The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. James Hardie Industries Ltd first listed on the Australian Stock Exchange in 1951 and is an industrial building materials company headquartered in Ireland which specialises in fibre cement products. James Hardie manufactures and develops technologies, materials and processes for the production of building materials. For over 20 years, Hardie has also operated a research and development facility devoted solely to fibre-cement technology. The company was a key player in asbestos mining and manufacturing in Australia through most of the twentieth century. Working with products containing asbestos - including the building material known as "Fibro" - caused people to develop various pleural abnormalities such as asbestosis and malignant mesothelioma. In December 2001, the company shareholders unanimously voted to restructure and relocate the company in the Netherlands as a parent company. Mount Pleasant Primary School 1435 was formerly known as Clayton's Hill, and evolved from a tent school, commenced in 1855 by William McIntosh. When changed from a Wesyleyan day school to a Common School it was given the number 424, received State funding and was conducted by William H. Nicholls. On 01 January 1873 the school became a non-vested school under control of the Education Department until 31 August 1873. The State then leased the school until 31 July 1874, with the current brick school, Mount Pleasant No.1436, opening on 01 August 1874. The Head Teacher of the new school was William H. Nicholls, remained at the school until 1887. His assistants were Thomas Gray, Jane Shaw, Jane Tratham, Catherine J. Berriman, John Blight, Herbert Berchaivaise and Annie Hicks, all who had worked at Mount Pleasant No. 424. William Nicholls and his assistant Gray established after school classes to enable students to gain Exhibitions and Scholarships to matriculate for the University of Melbourne, and courses enabling entry to teaching, pharmacy and civil service. Before the establishment of State Secondary and Technical Educaiton over 100 pupils from Mount Pleasant Primary School has matiriculated and entered the various professions. (Visions and Realisations, Vol. 2, pg 653 and 767) William Henry Williams became the first classifier of teachers for the Victorian Education Department. He died aged 51 while Head Teacher at Yarra Park Primary School on 01 April 1899. Some former students of this school include: J.G. Eagleston (County Court Judge); H.E. Starke (Judge of the High Court of Australia ); Bernard O'Dowd (parliamentary draughtsman and poet); Albert Coates (Surgeon and Medical Officer in Burmese Prisoner of War Camps). These pieces of Kelly Gang armour (including pieces manufactured by police) were photographed outside Beechworth Court House during committal proceedings in 1880. Ned Kelly, born in June 1855, was one of the last Australian bushrangers. An outlaw, gang leader and convicted police killer, Ned Kelly's distinctive armour has become entrenched in Australian lore. Ned's younger brother Dan Kelly (born in 1861), wore similar armour to his older brother. This drill once belonged to Goodall and Sons, who were blacksmiths in Terang. The smith was called upon to do a variety of work. In the early 1900s he was often the nearest person to be able to perform an engineer’s services for many miles around. The Dawn Ball-bearing Post Drill no. 611 is described in McPherson’s Catalogue as a “drilling machine with adjustable automatic feed, with improved Dawn coupler and ball-bearing thrust’. The heavy design of the flywheel enables it to maintain momentum” and is “fitted with pulleys for belt drive if desired” The hand crank drives an automatic feed to work off a cam-follow system opposite a large wheel. Made by Dawn Manufacturing Co. Australia 1920-1950. DAWN MANUFACTURING CO. Dawn Manufacturing Co. was founded in Coburg, Melbourne, in 1917 by the four Blake brothers, who were all engineers. After World War I Dawn was supplying drills Australia wide and the company was growing at a healthy rate. During the depression they remained busy, with employees working 60-80 hour weeks. Dawn was contracted to supply vices and clamps to the Australian Defence Department and munitions factory during the World War II. In 1959 the company was taken over by G.N. Raymond Group, then in 1973 the Siddons Ramset Limited acquired Dawn. In December 1991, Dawn became a unit of the United States owned Stanley Works Pty. Ltd. In November 1998 Dawn became 100 per cent Australian owned. HENRY GOODALL & SONS Henry Goodall (1870-1936) was proprietor of garages as H. Goodall & Sons Pty. Ltd., at both Terang (McKinnon and High Streets) and Mortlake (Dunlop Street). His business was in operation in at least in 1916 and perhaps well before, considering the date of the tyre bender and its use for wagons with wooden wheels. It was still in operation in 1953, chasing up debtors in Mount Gambier Court. Amongst the employees of H. Goodall & Sons Pty. Ltd. was Ernie Entwistle, a blacksmith (a soldier who died in 1916 ) and Alfred Hodgetts, radio expert (killed in a fatal accident in 1943, when he was in his early 30s ). Henry Goodall was involved in the community as a Justice of Peace, a deputy coroner, President of the Mortlake Hospital, trustee of the Soldiers’ Memorial Hall, and as a prominent Freemason. He and his wife had two sons (Charles and John) and one daughter (Mrs. Chas. Newton, of Skipton). The drill is locally significant as it was used by a local company in Terang and Mortlake in their blacksmith, wheelwright and garage business. The Government Gazette of January 18, 1888 advertised the acceptance of a contract of 149 pounds for a "Table for central library, New Law Courts, Melbourne". The table was purchased four years after the Court had moved to the William Street address.The table is not of state significance in its own right, but it is a high quality piece of Australian furniture. Its significance rests on its importance on the overall decorative scheme of the library and the fact that it was designed for this specific space.Blackwood, decagonal (10 sided) table, with 10 carved scroll and griffin supports, moulding and blue leather inserts.

