Warrnambool's Mechanics' Institute (or Institution as it was sometimes called) was one of the earliest in Victoria. On 17th October 1853 a meeting was held where it was resolved to request the Lieutenant Governor of the Colony to grant land for the erection of a Mechanics' Institutes building. A committee was formed at the meeting and Richard Osburne chaired the first meeting of this committee. The land on the North West corner of Banyan and Merri Streets was granted but there were no funds to erect the building. The Formal Rights of the Warrnambool Mechanics' Institute's encompassed its aims and these were officially adopted in1859; "This Institution has for its object the diffusion of literary, scientific, and other useful knowledge amongst its members, excluding all controversial subjects, religious or political. These objects are sought to be obtained by means of a circulating library, a reading room, the establishment of classes, debates, and the occasional delivery of lectures on natural and experimental philosophy, mechanics, astronomy, chemistry, natural history, literature, and the useful and ornamental arts, particularly those which have a more immediate reference to the colony." The Warrnambool Mechanics' Institute opened its first reading room in November1884 in the National School building at the corner of Banyan and Timor Streets. The Institute was funded by member subscription, payable on a quarterly, half yearly or yearly basis. Samuel Hannaford, the Manager of the Warrnambool Bank of Australasia, was the first Honorary Secretary of the Mechanics' Institutes, and an early President and Vice-President. He also gave several of the early lectures in the Reading Room. Another early Secretary, Librarian and lecturer was Marmaduke Fisher, the teacher at the National School. Lecture topics included The Poets and Poetry of Ireland', 'The Birth and Development of the Earth', 'The Vertebrae - with Remarks on the pleasures resulting from the study of Natural History' and 'Architecture'. In 1856 the Reading Room was moved to James Hider's shop in Timor Street, and by 1864 it was located in the bookshop of Davies and Read. In the 1860's the Mechanics' Institute struggled as membership waned but in 1866, after a series of fund raising efforts, the committee was able to purchase land in Liebig Street, on a site then called Market Square, between the weighbridge and the fire station. A Mechanics' Institute building was opened at this site in August 1871. The following year four more rooms were added to the main Reading Room and in 1873 the Artisan School of Design was incorporated into the Institute. The same year Joseph Archibald established a Museum; however it deteriorated when he was transferred to Bendigo in 1877. In 1880, with Archibald's return to Warrnambool, the Museum was re-established, and in 1885 a new building was built at the back of the Institute to accommodate the re-created School of Design, the Art Gallery and the Museum. In 1887 the Museum section was moved to the former court house in Timor Street (for some time the walls of the building formed part of the TAFE cafeteria but all is now demolished)). In 1911 the Museum was transferred back to the original building and the management of the Mechanics' Institute was handed over to the Warrnambool City Council. The Museum and Art Gallery became one and housed many fine works of art, and the Library continued to grow. The building was well patronised, with records showing that at the beginning of the 20th century there were between 500 and 800 visitors. During World War One the monthly figures were in the thousands, with 3,400 people visiting in January 1915. The Museum was a much loved Institution in Warrnambool until the contents of the Museum and Art Gallery were removed to make room for the Warrnambool City Council Engineers' Department. The contents were stored but many of the items were scattered or lost. When the original building was demolished the site became occupied by the Civic Centre, which included the new City Library. (The library was temporarily located in the old Palais building in Koroit Street.) In the process of reorganisation the Collection was distributed amongst the community groups: -The new City Library took some of the historic books and some important documents, historic photographs and newspapers. -The Art Gallery kept the 19th Century art collection and some of the artefacts from the museum. -The Historic Society has some items -The State Museum has some items -Some items were destroyed -Flagstaff Hill Maritime Village has old newspapers, Government Gazettes, most of the Mechanics' Institute Library, ledgers and documents connected to the Mechanics' Institute Library, some framed and unframed art works and some photographs. The Warrnambool Mechanics' Institute Library book collection is deemed to be of great importance because it is one of the few collections in an almost intact state, and many of the books are now very rare and of great value. fictionA classic detective story. Harold Avery was born in 1869. His life reads like one of his own adventure stories. He was shipwrecked off the coast of Malaysia at the age of ten on his way