Hamilton, B.A., Judge of County ...This book is a legal reference book used by the Bank of Australasia after 1900. The Bank of Australasia was incorporated by the Royal Charter of England in March 1834. The bank began in Australia on 14th December 1835, opening in Sydney. The Acting Superintendent of the bank at that time was David Charters McArthur. He was Superintendent from 1867-to 1876. The Melbourne branch opened on 28th August 1838 in a two-roomed brick cottage on the north side of Little Collins Street, where two huge mastiff dogs were used at night to guard the bank. The government also provided an armed military sentinel. Due to the bank's rapid growth, a new building for the Melbourne branch was opened in 1840 at 75 Collins Street West. By 1879 the bank had been upgraded to a magnificent two-storey building on the corners of Collins and Queens Streets, with the entry on Collins Street. In 1951 the Bank of Australasia amalgamated with the Union Bank to form the Australia and New Zealand Bank, now known as the ANZ. Then in 1970, the ANZ merged with both the ES&A and the London Bank of Australia to form the ANZ Banking Group Limited. The ANZ Banking Group Ltd kindly donated a variety of historic items from the Bank of Australasia. BANK of AUSTRALASIA, WARRNAMBOOL – In 1854 Warrnambool had two banks, the Union Bank and the Bank of Australasia. Later, completely different bank businesses opened; in 1867 the National Bank of Australasia, then in 1875 the Colonial Bank of Australasia. The original Warrnambool branch of the Bank of Australasia was established in July 1854, and operated from a leased cottage on Merri Street, close to Liebig Street. The bank later bought a stone building previously erected by drapers Cramond & Dickson on the corner of Timor and Gibson Streets. Samuel Hannaford was a teller and then Manager at the Warrnambool branch from 1855 to 1856 and the Warrnambool Council chose that bank for its dealings during 1856-57. In 1859 Roberts & Co. was awarded the contract to build the new Bank of Australasia branch for the sum of £3,000. The land was on a sand hill on the northeast corner of Timor and Kepler Streets and had been bought in 1855 from investor James Cust. The new building opened on May 21, 1860. The bank continued to operate there until 1951 when it merged with the Union Bank to form the ANZ Bank, which continued operating from its Liebig Street building. Warrnambool City Council purchased the former Bank of Australasia building in 1971 and renovated it, then on 3rd December 1973 it was officially opened as the Art Gallery by Cr. Harold Stephenson and Gallery Director John Welsh. The Gallery transferred to the purpose-built building in Liebig Street in 1986 and the old bank building is now the Gallery club. Staff at the Bank of Australasia in Warrnambool included the following men but others were also involved: Samuel Hannaford, Teller then Manager from 1855-1856; W H Palmer, Manager from January 1857 until November 1869 when the Teller Basil Spence was promoted to Manager; H B Chomley, Manager from April 1873 and still there in 1886; A Butt, Manager in 1895-1904; J R McCleary Accountant and Acting Manager for 12 months, until 1900; A Kirk, Manager 1904; J Moore, staff until his transfer to Bendigo in December 1908; J S Bath was Manager until 1915; C C Cox, Manager until April 1923; Richard C Stanley, Manager 1923 to April 1928. The book has historical significance as it is connected to the Bank of Australasia which was established in Australia in 1835 by Royal Charter during the early Colonial period of Australia's history. The book was used as a reference to financial law by the Bank. The book is significant for its association with the Bank of Australasia in Warrnambool, the first bank in Warrnambool, established in 1854. The bank continued to operate until its merger in 1951 when it became the ANZ Bank, which is still in operation today. The Bank was an integral part of the establishment and growth of commerce in Colonial Warrnambool and throughout Australia.Book, dark brown, hard-covers with embossed borders front and back. She studied at Ballarat High School, Ballarat Technical Art School (a division of the School of Mines) and RMIT, and was a member of the Victorian Artists' Society and the Contemporary Art Society. In 1945 she was appointed Director of Handcrafts for the Victorian Division of the Red Cross Society. Isabel Huntington had previously held the position of Supervisor of Handcrafts at Heidelberg Military Hospital for three and a half years. She was a member of the Arts and Crafts Society. Isabel Huntington had five 'one-man" shows, three in Melbourne, one in Ballarat and one in