Establishment and Functions Prior to 1860, the Chief Secretary's Department had been responsible for the administration of the gold fields and associated mining activities. In November 1860 a Commissioner of Mines was appointed and a Department was established under his administration. For the period November 1861 to June 1863, the Postmaster General was responsible for the Mining Department. A Minister of Mines was again appointed in 1863. Responsibilities of the Department of Mines were: 1. Regulation of mining and related public works activities through the issue of miners rights, business and residence licences, mining leases, mineral and other prospecting licences 2. Superintendence of the activities of mining surveyors, registrars, wardens and Mining Boards. 3. Investigation of the state's geological structure, mineral wealth and underground water resources 4. Development of the mining industry 5. Supervision of the safe working of mines, machinery and quarries including checking the credential of mine managers, inspectors and operators 6. Regulation of the disposal of sludge and other waste products 7. Administration of the Victorian Mining Accident Relief Fund. Arising from its initial responsibility for the supply of water on the gold fields, the Department became responsible for rural water supply from the mid 1860s. Statutory responsibility for rural water works during this period rested with the Board of Land and Works. In 1865 the Waterworks Act gave the Board power to construct waterworks, purchase land, levy charges and lease or sell works, while the Public Loans Act 1865 empowered it to provide loans to local water trusts for waterworks. The actual administration of these statutory provisions was undertaken by the Victorian Water Supply Department which operated from 1865 to 1889 as a sub-department of the Department of Mines, from 1889 as a department in its own right, and from 1895 to 1909 as a sub-department of the Department of Mines and Water Supply. For a brief period from 1891 to 1893 the Department of Mines was also responsible for forests and, until 1880, for the Schools of Mines subsequently transferred to the Education Department. In 1895 the Department of Mines and the Victorian Water Supply Department were amalgamated to form the Department of Mines and Water Supply. Duirs and Warrell (62-64 Liebig Street) was prominent in Warrnambool for many years. The business had the name of Duirs and Warrell for nearly 90 years but the store was first established by William Jamieson in 1857. It was then acquired by J.C.A. Kruger before being taken over by James Duirs in partnership with Warrell. The liquor licence of Duirs an Warrell passed to Dickins Supermarket and the shop closed in 1971.These are important labels as the firm Duirs and Warrell was prominent in Warrnambool for many years .1 White label with three straight sides and a curved top. Edward ( Ted) Salamy (1903-1977) succeeded his father in business in Warrnambool as a jeweller and was at 179 Liebig Street when he retired in the 1960s. On 1st December in 1924 he obtained an amateur radio licence ( Call sign A3AJ). This was the 35th licence issued in the State of Victoria and the first in Warrnambool. The original licence cost two shillings and sixpence. Amateur radio, still a popular hobby today, was particularly important in the 1920s when few people had radios of any sort and there were no provincial radio stations. People were able to access amateur radio sets to listen to such broadcast as overseas cricket matches. This amateur radio set is of considerable historical importance as it belonged to Ted Salamy, credited with being the first to operate an amateur radio station in Warrnambool.This is a rectangular box containing five valves, a radio frequency mechanism and three coils with fine copper winding. The mechanisms are connected by wires and metal screws. The box has a raised black -composite material front which has a voltage meter, three switches or knobs and a tuning dial. This is a letterhead from Proudfoot’s Boathouse in Warrnambool. Thomas Proudfoot built the boathouse near the mouth of the Hopkins River in 1885 and it was an accommodation and dining place for tourists, especially for those interested in fishing and other recreational pursuits and it was the base for the Hopkins Rowing Club. Proudfoot built additions in 1888 and 1893 and after he died in 1900 his wife Catherine continued on the business for over 30 years, transferring the licence to her son. In 1939 Thomas Proudfoot’s granddaughter, Ena Hunt gained the licence and operated the business with her husband Percy until 1979. It is Percy Hunt’s name on the letterhead described here. The business today is mainly centred around catering and dining. In the 1990s other buildings were added to the boathouse complex, with the original buildings now being heritage-listed. This item is of some interest as it is the only memento we have of the Hunt family’s 40 years proprietorship of Proudfoot’s Boathouse, a significant set of buildings in Warrnambool.This is a single sheet of cream coloured paper with blue and red printing and a blue-coloured photograph of Proudfoot’s Boat House. The Ozone Hotel, formerly the Grand Ozone Coffee Palace, was erected in 1890 at a cost of around ten thousand pounds at the corner of Kepler and Koroit streets by a company of local business men and leased out. Coffee Palaces were temperance hotels, which were popular in the latter part of the 19th century and offered recreation and superior accommodation. In 1891, the Coffee Palace was granted a wine licence. In 1895, Thomas Randall was the proprietor of the building and it was renamed the Ozone Hotel. The coffee palace operated until 1915 and was then closed before re-opening in 1920 as Hotels Mansions. It had major renovations including a large theatre area. February 23rd 1929 saw the most spectacular fire in Warrnambool's history when the Hotel Mansions was burnt to the ground. Evelyn O'Brien was granted a temporary licence and in September 1930 she was