to Australia with his parents who were drowned. Avery was brought up by the natives who, after three years put him on a Dutch boat bound back to England. He was brought up by an aunt who sent him to Eton and then settled with him in Edinburgh. Avery took a job in the city’s Water Department and in 1894 wrote his first book The Orderly Officer. In the next 45 years he wrote over fifty more books, mainly school stories and adventure stories. In 1941 he left Scotland to travel round the world and the last that was heard from him was a postcard sent to his aunt from Rio de Janeiro in 1943. The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. Robert Brough Smyth (1830-1889), civil servant and mining engineer, was born on 18 February 1830 near Wallsend, Northumberland, England, son of Edward Smith, mining engineer, and his wife Elizabeth, née Brough. On 14 November 1852 Smyth arrived in Melbourne and went to the gold diggings, where he worked as a carter on the construction of roads at Sawpit Gully. Back in Melbourne, on 7 November 1853 he became a draftsman under the surveyor-general, Andrew Clarke, and soon was acting chief draftsman. Smyth compiled numerous reports and wrote catalogues for exhibitions of minerals and fossils. In November 1869 he superintended the establishment of a museum of economic geology, mineralogy and mining and published in Melbourne The Gold Fields and Mineral Districts of Victoria … Covertly involved in the controversy that led to the disbanding of the Geological Survey in 1869, he became its director on its reinstatement in 1871; he increased its part in the search for and proving of economic mineral and coal deposits. In 1875 he became chief inspector of mines and published the geological reports on John Forrest's Western Australian exploration. On 19 June 1860 Smyth had become honorary secretary to the Board for the Protection of Aborigines and in 1863 became a voting member. Zealous and determined, he assumed the role of chairman, which belonged ex officio to the chief secretary, and wielded great power, including the dubious dismissal of John Green, general inspector of Aborigines in 1861-75 with whom he had earlier collaborated. Smyth's compilation, The Aborigines of Victoria … (1878), arose from his efforts to gather information and artefacts of Victorian Aboriginal cultures at a time when their vestiges were fast disappearing. The work, still valuable though long since superseded, relied heavily upon others such as L. Fison, G. B. Halford, A. Howitt and J. Milligan. Press reports and a petition from officers in the Mining Department accused Smyth of 'tyrannical and overbearing conduct', and in February 1876 a board of inquiry was constituted and heard evidence until April. McCoy defended 'one of the best heads of department he had ever known' but the board found the charges of 'excessive severity … in the main substantiated', and reported that Smyth had been irritable, lacking self-control and over-fastidious, but acknowledged his 'unremitting energy and zealous labours in the public service'. On 4 May Smyth resigned all public offices except his membership of the Aborigines' board. "The fine structure of St. Peter's, with its prettily-decorated interior, which holds crowded congregations at Holy Mass on Sundays, is alone an eloquent testimony of the piety and devotion which permeates the whole parish. Attached to the church is a circulating library, and Catholic papers and other literature are distributed at the church door. Branches of the H.A.C.B. Society and Catholic Federation are doing much good work. (Melbourne Advocate, 17 January 1914) "OPENING AND CONSECRATION OF THE NEW CATHOLIC CHURCH OF ST. PETER’S, DAYLESFORD Cross on St. Peter'sNotwithstanding the inclemency of the weather, the opening of the new Catholic Church of St. Peter’s, yesterday (Sunday), attracted a crowded congregation. Although the rain, which has poured almost incessantly for some days past, had left our roads and streets in the condition for which Daylesford is celebrated in winter weather, and although he storm and rain seemed to increase as the hour announced for the ceremonies approached, the church was filled by a large congregation, comprising all sects and denominations of Christians in and around the district. The beautiful edifice, erected mainly through the zeal, liberality and energy of the respected pastor, presented a most imposing appearance, and reflects infinite credit upon the Rev. Mr. Slattery, and the flock committed to his charge. The church was commenced in November 1863 and has been in the hands of the workmen up to the present time, work being uninterruptedly carried on. On commencing the foundations, it was necessary to excavate until solid clay was reached, which in consequence of the deep rich chocolate soil on the site of the building, had to be carried down to an average depth of 6 feet 6 inches. The foundations were laid with massive stones in courses of 12-inch, and four feet thick, reducing to 3 feet below the floor line. The style of the building is decorated Gothic, and consists of a nave, 80 feet by 30 feet in the clear, and a chancel 18 feet high; from floor line to apex of roof, 