeper, Mr J. F. Kerr was appointed in October 1857.
