Tait collection: item 41 of 62 This document gives the details of the Will and Probate of Henry Phillips who died in Warrnambool in 1895 at the age of 55. He came to Australia from England in 1861 and established a hay and corn store in Liebig Street, Warrnambool. He was a prominent member of the Congregational Church and lived at ‘Ilfracombe’ in Lava Street. He and his wife Emma had eight children, two of whom had businesses in Warrnambool. Henry Phillips left personal estate to the value of £521 and the beneficiaries were his wife, Emma and their children. This document came into the possession of a Warrnambool lawyer, Ernest Chambers and passed down to successive lawyers occupying legal premises in Kepler Street. The document was located in this building in 2014 in the former premises of the law firm of Mackay Taylor. This document is of considerable importance as it contains details of the Will and Probate of Henry Phillips. He was a prominent businessman in Warrnambool in the 19th century. The document will be useful to researchers. This is a cream-coloured piece of parchment paper folded in two and containing the Will and Probate details of Henry Phillips, a Warrnambool hay and corn merchant who died in 1895. The document has handwritten material (black ink) on three sides of the paper. A seal of the Supreme Court of Victoria is attached with a green ribbon and there is one red stamp of the Master in Equity of the Supreme Court on the second page. The handwriting is fading in some places but is still legible. Edward Kellett was born in Chorley, Lancashire, England, son of John Kellett and unknown mother. It is not known when he arrived in Melbourne but he married Selina Wells in 1852 at St Peters, Eastern Hill. She was born in c1827 in Aston Clinton, Buckinghamshire, daughter of William Wells and Elizabeth Allan. Her family arrived from Aylesbury, Buckinghamshire on the 'Osprey' on 22 March 1849. Edward and Selina had 8 children - 5 girls and 3 boys; 3 died in infancy. All were born in Collingwood before the family came to Surrey Hills. Edward and Selina were the first owners of ‘Yielima’ at 32 Erasmus Street, Surrey Hills, built c1887. It was known by this name until c1922. Edward pre-deceased his wife. Edward's funeral notice in The Argus of 11 July 1893 states that he was a corn merchant of Exhibition Street. His property was sworn at 1512 pounds, 1232 in realty and 280 pounds personally. He was buried in Melbourne General Cemetery (CofE Compartment K, No 306). Selina is listed in Erasmus Street in the 1903, 1905 and 1908 electoral rolls as a boarding house keeper. She died at Surrey Hills on 22/10/1911. In her will she left realty valued at 900 pounds and personally at 220 pounds. She was buried with her husband. 'Yielima' was sold on 19 February 1919 with a sale of contents on 18 March 1919. The portrait is by an unknown artist. It was passed down through the family of his eldest son Edward Allan Kellett and then his daughter Ethel Emily Kellett. A digital copy of a portrait of Edward Kellett dressed in a dark suit with tie secured by a tie pin. Known as ‘Yielima’ 1888-1922 and ‘St. Aubins’ 1922-1956, this ‘modernized’ mansion was built about 1887 for Edward Kellett. He was born in Chorley, Lancashire, England. From 1922-1947 Thomas Daniel O’Callaghan (c1871-1962), a police magistrate, made his home here. He is remembered as being of ‘soldierly demeanour, with a flowing mane of hair’. He always carried a walking stick and wore a flower in his buttonhole. His wife was Florence (nee Harling, c1873-1933) pre-deceased him. They had previously lived in Essendon, Moonee Ponds and Stawell before coming to Erasmus Street. After moving out of Erasmus Street he is listed in the 1949 and 1954 electoral rolls at 90 Durham Road, Surrey Hills. In 1952 the property was purchased by Father Timothy Fitzpatrick, Parish Priest of Our Holy Redeemer Parish, Surrey Hills. It consisted of a large two storey house, a coach house and stable, and an acre and a half of land. In 1954 the coach house and stable were converted into the Church of Our Lady of Perpetual Succour and the following year Father John Kelly was appointed parish priest. and resided in the house. At this time the house was not in good repair. "The gentleman who had lived there alone since his wife died many years before, lived in the servants quarters and the rest of the house had been badly neglected. (REF: https://ourholyredeemer.cam.org.au/history) At the beginning of 1957 the Missionary Sisters of the Sacred Heart opened a school next door. As they travelled from Balwyn on a daily basis, the property at 301 Elgar Road was purchased as a presbytery and 'Yielima' became a convent. The stables continued to be used as a church until 1964 when a new church was completed and opened by His Grace Archbishop Simmonds on the 20th of March. There were never large numbers of double-storey Victorian mansions in Surrey Hills. 