They are also good mementos of Charles Rogers, a notable personality in Warrnambool in the 1930s, 40s and 50s.1 This is a piece of ceremonial regalia worn over the shoulder and called an aigullette. It has a plaited silver-coloured cord ending in silver metal tagged points. The metal points or stakes are highly decorated. The cords also have an accompanying smaller silver-coloured cord and another attachment of cord with an end of interwoven material in the shape of an elongated pear or acorn. The item is a little tarnished. .2 These are epaulettes worn on the shoulder. One is attached to the aigullette and the other is detached. These boots belonged to Captain Charlie Rogers of the Australian Army who wore these and ceremonial regalia when he was part of the Guard of Honour during the visit of the Duke of Gloucester in 1934. Rogers was a well-known Warrnambool identity in the 1930s, 40s and 50s as a horseman and an Army identity. He built a house in Birdwood Avenue, Warrnambool, in 1935 and was a long-serving Warrnambool Show official as a judge of equine events. Rogers died in 1961. These items are of great interest as examples of the boots worn by Army Lighthorse personnel in the 1930s. The mechanism for keeping the boots in good condition is of some technological interest. They are also of interest because they belonged to a well-known 20th century Warrnambool person. These are two knee-high brown leather boots with brown laces. The boots are slightly scuffed. Inside the boots are two pieces of red-striped canvas. The boots have wooden inserts to support the boots in storage. These wooden inserts, all varnished, are in four pieces - a solid foot shape to fit in the foot of the boots, two pieces shaped to fit the calf of the leg padded with green felt, one with slight indents at the top and the bottom and the other with a decided groove and the centre piece that has a hole cut out to fit the shape of the other two. This last piece has a wooden handle with a metal attachment. There is only one handle as it can be screwed out and fitted to either wooden insert. In 1861, August Dhmel of Slatey Creek near Ballarat, applied to be naturalized. He was born in Prussia and arrived by ship from Hamburg in 1849. He was thirty years old and was wishing to purchase land intending to settle for the rest of his life in the Colony of Victoria. This would be granted after taking the Oath before one of the Judges of the Supreme Court. This was taken before Sir Redmond Barry, Knight, in April 1861. In 1860, Charles Herold of Ballarat, a gold miner applied to be naturalized. He was born in Kitzinger Bavaria and at the age of thirty-five arrived by the ship "Mary Ross" in Tasmania in 1854 from Hamburg. He then came to the Colony of Victoria by the SS "Queen" in 1857. He wished to purchase land and settle in the Colony for life. This was granted but he first needed to swear an Oath before one of the Judges of the Supreme Court. Charles Gordon Watts-Phillips was born in 1849 at Forest Hill, Surrey, England, the son of Dramatic Author, Watts Phillips, and Lily Mariner. He departed England for Australia around 1874. His sister Roland was a favourite Australian actress of the early 1900s. Gordon as he was known, whilst residing in Goolwa, South Australia and working as a clerk met and married a widow, Jane Luxon (nee Miller) on the 7th August, 1876 at the Wesleyan Church in Strathalbyn, South Australia. Jane, Gordon’s elder by some 11 years was born in Ireland in 1838, the daughter of Robert Joseph Miller, a carpenter and Jane Miller. She had previously married Captain William Luxon in 1861 at Encounter Bay, South Australia at age 22 and they had four children: William (1864), George Robert (1865), Miriam Louisa (1867) and Harriet Jane (1869), all born at Encounter Bay. Gordon and Jane had two further children together: Caroline Roland Watts-Phillips (1877 Islington S.A.) and Charles Gordon Watts-Phillips (1879 Yatala, S.A.). At some stage, Jane then deserted her husband. Gordon obtained a master's certificate and was a part owner of a small trader. He had also been captain of one of the passenger boats on the Darling River. He was reputedly a popular coastal skipper. By 1891 Gordon was the Captain of the S.S Omeo operating around Sale, Victoria. In August of that year some of the heaviest flooding of the Thomson