Hamilton, Victoria. Ursula Hoff (from the National Gallery Victoria) judged the 1965 Albury awards for watercolour, and religious paintings in oils, awarding the prize to Isabel Huntington. In the same year Isabel Huntington travelled to Europe. After returning from overseas she taught at Rosanna High School, Victoria. Isabel Huntington lived at Montmorency, Victoria, and was there at the time of her death. She works primarily with video and installation, and has exhibited widely throughout Australia and internationally, Lou Hubbard is currently the Head of Photography at the Victorian College of the Arts. In announcing the award 2015 Guiguis New Art Award the judges applauded Lou Hubbard on her compelling installation, which comprised a deflated, disembowelled latex horse collapsed over a Coalbrookdale patio chair, table and bench seat situated over a skateboard and plastic dog. “Occupying a space between the traditions of equine, assemblage and unmonumental sculpture, Lou Hubbard’s Dead Still Standing confounds and compels viewers in its uncanny play of materials and movement,” senior curator, contemporary art, National Gallery of Victoria and judge Max Delany said. “In this elaborate yet concise work, Hubbard has created a form of surprising and unsettling effect that reflects our experience of a world in translation.” The win came as a surprise for Hubbard, who said she was overwhelmed at the talent of all 15 finalists. “I was so surprised, because I was in good company with the other artists, who were all quite extraordinary,” she said. “In the nature of the competition, I feel very lucky.” With multi-layer meanings to her piece, Hubbard said it was actually Ballarat’s rich history that inspired her work. She said it was the Ballarat goldfields and the idea of what horses might have gone through during those years that gave her a concept to work with. But that wasn’t the only source of ideals portrayed in the piece – Hubbard also explored the effect training had on horses. “The horse stands in a way that portrays (how) the human exhorts the way of training,” she said. “The horse is edging like it wants to move, which is impossible, and the furniture acts in lots of ways. The chair, for example, is like the horse’s ribs, which are being ripped out.” It was these multiple meanings that also had the curator of the Post Office Gallery, Shelley Hinton, impressed with the work. “The work challenges us ethically and culturally, in a way that pleads for analysis, as we do in our complex daily lives,” she said. Lou Hubbard's 'Dead Still Standing' won the was awarded the prestigious $20,000 Guirguis New Art Prize in 2015. The Federation University Guirguis New Art Prize was a national biennial and aquisitive contemporary art prize. He was born in Kitzinger Bavaria and at the age of thirty-five arrived by the ship "Mary Ross" in Tasmania in 1854 from Hamburg. He then came to the Colony of Victoria by the SS "Queen" in 1857. He wished to purchase land and settle in the Colony for life. This was granted but he first needed to swear an Oath before one of the Judges of the Supreme Court. The Certificate was signed by Henry Barkly. Charles Herold took the Oath before Robert Molesworth, Judge of the Supreme Court on 18 July 1860.Thick cream paper, hand written in ink. The booklet comprises of a series of papers published in the Ballarat Star, with some revisions. The Administrative Council hoped the publication would increase interest in Technical Education, especially the Art of Mining. He would also hope the public would recognise the Ballarat School of Mines as an institution adapted to supply technical education. The Ballarat School of Mines Council listed at the front of the book includes: Redmond Barry (President and Trustee), Judge Rogers (Vice-President), Somerville Livingstone Learmonth (Trustee), Rivett Henry Bland (Trustee), Charles Gavan Duffy, John A. MacPherson (MLA), William McLellan (MLA), Duncan Gillies (MLA), F. McCoy (University of Melbourne), John I. Bleasdale, W.H. Barnard, James M. Bickett, Henry Richards Caselli, P. Chauncy, J.M. Section I outlines the establishment of the Ballarat School of Mines, the buildings and land used by the school, describes in detail the former Ballarat Circuit Court and describes the lecture rooms. Section II describes the Ballarat School of Mines Museum, including a description of exhibits. Section III describes the lecture hall, and the apartments on either side of the hall, including the office of the registrar W.H. Barnard, mathematical classroom, chemical laboratory, and metallurgical laboratory. Section IV outlines the subjects offered by the Ballarat School of Mines, including Mathematics taught