'Yielma' is significant as one of the few remaining ones. Tait collection: item 27 of 62. This document contains details of the Will of William Stacey Spencer, formerly of Stanstead, Mount Fitchet but late of Birchanger, Essex, England. He was a corn merchant and malster and died in England in October 1897. He left an estate with a gross value of £4973, with the beneficiaries being his wife and children. Three codicils were added to the will, one being caused by the death of an executor, William Spencer’s brother. The English lawyers involved in drawing up this will were Richardson, Foxwell and Hart of Much Hadham, England. As this document is an Exemplification of the Will and was drawn up in the colony of Victoria it is presumed that one or more of the beneficiaries was a resident in Victoria and possibly in the Warrnambool district. The Warrnambool lawyers, Henry Parrington and Con O’Mahony have their names in the document. The document has been, with others, passed down to successive lawyers occupying legal premises in Kepler Street, Warrnambool and located in that building in 2014. Unless some local connection can be found to William Spencer, this document is of interest only in that it was drawn up by local Warrnambool lawyers in 1899.This is a cream-coloured document consisting of five double parchment pages bound together with green cord and including a folded-over inset piece of paper on the front page. Nine of the pages have ruled black lines on the edges and there is handwritten material in black ink on nine pages. The document gives details of the will and codicils of William Spencer of Essex, England who died in1897. The document has the seal of Her Majesty’s High Court of Justice, Probate Division, attached with white binding and a stamp for three pounds attached with a metal insert. This book was written in 1801 in an epic poem form. It is unrhymed. It falls into the category of fantasy. The original owner of this book seems to have been John Bland. He is most important in the early history of Port Fairy and had a business in Port Fairy with John Cowtan (corn millers and general merchants). The Cowtans originally had land in the vicinity of the Cassady property of Boughton, Merri River (in Caramut Road near Cassady’s Bridge today) and were related by marriage to the Cassadys. A later owner of the book was William Anderson whose father came to the Yangery district in 1854 and established the property of Rosemount and William remained in this area until his death in 1909. The Andersons were related by marriage to the Cassadys and this book came to us following a clearance sale at the Cassady property, Boughton. This book is of great interest less for its literary content than for its ownership which probably dates back to the 1840s. It is associated with the families of Bland, Cowtan, Cassady and Anderson, all early settlers in Warrnambool and district.This is a brown leather-covered book of 271 pages. The cover has gold decorative borders and patterns and gold lettering. The pages are gilt-edged. The book is the fourth edition of volume one of a Robert Southey poem and has a Preface and Books 1 to 5 with Notes. The inscriptions are handwritten in black ink. She weighed 425 tons gross with a length of 160.4 feet, beam of 24.1 feet and depth of 10.2 feet. She had saloon accommodation for 35 people, forecabin for 25 more people, and she carried 300 tons of cargo. While on her delivery journey on May 30th 1882 the S.S. Casino called in at the Port of Warrnambool for coal ., narrowly escaping going ashore in gale force winds due to the quick action of the pilot. At that time, still at anchor, she impressed the directors of the Belfast and Koroit Steam Navigation Company so much that they bought her immediately; she was ideal for trade in along the West Coast of Victoria. (Belfast is the original name for Port Fairy, South West Victoria. The Belfast and Koroit Steam Navigation Company was first managed by Messers. Saltau and Osburne and after the passing of Mr. Osburne, by produce merchants Messers H. Sautau and Sons, whose had a hay and corn store and shipping agency was on the corner of Liebig and Koroit Streets in Warrnambool. ) The S.S. Casino became “the most famous steamer to operate in Victorian waters along the West Coast” by author Jack Loney. Captain Boyd was her first