River ever experienced in twenty years occurred over the 3rd and 4th of August. Gordon, and others, rescued the lives of many families over that period for which he was awarded a Bronze Medal by the Royal Humane Society. By 1892 the S.S. Omeo had passed to another Captain and Gordon subsequently retired from the sea and moved to Melbourne. Whilst residing in Coburg, Victoria, Gordon met Mary Hilda Harvey Huxley who was living in Brunswick. Mary was born in Horsham, the daughter of George Harry Huxley, a miner, and Emma Deane. Having not heard from Jane for some years and believing her dead, Gordon and Mary marry at Carlton on Christmas Eve, 1900. Interestingly, an announcement of the marriage was not placed in The Age newspaper until September 1903, nearly three years after the event by which time Gordon and Mary had a son, Victor Gordon Watts-Phillips, born 8 February 1903 in Carlton. Within months of the placement of this marriage announcement, his former wife, Jane, makes a reappearance but apparently does not interfere and Mary and Gordon continue to live together as husband and wife. Around the same time in late 1903, Gordon’s brother, Basil Watts Phillip wrote from London to the Victoria Police seeking assistance to locate his brother. He had last heard from him in a letter dated Cunninghame, Gippsland, 1891. He indicated that about 1893 Gordon and Jane and their two children were living at Beaconsfield Parade, Albert Park but the whereabouts of all was now unknown. He mentioned Gordon had also been awarded 21 guineas by Judge Boucaut on the 26th February 1884, also a silver medal, for arresting two ruffians who had brutally assaulted a jockey (in South Australia) and that he had been awarded the Royal Humane Society's medal, London, and in 1891, was presented with the Royal Humane Society's certificate of merit (Victoria). Basil also stated his brother had lost the sight of one eye through a stab he received in New York and had a scar on his temple, one on the wrist, two under the shoulder blade, and one on the thigh, and two bullet wounds in the leg. Basil’s quest was published in the Melbourne Herald and assistance was soon forthcoming to the Police. In June 1906 Gordon made his Will, leaving all his estate to his youngest son Victor. Mary was appointed Executrix and it was witnessed by Olive Huxley, married woman, and James Huxley, a pottery maker. James was subsequently killed in France in May 1918. Gordon and Mary have a second son, Basil Douglas born in Carlton in 1911 but he dies as toddler in 1913. At some point Gordon and Mary made their home at Eltham though official electoral roll records record them at Little Flinders Street Melbourne, employed as a caretaker and from 1906 in Brunswick as a decorator then painter. Eltham may have been a ‘holiday’ home but it seems Mary was actively engaged in the community as a newspaper report in the Advertiser in 1922 not long after Gordon’s death indicates Mary was one of the best known and best liked ladies of the Eltham district. She was actively engaged in all matters, tending towards the welfare of the district. At the time of Gordon’s death Mary was president of the Ladies' Public Hall Committee, responsible for the conduct of numerous, and successful entertainments. Gordon’s first and only legal wife, Jane Luxon Watts-Phillips nee Miller, died 6 November 1921 and was buried 8 November 1921 at Springvale Cemetery. Jane had lived 34 years in South Australia and 30 years in Victoria. With Jane now dead, Gordon was now officially a widower and just three weeks later, the retired master mariner of Eltham at age 55 remarried Mary, 42, of 174 Hickford Street, East Brunswick on the 29th November 1921 in the Parish of St Cuthbert, East Brunswick. Gordon died at their home, ‘The Rest’, at 174 Hickford Street, East Brunswick on February 9, 1922 and was buried at Eltham Cemetery on February 11. An interesting link is established with the heavy floods of August 1891 by the erection of a tombstone in the Eltham cemetery. The stone bears the inscription: - “In loving memory of (Captain) Gordon, dearly beloved husband of Mary Watts Phillips. Died 9th February 1922, aged 62 years." Beside the stone is a replica, carved in a marble scroll, of the Royal Humane Society of Australia's Certificate of merit. Part of the wording of this certificate is as