Defenant's request for further particulars under the statement of claim 3. ...The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. The lease was 76 acres, 660 yards on line of reef. The Kent shaft was the next mine north Havilah Road, Boldt Street's corner. 'The Carlisle United was formed by the amalgamation of ttte companies, the Old Carlisle, the North Garden and the Passby. These mines were situated on the west side of Bennett Street in about a length of a few hundred feet, with the Passby on the Casley Street corner. And the old Carlisle and North Garden only recently being unearthed beneath the Unity, 'Carlisle' sand heap.' However, a lack of working capital meant that many of the mines operated by up to 17 different companies petered out. With the renewal of an offer of a government subsidy and the sale of shares, has allowed the purchase of these old claims and their infrastructure. Capital consisted of 16 shares of £75 each. In a short time, after only £160 had been called up, payable quartz from a depth of 173 feet enabled dividends of £2,778 ... In 1870 a registered company was formed with capital of £24,000 ... There were two shafts on the lease, each 280 feet in depth, while work had commenced on a new engine shaft and the erection of a winding plant. The company purchased the Robin Hood's lease and plant in 1878. The Robin Hood shaft became the New Moon main shaft and was eventually deepened to 2,400 feet. The New Moon Company was re-registered in 1886 as a No Liability Company with capital of £12,000 ... and the mine developed into one of the best-managed and most economically worked mines on the Bendigo goldfield ... This company, at the close of 1906 declared its 200th dividend ... Until 1924 Hurstbridge was known as Allwood. The building, one of the district's oldest is situated back from the corner of Arthurs Creek Road and Main Road. Covered under Heritage Overlay, Nillumbik Planning Scheme Published: Nillumbik Now and Then / Marguerite Marshall 2008; photographs Alan King with Marguerite Marshall.; p17 Hurst, who was a surveyor, came to Melbourne in 1852 by default, as on the way to Sydney he contracted typhoid and was off-loaded in Melbourne. Deciding to settle near Melbourne, he selected some land near the present Eltham railway station and was one of the first to grow crops there.2 But disaster struck again, when his shack was looted and burned, while he was carting goods for sale to nearby goldfields. It was then that Hurstbridge’s first settler, Cornelius Haley, asked Hurst to manage his 160 acres (65ha) grazing property and 9000 acres (3443ha) of leased land where the present Hurstbridge stands. Hurst proved equal to the tough conditions and he and his brother, Fred, cut a track with a bullock team from the property to Romsey, where Haley had selected some land. Hurst also put up a bridge across the creek near his house, after which Hurstbridge was named. He ran the property helped by two ticket-of-leave men and others, several of whom were sailors who had abandoned ship in search of gold, and were working there temporarily. In 1866, only 14 years after coming to Australia, Hurst met an early tragic death. One day a bushranger named Burke came to the house and demanded a horse. Hurst thought the bushranger might be an officer in search of runaway sailors3 and anyway, did not like the look of him, so he refused. A tussle followed and apparently Hurst shot first.4 He was shot and died five hours later from loss of blood. Later, troopers found Burke, who was subsequently hanged. The event is recorded in the Old Melbourne Gaol. The government offered the family £500 but the family refused it as ‘blood money’. Hurst’s father, Robert, even signed a petition against the bushranger’s death, claiming one life did not replace another. Hurst’s family continued to live in the district and saw a rise in their fortunes. They bought Haley’s cattle station and built the present Allwood House, using the original home as an orchard packing shed. The present Victorian style timber house had several outbuildings including a blacksmith’s shop. The property passed on to William Gray, an orchardist and nurseryman, who married Hurst’s grandniece, Frances. The business boomed from the early 1900s when it supplied most of the orchards in the area. Gray was Eltham Shire’s President for two terms and was asked to stand for parliament, but his wife’s illness and other family commitments prevented him from doing so. Then several calamities drove the family to bankruptcy. During World War One, Gray lost more than one million pounds on trees shipped overseas, which the Lloyd’s company had refused to insure. Other factors, including the Great Depression, ruined the family’s fortunes. The land was reduced from more than 640 acres (256ha) to 50 acres (20ha) and the older members married and left. After Mr Gray died, the house was leased, until his daughter Sheila Ferguson and her husband Gordon settled there in 1951, after buying it from other family members. However in 1975 the Shire designated the property as a passive recreation reserve. The Ferguson family sold most of the land, leaving the house on 0.6 hectares.This collection of almost 130 photos about places and people within the Shire of Nillumbik, an urban and rural municipality in Melbourne's north, contributes to an understanding of the history of the Shire. Published in 2008 immediately prior to the Black Saturday bushfires of February 7, 2009, it documents sites that were impacted, and in some cases destroyed by the fires. It includes photographs taken especially for the publication, creating a unique time capsule representing the Shire in the early 21st century.
