Bendigo Weekly from Friday, June 28, 2002 - Snippets of Bendigo history, the Pall Mall story, part two - by Edith Lunn. Close to the jeweller's shop, we came to Chancery Lane. Many early legal firms had their offices there. Among them were: Quick&Rymer, Luke Murphy&Don and Macoboy&Taylor. A branch of the Bendigo united Friendly Society's Dispensary opened on the corner. Other small business in the walk included a florist, men's hairdresser and a boot and shoes repairer. Moving on there was Betteridge's Agency for the Singer sewing machine company, Wilkinson's photographic studio, Sutton's music shop and Favaloro's cake shop and café the ''Savoy'' was opened in the 1920's. Whitelock and Carter had their men outfitters business in the building, Cocking's was a very popular drapery store. After Cocking's closed down, Stoneman's supermarket opened in the premises. Alongside there was a passageway that led upstairs to the office of Phillip Secher and Son, Accountants and the Bendigo jockey club. The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. Organisation-Club/society-sport3767.4a: A receipt of purchase from Henry Jackson, General ironmonger and Iron merchant, by Mr F.D. Jones (labelled as secretary on the receipt/treasure in other documents) on behalf of the Devils Own Cricket club. The receipt is a professionally made, printed template printed on blue/purple coloured limed paper with red margins. The transactions made by Mr Jones are handwritten in cursive font with black ink. The receipt indicates that payment was made to Mr Jackson on the 10th and 25th of March 1875. the pound was used as currency. 3767.4b: This receipt is dated March 25th 1875. Detailing the repair of a cricket ball. W.B. Fox, a saddler and harness marker, executed the repairs. The receipt is a professionally made, printed template in black ink on a light blue sheet of lined paper with red margins. The purchase order and payment remarks are handwritten in cursive with black ink. Pounds were used a currency. 3767.4c: This receipt is entirely handwritten in cursive with black ink on a torn rectangular piece of blue coloured paper. There is no official printing or branding on the receipt. The receipt details the purchase of a cricket ball by the Treasurer of the DOCC in March 1875 from F. Macoboy. The page has a large red stain/smudge in the top right-hand corner. 3767.4d: This professionally printed receipt is printed in black ink on a rectangular piece of white/cream coloured paper. The official branding is that of W. Welch, a general printer, binder etc. from Sandhurst. The record of the purchase of a 150-page record book for the DOCC by Mr. Jones is handwritten in cursive with black ink. The receipt is dated 8th March 1875 and payment was made on 9th March 1875. 3767.4e: This reciept is a handwritten note in black ink on a blue piece of lined paper no larger than a business card. The note, dated 1st March 1875, is addressed to Mr. F Jones, Hon Treasurer Devils Own C.C. The note is written by R.W. Franklyn in reference to 3767.4c and reads as follows: "Please pay M'acoboy 5/- price of ball" 3767.4f: This receipt in professionally printed in black ink on a blue coloured, lined paper. The branding refers to Henry Jackson, as per 3767.4a, and details the purchase of cricket equipment by the Law C.C.