Master, followed by Captain Chapman, who stayed with her 1890 until 1924. Captain W. Robertson followed for a short term, then Captain Middleton then took command 1925 - 1932. The S.S. Casino had several mishaps during her life. One was on 3rd January 1898 when she collided with the S.S. Flinders in Apollo Bay with minor damage. Another was on 24th October 1924 when she grounded on a reef at Point Hawdon near Grey River and most of her cargo (of Christmas goods) had to be dumped into the sea. Then in February 1929 she was ‘holed’ when she struck a submerged object as she entered Lady Bay, Warrnambool. On the morning of 10th July 1932, after attempting to berth at Apollo Bay jetty in heavy seas, Captain Middleton decided to take her out into the bay and wait until the seas abated. It was not realised that the anchor used to steady her as she manoeuvred to her berth had pierced her hull. She put about and headed for the beach but sank. Captain Middleton and nine others lost their lives; nine people were rescued including the two female passengers . Captain Middleton had been in charge of the S.S. Casino for seven years. He was the first ship’s Master to lose his life through shipwreck in the West Coast trade. In the years following the turn of the century the S.S. Casino remained the only regular trader with normal passenger accommodation along the West Coast. From 1882 she had made at least 2,500 voyages on the one run. Flagstaff Hill’s collection has a photograph of a portrait of Captain Chapman, , a ship model of the S.S. Casino that shows both forms of power under which she sailed, steam and sail. The ship is painted green and flies three flags. The inscription across the case of the ship model, incorrectly dated, tells the sad story of the wreck of the ship and the loss of lives on July 10th 1932 at Apollo Bay. John Marfell (1847-1927) established a hay and corn dealing business in Liebig Street in 1878 in partnership with Henry Phillips. In 1887 he built a grain store in Raglan Parade and carried this business on until his death. He also managed a Warrnambool flour milling company in Banyan Street and with several other local business men established the Warrnambool Woollen Mill. He was a Warrnambool Councillor for 22 years and Mayor in 1903.These labels are a mementoes of John Marfell a prominent late 19th and early 20th centuries business man in Warrnambool. The first photograph was taken prior to 1910. The location is at the corner of Centre and Jasper Roads, East Brighton, (now known as Bentleigh). It is an early view of John L. and "Minnie" Smith's Hay and Corn Store, situated on the South West corner of those two roads. The first photo was taken prior to the introduction of electricity in the area. A gas lamp and horse "hitching post" can be seen "in shot". There are several loaded wagons waiting in line to have their hay milled to chaff. Farmers came from places as distant as Carrum to have their loads of hay milled into chaff. John Smith was born in 1860 in Point Nepean Road, Brighton, and Minnie was born in Patterson Road, Moorabbin, in a wattle and daub cottage with earthen floor and butter muslin over the windows. The couple married in 1884, Minnie was a devout Methodist and the family became very involved in the development of the local Methodist church. The couple had four children and during the 1890s Depression their first child died, they lost all their possessions, and John's family struggled to survive. Finally in the late 1890s JL Smith was able to rent a shed from Mr Henry Box on the corner of Centre and Jasper Roads, and he later purchased that property. With the gradual improvement in the economy, and the development of the successful market gardening industry in the Shire of Moorabbin, JL Smith's produce store became quite prosperous. Over some years the little "shed" developed into a thriving Hay and Corn Store. JL Smith went on to become Moorabbin Shire President in 1914. He and his wife were active in assisting soldiers returning injured from the 1st WW, in the local Methodist Church and other early community projects. Smith was a typical example of the majority of the early settlers in the Shire of Moorabbin, being god-fearing and devoted to the idea of service to the community. The photographs demonstrate the primitive conditions and early development of what is now a bustling and well-recognised area of Bentleigh, (known as east Brighton before 1907). The photo shows a gas lamp in use before the introduction of electricity in 1916. The Smith's story is representative of the many early pioneering traders, who elected to "set up shop", who suffered