by John Victor of Grenville College, who had been educated at Trinity College Dublin. Mining and Land Surveying was taught by C.W. Thomas. Mr Croll taught mechanical drawing, followed by Jonathan Robinson of the Union Foundry, and finally S. Keast. It then lists some text books used in the school. Section V mentions the School Council, lack of funds, future directions, mining laboratory. Vi- Describes the land and out buildings, and the proposed building for metal and wood turning, brass foundry, blacksmith, working engine, etc. This section describes some large donations to the school - 50 pounds from the Misses Meglin of Melbourne, 10 pounds 10 shillings to the 'Pyrites fund' by the Walhalla and Long Tunnel Companies in Gippsland. Section VII covers the teaching of chemistry by Joseph Flude. Section VIII outlines the metallurgy classes and the process of assaying. Section IX covers telegraphy taught by Mr Bechervaise Section X describes the examination process at the Ballarat School of Mines. Examiners in mathematics were G.J. Russell (Buninyong) and John Lynch (Smythesdale), mining and land surveying John Lynch and P.C. Fitzpatrick (Ballarat), Principles and Practice of Mining R.M. Serjeant (Band and Albion Consols), Mechanical Engineering John Lewis (New North Company Clunes, Mineralogy and Geology G.H. F. Ulrich, Assayign and Chemistry J. Cosmo Newberry, and Telegraphy R.L.J. Ellery (government astronomer) and Sam W. Macgowan. Underground managers and captains in quart mining was examined by Henry Rosales (Walhalla Company), and alluvial mines by Messrs Bockett, Kent, Martin and Mitchell. Portrait, Robert Dowling, Sir Redmond Barry, 1886
This painting was created by Robert Dowling (1827-1886) in 1885. At this time Dowling was considered Australia's best portraitist. Dowling had been born in England, but migrated to Van Diemen's Land in the early 1830s with his parents. Dowling worked in both Tasmania and Victoria as an artist, before returning to England in 1857. He did not return to Australia until 1884 and received eighteen commissions for portraits. The Barry portrait was commissioned after Barry's death which explains some of the mistakes in the depiction of Barry's robes; the fur cuffs and collar are too large, and the cummerbund is sitting in the wrong place. Sir Redmond Barry is an important figure in Colonial Victorian History, responsible for the establishment and support of some of our finest cultural institutions (the University of Melbourne, the State Library of Victoria, the Supreme Court Library, and aspects of the Museum of Victoria's collection). This is in addition to his role as barrister defending aborigines in the 1840s and his position as a foundation judge of the Supreme Court of Victoria, a position he held for nearly 30 years, presiding over two of the most well known of colonial trials: the Eureka Trials in 1854 and the Kelly trial in 1880.The portrait of Sir Redmond Barry is significant because of the historical importance of Redmond Barry in colonial Victorian history. The painting is also of aesthetic significance as the work of the distinguished portraitist Robert Dowling. Portrait in oils of Sir Redmond Barry. Portrait, Sir William a'Beckett
Correspondence held by the library has John Denniston Wood (1829-1914), a barrister and politician, presenting the portrait to the Library Committee in 1867. Wood hopes that the painting will "hang there [in the Court] in like manner as the portraits of many of the sages of the law are held in the Courts at Guildhall". Wood also provides information about the painter, Mr Mosely "now deceased", but who was "selected by Sir WIlliam himself" to undertake the commission. Early accounts have the painting hanging in a prominent position in the 'old' Court house at La Trobe and Russell Streets; the portrait was moved down to the library in 1884, when the portraits of Barry, Stawell and Molesworth were also commissioned. Sir William a'Beckett was the first chief justice of the colony of Victoria, having previously had a busy career at the Sydney bar. The portrait is of historic signifcance because of its subject Sir William a'Beckett and its long association with the Court. Portrait, Sir William Stawell
The portrait was commissioned in 1884, near the end of Stawell's term of office. The portrait was commissioned at the same time as those of Redmond Barry and Justice Molesworth. The total cost of all three paintings was 1200 pounds. Sir William Stawell arrived in Victoria in 1842; he quickly established a reputation for himself at the Bar. After the separation of the Port Phillip colony from New South Wales, Sir William served as the attorney general in the first representative government and was the leading prosecutor in the Eureka trials. Sir William was appointed as Chief Justice of the Supreme Court in 1857, serving 29 years in the post. In addition the township of Stawell was named after the recently appointed Chief Justice in 1858. Portrait, George Higinbotham