47 feet, which is elegantly constructed, consisting of six spans or frames with puncheons resting on carved corbels, low down between the windows. The north side consists of a handsome entrance, near the north-west angle, approached by nine steps of cut stone, and four bays of windows on nave, and a small door on side of chancel, intended as an entry from the sacristy. The south side presents a very handsome view to Victoria street, a beautiful porch entrance giving access to the building on the south-east end of nave; and on the south-west angle a handsome octagonal spire, terminating in an iron cross, with gilt floriations; the height of top of cross, from floor line, is 88 feet. A stone stairs gives access to the organ gallery and the belfry. The whole of the windows are of a handsome geometrical design, and carved in stone, with mullions and tracery, and glazed with amber-tinted glass, the chancel window being 15 feet high, and 8 feet wide. The chancel arch is unusually large, 27 feet St. Peter's interiorhigh and 18 feet wide, and handsomely moulded, and presents a fine appearance from the body of the church. The roof is stained a rich oak, with heavy cornice, and all the walls are smoothly plastered, and colored peach color, giving the amber-tinted glass a beautiful soft cathedral appearance to the interior. The altar is of a very chaste design, the panels being moulded with Gothic heads, and finished in white and gold; the altar rail was not completed, but is intended to be of polished cedar, with carved pillars. The interior fittings will be proceeded with immediately, and to complete the design, an organ gallery, with sittings for about 100 persons besides the choir, will be constructed on the west end. It is intended also to place pillar gaslights on each side of the main entrance, for lighting during vespers in winter. The style of architecture has been strictly carried out, and in the best and most substantial manner. The building has been erected under the superintendence of the architect Mr. John Townsend Brophy, a member of the congregation, and who has discharged his duty with great ability and care. The hour of half-past eleven has scarcely passed when from the sacristy entered His Lordship the Right Rev. Dr. Gould, Bishop of Melbourne, preceded by the Very Rev. Dean Hayes (Sandhurst), the Rev. P. J. Slattery, and a number of boys dressed in white surplices. The Right Reverend Prelate proceeded to the foot of the altar, the Very Rev. the Dean on his right, and the Rev. P. J. Slattery on the left. The prayers usual upon the occasion were read by the Bishop. A procession was then formed, and went around the church in the following order. Several youths bearing wax candles first, next the Very Rev. the Dean, then the Bishop and his train bearers, and following were the Rev. Mr. Slattery and acolytes. Having returned to the altar in the same order, the Deacon (Dean Hayes) and Sub-Deacon (Rev. P. J. Slattery) proceeded to robe his Lordship, who had taken his seat at the epistle side of the altar, for the solemn High Mass, at appropriate times wearing his mitre and bearing his crozier. The mass, which was chanted by the Bishop with touching simplicity and earnestness, was then commenced. The choir, under the direction of Mr. Meunsch, organist, was full and most effective. Mrs. Testar, of Melbourne, having generously offered her valuable services, took the leading soprano solos, and it is scarcely necessary to add, rendered them with exquisite taste and feeling – her beautiful voice being heard with great effect throughout the entire building. The choir consisted of the following ladies and gentlemen who volunteered to aid in the ceremonies upon this most interesting occasion. Ladies: Mrs. Tresar, soprano; Mrs. J.J. McCormick, alto; Miss Julia Conry, soprano; Mrs. Vincent, soprano; Mrs. Aitken, soprano. Gentlemen: H. Guthiel, tenor; Master John Murphy, tenor; James Knox, bass; J. M. Murphy, bass; Mr. Staunton, baritone; Mr. Sourby, alto; Mr. Short, bass. The chant, “Let us adore,” during the procession, was given by Mrs. Vincent with considerable power. The selection of the “Imperial Mass” (Haydn’s No. 3) was felicitous, and the highly artistic and finished manner in which the different parts were sustained, demonstrated that great and persevering care must have been bestowed on the preparation for “the opening day.” The “Kyrie” was given with the full strength and power of the choir. The swelling of the voices in complete harmony, and the pealing of the organ in the midst of incense and prayer, produced a most marked effect upon the congregation. In the “Gloria,” the solos of Mrs. Testar were really beautiful and Mrs. McCormick rendered the alto solos with considerable merit. Mr. Knox sang the part commencing with the words “Qui tolles” with much taste and power. The “Credo” than which we believe there is not a more magnificent piece of sacred music extant, was most successful in its rendering, nor do we ever remember to have heard anything more touching than the manner in which the line “Vetam Venturi in Seculi,” was given by Mrs. Testar. The offertory hymn “Come unto Me all ye that labor,” was given by Mrs. Testar with