Portrait, Sir Edmund Herring, 1963
Sir Edmund Herring had a military career before becoming the Chief Justice of Victoria in 1944. Sir Edmund served as an artillery officer with the British Army in World War One and was awarded the Military Cross. While he returned to the Law between the wars, becoming King's Counsel in 1936, he continued his military associations through Australian Militia Forces, rising to colonel by the start of the Second World War. At the outset of WWII Herring was appointed as Commander of the Royal Artillery for the Australian Sixth Division. Herring saw service in North Africa and Greece and was in charge of Australian Northern forces in 1942, afterwards working with General Blamey in Papua New Guinea. Sir Edmund was appointed Chief Justice, straight from his army command in 1944. As Chief Justice he quickly established the Law Reform Committee and after the war oversaw the extension of the Supreme Court buildings, with the creation of new Courts. He was considered an able administrator, but his refusal to appoint Joan Rosanove a Queen’s Counsel throughout the 1950s, did not sit well with many legal practitioners. After his retirement from the Bench, he continued in his many public activities, including trustee of the Shrine of Remembrance and the Australian War Memorial and a member of the Melbourne Grammar School Council, as well as Lieutenant Governor of the State of Victoria, a position he held from 1945 to 1972. Herring was also an outspoken social critic; between the wars he had been a member of the White Guard, who were a far right group acting against communism. During the Cold War period of the 1950s, Herring spoke out in favour of the British Empire and the American alliance. The portrait of Sir Edmund Herring is the second one that Sir William Dargie (1912-2003), completed of Sir Edmund; his first effort in 1944/45 won the Archibald prize. Dargie won the Archibald prize a record eight times. His fame as a portrait painter was not without controversy, as he was considered ‘safe’ and the favourite of conservative sitters, particularly as many of his Archibald winners were of ‘Captains of Industry’. While no Archibald prize was awarded for this portrait, it is an interesting counterpoint to Dargie’s 1944/45 portrait. The portrait of Sir Edmund Herring is significant because of whom it portrays and the artist William Dargie who painted it.Portait in oils of Sir Edmund Herring. This is a half portrait of Sir Edmund in his red judicial robes. Gold leaf frame, with plaque.Plaque reads "The Honourable Sir Edmund Francis Herring, KCMG, KBE, DSO, MC, ED. Portrait, Sir Frederick Mann
The portrait was presented by the legal profession ot the Court in 1946. It would appear to have been commissioned at the time of Chief Justice Mann's retirement. Charles Wheeler, had won the Archibald prize in 1933 and was the head of the art gallery schools during World War two. Chief Justice Sir Frederick Mann (1869-1958) studied the law and worked at the Crown Law Department before his stint in the Army during the Boer War. After the war, he practised as a barrister, mainly working in the common law and equity area including appearences in the High Court on constitutional matters. He was appointed to the bench in 1919 along with William Schutt, to help remedy a shortfall in the number of judges on the Bench, after measures of economy during World War One. He became Chief Justice in 1935 following the retirement of Sir William Irvine, and retired in 1944.The portrait is of interest because of whom it portrayed, it is a well executed work by a well known artist of the period.Half Length portriat painting in oils of Sir Frederick Mann, seated and balancing a book on his knee. He sits of a chair with carved arms. The frame is painted dull gold.Signed upper left C. Wheeler. Plaque identifies Sir Frederick Mann, the Hon. Herring saw service in North Africa and Greece and was in charge of Australian Northern forces in 1942, afterwards working with General Blamey in Papua New Guinea. Sir Edmund was appointed Chief Justice, straight from his army command in 1944. Book, Manual of Military Law, 1929
This book belonged to Captain Charles Rogers of the Australian Army. He was part of the Guard of Honour during the visit of the Duke of Gloucester in 1934. The visit was part of Victoria’s Centenary celebrations. Rogers was a well-known Warrnambool identity in the 1930s, 40s and 50s as a horseman and an army man. He was a long-serving Warrnambool Agricultural Show official as a judge of equine events. He died in 1961. The book is of interest as it belonged to a well-known resident of Warrnambool in the 1930s, 40s and 50s. This is a hard cover book of 1068 pages. It has a red cover with black printing on the spine. The book has an Introduction, textual material on military law in three Sections and an Index. It also has several pages of advertisements printed on pink paper at the front of the book. The cover at the top part of the spine is torn away, there is evidence of silverfish damage in several places and the text has been annotated in many places, in handwriting in red ink. There is a signature of the owner in pencil on the one of the first pages and blue stamps of the Warrnambool & District Historical Society on the same page and on a back page. There is evidence of mould on the back cover.‘C.A.Rogers’ captain charles rogers, military law, history of warrnambool -