the adversity of the 1890s depression, but who survived and made their living in the largely undeveloped area of East Brighton ( now Bentleigh) district. Initially John Matchett had a grocery store in Pall Mall. In 1893, he advertised as a hay and corn dealer. When he retired to a farm in Kamarooka, the business was taken over by his son Robert Matchett (1864-1928). In 1904 the business moved to the Corner of Mitchell St., and Bath Lane. As well as a grocers this was a wine and spirit merchant. After Robert Snr. died the shop and the liquor licence was transferred to his son Robert Jnr. Print of a picture of the S.S. Casino, This print is from an original painting by the Australian marine artist A V Gregory (1867-1957), also known as Arthur Victor Gregory. Gregory lived and worked in South Melbourne. He took over the Gregory Studio owned by his father, George Frederick Gregory, painting actively between 1899 and 1932. He usually signed his works as ‘A V Gregory’. Some of his original works have been sold for thousands of dollars. The S.S. Casino was a passenger and freight steamer built in Dundee, Scotland, in 1882 for the Newcastle and Hunter River Steam Navigation Company of N.S.W. She weighed 425 tons gross with a length of 160.4 feet, beam of 24.1 feet and a depth of 10.2 feet. She had saloon accommodation for 35 people, a fore cabin for 25 more people, and she carried 300 tons of cargo. While on her delivery journey on May 30th 1882 the S.S. Casino called in at the Port of Warrnambool for coal ., narrowly escaping going ashore in gale force winds due to the quick action of the pilot. At that time, still at anchor, she impressed the directors of the Belfast and Koroit Steam Navigation Company so much that they bought her immediately; she was ideal for trade along the West Coast of Victoria. Then in February 1929 she was ‘holed’ when she struck a submerged object as she entered Lady Bay, Warrnambool. On the morning of 10th July 1932, after attempting to berth at Apollo Bay jetty in heavy seas, Captain Middleton decided to take her out into the bay and wait until the seas abated. It was not realised that the anchor used to steady her as she manoeuvred to her berth had pierced her hull. She put about and headed for the beach but sank. Captain Middleton and nine others lost their lives; nine people were rescued including the two female passengers. Captain Middleton had been in charge of the S.S. Casino for seven years. This photograph was one of ten photographs donated to Flagstaff Hill Maritime Museum and Village by Fred Trewartha. Frederick John Fox Trewartha (Fred) was a well-known Warrnambool businessman. He was born in Beeac near Geelong in 1920 and came to Warrnambool with his family as a very young child. He was apprenticed to his father John, as a saddler and later opened his own shop on Raglan Parade. He then moved into working with tarpaulins and canvases for the trucking industry. Fred was keenly interested in photography (and was a member of the Warrnambool Cine Club), yachting and boat building. He kept his yacht moored at Port Fairy for many years and participated in sailing events locally and interstate. He also built boats with his sons. He had the opportunity to meet many older sailors and it's thought this photo (and others in the set) may have been given to him by one of these men. Fred Trewartha died in 2016 in Warrnambool. Warrnambool by the 1920's and 1930's had become a popular holiday destination with visitors arriving by steamer and train. It was during these decades that a "Surf Bathers Association" began in Warrnambool in response to the growing popularity of local sea bathing. They worked with the local council to develop a "Beach Improvement Fund" and a comprehensive plan of "Beach Improvement" which included erecting and maintaining beach boxes, building a kiosk, improving paths and roads to the beach, planting marram grass on the sand dunes, building new enclosures for vehicles and horses and generally making the beach more attractive for visitors and townspeople. The 1930's was also an era when free "Herald" Learn-to-Swim classes were being held throughout Victoria. In 1931 it was reported in "The Age" newspaper that "over the past week in Warrnambool, 250 pupils had passed through the hands of the local life saving club swimming instructors". The Port of Warrnambool - In the early years the Port of Warrnambool was a busy port. Steamships and sailing ships were frequent visitors to the port. Steam navigation companies were plentiful, carrying passengers and freighting cargo such as coal, timber, food, livestock, furniture, hardware and haberdashery