The portrait was commissioned after Higinbotham's death in 1893. A committee was appointed to investigate the making of a portrait and they appointed Mr L Bernard Hall, instructor and later director of the National Gallery of Victoria. George Higinbotham (1826-1892) had a distinguished career as a newspaper editor and politican before becoming a Judge of the Supreme Court in 1880 and the third Chief Justice in 1886. Higinbotham was a long serving attorney-general in the 1860s colonial administration. Higinbotham was active in the education, land and constitutional debates of his time. He played a prominent role through his chairmanship of the of the Royal Commission into Public Instruction with regard to the introduction of the free and secular primary school education.The portrait of George Higinbotham is of historic significance as the depiction of an important public figure in 19th Century Victoria. Portrait, Sir Robert Molesworth
The portrait was commissioned in 1884, near the end of Molesworth's term of office. The portrait was commissioned at the same time as those of Redmond Barry and Chief Justice Stawell. Robert Molesworth, like his contemporaries, Stawell and Barry, went to Trinity College, Dublin, and practiced at the Irish Bar before migrating to Australia in 1852. Molesworth quickly gained a large practice at the Bar. In 1853 he was acting Chief Justice and he later served as Solicitor-General in the early Victorian colonial administrations. Molesworth was appointed to the bench in 1856. He primarily worked in the Equity area, but his main contribution to Colonial administration was as the Chief Judge of the Court of Mines, establishing the basis of mining law in Australia.The portrait of Molesworth is significant because of whom it portrays and is the only known portrait of Molesworth.Full length portrait in oils of Sir Robert Molesworth. This painting was presented to the library in December 1930. The painting had been paid for through subscription from Judges of the High Court, the Supreme Court and the County Court as well as both branches of the legal profession. An almost identical portrait is held by both the Melbourne Cricket Club and the National Gallery of Victoria. This portrait is of interest for its subject and artist. Sir Leo Cussen (1859-1933) is probably best known for his role in two consolidations of the Victorian Statute books in 1915 and the mid 1920s. These were immense undertakings and included determining the application of English Law in Victoria. Sir Leo was appointed at Surpem Court Judge in 1906, he was at various times Acting Chief Justice of the Supreme Court of Victoria. In addition, he was trustee of both the Art Gallery (NGV) and the Melbourne Cricket Club, and held various positions with the Melbourne University Law Faculty and the Council of Legal Education. Sir Leo was regarded as one of the finest legal minds of his generation and at his death, Robert Menzies, at this time the Attorney General, said that Sir Leo was "one of the great lawyers of the english speaking world". Sir John Longstaff was one of Australia's best known and well regarded portraitist in the early 20th Century, he won the Archibald prize five times (1925, 1928, 1929, 1931 and 1935).3/4 Lenght portrait in Oils of Sir Leo Cussen, a judge of the Supreme Court, 1906-1933. Portrait, John Schutt, Supreme Court Librarian, 1916/1917
This portrait was presented by the Victorian Bar to the Library in 1917 to commemorate Schutt’s fifty years as the Supreme Court Librarian. The portrait was presented at a ceremony presided over by Mr Mitchell KC who noted the “unanimity with which the members of the profession had adopted the suggestion that the eminent services of Mr Schutt should be recognised in this way.” Chief Justice Madden also spoke on this occasion and there were a number of judges and members of the legal profession present. John Schutt had been born in England in 1831 and migrated to Victoria as a young man, initially working as a school teacher he was appointed librarian, during Redmond Barry’s time in 1866. He started work in the Old Court in Russell street and would have supervised the move of the library to its new and greatly expanded premises in William Street in 1884. As well as secretary to the Library committee, he also acted as the Secretary of the Board of Examiners on occasion. After his death in 1919 in