... service, an army, and a law enforcement system deeply alienated ...n 1900, Germany was one of modernity's great success stories: The most progressive and dynamic nation in Europe, it was the only country whose rapid economic growth and innovation rivaled that of the United States. Its political culture was far less authoritarian than Russia's and less anti-Semitic than France's. Representative institutions thrived, and competing political parties and elections were a central part of life. How, then, could it be that in little more than a generation this stable modern country would fall into the hands of Adolf Hitler and the violent, racist, extremist political movement he led, a movement that would lead Germany and then all of Europe into utter moral, physical, and cultural ruin?" "There is no story in twentieth-century history more important to understand, and Richard Evans has written the definitive account for our time. A masterful synthesis of a vast body of scholarly work integrated with important new research and interpretations, Evans's history restores drama and contingency to the rise to power of Hitler and the Nazis, even as he shows how ready Germany was by the early 1930s for such a takeover to occur. Its citizens were angry and embittered by military defeat and economic ruin, and its young democracy undermined by a civil service, an army, and a law enforcement system deeply alienated from the new order. The electorate was beset by growing extremism and panic about communism; and the small but successful Jewish community was subject to wide-spread suspicion and resentment. He served for 12 years in the regular army and attained the rank of Captain. Serving part time in the V.D.C. as Battalion Commander. Melbourne Legacy ran three residences: Blamey House (purchased 1947) , Stanhope (purchased 1945) and Harelands (purchased 1950), to take care of children whose fathers were servicemen, and who may have been left orphans, or whose mother may have been unable to care for them herself. Article, Bulletin VALE Legatee JHB Armstrong, 1978
An article from the Melbourne Legacy Bulletin on the death of Legatee Brian Armstrong, a long serving Legatee and past president (1937). He was one of the founding group of Legatees, being enrolled in 1924, and served for 54 years. The Bulletin often published articles on Legatees when they passed away. John Henry Brian Armstrong was born 23 June 1894 and completed a law degree at Melbourne University. He served with the militia when at University and tried to enlist in December 1915. He was accepted into the Army Medical Corps in April 1916. He served in France and Belgium as a Lieutenant with 22 Infantry Battalion and was wounded near Dernacourt on 24th April 1918. He was wounded again and taken prisoner at Herleville, France on 18 August 1918 when leading a night patrol in an action in which the majority of the party were killed. For a number of years Brian was a Trustee of the Frances Ormond Estate, which was the genesis of The Royal Melbourne Institute of Technology (RMIT). Along with Legatee Jim Gillespie (and Jim's grandfather) the trustees were identified with all the notable developments of RMIT. He remained a bachelor his whole life. He was one of the initial archivists of Melbourne Legacy. One of his speeches in 1961 gives an insight into why he became a Legatee. Article - Speech, Past President's Day Address - Brian Armstrong, 1961
An article from the Melbourne Legacy Bulletin of a Past Presidents' Day speech by Legatee Brian Armstrong, a long serving Legatee and past president (1937). It is poignant for it's insight into what he saw on the Western Front, in particular around Pozieres and the Windmill that had stood there and was destroyed in battle. He had recently visited France and recalled his personal feelings. “I have no doubt that each one of you had some special memory of war that is bound up with your membership of Legacy – some event, place or happening. This was one of mine – you will find the story in a book we all know ‘There goes a man’, a story of endurance, determination and incredible courage. The feeling came to me as I stood in that little enclosure that here began the long road that led to Legacy, for in the middle of that holocaust was the Victorian Brigade from which later came the first man of Legacy. I am certain that many splendid men, some of whom were my friends, whose last sight was that battered windmill, would, had the finger of fate but pointed another way, been original members of this Club. A question seemed to hang in the still air – not for me, for I was only a cypher, but for all of us for whom, in those or later years, the finger had pointed to ‘LIFE’ – what have you done to merit and repay your deliverance from this and similar ordeals." He was one of the founding group of Legatees, being enrolled in 1924, and served for 54 years. The Bulletin often published articles recounting the speech from the week before.