between Melbourne and the ports along the southwest coast of Victoria, including Warrnambool. The carts would take their loads into the township for distribution. The Breakwater was built (using 32 ton blocks of concrete) between 1874 and 1890 to provide ships with greater protection from the Southern Ocean. The Lifeboat and Rocket House - The coastline of South West Victoria has had over 600 shipwrecks and many lost lives; even in Warrnambool’s Lady Bay there were around 16 known shipwrecks between 1850 and 1905, with eight lives lost. In 1859 the first Government-built lifeboat arrived at Warrnambool Harbour and a shed was soon built to house it, followed in 1864 by a rocket house to safely store the Rocket Rescue equipment. In 1878 the buildings were moved to the Breakwater area, and in 1910 the new Lifeboat Warrnambool arrived with its ‘self-righting’ design. For almost one hundred years the lifeboat and rocket crews, mostly local volunteers, trained regularly to maintain and improve their skills, summoned when needed by alarms, gunshots, ringing bells and foghorns. Some became local heroes but all served an important role. By the end of the 1950s the lifeboat and rescue equipment had become obsolete. The S.S. During the years between 1884 and 1915, the Casino would take locals and holiday makers on excursions around the Port Fairy Bay. Local towns such as Terang, Penshurst and Mortlake held their Picnic Days in Port Fairy and excursions on the Casino would be available for them and in 1906 Terang and District Schools held an excursion to Port Fairy (where the Casino was organised to provide a series of trips around the Bay.) In 1916 new regulations introduced by the Marine Board requiring the Casino to carry enough lifebelts for every passenger on board, prevented the steamer from making trips around the Bay on excursion days. Casino became “the most famous steamer to operate in Victorian waters along the West Coast” by author Jack Loney. Captain Boyd was her first Master, followed by Captain Chapman, who stayed with her 1890 until 1924. Captain W. Robertson followed for a short term, then Captain Middleton then took command 1925 - 1932. The S.S. Casino had several mishaps during her life. One was on 3rd January 1898 when she collided with the S.S. Flinders in Apollo Bay with minor damage. Another was on 24th October 1924 when she grounded on a reef at Point Hawdon near Grey River and most of her cargo (of Christmas goods) had to be dumped into the sea. Then in February 1929 she was ‘holed’ when she struck a submerged object as she entered Lady Bay, Warrnambool. On the morning of 10th July 1932, after attempting to berth at Apollo Bay jetty in heavy seas, Captain Middleton decided to take her out into the bay and wait until the seas abated. It was not realised that the anchor used to steady her as she manoeuvred to her berth had pierced her hull. She put about and headed for the beach but sank. Captain Middleton and nine others lost their lives; nine people were rescued including the two female passengers . Captain Middleton had been in charge of the S.S. Casino for seven years. He was the first ship’s Master to lose his life through shipwreck in the West Coast trade. In the years following the turn of the century the S.S. Casino remained the only regular trader with normal passenger accommodation along the West Coast. From 1882 she had made at least 2,500 voyages on the one run. Flagstaff Hill’s collection has a photograph of a portrait of Captain Chapman, , a ship model of the S.S. Casino that shows both forms of power under which she sailed, steam and sail. The ship is painted green and flies three flags. The inscription across the case of the ship model, incorrectly dated, tells the sad story of the wreck of the ship and the loss of lives on July 10th 1932 at Apollo Bay. A print in the Collection show S.S. Casino underway in heavy sea off Point Lonsdale, another two photographs show her at the Port of Warrnambool, leaving from the Breakwater in Lady Bay and another identifies the S.S. Casino as a ship from the Belfast and Koroit Steam Navigation Company. (Belfast is the original name for the township of Port Fairy). This ship model is significant because of its association with the coastal trader S.S. Casino 1882-1932 and its significance to trade along Victoria's West Coast in the late 19th and early 20th century. The wreck of the S.S. Casino is considered an important part of Victorian and Australian cultural heritage and as such has been declared and protected as an Historic Shipwreck under State and Commonwealth Law in the Commonwealth Historic Shipwrecks Act (1976).
