... mentioned in this will comprised £689 as a mortgage secured loan ...Tait collection: item 47 of 62 This is a document giving details of the Will and Letters of Administration following the death in 1895 of Charles Spencer of Brooklands, Birchanger, Essex, England. It is not known why the document has been drawn up in Melbourne and also makes reference to Warrnambool lawyers but it is presumed that some or all of the beneficiaries of the will lived in the Warrnambool district at the time. Charles Spencer left personal estate to the value of £689 to his wife, Emily, and children. Mentioned in the document are the lawyers J.S.Tait and Henry Parrington who were partners in a law firm in Warrnambool at the end of the 19th century (going under the name of Higgins and Parrington). The document has been passed down to successive lawyers occupying legal premises in Kepler Street and it was located in this building in 2014. The Letters of Administration for this estate was granted to Henry Parrington. The personal estate comprised £689 which had been lent to Spencer Smith on the security of land in the Parish of Wangoom, County of Villiers the repayment of which is secured by an indenture of mortgage dated 1st June 1892. [Ref: PROV. VPRS28/P0002, 73/750 Charles Spencer Grant of Administration] This document has no known local relevance except for the involvement of two Warrnambool 19th century lawyers. Further investigation has shown the personal estate mentioned in this will comprised £689 as a mortgage secured loan to a local resident, Spencer Smith.This is a cream-coloured piece of parchment paper folded in two and containing handwritten material on four pages which have black ruled lines on the edges. The 1899 document gives details of the Will and Letters of Administration of Charles Spencer, of Brooklands, Birchanger, in the County of Essex in England. The blue seal of the Supreme Court of Victoria is attached with a green ribbon and there are two red stamps of the Master in Equity of the Supreme Court. This ledger appears to have been a mortgage document held by the law firm of Mackay Taylor and Co. with the evidence for this the presence of two loose sheets of paper in the ledger with that firm’s letterhead. Mackay Taylor was established in 1893 with the merger of the firms of George Sutherland Mackay and James Fletcher, independent practising lawyers at the time. The new firm became Fletcher and Mackay and later changed to Mackay and Taylor when J. McD. Taylor became a partner in the 1920s and the business was at 131 Kepler Street, with a new building erected in the late 1920s. The legal business closed in the 1990s with the mortgage section of the firm becoming Mackay Taylor Securities in 1990 (later Southern Securities). The ledger was recovered when the building was being cleared out and Percy Eccles, a real estate agent, handed it to the Warrnambool and District Historical SocietyThis ledger has considerable significance as an example of a law firm’s business activities in the mid 20th century. Crown Portion 3 of Eltham, Parish of Nillumbik, County of Evelyn, Lots 26, 26A and 26B were part of the Greensborough Railway Station Estate. The land detailed is bounded by present-day Rattray Road, Reichelt Avenue, Wooded Way and Ryrie Court, Montmorency. Originally purchased in September 1913 by George William Miller, signwriter of Greensborough and Harry Frederick Miller, the land was sold to Mrs Margaret Barr Honeyman, 24 June 1918 on mortgage for £400, deposit paid £150. In February 1920, Mr Honeyman called for the title and paid off the loan early, settlement occuring 11 October 1920. Contents: 1. Handwritten payment plan (Sep 1913 to Mar 1923) for Lots 26, 26A and 26B being parts of Crown Portion 3, Parish of Nillumbik, County of Evelyn on the plan of subdivision making up the Greensborough Railway Station Estate situated on Rattray Road; purchased for £179.2.0 with a deposit of £18.0.0. 2. This file contains three items: 1/A review of the ROSSTOWN RAIL TRAIL from LIVING IN GLEN EIRA, vol. 11, 2004, Issue 4, no. 25, date and author unknown. The review explains the purpose of the Rail Trail with a brief narrative of the history behind Rosstown Sugar Mill Railway line. Concluding with information on the location of the Trail and the expected time required to walk the entire track included in the review is a map of the Rail Trail, which marks significant sites along the trail with historic pictures. 2/A newspaper article from THE AGE, dated Tuesday 21/10/1980 and written by Iola Matthews, reporting on the circumstances that led to the publication of the book RETURN TO ROSSTOWN written by Des Jowett and Ian Weickhardt. The article begins with a brief biography of the authors before moving into details of the book’s content, providing a further biography of W. Murray Ross which includes information on his financial ventures – particularly the Rosstown Rail – his marriage and children.