This medallion was awarded by the Commissioners of the Warrnambool Industrial & Art Exhibition to ten boys from the Kew Asylum who sent handmade items (basketware, matwork etc ) for display at the Education Court of the Exhibition. The Warrnambool Industrial & Art Exhibition, held in Warrnambool from December 1896 to March 1897, partly to commemorate Queen Victoria's Diamond Jubilee, was a signal event in Warrnambool's history, with one report suggesting that over 70,000 people attended the various activities held over these months. These included concerts, operas, displays, business stands, sporting events and competitions. The earliest surviving voice recordings made in Australia were produced in Warrnambool at this Exhibition and there were various other 'firsts'. The medallion awarded to the boys at the Asylum for the high quality of their work, was made by the Melboune firm of Stokes and Sons who had a stall and machinery at the Exhibition and made small souvenir Exhibition coins on the spot for visitors to buy. As well as the gold medallion the boys were also given by the Commissioners some small souvenirs to the total value of 12 shillings. This medallion is of great historical value as it is a precious and rare memento of the 1896-7 Warrnambool Industrial & Art Exhibition, an important event in Warrnambool's history..1 A round gilt-bronze medallion with a bust image of Queen Victoria and lettering on one side and a laurel wreath and lettering on the other side .2 A square black box with a metal hinge and clasp. The inside is lined with dark blue satin and silk and has a sunken area to hold a medallion. This set of magazines is a vital tool for those researching the early days and later development of ATCV and CVA. It was modelled loosely on the magazine "Conserver" of the British Trust for Conservation Volunteers (BTCV). Issues become more sophisticated in format over time and each includes news, project reports, lists of upcoming projects, and stories. The editor for 62 issues was Mr Alf Bailey (staff 1987-current (2010)who edited the Conservator from Mar 1987 to mid-2006.Alf was a former high school principal and set a high standard. Since 2006 a more compact and economical newsletter "Conservation Volunteer" has been mailed to CVA and CVNZ members and is also downloadable from the CVA website.This set of magazines is significant because it is the most comprehensive record of all aspects of the establishment, growth, expansion, and nature of ATCV/CVA and its activities. It reveals the change from a local charity to a nation-wide corporate structure engaging thousands of volunteers tackling hundreds of projects a year in Australia and New Zealand in the present day.This was the final issue of a magazine produced by ATCV/CVA from 1982-2006 (c. 90 issues). This photograph was taken at the scene of the wreck of the HMAS Warrnambool J202 on September 13th 1947.The photographer has captured the crew in a lifeboat surrounded by sea. The lifeboat is approaching the HMAS Swan II. The HMAS Warrnambool J202 was commissioned by the Royal Australian Navy for use as a minesweeper during World War II. The Bathurst Class Corvette, fitted out with a range of armaments, was launched in Sydney in May 1941. The ship began service in Bass Strait in 1941. At the end of the year it called into its namesake city, Warrnambool, where the crew paraded for the public marching eastwards along Timor Street. A gift of books for the ship’s personnel and a plaque bearing the City of Warrnambool’s Coat of Arms were presented to the ship. The ship was involved in evacuating a family of nine from the Dutch East Indies that was later successful in its challenge of Australia’s Immigration Restriction Act (White Australia Polity). The ship had many other appointments around Australia. On 13th September 1947 HMAS Warrnambool was leading a flotilla of minesweepers in northern Queensland’s coastal waters, clearing mines previously laid to defend Australia. The ship hit a mine, which exploded and very quickly sunk the ship. Boats from the nearby ships rescued most of the seamen although one was killed at the time. The survivors were taken by the HMAS Swan II to Darwin, and they went from there to hospitals in Brisbane and Sydney. Three of these men later died from their injuries. A number of items were recovered by Navy divers in 1948 including the ship’s bell and a plaque with Warrnambool’s Coat of Arms. In 1972-75 the wreck was sold and other items were salvaged. In 1995 a memorial plaque was erected in Warrnambool near the RSL. NOTE: The RAN built a second HMAS Warrnambool FCPB204, launched in 1981 and decommissioned in 2005. There was also a steam ship SS Warrnambool built in London 1892 and broken up in 1926.
