The Batman Deed is sometimes called the Batman Treaty, the Dutigullar Deed, the Dutigullar Treaty or the Melbourne Deed. The deeds had been drafted by JT Gellibrand, a leading lawyer in the colony. Batman's Treaty was a document signed on 6 June 1835 by John Batman, an Australian grazier, businessman and explorer, and a group of Wurundjeri elders, for the purchase of land around Port Phillip, near the present site of the city of Melbourne. The document came to be known as Batman's Treaty and is considered significant as it was the first and only documented time when Europeans negotiated their presence and occupation of Aboriginal lands directly with the traditional owners. The so-called treaty was implicitly declared void on 26 August 1835 by the Governor of New South Wales, Richard Bourke. The original Batman Deed is of enormous significance to the history of the European settlement of Victoria. Framed print of the Batman Deed, dated 1835. The document consists of handwritten text in black ink with eight signatures in the lower right hand side and three signatures in the lower left hand corner. Appearances to the contrary, the item is not a weathervane but a finial. It was the gift of Mr John Sanderson (Jottings Easter 1920), from John Sanderson & Co., wool merchants, stock and station agents, commission and shipping agents before he leaves for England to become senior partner in Sanderson Murray & Elder, London, import and export agents. It was designed by Walter & Richard Butler Architects. (sketch published in Building : the magazine for the architect, builder, property owner and merchant vol.33, no 193, 12 Sept. 1923). The finial was already drawn on the sketch of the Central Institute made by Walter Butler. The maker of the finial, was Henry Alfred George Arnold Saw (born June 1881 in Hotham, Victoria was the son of Edward Saw (1854-1926) a tinsmith and Catherine Barton (1863-1907). He worked as a metal artificer for a metal-working business located opposite the Trades Hall in Lygon Street and was given the job of making the copper ship finial. Henry married Florence Charlotte Reeder and they had four children. Also known as Harry Saw according to his grandson Brian, he died on 9th February 1960. Henry and Florence both died within two months of each other in 1960. It is not clear when the ship was actually installed on the roof, the earliest photograph dating from 1927. The windvane fell or moved several times because of gale forces: - In 1995 : After the funds were raised to repair it, it was treated by sculptor David Hope, and reinstalled in the 1998 (Ship to Shore #3 Sept 1998). - In 2017: Carmela Lonetti from the Grimwade Centre for Cultural Materials Conservation (Ship to Shore Autumn 2017) - In 2019: a generous passerby donated the necessary funds for the conservation. It was sent to Grimwade Centre for Cultural Materials Conservation (Ship to Shore 2019), treated by Evan Tindal (City of Melbourne Magainze Oct. 2020). It was reinstalled over the Summer of 2019-2020 (Ship to Shore Summer 2020). The weathervane was stolen during the night of the 6-7 March 2022. Copper price surge sparks rise in theft in Victoria in 2021-22 so it's likely the vane was stolen to be melted This sculpture is closely associated with the 1917 building and described in clippings and annual reports when the building was first newly opened. It can be seen in some of the earliest photographs of the new building and in the artist/architect Butler's impressions. The galleon is often a decorative design of Mission to Seafarers wind vane (London, Adelaide).Bronze and copper sculpture fashioned as a Wind Vane in the form of a Galleon style sailing ship with 2 pennants flying and two sails rigged atop with lower cross piece with wind directions N S E W . Originally known as the Melbourne Cash Stores the general merchandise business of Younger and Co. was a dominant one in Liebig Street, Warrnambool from 1888 with the arrival in town of John Younger through to the store closure in 1983. John Younger was the director of the Warrnambool Woollen Mills in1903, the Mayor of Warrnambool in 1910 serving two terms and an elder of the Presbyterian Church. Florence May Aldous was born 1883, her sister Elizabeth Annie was born 1 Nov. 1885 A duplicate image is contained in Album 2 (05664) Aldous family assumption was that the child was Elizabeth Annie. However upon further investigation with the original source of information written on back of a duplicate photo has confirmed in Annies hand it says “my mother and father”. Given that photo was handed down Elizabeth Annie's line, it is a reasonable presumption to have thought the child was Elizabeth Annie however it begs to question why her elder sister by two years is not in the photo. On August 12, 1902, appearing before T. Smallman, Esq,. Police Magistrate, and Messrs. W. Duncan and W.J. Taylor, Justices of the Peace is Luther Haley, baker. Wilfred Henry Johnston, by his agent Stanley Ernest Elder had applied for a warrant of ejectment under the Landlord and Tenant Act 1890 against Luther Haley from the bakery premises at the corner of Main Road and York Street. From the evidence presented it is made known that Mrs Burgoyne of Eltham had purchased the property some months earlier from Mr Johnston, which consisted of a store and bakery establishment at Eltham occupied by Mr. Luther Haley, and whose lease expired some little time back, and up to the present time, Mr. Haley was not prepared to leave. He informed the court that he was unable to secure at Eltham a suitable house in which to carry on his business, but he was building a place near the railway station which he expected to be done in about three weeks time, at which time he would give up possession of the bakery. Mr Smallman informed the defendant, Luther Haley, that he would have to quit the premises in three weeks from the present date, and that a warrant of ejectment would be issued. However he also informed Mr Haley that he would order the warrant to lie in the office for three weeks from that date. The premises under construction refered to by Luther Haley in court were situated on the western side of Main Road, near the railway station slightly opposite present day Arthur Street. It was opened around September 1902 as a General Store, Bakery and Tea Rooms. In June 2024 Annie Hackrath shared a memory of living in the old bakery: "My husband and I lived in the old bakery for 18 months in 1978-9 , husband Geoff used the old bakery out the back as a wood workshop, making turnery and handcrafted furniture. The front shop was operated as a “sometimes” art gallery which we called “Gouge and Grain”. There were old sheds against the back fence which we thought were probably stables from the bakery days. Lovely memories of the old place which had so much character and seemed to attract a multitude of interesting creative people!