the most thrilling effect. The “Sanctus” having been sung, in which Mr. Sourby ably rendered an alto solo, the “Agnus Dei” was commenced with a solo by Mrs. McCormick and was given with great taste and feeling, Mrs. Testar, at the conclusion of the “Agnus,” taking up the soprano part. Mass being concluded, the Very Reverend Dean Hayes ascended the altar and proceeded to preach the opening sermon, taking as his text Second Paralipomenon [Chronicles II], 7th chapter and 16th verse – “For I have chosen and have sanctified this place that My hand may be there for ever, and My eyes and My heart may remain there perpetually.” St Peter's manseAt the close of the sermon a collection was made by the very reverend preacher, assisted by John Egan, Esq., Corinella, on behalf of the church, and about fifty pounds were contributed. When it is remembered that 500 tickets had been issues at 10s each, and the inclemency of the weather taken into consideration, the collection may be regarded as a large one. Benediction was sung by the Rev. P. J. Slattery, assisted by Dean Hayes, the choir singing the “O! Salutaris Hostia” and “Laudate.” Handel’s Hallelujah Chorus was sung at the termination of the ceremonies. The vestments issued at Benediction, as well as at the Mass, were of the most gorgeous and beautiful character. When the Benediction was over, the Rev. P. J. Slattery, standing at the front of the altar said– “I wish to say one or two words before the congregation leave. I feel most deeply indebted to all of you who have attended here today for the honor and glory of God, not withstanding the difficulties you had to encounter from this most inclement season. This medal was awarded to Dr George Rothwell Adam, who was a lecturer in Obstetrics at the University of Melbourne from 1899 to 1913. As part of receiving this award, Adam delivered a Listerian Oration entitled ' The influence Listerism exercises on obstetrics' at a meeting of the South Australian Branch of the British Medical Association on May 25, 1922. "This Oration and Medal was established by the South Australian Branch of the British Medical Association in 1914. The first Oration was delivered on Thursday, June 25th of that year. On that day, the new premises of the Branch was opened. Subsequently, this annual Oration became recognized as the most important scientific event in the calendar of branch Scientific Meetings. In 1948 it was delivered by one of South Australia’s famous sons, Sir Hugh Cairns. There has been no Lister Oration since 1979. The obverse of the Lister Medal shows a portrait of Lord Lister 1827-1912, and on the reverse is inscribed ‘British Medical Association, South Australian Branch, Lister Oration’. In Retrospect In mid 1952, a distinguished man arrived in Bendigo and interested several citizens, including Dr. P Goodman, the President of the Musical Advancement Society, in the formation of a Company for the production of Musical Comedy. The meeting was called at the home of Mr Fred Bush, and a group of enthusiasts made the acquaintance of Mr Norman Lee, our producer and sequently the M.A.S. and several leading citizens, sponsored the first production, by subscribing funds for initial expenses. From such humble beginning, our present Society originated. Mr Cyril Cyril Warne was appointed Musical Director, Mrs Phyllis House, Pianist, and Miss Madge Welch, Ballet Mistress. During the Season of ''Chu Chin Chow,'' the Society will stage its 100th performance - indeed an outstanding feat in such a brief history. The treasurers of the fund, to whom I have handed the draft, are transmitting by this mail a formal receipt for the amount of your generous contribution. ' I am very happy to learn from reports which have appeared in our newspapers here within the past few days that the vacancy in Melbourne has been accepted by our worthy, able, and patriotic prelate, the Most. Rev. Dr. Carr, Bishop of Galway. While the Catholic people of the diocese of Melbourne will find in Dr. Carr an able, zealous, and dignified prelate; of whom they will haye every rea son to be proud, the Irish Catholics of the diocese will, in an especial sense, find in him one who knows the wants of their country, who is deeply in sympathy with .the just feelings and aspirations of her people, and who is second to none in his desire to see his native land happy and prosperous I thought our friends in the Federal Council of the League would be anxious to know what man ner of man the new prelate is, and, therefore, writing to you so soon after his appointment I think it my duty to say so much. Kenny, M.P., the following resolution was unani mously adopted by the Organizing Committee of the Irish National League :— 'That we have heard with regret of the proposed retirement from the treasurership of the Irish National League of Australia of Mr. Joseph Winter, manager of the Melbourne Advocate, and we seize this opportunity of placing on record our appreciation of tbe signal services which he has rendered to the Irish people by his unselfish and devoted advocacy of their cause, especially during the past eight years, during which time the sum of £27,487 has reached the home move ment through his hands.