follows:- “At a general court of directors holder at the offices of the society at Melbourne on the 6th day of September 1891, it was resolved that the courage and humanity displayed by Gordon Watts Phillips aged 30-years captain of S.S. Omeo, Sale, in rescuing many families from drowning during the heavy floods on Thomson River on 3rd and 4th of August 1891 call for the admiration of the court, and justly entitles him to the certificate of merit of this society, which is hereby awarded." Unbeknownst to Gordon, his second and subsequent legal marriage to Mary initiated a revocation of his Will of 1906, which had solely benefited his son Victor. Consequently, Mary had to apply for Letters of Administration and the only legal beneficiaries would be Mary and his two children by Jane. On June 18, 1940, at age 61, Mary married 70-year-old Arthur Ernest Fenn in Melbourne. Unfortunately for her, Arthur died a year later in July 1941 and was buried in the Cohuna Cemetery near Echuca. Mary lived a further 8 years, passing away suddenly July 4, 1948 in Carlton, and was buried July 7 with her beloved husband Gordon, at Eltham Cemetery. The hearing of the case of John T. Burns, retired railway employee, of Buckley Street, Essendon v. Philip Cooney, licensed victualler, was concluded in the Supreme Court of Victoria (Bendigo) in June 1921. John sued the defendant for a specific performance of contract regarding the sale of ingoing furniture, etc., of the Limerick Castle Hotel, in Williamson Street, Bendigo. He also claimed the profits of the business from 21 February last to the date of possession. Burns also applied for an injunction restraining the defendant from disposing of the lease, licence and furniture of the hotel and premises to anybody else. The defence was that no agreement had been made between defendant and plaintiff for the sale of the hotel lease, although several attempts had been made to bring them to an agreement. Mr Cooney had authorized Mr. J. F. Kelly to sell the ingoing for £750. Burns had offered £650, but the defendant refused to accept that sum. The jury returned a verdict in favour of plaintiff. Judgment was deferred, pending an appeal, it was again heard by the High Court (Melbourne) and the onto the High Court of Australia (Sydney) on a point of law. The legal principle determined by this appeal is of great importance to buyers and sellers of landed property establishing the rule of law: that a house and land agent cannot, safely sell such property without the authority of the owner in writing, signed by such owner. It appears that the hotel-owner's agents had organised a sale to of the hotel along with furniture etc. to John Burns. The owner of the hotel Philip Cooney then objected to the sale of the furniture, although at some stage John Burns offered him 650 pounds to cover the items. The appeal came up for argument before the High Court at its Melbourne sittings on February 20 1922 the hearing extending over four days. Mr. Charles Gavan Duffy (instructed by Messrs. Quick and Luke Murphy) appeared for the appellant, and Messrs; Cohen and Robertson (instructed by Messrs. Macoboy and Taylor); for the respondent. The last court of appeal, the High Court in Sydney reserved its decision, as follows: The Appeal was allowed, with, costs. Judgment to he entered for the defendant Philip Clooney. This book is a legal reference book used by the Bank of Australasia after 1900. The Bank of Australasia was incorporated by the Royal Charter of England in March 1834. The bank began in Australia on 14th December 1835, opening in Sydney. The Acting Superintendent of the bank at that time was David Charters McArthur. He was Superintendent from 1867-to 1876. The Melbourne branch opened on 28th August 1838 in a two-roomed brick cottage on the north side of Little Collins Street, where two huge mastiff dogs were used at night to guard the bank. The government also provided an armed military sentinel. Due to the bank's rapid growth, a new building for the Melbourne branch was opened in 1840 at 75 Collins Street West. By 1879 the bank had been upgraded to a magnificent two-storey building on the corners of Collins and Queens Streets, with the entry on Collins Street. In 1951 the Bank of Australasia amalgamated with the Union Bank to form the Australia and New Zealand Bank, now known as the ANZ. Then in 