its obituary, the Williamstown Chronicle noted that Schutt was regarded as a Solon, an ancient greek law giver who gave wise advice. Away from the Court he was a councillor of many years standing in Williamstown, representing the Victoria Ward, what is now the suburb of Newport, it would appear Schutt street in Newport was named after him. His eldest son William Schutt was appointed a Supreme Court judge in 1919. The portrait of Schutt is a companion piece to the Sir Thomas a’Beckett picture painted shortly before the Schutt portrait and for the same client, they share the same frame design with gum leaf motif. This portrait was undertaken early in Meldrum’s career and before he had fully developed his theory of painting. Duncan Max Meldrum (1875-1955) was a controversial figure in his later years as he strongly opposed modernism and non-figurative art. His works are found in most of the state galleries, including a wide selection at the National Gallery of Victoria. This portrait is of interest for whom it portrays and as the work of a well known artistFull length portrait in oils of John Schutt. Schutt is standing up looking out the to the viewer. His hand rests on a small pile of books. He is dressed soberly in a three piece black suit. His white beard and hair all meticulously trimmed and realised. The props used in this painting provide the main colour as the background has become dark over the years. The books sit atop of a red and gold draped table. Behind Schutt is what appears to be a crimson velvet chair and he gives every appearence of having just arisen from the chair to engage with the viewer. Domestic object - Tankard, Before March 1878
A tankard is a form of drinkware consisting of a large, roughly cylindrical, drinking cup with a single handle. Tankards are usually made of silver or pewter but can be made of other materials, for example, wood, ceramic or leather. A tankard may have a hinged lid, and tankards featuring glass bottoms are also fairly common. Tankards are shaped and used similarly to German beer steins. The word "tankard" originally meant any wooden vessel derived from the 13th century and later came to mean a drinking vessel. The earliest tankards were made of wooden staves, similar to a barrel, and did not have lids. A 2000-year-old wooden tankard of approximately four-pint capacity has been unearthed in Wales. Metal tankards often come with a glass bottom and the legend is that the glass-bottomed tankard was developed as a way of refusing the King's shilling, i.e. conscription into the British army or navy. The drinker could see the coin in the bottom of the glass and refuse the drink, thereby avoiding conscription. However, this is likely to be a myth, since the Navy could press by force, known as press-ganging, rendering deception unnecessary. In a bar fight, the first punch was thrown while the recipient had the tankard raised to his mouth; another legend has it that the glass bottom was implemented to see the attack coming. A further story is that the glass bottom merely allowed the drinker to judge the clarity of their drink while forgoing the expense of a fragile pint glass. It is unclear if all or any of these legends have any substance. The Tankard is associated with the shipwreck of the Loch Ard which is of significance for Victoria and is registered on the Victorian Heritage Register (S 417). Flagstaff Hill has a varied collection of artefacts from Loch Ard and this tankard is one item from the largest accumulation of artefacts from this notable Victorian shipwreck. The tankard was found on the wreck and it gives us a snapshot into Victorian maritime history. Allowing us to interpret the story of this tragic event. This drinking vessel is also archaeologically significant as it represents aspects of Victoria's history that allows us to interpret Victoria's social and historical themes of the time. The tankards significance is unfortunately its association with the worst and best-known shipwreck in Victoria's history. This photograph shows Sam Lynn with his team of Clydesdales. Samuel James Lynn was born in 1865 in Coleraine, Northern Ireland. His father was James Lynn and his mother was Mary Jane Keith. Sam, as he was known, was the second of three brothers, his older brother being William and his younger brother was John Wilson Lynn. (info. Margaret Hollands) Samuel Lynn was a well-known Orbost pioneer. He owned much property throughout the district , bred Clydesdale horses and fattened about 600 cattle. He was in great demand as a judge of both cattle and horses at agricultural shows in Victoria and interstate. He was a shire councillor for 30 years and president several times. He took a