given permission to rebuild. The new hotel named Hotel Warrnambool was opened in March 1931. This cup is a remnant of the Ozone Hotel.The Ozone Coffee Palace and later the Ozone Hotel Hotel Mansions was a significant grand building in Warrnambool. The destruction by fire in February 1929 was a major loss to the town. This cup, although damaged, is of considerable importance as it is one of the few surviving objects from the Ozone Hotel. He erected the Shamrock Hotel in Dennington in 1868 and it was opened for business in 1869 with David Duffy as the first licensee. Thomas Smith was the licensee in 1870 and members of his family (Cornelius, Robert and Mary Smith) held the licence of the hotel until 1880. A codicil to the will gave Mary Smith, Thomas’ daughter, the hotel land and building. This hotel closed in 2011. Thomas Smith signed the original will with a cross (his mark). Marriage licence issued to James Bostock and Alicen Aitkin to be executed within a period of 3 months. It has been issued by the Bishop of Melbourne of the United Church of England and Ireland. It is signed by P Teulon Beamish who was arch Deacon in Warrnambool for many years. Three Bostock brothers married three the Aitkin sisters. James was the youngest of the Bostock family as his mother died in childbirth at his delivery. He had a keen interest in horses and worked for both Augustus and John .He died in 1919. Alice died in 1896 at the age of 53.This is one of a number of documents which relate to the Bostock family who were one of the most important pioneering families of the Western District. They owned and leased various properties around Warrnambool and were involved in many aspects of social and business life. Zilles Printers was begun by Lewis Zilles in the early 1930s. It was in McKenzie Street Ballarat. His son Jeffrey also became a printer - letterpress, offset and screen printer. This Australian yesteryear postcard was published by Cobb & Co in circa 1990. It is a sepia toned artwork of the Ann Jones Inn in Glenrowan which was taken prior to 1880. The building at rear in this photograph was the private residence of Ann Jones, a migrant from Tipperary, Ireland. Two years after building her private residence, in 1878/1879, Ann Jones added the Inn to the front of the building which is depicted in the postcard. In 1880 the Inn was burned to the ground during the Kelly Gang siege. After the siege, Ann Jones and her children continued to live on the same location in a makeshift hut. This hut was later replaced with a dwelling using compensation money provided to Ann from the government for the loss of her property and goods; however, she was denied a new trading licence which did not enable her to re-establish her previously successful business. The reverse of this postcard provides a snippet of information into the Glenrowan siege, for which this site is most well-known. It outlines the role and demise of the members of the Kelly Gang but what it does not include is how Ann Jones, owner of the Inn depicted on the postcard, was impacted. Ann’s son of 13 years, Johnny was killed during the siege, and a bullet grazed the forehead of her daughter, Jane Jones. Jane would die two years after this event from tuberculosis, but it was believed by Ann that the cause was grief for the death of her brother and distress at having witnessed the siege. Ann was provided with 100 pounds in compensation money for the loss of her children. Her husband, Owen Jones passed away late 1880 and in 1891 Ann Jones remarried. She died at the age of 80 in 1910. The “last stand” of the Kelly Gang at this location is estimated by Dr Stuart Dawson of Monash University to have taken less than 10 minutes in duration. During and following this time, the life of Ann Jones was turned upside down and everything she had worked for in the preceding years was now in ruins. This postcard has the capacity to reveal information about the popularity of the Kelly story in Australia. It was created in approximately the 1990s which perhaps reveals a resurgence in interest into the Kelly Gang and Australian history when card was made. This image, and others depicting the Ann Jone’s Inn, have the ability to shed light on the Kelly story and the events of the Glenrowan Siege. Additionally, they can reveal information into the life of a female business owner during the 1870-1880 period. The Eltham Hardware and Timber Company first opened on Main Road opposite the Railway Station around late 1922. An advertisement placed in the Hurstbridge Advertiser advised that the Hardware Store had just opened with a varied stock of Saws, Hammers, Nails, Shovels, Screw Drivers, and every article required in a house or on a farm. People were also encouraged to try their Jams, Pickles, Sauces, Cups and Saucers, etc. A few months later in May 1923, William Walker, a plumber, placed an advertisement wishing to to announce that he had taken over the ELTHAM HARDWARE STORE, and asked for the continued support of the district. He also noted that all kinds of Plumbing work was done. Walker remained the proprietor of the Hardware Store for many years regularly advertising its services and wares up until at least 1941. The trail goes a bit quiet then but he does appear in the 1944 Electoral Roll listed as a Plumber, of Main Street, Eltham. However he is not listed in the 1949 Electoral Roll but his son, Thomas Roy Walker, also a plumber of Main Road is listed. Thomas had been on active duty overseas during the Second World War and returned at the end of 1945. It is assumed that William died sometime between 1945 and 1949. On November 18th, 1950 the Hardware Store and residence was auctioned on site by Scarff Bros. Pty Ltd. It is presumed that this is when J.N. Burgoyne and Sons took over the business. It would have been around this time the picture of the store was taken for only three years later, in October 1953, the business and dwelling was again put up for sale, this time by Trebilcock Bros, in two separate lots. The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney.