1970, the ANZ merged with both the ES&A and the London Bank of Australia to form the ANZ Banking Group Limited. The ANZ Banking Group Ltd kindly donated a variety of historic items from the Bank of Australasia. BANK of AUSTRALASIA, WARRNAMBOOL – In 1854 Warrnambool had two banks, the Union Bank and the Bank of Australasia. Later, completely different bank businesses opened; in 1867 the National Bank of Australasia, then in 1875 the Colonial Bank of Australasia. The original Warrnambool branch of the Bank of Australasia was established in July 1854, and operated from a leased cottage on Merri Street, close to Liebig Street. The bank later bought a stone building previously erected by drapers Cramond & Dickson on the corner of Timor and Gibson Streets. Samuel Hannaford was a teller and then Manager at the Warrnambool branch from 1855 to 1856 and the Warrnambool Council chose that bank for its dealings during 1856-57. In 1859 Roberts & Co. was awarded the contract to build the new Bank of Australasia branch for the sum of £3,000. The land was on a sand hill on the northeast corner of Timor and Kepler Streets and had been bought in 1855 from investor James Cust. The new building opened on May 21, 1860. The bank continued to operate there until 1951 when it merged with the Union Bank to form the ANZ Bank, which continued operating from its Liebig Street building. Warrnambool City Council purchased the former Bank of Australasia building in 1971 and renovated it, then on 3rd December 1973 it was officially opened as the Art Gallery by Cr. Harold Stephenson and Gallery Director John Welsh. The Gallery transferred to the purpose-built building in Liebig Street in 1986 and the old bank building is now the Gallery club. Staff at the Bank of Australasia in Warrnambool included the following men but others were also involved: Samuel Hannaford, Teller then Manager from 1855-1856; W H Palmer, Manager from January 1857 until November 1869 when the Teller Basil Spence was promoted to Manager; H B Chomley, Manager from April 1873 and still there in 1886; A Butt, Manager in 1895-1904; J R McCleary Accountant and Acting Manager for 12 months, until 1900; A Kirk, Manager 1904; J Moore, staff until his transfer to Bendigo in December 1908; J S Bath was Manager until 1915; C C Cox, Manager until April 1923; Richard C Stanley, Manager 1923 to April 1928. The book has historical significance as it is connected to the Bank of Australasia which was established in Australia in 1835 by Royal Charter during the early Colonial period of Australia's history. The book was used as a reference to financial law by the Bank. The book is significant for its association with the Bank of Australasia in Warrnambool, the first bank in Warrnambool, established in 1854. The bank continued to operate until its merger in 1951 when it became the ANZ Bank, which is still in operation today. The portrait was commissioned after Higinbotham's death in 1893. A committee was appointed to investigate the making of a portrait and they appointed Mr L Bernard Hall, instructor and later director of the National Gallery of Victoria. George Higinbotham (1826-1892) had a distinguished career as a newspaper editor and politican before becoming a Judge of the Supreme Court in 1880 and the third Chief Justice in 1886. Higinbotham was a long serving attorney-general in the 1860s colonial administration. Higinbotham was active in the education, land and constitutional debates of his time. He played a prominent role through his chairmanship of the of the Royal Commission into Public Instruction with regard to the introduction of the free and secular primary school education.The portrait of George Higinbotham is of historic significance as the depiction of an important public figure in 19th Century Victoria. This painting was presented to the library in December 1930. The painting had been paid for through subscription from Judges of the High Court, the Supreme Court and the County Court as well as both branches of the legal profession. An almost identical portrait is held by both the Melbourne Cricket Club and the National Gallery of Victoria. This portrait is of interest for its subject and artist. Sir Leo Cussen (1859-1933) is probably best known for his role in two consolidations of the Victorian Statute books in 1915 and the mid 1920s. These were immense