great interest in the sporting clubs of the town and played cricket until late in life. He was goal umpire for the local football team for many years, judged for the Orbost Racing Club and was the first president of the Orbost Bowls Club. He was also a member of the first municipal band. Sam Lynn was a well-known Orbost pioneer. Kraft-Walker Cheese Company commenced in Allansford in 1935 leasing the factory premises from Warrnambool Cheese and Butter Factory Company. Dairy companies entered competitions organised by the Dairy Industry Association and associated organisations and local agricultural societies to encourage improvement in products. Some of these awards are considered prestigious and highly regarded within the industry. The certificates were passed to Cheese World Museum by the factory management.This certificate was held by the factory management until transfer to Cheese World Museum. The certificate provides an insight into the dairy industry during the 1950s.Cream card certificate from Royal Agricultural Show has a plain line border on left, bottom and right side with inner border of green vine plant on left, top and right side. A sheaf of oats and a scene of haymaking complete the border design. The top of the certificate has the Department of Agriculture Victoria logo flanked by circular images of a sheep and cow on the left and a hen and horse on the right. This book belonged to Captain Charles Rogers of the Australian Army. He was part of the Guard of Honour during the visit of the Duke of Gloucester in 1934. The visit was part of Victoria’s Centenary celebrations. Rogers was a well-known Warrnambool identity in the 1930s, 40s and 50s as a horseman and an army man. He was a long-serving Warrnambool Agricultural Show official as a judge of equine events. He died in 1961. The book is of interest as it belonged to a well-known resident of Warrnambool in the 1930s, 40s and 50s. This is a hard cover book of 1068 pages. It has a red cover with black printing on the spine. The book has an Introduction, textual material on military law in three Sections and an Index. It also has several pages of advertisements printed on pink paper at the front of the book. The cover at the top part of the spine is torn away, there is evidence of silverfish damage in several places and the text has been annotated in many places, in handwriting in red ink. There is a signature of the owner in pencil on the one of the first pages and blue stamps of the Warrnambool & District Historical Society on the same page and on a back page. Sir William Irvine, (1858-1943) Eltham, Politician and Judge. "William Irvine was born at Dromalene, Newry, Down, Ireland and after the death of his father emigrated to Melbourne with his mother in 1879. Here be completed his legal studies and spent some years teaching and in legal practice before entering the Victorian Parliament in 1894. He rose to the position of Leader of the Opposition and in 1902 became Premier. He resigned in 1904 for health reasons but in 1906 entered Federal politics as the member for Flinders. He was knighted in 1913 and in 1918 resigned to take up the position of Chief Justice of Victoria. From 1919 he administered the state as lieutenant-governor several times and was acting governor for nearly three years from 1931. This ceremonial regalia belonged to Captain Charles Rogers of the Australian Army (Light Horse Regiment). He wore this regalia when he was part of the mounted Guard of Honour during the visit of the Duke of Gloucester in 1934. The visit was part of Victoria’s Centenary celebrations and the Duke officially opened the Melbourne Shrine of Remembrance. Charles Rogers was a well-known Warrnambool identity in the 1930s, 40s and 50s as a horseman and Army identity and he and his horse frequently led parades and celebrations in the city. He was a long-serving Warrnambool Agricultural Show official as a judge of equine events. Rogers died in 1961. These items are of great interest as examples of the regalia worn by Australian military personnel in the 1930s. They are also good mementos of Charles Rogers, a notable personality in Warrnambool in the 1930s, 40s and 50s.1 This is a piece of ceremonial regalia worn over the shoulder and called an aigullette. It has a plaited silver-coloured cord ending in silver metal tagged points. The metal points or stakes are highly decorated. The cords also have an accompanying smaller silver-coloured cord and another attachment of cord with an end of interwoven material in the shape of an elongated pear or acorn. The item is a little tarnished. .2 These are epaulettes worn on the shoulder. One is attached to the aigullette and the other is detached.