undertakings and included determining the application of English Law in Victoria. Sir Leo was appointed at Surpem Court Judge in 1906, he was at various times Acting Chief Justice of the Supreme Court of Victoria. The Potosi was built in Scotland in 1873 by John Elder and Co.It was a cargo/passenger iron screw steamer and sailed from 1880-1887 under the Orient Line Australia service. Samuel James Lynn was born in 1865 in Coleraine, Northern Ireland. Sam left his home in Coleraine in 1883 at the age of 17. (More information in O.D.H.S. newsletter No. 91 September, 2012 by Margaret Hollands) Samuel Lynn was a well-known Orbost pioneer. Ho owned much property throughout the district , bred Clydesdale horses and fattened about 600 cattle. He was in great demand as a judge of both cattle and horses at agricultural shows in Victoria and interstate. He was a shire councillor for 30 years and president several times. He took a great interest in the sporting clubs of the town and played cricket until late in life. He was goal umpire for the local football team for many years, judged for the Orbost Racing Club and was the first president of the Orbost Bowls Club. He was also a member of the first municipal band. Improving meat production In 1905, the English firm Thomas Borthwick & Son set up operations in Australia. Borthwick was a major meat exporter and ran freezing works as well as having its own cattle stations in Australia. From the early 19th century, Borthwick encouraged the production of quality beef by awarding prizes at agricultural shows throughout Australia. In the early 1950s the Australian Meat Board and The Royal Agricultural Society of Victoria (RASV) also took steps to encourage beef producers. Perpetual Trophy For the Coronation Show in 1953, Borthwick introduced a perpetual trophy. The Borthwick Trophy was awarded to the Fat Cattle Champion with the winner being judged from the best team of three steers under three years old. The winning team was the one that gained the highest aggregate score from both the live and carcase judging. Initially, the relevant winning Breed Society retained the trophy for a year and returned it for the following Royal Melbourne Show but the Borthwick Trophy is now displayed at the Melbourne Royal offices on the Melbourne Showgrounds. Martin Romuld was born near Trondheim in Norway on September 26, 1905. He started jumping on skis at age 6 or 7 and became very good at it. He completed his degree in Civil Engineering at the University of Trondheim and decided to come to Australia. He arrived on 7 March 1928 and found a job with the SEC. The SEC wanted to investigate the possibility of a hydrological surveys necessary to determine the flow of water over a period of years. These surveys started in 1934 and continued until 1941. He lived at Wilkinson’s hut for most of the time during those years both in summer and winter. In his role with the SEC, Martin visited all the various creeks to measure water flow rates as often as was necessary. These skis were used on his winter rounds during the time he spent in the area. Martin also competed in skiing during the 1930s. He won the combined Australian title 3 or 4 times. He was unbeatable in cross country, probably due to the continual practice in his job. Before migrating to Australia, Martin had been runner up in the 1926 European Jump Championships held in France. Jumping was his favourite thrill and he would often construct a jump for practice near the Scout Hut (or Rover Chalet) quite near to Wilkinson’s. In 1941 Martin joined the Royal Australian Air Force and after the War skied mainly at Mt Buller. He maintained his involvement in competitive skiing as an official. In 1958 Martin was the main judge of the National jump which was held to the left of the Nissen tow. He also designed the jumping course at the Donna Buang snow fields. Martin Romuld was Co Vice-President of the Federation of Victorian Ski Clubs in 1949, along with Tom Mitchell M.L.A. Martin Romuld died on 14 July 1998 in Prahran, Victoria,These skis are significant because they belonged to a pioneer of Falls Creek and the sport of skiing in Australia.A set of skis made for Martin Romuld. They are made from American hickory which arrived in Australia via Norway in October 1933. Andy Broad made the skis and they were furnished with steel edges.
